hereby published for general information under proviso to Rule 128 of the Rules of Procedure and

Conduct of Business in the Haryana Legislative Assembly :-

THE INDIAN STAMP (HARYANA AMENDMENT) BILL, 2018

A

BILL

further to amend the Indian Stamp Act, 1899, in its application to the State of Haryana.

Be it enacted by the Legislature of the State of Haryana in the Sixty-ninth Year of the

Republic of India as follows:-

1. This Act may be called the Indian Stamp (Haryana Amendment) Act, 2018. Short title

2. In Schedule 1-A to the Indian Stamp Act, 1899, under column “Proper Stamp Duty”, -

(a) against article 1, for the existing entry, the following entry shall be substituted,

namely:-

“Ten rupees.” ;

(b) against article 2,-

(i) in clause (a), for the existing entry, the following entry shall be substituted,

namely:-

“One hundred rupees.”;

(ii) in clause (b), for the existing entry, the following entry shall be

substituted, namely:-

“One hundred rupees.” ;

(c) against article 3, for the existing entry, the following entry shall be substituted,

namely:-

“One thousand rupees.” ;

(d) against article 5, in clause (c), for the existing entry, the following entry shall be


“Two thousand rupees.” ;

STATEMENT OF OBJECTS AND REASONS

The rates of stamp duty which are presently revised in the instruments where stamps of small denominations

were fixed since 1967. During these years, the rates of stamp duty have been revised in the neighboring States.

Therefore, it becomes necessary for the Haryana State to revise the rate of stamp duty in various Articles/documents.

Accordingly, the State Government of Haryana intends to enhance the rate of stamp duty under Article No. 1, 2, 3, 5,

7, 8, 10, 11, 12, 17, 22, 24, 25, 26, 29, 34, 39, 42, 46, 48, 50, 57, 60, 61, 64 and 65 of Schedule 1-A of the Indian

Stamp Act, 1899. Therefore, the Indian Stamp (Haryana Amendment) Bill, 2018 is placed on the table of House.

FINANCIAL MEMORANDUM

The rate of stamp duty which are presently revised in the instruments where stamps of small denominations

were fixed since 1967. During these years, the rates of stamp duty have been revised in the neighboring States.

Therefore, it becomes necessary for the Haryana State to revise the rate of stamp duty in various Articles/documents.

Accordingly, the State Government of Haryana intends to enhance the rate of stamp duty under Article No. 1, 2, 3, 5,

7, 8, 10, 11, 12, 17, 22, 24, 25, 26, 29, 34, 39, 42, 46, 48, 50, 57, 60, 61, 64 and 65 of Schedule 1-A of the Indian

Stamp Act, 1899. The Indian Stamp (Haryana Amendment) Bill, 2018 will increase the income of the State upto

Rupees 10 crore yearly. The existing and the proposed rates of stamp duty are as under:-
