June 21, 2017 The Corporation of the County of Prince Edward County of Prince Edward Council Shire Hall 332 Main Street, Picton, ON K0K 2T0 We, Cynthia Nicholls and Darrell Windsor are the owners of BEACH BUM in the County, a retail operation servicing both local and tourist clients. We are one of the longest, if not the longest existing retail business on Main Street, opening originally on April 1, 1990. In December 2016 we moved our location to a building we had purchased for the longevity of our operations. During that time, we installed a sign as part of the move (which is a major time consuming and logistical endeavor) while trying to ensure minimal disruption to our operations and availability to our clients. We, in haste, put up a sign that was in contravention of the sign bylaw size by a mere 2.4%. It was an error on our part and one which we will be rectifying. Otherwise, we conform fully to the municipal sign bylaw. Our building is not a significant heritage building worthy of designation. You are aware of our past issues with the Heritage District approval process. As a result, we have submitted a new application based on our sign conformity to the sign bylaw and await its approval. Further, we have made the following determination as to the heritage district approval process:
That the Heritage District approval process is seriously flawed.
That the heritage district guidelines are arbitrary and subjective.
That application of the district guidelines is inconsistent and meritless.
That the influence of County Staff, drive and dictate the decisions of the Heritage Advisory Committee.
Decisions are made demanding outrageously expensive changes with no regard for a small business’ operating costs.
That the decisions by staff and the Heritage Advisory Committee is contrary to protections provided by the Charter.

As such, we see your previous actions as an intrusion of our rights and as an attack against a small business that the municipality feels it can intimidate, bully and thus inflict its will. The nature of our sign constitutes the entirety of our identity; expression of who and what we represent. We will not alter our image and expression of what our business represents. The shiny brightness of the yellow sun, blue of the water and graphics are a pure expression of our identity. Should our application be rejected as is, be advised that we consider any attempt to change the impact of our commercial image, expression and communication of our business to the public, as a violation of Section 2 of the Charter of Rights and Freedoms. We request that you process our application as is. Please be advised we are prepared to litigate this matter. Application Procedure
The following is a summary of a typical procedure for considering CIP grant applications. Some of the grant programs will have slightly different approval procedures. As such, it is important to meet with staff prior to completing the application to confirm the details of the procedure and the information required.
1. Consult with staff from the Development Services Department (Planning Division) to determine:
a. eligibility for the grant, b. detailed procedure and information required by the Town to process the application, c. other application and/or agreement requirements; d. other agency approvals required (e.g. entrance permits from the Town or District;
approvals from Veridian Connections); e. time frame; f. what other departments may have an interest in the application and should be involved
with ongoing discussions.
NOTE: more than one meeting with Town staff may be required to ensure that all of the background material is provided. The Town staff will endeavor to coordinate the activities of other Town Departments in the application process, to simplify to application procedure (e.g. Building Dept staff to be involved in all applications where a building permit is required). Where appropriate, meetings can be arranged on site.
2. Submit grant application in advance or at the time of building permit/site plan application/approval, including the following:
a. Completed application form; b. Any supporting documents and information noted during the initial consultations.
3. Review by staff with ongoing discussions with applicant (as needed). This includes coordination
with other Departments as required to ensure that the application is complete and all other applications are underway.
4. Property inspection by Development Services staff with any other applicable departments/persons;
5. Staff prepares material for submission to Steering Committee/Review Committee;

6. At the call of the Chair, meeting with Review Committee, who will evaluate and make a decision on the grant application. (*)
NOTE: The applicant will be encouraged to attend the Review Committee meeting and participate in the discussions, including providing any additional background information that may assist the Committee in its review.
NOTE: Where an application is being made for a Heritage grant, a Heritage Committee representative will be on the Review Committee reviewing the proposal, and commenting and considering the heritage aspects of the proposal.
7. Decision is made by Committee regarding Approval of Grant – subject to permits being issued
8. Execution of any required agreements (previously identified – e.g. encroachment agreement for awnings and/or signs that project over the municipal road allowance; site plan agreement where required; (*) NOTE: The Review Committee may provide a conditional approval or defer a decision subject to modifications to the proposal.
9. Issuance of required permits to the satisfaction of the Chief Building Official or other approval authority;
10. Request for payment of the grant and inspection by Town staff to confirm completion of the grant eligible items;
11. Payment of grant in accordance with the provisions for each grant type.
NOTES:
Applications are not retroactive and cannot be considered for construction already commenced or completed.
The Review Committee is limited to the budget that Council has provided, and may find it necessary to give only partial approval of the requested funds, depending on the availability of funds, and prioritization of community impact.
