Saint Francis university’s Title IX Teamis here to receive, respond to, and resolveall reports of discrimination, harassment,and sexual misconduct that affect SaintFrancis university community members.
Our role is to eliminate, prevent, andredress all known instances of prohibitedgender-based misconduct, such as sexualviolence, domestic violence, datingviolence, stalking, and sexual harassment.
We are charged with: investigatingreported misconduct and other concerns;supporting the people involved;implementing measures to maximizecampus safety; and promoting everyone’sability to live and learn at Saint Francisuniversity in an environment free fromdiscrimination and harassment.

CONSENTConsent Defined: Consent is informed, freely given and mutually understood. Consent requires anaffirmative act or statement by each participant. If coercion, intimidation, threats and/or physical forceare used, there is no consent. If a person is mentally or physically incapacitated or impaired so that theperson cannot understand the fact, nature or extent of the sexual situation, there is not consent; thisincludes conditions due to alcohol or drug consumption or being asleep or unconscious. Whether onehas taken advantage of a position of influence over another may be a factor in determining consent.
Sexual Activity Requires Consent: Consent consists of an outward demonstration indicating that anindividual has freely chosen to engage in sexual activity. Consent is demonstrated through mutuallyunderstandable words and/or actions that clearly indicate a willingness to engage freely in sexual activity.Relying on non-verbal communication can lead to misunderstandings. Consent may not be inferred fromsilence, passivity, lack of resistance or lack of active response alone. A person who does not physically resistor verbally refuse sexual activity is not necessarily giving consent. In the absence of an outward demonstration,consent does not exist. If at any time it is reasonably apparent that either party is hesitant, confused oruncertain, both parties should stop and obtain mutual verbal consent before continuing sexual activity.
Consent to engage in sexual activity must be knowing and voluntary. Consent to engage in sexualactivity must exist from the beginning to end of each instance of sexual activity, and for each form ofsexual contact. Consent to one form of sexual contact does not constitute consent to all forms of sexualcontact. For example, an individual may agree to kiss but choose not to engage in touching of the intimateparts or sexual intercourse. An individual should obtain consent before moving from one act to another.
A current or previous dating or sexual relationship, by itself, is not sufficient to constitute consent.
Even in the context of a relationship, there must be mutually understandable communication that clearlyindicates willingness to engage in sexual activity each time such activity occurs.
Consent may be withdrawn by either party at any time.Withdrawal of consent must also be outwardlydemonstrated by words or actions that clearly indicate a desire to end sexual activity. Once withdrawalof consent has been expressed, sexual activity must cease.

Interim Actions/Remedies
� Access to counseling services and assistance in setting up an initialappointment, both on and off campus;
� Providing medical services;� Imposition of a campus no contact order;� Imposition of a no trespass order;� Ensuring that the reporting party can move safely between classes and activities;
� Ensuring the reporting party and responding party do not share classes orextracurricular activities;
� Academic accommodations (with agreement of the appropriate faculty, who willnot be informed of the specific reason for the request with permission of the student):
� Rescheduling of exams and assignments;� Providing alternative course completion options;� Change in class schedule or other academic accommodations;
� Providing academic support services, such as tutoring;
� Transportation assistance;
� Change in work schedule or job assignment;
� Residence modifications: � Change in on-campus housing;
� Arranging to dissolve a housing contract and pro-rating a refund inaccordance with campus housing policies;
� Receive requests for assistance from staff in completing housing relocation;
� limit an individual or organization's access to certain university facilitiesor activities pending resolution of the matter;
� Voluntary leave of absence;� Interim suspension or university-imposed leave;
� Any other remedy that can be tailored to the involved individuals to achievethe goals of this policy.
YOuR RIGHTS
Students and all members of the University campus community have the right to:
Reporting
� To report a potential violation of the university’s policy to the university’sTitle IX Coordinator or a Title IX Team member.
� To notify law enforcement and have assistance.
� To a prompt and thorough investigation of all reports of sexual misconduct.
Fair Process
� To be treated with dignity, empathy, and respect by university officials.
� For reports to be reviewed through the resolution procedures outlined inthe university’s policy.
� To refuse to have an allegation resolved through conflict resolution.
� To receive amnesty for minor student misconduct (such as alcohol or drugviolations) that is ancillary to the incident.
� To be free from retaliation for exercising their rights.
� To be informed in writing of the outcome/resolution, sanctions wherepermissible and the rationale for the outcome where permissible.
Advocacy and Support
� To interim support and protective measures to help to continue to live andlearn at Saint Francis university.
� To experience a safe living, educational and work environment
� To take advantage of campus support resources (such as Counseling or HealthServices)
� Advisors of their choosing to guide and accompany them throughout theresolution process.

Saint Francis university is committed to providing a variety of welcoming andaccessible ways for community members to voice concerns about and reportinstances of sexual misconduct.
If you are ready to report a gender-equity concern, you may speak with anymember of the Title IX Team. e Title IX Team makes every effort to protectthe privacy of all individuals. Speaking directly to the Title IX Team or to amandatory Reporter initiates a Title IX response.
Additionally, with the exception of the confidential resources,ALL Saint Francis University Faculty, Staff, and Administratorsare Mandatory Reporters of Information Related to SexualMisconduct. When Mandatory Reporters become aware ofinformation regarding sexual misconduct they are required toshare what they know with the Title IX Coordinator or anymember of the Title IX Team.
