Rae Roeder RealtyTRIM notices recently came out, and if your home has been homesteaded for a number of years youmay have noticed that your market value has gone down, but your assessed value has gone up as wellon your tax bill. That is due to something called “recapture.” Your assessed value goes up 3% even in adown market. Amendment 4 will give the legislature the authority to correct this problem.
Are you considering buying a new home? If you have no portable exemption, or are a first time buyer,your property will be taxed at full value while your neighbor next door will pay far less in taxes dueto his homestead exemption. Amendment 4 provides an additional exemption for the first five years toaddress this inequity.
Do you own a small business? Non-homestead property will have tax increases of 10% per year.Amendment 4 will reduce that increase to 5% and remove the “recapture” feature. The same scenario is inplace if you own rental property. Ask yourself if you think you can raise the rent by 10% per year whilebeing taxed at a higher rate due to “recapture”?
Florida needs growth in jobs which means attracting more people and industry to our state. If rental ratesare forced to increase, if home sales are hobbled because taxes make the monthly payments too high, ifthat clean industry company sees property taxes as a limiting factor, we all lose.
The good news: you can change your world by being an active voter! Never think“my one vote” doesn’t count. Don’t let an amendment fail because you thought it wasa great idea and everyone would vote yes. We will need 60% approval to pass anamendment and every vote counts.
The housing market appears to be taking an upward swing. We can give it a muchneeded boost by passing this amendment.

She requested a rea-sonably priced fix.
Before I offer solu-tions from other readers,I shouldmention, as Deb-orahKates, the vicepresident of the Coates-ville Area Art Alliance,remindedme, that a “sun-ny sill is the worst place
to let tomatoes ripen.”“They should be out of
the sun,” said Kates, whoalso teaches courses inorganic gardening andjam-making. “Nowonderthey gotmushy and cre-ated that expensive prob-lem.”
We put ours in a paperbag to ripen and just waitthem out. I ate the lasttomato from our 2011
garden in January. Ourfood editor came to therescuewith BarKeepersFriend, which you canbuy just about anywherein liquid or powder formfor under $3.

“The two systems donotmixwell,” Ponessasaid. “If considering re-placement of old radia-tors with themodernEuropean sheet-metalunits, I would quiz theplumber very carefullyabout radiator sizing andperformance.”
The lightweight radia-torsmay not work verywell if mixedwith the oldcast-iron units, he said.Modern, low-profile cast-
iron baseboard units areanother alternative to theold units. Ponessa alsohas had firsthand experi-ence painting radiatorsand building covers.
Whethermade of alu-minum orwood, all haveheld upwell, with nosplitting or warping. Ifyou screw awoodencrosspiece on the top ofthe cover, theremay besplitting unless the cross-piece is slotted for thescrews to allow the top toexpand and contract.

“Everything is veryspecific,” Keidan said ofher decorating style. “Iwant your eye to look atsomething. I like havingthings to look at —things that are pretty.”
In the otherwise all-white cottage kitchen, astartling blue contempo-rary triptych by Veniceartist Melissa Harring-ton catches your eye. Inan otherwise staid, tradi-tional guest room? A redabstract painting.
“I enjoy those piecesevery day,” she said,noting that the red paint-ing was by her grand-mother.
Keidan’s passion forart is not surprisinggiven her background:Her great-grandfatherwas pianist Leopold Go-dowsky. Her grandpar-ents were Leopold Go-dowsky Jr., a violinistand co-inventor of Koda-chrome film, andFrances Gershwin Go-dowsky, sister to com-posers George and Ira.The multitude of art-works throughout Kei-dan’s house creates anambience that is elegantyet whimsical — anddeeply personal.
“I love that there is astory behind each art-work,” she said. “It’s asthough my friends andfamily have left thumb-
prints on my home.”She purchased the
three-bedroom, two-bathhouse last year afterlooking at more than 100properties in the lastfour years. She had, shesaid, given up when shevisited the Venice house,where friends from Lon-don had been staying. “Itwas a little like the cli-che you often hear aboutfalling in love,” she said,laughing. “Stop lookingand you will find it.”
After convincing theowner to sell, Keidanembarked on a four-month renovation to givethe 1947 home a cleanerlook.
“I wanted it to be lightand airy and cheerful,”she said.
Mustard and red ac-cent walls were paintedmuseum white andsoothing neutral tones.The exterior went fromdark blue to more white.
New windows were in-stalled to bring in natu-ral light, and new land-
scaping made the mostof outdoor spaces.
Small fixes, such as
smoothing the home'swarped walls, helped toachieve the clean-lined
look Keidan wanted. Andthough much changed,Keidan was careful tokeep what worked: theoriginal floor plan andstriking leaded glasswindows that Keidansaid were from the oldHelms Bakery on theL.A.-Culver City border.
For Keidan, who grewup in New York, theresult is much like theVenice community shehas grown to love: aneclectic space thatdoesn’t conform to oneparticular style — justlike her jewelry.

