1. On the availability of the unavailable ACRs of previous years as
mentioned above, if the integrity of the promotee is found doubtful
he/she will be reverted without giving any notice.

The inter-se-seniority of the promotee is subjected to the claim of their
seniors, who have not been promoted in these order due to varioLls
reasons and for whom the posts are kept reserved.
If an official is found senior to these officials at any stage due to
refixation of his/her seniority in his/her feeder cadre, the junior most
promotee shall be reverted without giving any notice.
If at any stage it is found that any official has been promoted in these
orders inadvertently who was otherwise actually not eligible for
promotion will be reverted to his/her feeder cadre original post
without any notice.
That these promotions are subject to the condition that all the
particulars and data supplied by the concerned employees and field
offices are correct. In the event of any information found to be
factually incorrect, erroneous or misrepresented, the promotion so
granted shall be withdrawn forthwith without affording any further
opportunity.
The promotion is subject to the decision of the Hon'ble High Court in
CWP No.5592/1992-Sh. S.S. Sethi Vs. State, CWP No.3633/94 -
Ravinder Sethi Vs. State, CWP No.4857/99- Sh. Attar Singh and
others Vs State and CWP No. 9746/2001- Sher Singh and others Vs
State of Haryana & others and other similar writ petitions.
If the seniority of any official is fmed later on according to the
instructions contained in Govt. letter No.22 / 73/92-3GS-III dated
14.10.99, he/she will be reverted without giving any notice.
That the Lecturer(s) who are on deputation with Chandigarh
Administration or on foreign service and his/her junior is given
promotion, he/she will be entitled for proforma promotion under next
below rules.
Incumbents promoted from amongst Lecturers shall have to undergo
atleast three weeks in service training in administrative and accounts
module.
All the promotes are directed to join their new place of posting and
submit their joining report direct to the undersigned/ Director Secondary

Education, Haryana, Panchkula within seven days otherwise theirpromotions will be treated as cancelled without any further notice. It shallbe assumed that since he/she has not joined, he/she is not interested inpromotion and the next incumbent will be considered for promotion.

6 In case of urban area stations while implementing the transfer orders, it may be ensured that thetransferee has completed the rural service as per transfer policy.

Rules-2003 Education Department, Haryana permission is hereby granted to establish a newproposed school on the terms and conditions mentioned below:-
The Proposed School shall have the required infrastructure regarding land and Buiklingi.e.number & size of class rooms with varanda and other rooms for Head ofInstitution/Office, Library, Laboratory, Stairs, Ramp and Toilets etc. as per Rule 30.
(n) The Management of the school shall have to apply for permanent recognition within thestipulated time in thepresaibed form-IIwith documents as per rule 31.The Management shall not make admission beyond Class-HI before the sanction of itsrecognition or in its anticipation.
(iv) The letter of permission is based on the undertaking given by the applicant as per detailsgiven overleaf. Any violation of the undertaking automatically nullifies the permission.This permission is further subject to 'No Objection certificate' from the 'CompetentAuthority' regarding the land use of the proposed site.
This is only a formal permission to establish a New School or Start Classes and does not enableyour school to get recognition automatically for which physical verification of infrastructure andrecords in this respect shall be made by District Inspection Committee.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Ruels 2011 and amendments it any thereafter. The Managing shall be liable fordisciplinary action in case of violation of any provisions of the rules.

