Property Description/Findings of Fact: The subject property is a 10,000± sq. ft. parcel located off of SE 19th Place, a local road with access to Palaco Grande Pkwy, east of Del Prado Boulevard in Southeast Cape Coral. The subject property is improved with a single-family home with a pool, and a marine improvement that includes a boat slip and decking. The subject property has frontage and access from SE 19th Place. The property has 80 feet of water frontage on the Carolyn Canal that has a platted width of 90 feet. The property is 500 feet north of the Palaco Grande canal that provides access to the Caloosahatchee River. Surrounding properties consist of single-family residences. The Carolyn Canal comes to an end approximately 360 feet north of the subject property. Ten other properties have access to the Carolyn Canal north of the subject property, nine of which have marine improvements. Project Description: The applicant is requesting three marine improvement deviations to LUDR, Section 3.16 that, if approved, would permit a one-foot extension into the 12-foot side setback, a one-foot extension beyond 25% of the canal width, and a 10-foot increase in the length of a boat canopy. LUDR, Section 3.16.2.E.4 governs the 12-foot side setback and states, “Except as otherwise provided herein for boat canopies attached to joint marine improvements, no part of

any boat canopy shall be located less than 12 feet from the ends of the water frontage line unless the prior written consent of the affected abutting property owner(s) is obtained. Such consent shall be recorded in the public records of Lee County, at the expense of the property owner(s), shall be irrevocable by the affected abutting property owner, and shall be binding on the heirs, tenants, successors in interest and/or assigns of the affected property owner unless the owner of the property with the boat canopy that is located less than 12 feet from the ends of the water frontage line consents in writing to the revocation and removes or relocates the boat canopy so as to comply with all applicable requirements of this section. The owner of the parcel containing the marine improvement to which the boat canopy is attached shall be responsible for providing the aforesaid written consent to the city prior to obtaining a permit for the construction or erection of a boat canopy.”

The applicant has received the consent letter from the abutting property owner. LUDR, Section 3.16.2.B.2 governs the 25% canal width extension restriction and states,

“Except as provided below, no part of any marine improvement, including but not limited to docks, mooring posts, boat lifts, lift structures, and/or walkways shall project into a waterway to a point more than 25% of the calculated waterway width or 30 feet, whichever is less, as measured from the water frontage line.”

LUDR, Section 3.16.2.E.2 governs the canopy size requirements and states,

“No boat canopy shall exceed 40 feet in length or 18 feet in width unless a deviation to allow a greater width or length is approved pursuant to § 3.16.9.”

Normally, this deviation would be handled administratively, but it is the increased canopy length that has caused the need for the additional deviation requests. The proposed canopy is below:

Analysis The applicant is requesting multiple deviations to allow a canopy 50 feet in length and 13 feet in width. The applicant indicates in their application that their boat slip is 13.67 feet wide. The proposed canopy will be oriented parallel to the Carolyn Canal. Staff has reviewed the deviation application based on LUDR, Section 3.16.9.B and C, which addresses Marine Improvement Deviations. Factors to be considered include:

• A present need to cover a marine vessel that could not be protected unless a larger boat canopy were to be permitted,

• The design, size, and proposed location of the proposed larger boat canopy, and • The effect of such larger boat canopy on the waterway in which it is proposed to be located and

on the use and enjoyment of surrounding properties.

Staff finds the applicant has demonstrated a need for a boat canopy due to the presence of a marine improvement with a boat slip that is 44 feet in length and 13.67 feet in width. However, as indicated in the Background section, the proposed 50’ x 13’ boat canopy would extend into the minimum side 12-foot setback. In addition, the canopy also extends farther than 25% of the canal’s width of 90 feet by one-foot. The design, size, and proposed location of the proposed larger boat canopy is appropriate for the boat’s size. As the boat lift is located parallel to the canal, and the dock marine improvement is built to the edge of the 12-foot side waterfront setback, there are no other alternative locations for the placement of the boat lift, and consequently, the boat. The property directly north of and adjacent to the subject property contains a marine improvement which is 35 feet from the subject properties’ northern property line, which provides sufficient room for navigation and visibility. As identified above, the neighboring property owner has submitted a letter of no objection to the variance request within the 12-foot setback. While the proposed boat canopy extend one-foot beyond the 25% canal width, the nature of the canal is such that there are few impacts on navigation. As discussed in the Findings of Fact section, only ten waterfront properties are located north of the subject property, so the effects of navigation are minimal, as there is little through-traffic. Given the number of marine improvements already present on the Carolyn Canal, there are minimal impacts on visibility both for mariners and for property owners. Due to the analysis above, the proposed boat canopy requires appears to have a minimal effect on the use and enjoyment of surrounding properties. Recommendation Based on analysis and characteristics of the site, Staff has provided the following recommendation:

The owner shall be responsible for reimbursing the City for all recording fees. This deviation shall not be effectuated until such fees have been paid in full by the owner to the City.

Section 3. Pursuant to City of Cape Coral Land Use and Development Regulations, Article III, Supplementary District Regulations, Section 3.16, Marine Improvements, the Applicant's request for a deviation is hereby granted.

Section 4. This Resolution shall take effect immediately upon its adoption.

DEVIATION (MARINE IMPROVEMENT) – APPLICATION

CRITERIA APPLICABLE TO DEVIATIONS Cape Coral Land Use & Development Regulations Section 3.16

A. Any person aggrieved by the effect of this section shall have the right to request a deviation from the

provisions of this section.

B. Deviations from the provisions of this section may be approved by the Board of Zoning Adjustment and Appeals provided that the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. In determining whether a particular deviation request should be approved, factors the Board of Zoning Adjustment and Appeals shall consider include, but are not limited to, the following: the effect the proposed deviation would have on the navigability of the waterway involved; the design, size, and proposed location of the marine improvement for which deviation is sought; the effect, if any, that the proposed deviation would have on any extant marine improvements in the subject waterway. Subject to these standards and criteria, the Board of Zoning Adjustment and Appeals shall approve only the minimum deviation from the provisions of this section necessary to avoid the unnecessary or undue hardship required herein. C. Any person aggrieved by the decision of the Board of Zoning Adjustment and Appeals or the Director of the Department of Community Development or the Director's designee concerning the interpretation and application of this section with respect to a waterfront parcel located on a lake or basin or concerning a requested deviation from the provisions of this section may appeal such decision to the City Council provided that a written notice of appeal is filed within 30 days after the date of the action appealed from. The notice of appeal shall be considered filed when it is received by the Department of Community Development.
