Theideasbusiness(especiallyoneasfluidandrapidlyevolvingasthesoftwaretrade)raisesmanythornyquestionsconcerningthelawsofintellectualproperty(IP).ItisoneareainwhichitispossibletodetectinconsistencyinGates’sapproach,largelydependingonwhoseintellectualpropertyisinquestion.
AccordingtotheWorldIntellectualPropertyOrganization,IPrefersto‘thecreationsofthemind,suchasinventions;literaryandartisticworks;designs;andsymbols,namesandimagesusedincommerce’.Tothewiderworld,itisallthatstufflegallyprotectedthroughpatents,copyrightandtrademarks,oftendenotedwithlittlesymbolsonmerchandise.Butestablishingexactlywhatconstitutesintellectualpropertyisatrickybusiness,andonewithhugefinancialimplications.Asaresult,BillGatesandtheMicrosoftlegalteamhavehardlybeenstrangersinthelawcourtsofAmericaandbeyondovertheyears.Theyhavebeeninvolvedinnumerouscaseswheretheystoodaccusedofmisappropriatingintellectualproperty,justastheyhaveaccusedothersofdoingthesame.

FewserioustechnologyhistoriansdisputethefactthatSiliconValleywasbornoutofafairlyliberalsharingofideas,ameltingpotinwhichideasevolved.Insuchaclimate,inevitablytherearethosewhofeeltheymissedoutontheirdeservedcreditforinnovatingsomethingentirelynew.Thevictorwasoftentheonewhocouldfinesseanideaandgetittomarketfirst.AsGatesnotedinaninternalMicrosoftmemoin1991:‘Ifpeoplehadunderstoodhowpatentswouldbegrantedwhenmostoftoday’sideaswereinvented,andhadtakenoutpatents,theindustrywouldbeatacompletestandstilltoday.’Inotherwords,ifdevelopershadbeenwilieraboutpatentingfromthestart,therewouldneverhavebeentheexchangeofideasthatallowedtheindustrytoevolveasquicklyasitdid.
YetthereisanothersidetoGatesthatisfiercelyprotectiveofIP.Whenjuststartingoutinthebusiness,hewroteanimpassionedletterthatappearedinapopularhobbyists’magazine,criticizingthoseamateurenthusiastswhoillegallycopiedMicrosoftsoftware.Hisargumentwassimple:thatdevelopershadtherighttobepaidfortheirwork.Inhiswordsatthetime:‘Asthemajorityofhobbyistsmustbeaware,mostofyoustealyoursoftware.Hardwaremustbepaidfor,butsoftwareissomethingtoshare.Whocaresifthepeoplewhoworkedonitgetpaid?’Iftheywereindeeddeniedthatright,akeyimperativetoseriousdevelopmentwoulddisappear.Inshort,everyonewouldloseout.
Certainly,Microsofthascometofiercelyembracetheworldofpatents,pursuingthoseitbelievestobeinviolationofthelaw.In2004,SteveBallmerallegedthattheLinuxoperatingsystembreachedsome235Microsoftpatentsalone.PatentshavethusbecomeabigpartoftheMicrosoftbusiness,generatingbillionsinrevenueeachyearandkeepingawholedivisionoccupied.Meanwhile,thecompanyarguesthatpropermanagementofpatentsisessentialtofosteringtechnologicalbreakthroughs.
