Whereas by Government NotificationN o. 22/12/98-RD dated 30-3-99 published on page 5 of Series II, No, 1 ,(Extraordinary) of the Official Gazette dated 5-4-1999 and in two newspapers (i) Rashtramat dated 7-4-99 and (ii) Herald dated 7-4-99, it was notified under section 6 of the Land AcquisitionAct, 1894 (hereinafter referred to as the "said Act") tnat the land specified in the Schedule appended to the said notification (hereinafter referred to as the" said land ") was needed for public purpose viz. for consturction of Gopalem road via post office and Xiro in V. P. Carmona (Add!. Area).

And whereas in the opinion of the appropriate Government (hereinafter referred to as the "Government")

. the said land is not required for the aforesaid pUl1l0se.

Now, therefore, the Government is pleased to'declare under sub-section (1) of section 48 of the said Act that it

has withdrawn from acquisition of the said land for the aforesaid public purpose and the aforesaid Government notification shall be deemed to be cancelled so far as it relates to the said land. The persons interested in the said land, may lodge to the Land Acquisition Officer, PWD (Cell), Altinho, Panaji, within a period of thirty days from the .<:Iate"of this notification claims \Inder sub-section (2) of section 48 of the said Act, for the damages sufferred by them in consequence of the notice or of any proceedings thereunder, and for costs reasonably incurred by them in prosecution of the 'proceedings under the said Act relating to the said land.

Whereas by Government Notification No. 22/2/97-RD dated 7-9-1999 published on pages 415, 416 of Series II, No. 26 of the Official Gazette dated 23-9-1999 and in two newspapers (1) Herald dated 24-9-1999 it was notified under section 4 of the Land Acquisition Act, 1894 (Central Act 1 of 1894) (hereinafter referred to as "the said Act"), that the land specified in the Schedule appended to the said Notification (hereinafter referred to as the said land), was 'li)<:ely to be needed for public purpose, viz. for wide"ning of road from Merces to Chimbel.

And whereas, the Government of Goa (hereinafter referred to as the "Government") being of the opinion that the acquisition of the said lalld is urgently necessary, hereby applies the provisions of sub­section (1) and sub-section (4) of section 17 of the said Act and directs that the Collector appointed under paragraph 2 below, shall, at any time, on the expiry of fifteen days from the date of the publication of the notice relating to the said land under sub-section (1) of section 9 of the·said Act, take possession of the said land.

Now, therefore, the Government hereby declares under the provislOns of section 6 of the said Act, that the said land is required for the public purpose specified above.

2. The Government also hereby appoints under clause (c) of section 3 of the said Act, the Dy. Collecter (LA): Collectorate of North Goa, District, P~naji to perform the functions of the C;ollector for all proceedings hereinafter to be taken in respect of the said land a:q.d direct,S him under section 7 of the said Act to take' order for the acquisition of the said land.

3. A plan of the said land can be inspected at the office of the Dy. Collector (LA), Collectorate of North Goa District, Panaji till the award is made under section 11.