Hidden Costs of Foreclosures Pose Risks Not Found in New HomesThe economic downturn has hurt many
Tallahassee-area families during the past fewyears, and sadly thatmeans there are a largernumber of foreclosed homes on the marketthan during a healthy economy.
The lower price of these homes can makethem look like a bargain, but home buyersneed to carefully compare the actual cost—and advantages—of a newly-constructedhome versus a foreclosed one before theymake their final decision.
At theNational Association ofHomeBuilders(NAHB) 2012 International Builders Showin Orlando, Jay McKenzie, vice presidentof Builder Digital Experience, LLC, offereda number of advantages of purchasing a
brand new home, and warned of hiddencosts of foreclosed homes that buyers needto consider:
• Many foreclosures are sold “as is” withno disclosure requirements. Buyers couldbe surprised with major repair bills forissues such as foundation faults or otherstructural defects, mold, hidden waterdamage, unsafewiring, rodent infestationsand more.
A foreclosed home that appears to havebeen renovated may not have been donesowith the proper permits and inspections.A brand new home provides peace ofmind for your family’s safety because ithas passed inspections and conforms tocurrent building codes. A new home is alsounder warranty and any issues that ariseduring the warranty term will be fixed atno cost to the home owner.

It is important to note that some homebuilders have expanded their businesses toinclude buying foreclosures, then renovatingand re-selling them. In these cases, the buildernormally has inspected the home for hiddendamage or dangerous conditions, gottenthe required permits, and completed thenecessary repairs. They also often renovate,replace appliances and components, andp e r f o r m m a n ycosmetic upgradesto make the home anattractive and safeplace for the homebuyer.

ANSWER: It’s never agood idea to ignore alawsuit, even if you thinkyou have nothing to lose— because you may bewrong and actually have
something to lose. Meetwith a lawyer to seewhether you have anyliability. In these situa-tions, there are simplesteps that you can take todisclaim any interest inyour late mother’s prop-erty, such as filing acertain form in the publicrecords or deeding yourpotential interest to the
condo association.Q: I live in a condo,
and the unit above me isrented to a family that’sloud. We had a meetingwith the owner, but thetenants are back to theirold tricks. How can wefix this? — Leslie
A: Speak with thelandlord again. Also, readthe condo rules and see
whether your neighbor isbreaking any of them. Ifso, the landlord may befined, and that may bewhat it takes to get theproblem resolved.
Also, some condoshave rules about types offlooring and padding thatcan be installed. In thatcase, the association canmake the unit owner fix

WASHINGTON (AP)—AverageU.S.mortgagerates rose only slightlythis week and continuedtohovernear record lows,a trend that has helpedboost home sales and refi-nancing.
Mortgage buyer Fred-die Mac said Thursdaythat the rate on the 30-
year fixed mortgageedged up to 3.41 percent,from 3.37 last week.Three weeks ago, the ratetouched 3.36 percent.That’s the lowest level onrecords dating to 1971.
The average rate onthe 15-year fixed mort-gage, often used for refi-nancing, rose to 2.72 per-cent. That’s up from lastweek’s record low of 2.66percent.

