2 PROPOSED TERMS OF REFERENCE
The proposal to expand the capacity of SPM, COT, the connecting pipeline from SPM to COT at Mundra Port and
the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab including the existing intermediate
pumping station does not involve any of the following :
1. Change in process or technology : The process and technology being used at the existing intermediate
pumping station will merely be repeated in these two stations.
2. Any land acquisition : Sufficient land owned by HMPL exists at these pigging stations for conversion into
pumping stations.
3. Any change to the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab
including the existing intermediate pumping station : The pipeline has sufficient strength and
additional capacity to handle the new flow requirement.
4. Any change to SPM, COT, the connecting pipeline from SPM to COT at Mundra Port : The capacity
expansion of the SPM will simply be achieved by increasing the berth occupancy at the SPM from present
approx. 19% to approx. 24% i.e. by unloading more crude oil tankers at the SPM to fill the storage tanks at
COT at a higher frequency. Similarly capacity expansion of the COT from present 9 MMTPA to 11.25 MMTPA
can be achieved by receiving crude oil from the SPM at a higher frequency commensurate to its berth
occupancy of approx. 24% and pumping out the crude oil into the Mundra – Bathinda pipeline at a higher
flow rate. In fact, the quantity of liquid effluents at COT and fugitive emissions will also remain within the
already approved quantity.
5. Increase in the production capacity or change in product mix : The SPM, COT, the connecting
pipeline from SPM to COT at Mundra Port and the Crude Oil Pipeline from Mundra coast in Gujarat to
Bathinda in Punjab is used for unloading, storing and transporting imported crude oil from Mundra Port in
Gujarat to Guru Gobind Singh Refinery of M/s HPCL-Mittal Energy Limited near Bathinda in Punjab. As such,
no production or product mix is involved.
Para 4 of EIA Notification dated 14th September, 2006 states that:
“Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986, read with clause (d) of sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986 and in supersession of the notification number S.O. 60 (E) dated the 27th
January, 1994, except in respect of things done or omitted to be done before such supersession, the
Central Government hereby directs that on and from the date of its publication the required construction of
new projects or activities or the expansion or modernization of existing projects or activities listed in the
Schedule to this notification entailing capacity addition with change in process and or technology
shall be undertaken in any part of India only after the prior environmental clearance from the
Central Government or as the case may be, by the State Level Environment Impact Assessment
Authority, duly constituted by the Central Government under sub-section (3) of section 3 of the said Act, in
accordance with the procedure specified hereinafter in this notification.”
Further, section 7 ii of EIA Notification dated 14th September, 2006 states that:

threshold limit prescribed in the Schedule to this notification through change in process and or
technology or involving a change in the product –mix shall be made in Form I and they shall be
considered by the concerned Expert Appraisal Committee or State Level Expert Appraisal Committee within sixty
days, who will decide on the due diligence necessary including preparation of EIA and public consultations and the
application shall be appraised accordingly for grant of environmental clearance.”
Since, the proposed capacity addition to the SPM, COT, the connecting pipeline from SPM to COT at Mundra Port
and the Crude Oil Pipeline from Mundra coast in Gujarat to Bathinda in Punjab including the existing intermediate
pumping station from 9 MMTPA to 11.25 MMTPA do not involve any change in process or technology, we
understand that prior environmental clearance for the capacity addition may not be required.
We, therefore do not propose any TOR for the proposal.
