ADOPTION OF THE MINUTES FROM THE MARCH 15, 2007 MEETING OF THE BOARD A motion was made and seconded to adopt the minutes, as amended, from the March 15, 2007 meeting of the Board. INDIANA STATE NURSES ASSISTANCE PROGRAM (ISNAP) REPORT Ernie Klein, ISNAP Executive Director, addressed the Board regarding current participants in the ISNAP program. He requested a meeting with the Board, with IPLA staff and the Attorney General’s Office. Charles Lindquist, ISNAP Program Director, presented the monthly report to the Board. Mr. Lindquist informed the Board that ISNAP has, as of March, 2007, 463 active clients, 25 new intakes, 50 intakes in process and 15 RMA’s returned. Mr. Lindquist stated that ISNAP met on March 15 to review those who have applied for the needs assistance fund. They have reviewed four applications, three of those qualified for assistance and vouchers were mailed. Mr. Lindquist stated that ISNAP uses 200% of the 2006 Poverty Guidelines as eligibility guidelines. To date, ISNAP has sent out 104 applications and only 35 have been returned for consideration. INDIANA STATE BOARD OF NURSING

April 19, 2007

I. CALL TO ORDER & ESTABLISHMENT OF QUORUM

Mr. Helmuth called the meeting to order at 8:32 a.m. in the Auditorium of the Indiana Government Center South Building, 302 West Washington Street, Indianapolis, Indiana 46204 and declared a quorum, in accordance with IC § 25-23-1-5(b).

II. ADOPTION OF THE AGENDA

A motion was made and seconded to adopt the agenda, as amended. HELMUTH/SLAGLE Motion carried 6-0-0

III. ADOPTION OF THE MINUTES FROM THE MARCH 15, 2007 MEETING OF THE BOARD

A motion was made and seconded to adopt the minutes, as amended, from the March 15, 2007 meeting of the Board.

IV. INDIANA STATE NURSES ASSISTANCE PROGRAM (ISNAP) REPORT

Ernie Klein, ISNAP Executive Director, addressed the Board regarding current participants in the ISNAP program. He requested a meeting with the Board, with IPLA staff and the Attorney General’s Office. Charles Lindquist, ISNAP Program Director, presented the monthly report to the Board. Mr. Lindquist informed the Board that ISNAP has, as of March, 2007, 463 active clients, 25 new intakes, 50 intakes in process and 15 RMA’s returned. Mr. Lindquist stated that ISNAP met on March 15 to review those who have applied for the needs assistance fund. They have reviewed four applications, three of those qualified for assistance and vouchers were mailed. Mr. Lindquist stated that ISNAP uses 200% of the 2006 Poverty Guidelines as eligibility guidelines. To date, ISNAP has sent out 104 applications and only 35 have been returned for consideration. V. EDUCATION

1. ITT Technical Institute – Letter of Intent and Application for Accreditation

Dr. Louise Hart and Marilyn Chestnut appeared before the Board on behalf of ITT Technical Institute. ITT is intending to start an Associate Program. They would like to begin admitting thirty students each quarter beginning in September, 2007. The total of students may be two hundred or more. They explained that the lab coordinator and clerical position will be the same person. Ms. Chestnut explained that there will be one skills lab with six beds. The Board suggested a job description for the program chair be provided. The Board stated that the philosophy statement looks good. The Board would like to see a student handbook available. The Board also explained that the full time faculty must have a Master’s Degree. Ms. Chestnut and Ms. Hart explained that they have begun renovation and ordering of supplies. Board Action: A motion was made and seconded to approve ITT Technical Institute’s letter of intent and application for accreditation. PETERS/SLAGLE Motion carried 7-0-0