SCREENING ON THE BASIS OFCRIMINAL BACKGROUND

Most landlords would agree -- They would rather havetenants who are not familiar with the inside of a jail cell.To screen out those with criminal records, the landlordasks whether the tenant has been convicted of a felony,or had adjudication withheld on a felony charge, or wasever convicted of a sexual crime. The landlord often runsa background check of all the adults in the household justto make sure.
If the landlord learns the applicant does indeed have acriminal record, the landlord can legitimately turn down theapplicant. It won’t be a violation of fair housing laws.
Fair Housing laws do not protect criminal activity.
Having a criminal record is not a protected class under thefair housing laws. Thus, landlords can establish screeningcriteria that reject an applicant who has a criminal record.
Conviction vs. Arrest vs. Adjudication Withheld
Convictions should not be confused with arrests. Aconviction means that a judge and jury have determinedthat the individual is guilty of the particular crime. Anarrest occurs if law enforcement suspects the individualcommitted a crime. There is a world of difference between
suspicion and conviction, as any Perry Mason fan can tellyou.
“Adjudication withheld” means the court determinedthe individual did the crime but the court is not enteringa conviction at the moment. Instead, the court placescertain conditions on the defendant. Examples are to notuse drugs, do community service, stay in school, etc. If thedefendant satisfies all of the conditions set by the judge,then the conviction is never entered against him. Eventhough the conviction is not entered, you can reasonablybelieve that the individual did the criminal activity.
A landlord should not reject applicants on the basis ofarrest records. Doing so would be considered unlawfuldiscrimination. That is because arrest statistics showthat arrest patterns have sometimes been discriminatoryagainst protected classes in some contexts. That makesarrests a bad screening criterion.
Uniformity and Consistency.
If the landlord conducts criminal background checks, itshould be done on every adult applicant. Doing anythingless would be considered discriminatory.
The landlord should not accept some applicants withcriminal records and reject others. For example, a landlordshould not accept a female applicant with a record ofassault but not a male applicant with a similar conviction.Once exceptions are made, the criteria cease to be fair.

WASHINGTON—Thenumber of Americanswho signed contracts tobuy homes rose onlyslightly, suggesting salesmay level off in the com-ingmonths after solidgains in the past year.
TheNational Associa-tion of Realtors saidThursday that its season-ally adjusted index ofsales agreements rose inSeptember to a readingof 99.5. That’s up fromAugust’s reading of 99.2but below a two-year highof 101.9 reached in July.Contracts are up14.5percent from a year ago.
An index readingabove100 is consideredhealthy. The index bot-tomed at 75.88 in June2010 after a homebuyer’stax credit expired.
The pending homesales index is ameasureof the number of signedcontracts to purchase
homes. The index cansignal where the housingmarket is headed becausea signed contract usuallyresults in a final sale oneor twomonths later.
The housingmarkethas been recovering thisyear, helped by the low-estmortgage rates indecades, a limited supplyof homes for sale andsteady price increases.
Some economists saidthe rising trend in homesales will likely continue,despite a fewweakermonths this fall.
The figures “suggestthat existing home salesare likely to flatten overthe nextmonth or two,”Joseph LaVorgna, aneconomist at DeuscheBank, said in an email.“Looking beyond then, weexpect sales to resumetheir uptrend as the un-derlying housing funda-mentals continue to im-prove.”
New home salesjumped last month to thehighest annual pace in
the past two and a halfyears.
And builders brokeground on new homesand apartments at thefastest pace inmore thanfour years in September.They also requested themost building permits infour years, a sign thatmany are confident thathome sales gains willcontinue.
The housing recoverycould help boost econom-ic growth and hiring attimewhenmanufactur-ing has weakened sharp-ly. Still, housingmakes upamuch smaller part ofthe economy than it didbefore the bubble. Sorising construction andsalesmay have less of animpact.
Andmany first-timehomebuyers are strug-gling to qualify formort-gages, since banks haveraised credit standards.Many also demand highdown payments thatmanywould-be home-buyers can’t afford.
The National Association of Realtors says its index of sales agreements dropped 2.6percent last month to 99.2. In July, the index rose to 101.9. That was the highest level sinceApril 2010, when the market benefited from a federal home-buying tax credit. AP
