STATEMENT OF REASONS AND ORDER
Defendant Universal Underwriters Ins. Co., moves to strike Answer and Defenses ofco-defendant
Hogan Bargain Buddies LLC for failure to produce certain designated individuals at a court
ordered deposition on March 1, 2017. The order to compel was entered February 17, 2017, upon notice to all counsel, and was unopposed. The proposed Order provided the names of all
deponents, as well as the date, time and location.
Co-defendant opposes the motion on several grounds. First, it asserts that because the copy of
the order apparently was mailed on February 28, 2017, and never received before March 1, the
Order is ineffective. While that should not relieve counsel of the knowledge of the content of the
proposed Order, and the timely posting of all Law and Equity motion orders online, more
compelling is the letter from Counsel informing the movant that one of the deponents will be in
the Philippines on March 1, 2017, and would be available on April 5. Included in that letter were
other issues regarding other individuals and representatives sought for deposition.
Accordingly, the motion to strike is denied. This SOR will serve as an Order to be entered,
compelling the appearance at a deposition of Mr. Edward D. Hogan and Edward Hogan Jr., upon
no less than 10 days' notice in writing. No other depositions are compelled by virtue of this
motion, and the February 17, 2017 Order is hereby Vacated.

LLC and The Law Office Of Christopher J. McGinn, by their attorney, Kelly Samuels Thomas,
Esq. of The Wolf Law Firm, LLC, appearing, and the Court having reviewed the moving papers
and any opposition thereto, and the Court having heard the argument of counsel and/or

1. Plaintiffs' Motion for Summary Judgment is hereby GRANTED;

Enea entered a binding and enforceable contract on October 29, 2014;

The Wolf Law Firm, LLC and the Law Office of Christopher J. McGinn are
entitled to the entry of a judgment in the amount of $100,000.00 against the
Defendants Route 46 Auto Sales, Inc. and Salvatore Enea;
5. The Court further finds that, pursuant to the default provisions of the contract,
The Wolf Law Firm, LLC and the Law Office of Christopher J. McGinn are

costs incurred in obtaining this judgment in this matter;
as attorneys' fees and