2. Indiana Business College – Letter of Intent and Application for Accreditation

Gary McGee and Vicki Thomas appeared before the Board on behalf of Indiana Business College. They explained this program will be a twenty-one month ASN program. The Director of Nursing will be responsible for admissions. The Board questioned the preceptor language in the documents provided. The Board wants to see more clarification regarding what a preceptor does. The Board requested Indiana Business College to change their wording regarding the education requirements of faculty. They have faculty must have a Bachelors in Nursing, it should state a Master’s in Nursing or include the language from 848 IAC 1-2-13. The Board explained this rule allows a little space for faculty members who do not quite have a Master’s degree. Mr. McGee and Ms. Thomas explained that in order to be admitted to Indiana Business College, each applicant must take two different tests, the accuplacer and Ati Teas. They also informed the Board that fifty percent of the program is the amount of credits they will allow transferred by a student. The Board questioned their student handbook and they informed the Board that they are currently working on it. Mr. McGee stated that Indiana Business College has $35,000.00 in the budget right now for start up cost fee.

Board Action: A motion was made and seconded to approve Indiana Business College’s Letter of Intent and Application for Accreditation. PETERS/PARKER Motion carried 6-1-0 Ms. Dye opposed. 3. Olympia College – Change of Name FYI for the Board. Olympia College has changed their name. The new name is now Everest College. 4. Indiana Wesleyan University – Change in Launch of ASN Program FYI for the Board. The ASN Program will not launch in August, 2007.

VI. RULES 1. LSA Document #07-58 - Notice of Intent to Readopt Rules without Changes:

After considering the factors pursuant to Indiana Code 4-22-2.5-3.1(c), the Board has determined that the following rules impose costs and requirements on small businesses:

VII. PERSONAL APPEARANCES

A motion was made and seconded to affirm the recommendations of Carolyn Slagle for the Board, as follows:

1. David Harrison

Mr. Harrison appeared before the Board regarding the positive response on his application for licensure by examination. Mr. Harrison was charged with minor consumption on April 15, 2004. He received fines and had to remain trouble free in Tippecanoe County for one year, which he completed. Mr. Harrison was charged with minor consumption in the sum of 2004. He received fines and eight hours of alcohol education class, which he completed. Mr. Harrison was charged with possession of marijuana on July 25, 2005. He received fines and had to complete ten days of road crew, which he completed. Mr. Harrison stated that he started attending drug and alcohol classes in the summer of 2006. He signed up at Penrod Center and attended classes during the summer. Mr. Harrison informed the Board that he has already been evaluated by ISNAP. Ms. Slagle recommended Mr. Harrison’s license be issued.

2. Teresa Najera

Ms. Najera did not appear before the Board regarding the positive response on her application for licensure by endorsement. She will be rescheduled for the May 16, 2007 Board meeting.

3. Erin Siebenmorgen

Ms. Siebenmorgen appeared before the Board regarding the positive response on her application for licensure by examination. Ms. Siebenmorgan was arrested on January 30, 2006 for operating a vehicle while intoxicated. She was under the influence of marijuana. Ms. Siebenmorgan was assessed $362.50 in fines and courts costs, eighty hours of community service, one hundred eighty days of informal probation and ordered to attend drug and alcohol classes. Ms. Slagle recommended Ms. Siebenmorgen be evaluated by ISNAP within thirty days. Once PLA receives approval from ISNAP, she may be licensed.

4. Carla Aberle

Ms. Aberle did not appear before the Board regarding the positive response on her application for licensure by endorsement. Ms. Aberle did not indicate the action taken against her North Dakota license on her application for licensure by endorsement in Indiana. IPLA received this information through the Nursys Database. Ms. Aberle submitted additional documentation for the Board to review. Ms. Slagle reviewed the documentation and recommended Ms. Aberle’s license by issued.

5. Yolanda Moore

Ms. Moore appeared before the Board regarding the positive response on her application for licensure by endorsement. In 1999 Ms. Moore purchased a car from a car lot in Detroit, Michigan that was selling stolen vehicles. She was arrested for being in possession of the car two years later. On July 23, 2001 she was placed on criminal probation. Ms. Moore explained that in the State of Michigan, they have a law that requires a licensed professional to be summarily suspended for any felony. Her suspension is dissolved, but, she is now on two year probation with the Michigan Board. Ms. Slagle recommended Ms. Moore’s license be issued on Indefinite Probation. Ms. Moore may apply for withdraw of probation once her Michigan license is clear.

