WHAT IS “DISABLED”…?

DISABLED

+ Definition: – By medical point: a physical or mental impairment

that has a substantial and long-term adverse effect on his/her ability to carry out normal day-to-day activities.

– By social point: It is the traditional concept which causes the individuals to be “disabled” in the environment. Ex: No ramps in buildings.

DISABILITY DISCRIMINATION ACT

+ It was legislated to make ”discriminating against disabled persons in connection with employment, (…)” to be unlawful.

+ Service providers have had to make 'reasonable adjustments' for disabled people, such as providing extra help or making changes to the way they provide their services.

+ Consolidated into the Equality Act (2010).PASSIVE ->ACTIVE

+ less favorable treatment for a reason related to a disabled person's disability

+ failure to make a "reasonable adjustment"

THE PROBLEM…

+ For adjustment: The Disability Rights Commission's Codes of Practice:– whether the proposed adjustment would meet the

needs of the disabled person– whether the adjustment is affordable– whether the adjustment would have a serious effect

on other people+ The Act therefore permits employers and

service providers to justify less favorable treatment in some circumstances.

+ Exemption of small firms(15 employees under)+ ‘reasonable adjustment’ clause that enables

employers to justify some non-adherence+ monitoring of compliance by employers+ Narrow definition of disability+ Puts burden of proof upon the disabled

DISCUSSION

+ Probably DDA needs a longer time to make a detectable effect.

+ There are other factors which effect employ rates, such as recession.

+ There are no other information about the experience of DDA, so it is hard to any definite conclusions.

CONCLUSION

+ The employment gap isn’t closed after the onset of DDA. On contrary, it increased.– DDA is a disguised form of suppressing the

disabled.+ The disadvantages of DDA shouldn’t be

neglected, and addition to the act is needed.