B. Appearance for Applicants by Renewal 1. Shelley Dawn Applegate

Ms. Applegate appeared before the Board regarding the positive response on her renewal

application. Ms. Applegate did not appear at the March 15, 2007 Board meeting. Ms. Applegate stated that she did not admit her termination on her February 28, 2007 renewal. She was terminated from Twin Lakes in July, 2006 for not reporting to work. Ms. Applegate also talked about how submitted a letter to the Board explaining that she dispensed Klonopin to her friends. She explained that it was her Klonopin that she dispensed. Ms. Slagle recommended Ms. Applegate’s license be renewed and issued on Indefinite Probation for a period of two years. Additionally, Ms. Applegate must submit quarterly reports from her employer and if she is not working she must still submit quarterly reports.

2. Terri Inman

Ms. Inman appeared before the Board regarding the positive response on her renewal application. Ms. Inman is currently licensed in North Carolina. She was in the North Carolina nurse’s assistance program. Ms. Inman stated that she has completed everything and her restrictions have been lifted as of February, 2004. Ms. Inman stated she has not been in monitoring since August, 2005. Ms. Inman stated that she voluntarily surrendered her North Carolina license. Ms. Slagle recommended Ms. Inman be evaluated by ISNAP within thirty days. Once PLA receives approval from ISNAP, her license may be renewed.

3. Nicole Serritella

Ms. Serritella appeared before the Board regarding the positive response on her renewal application. Ms. Serritella pled guilty to conversion, a class A misdemeanor. She received fines, is on criminal probation, forty hours of community service and completed a domestic abuse program. Ms. Serritella stated she is currently living at the YWCA and has established living with them for the next eighteen months. Ms. Slagle recommended Ms. Serritella’s license be renewed on Indefinite Probation for the length of her criminal probation.

4. John Anthony Hren

Mr. Hren appeared before the Board regarding the positive response on his renewal application. Mr. Hren did not appear at the March 15, 2007 Board meeting. Mr. Hren was charged with a D felony for controlled substance on November 20, 2005. He tried to bring in a controlled substance to the jail. Mr. Hren stated he is currently on parole for approximately the next twenty months. Mr. Hren was released from jail on March 2, 2007. His date of sobriety is February 13, 2006 and his drugs of choice were alcohol and vicodin. Ms. Slagle recommended Mr. Hren be evaluated by ISNAP. Once PLA receives approval from ISNAP, Mr. Hren’s license may be issued on Indefinite Probation until completion of his ISNAP contract.

VIII. PERSONAL APPEARANCES BEFORE THE FULL BOARD

1. Rebecca Guinn

Ms. Guinn appeared before the Board regarding the positive response on her renewal application. Ms. Guinn appeared before the Board at their January 18, 2007 meeting regarding the positive response on her renewal application. The board denied her renewal and requested that she obtain a psychological evaluation before she can reapply for renewal. Ms. Guinn submitted her psychological evaluation. Ms. Guinn stated she is currently attending counseling at Ball State University. Board Action: A motion was made and seconded to renew Ms. Guinn’s license. JONES/SHOOK

Motion Failed 3-3-1 Mr. Helmuth, Ms. Peters & Ms. Dye opposed. Ms. Slagle abstained.

Board Action: A motion was made and seconded to renew Ms. Guinn’s license on Indefinite probation. Ms. Guinn may submit another psychological evaluation from the same psychologist (Dr. Spengler). The psychological evaluation must include any diagnoses and any recommendations of further treatment. Additionally, Ms. Guinn must comply with the psychologist's recommendation(s). HELMUTH/SHOOK Motion carried 6-1-0 Ms. Jones opposed.