Whereas, a complaint bearing No. 116 of 2012 filed by Sh. Vinod Tushir S/o Sh.
Ajit Singh, R/o Village Nangal Kalan, District Sonepat, against the selection and
appointment of . Ms. Santosh Khatri, Principal, GMSSSS, Ganaur (Sonepat) as Principal
in direct recruitment quota has been received from Lokayukta, Haryana vide letter dated
19.03.2012. As a consequence of the same Smt. Suman Lata, District Education
Officer, Sonepat was appointed as enquiry officer to conduct preliminary enquiry in the
said complaint made against said Smt. Santosh Khatri, Sh. Dilbag Singh, the then DEO,
Sonepat and Sh. D. K. Gupta, Principal, Hindu Sr. Sec. School, Court Road, Sonepat.
Accordingly, she submitted her enquiry report dated 12.09.2012, wherein, it was held
that experience certificate submitted by Ms. Santosh Khatri as PGT is not genuine
because she has been appointed as TGT, English in April, 2003. As .a consequence of
the same, a show cause notice dated 08.04.2013/15.05.2013 on the following grounds
was served upon Smt. Santosh Khatri:-No appointment letter to the post of PGT English in Hindu Senior Secondary
School, Sonepat has been made available and only joining report dated
21.07.1998 has been submitted by her on the verbal directions of Manager of the
school, as stated.In the experience certificates dated 22.12.2006 and 09.10.2007, it has been
stated that she has been working in Hindu Senior Secondary School, New Court
Road, Sonepat as PGT English. since 21.07.1998 in the pay scale of 6500-200-
10500, whereas the same school vide reference No. HS/195/NCR dated
01.04.2003 have issued you an appointment letter as TGT to teach classes 6 th to
9th w.e.f. 01.04.2003 in the grade of Rs.6500-10500 and further confirmed on the
said post w.e.f. 01.04.2004 vide letter No. HS/513/NCR dated 03.06.2004.
3. In the attendance register of the school for the month of July, 2000, your name
has been shown at Sr. No. 33 with the designation of TGT English, whereas in
the application form dated 19.07.2007, experience has been shown to the extent
of nine years, without specific mention of category/designation.
The said notice was to be replied within 15 days. Accordingly, the incumbent
submitted her reply on 21.05.2013, wherein, she submitted that she has submitted the
experience certificate from 21.07.1998 to 20.07.2007 as PGT in English and not as
TGT, English. She further submitted that she has passed M.A. (English) in July, 1998,
whereas, the examination was held in May, 1998. She emphasized that she has taught
XI & XII classes of English subject from 21.07.1998 till 2007. She further made it clear
that by just showing as TGT in the attendance register does not prove completely that
she has not been teaching XI and XII classes and in fact she has been teaching XI and
XII classes since 21.07.1998 and keeping in view her performance results, she has
been given grade of PGT i.e. 6500-10500, in August, 2008. She stated in reply that
there is no post of TGT English in School Education Department, Haryana. Finally she
prayed that the said show cause notice be withdrawn. She was also heard in person on
24.07.2013 and reiterated the submissions already made in the reply and contended as
under:-
That she was called orally to work as Lecturer/ PGT English by Manager, Hindu
Sr. Sec. School, Sonepat on 21.07.1998. Accordingly, she submitted her joining
report on 21.07.1998 as Lecturer in English.
That on 21.08.1998, a post of Lecturer/ PGT in English was advertised in the
Tribune by SMS Hindu Sr. Sec. School, Sonepat. She was called for interview
on 12.09.1998. She was selected as Lecturer/ PGT,she had taught Class XI and
XII, but salary was given equal to TGT. Later on, on the basis of her previous
two years results, she was given the pay scale of PGT in August, 2000 and
continuously worked in this scale upto July, 2008. Her CPF was continuously
deducted since 1998 to 2008.
That school was affiliated to CBSE and only PGT is entitled to taught Class XI
and XII as per norms of CBSE.
That before offering her appointment letter as Principal by the Education,jii........_
then DEO and BEO.
I have gone through the contents of complaint made to Hon'ble Lokayukta,
Haryana, report submitted by DEO, Sonepat, contents of the show cause notice, reply
there, submissions made at the time of personal hearing and relevant contents of the
file. Before arriving at a conclusion the following issues need to be decided:-
Whether, the incumbent fulfills the qualifications prescribed for the post of
Principal as enunciated in the Haryana State Education (School and Inspection)
Cadre (Group B) Service Rules, 1998 as applicable to the said recruitment?
Whether, the experience gained by the incumbent can be termed as fulfilling the
requisite experience of 8 years teaching experience as Lecturer?
So far as, 1st issue is concerned, it is clear that the incumbent has passed M.A. in
English with 57% in 1998, whereas, she has passed B.Ed with 58% in 1996. Regarding
experience from the perusal of various certificates in the matter, there is not a scintilla of
doubt that the incumbent has been teaching X1 and XII Classes since July, 1998. It is
true, as is the practice in private recognized schools, that normally these institutions do
not give regular pay scales of appropriate level of teaching the classes and place the
persons in lower grade especially in view of financial constraints. But this does imply

6500-10500 and marking of attendance as English Teacher do not infer that, theincumbent has not kléen teaching classes XI and XII. Hence from the perusal of various
documents it is clear that the incumbeht has been teaching classes XI and XII since
July, 1998 and has been having the requisite 8 years experience as Lecturer, whileapplying for the post of Principal in Sr. Sec. School in direct recruitment quota in theyear 2007. The issue is decided accordingly.
So far as, issue no. 2 is concerned as detailed in issue no.1, no inference can bedrawn from the' appointment letter dated 01.04.2003 and designation as English teacherin attendance register that the i
ncumbent has not been teaching classes XI and XII.Further, results of Central Board Education of the said classes
pertaining to the saidschool fortifies the submissions made by the incumbent in her reply to the show causenotice and submissions made at the time of personal hearing. It is pertinent to mention
here that even the school lecturers of Govt. Schools in Haryana have been getting thescale of 6
500-10500, whereas, TGTs have been getting the scale of 5500-9000 beforethe introduction of sixth pay co
mmission scales. Hence, the said scale 6500-10500,which the incumbent has been getting, is equivalent to that of PGT.
Accordingly, theexperience gained by the incumbent can be termed as requisite terms of 8 years asLecturer without any ambiguity in the matter. The issue is decided accordingly.
In the light of above, show cause notice dated 08.04.2012 is hereby withdrawn,being devoid of merit.

pointment of Ms. Santosh Khatri, Principal, GMSSSS, Ganaur (Sonepat) as Principal
in direct recruitment quota has been received from Lokayukta, Haryana vide letter dated19.03.2012. As a c
onsequence of the same Smt. Suman Lata, District EducationOfficer, Sonepat was appointed as enquiry officer to conduct preliminary enquiry in thesaid complaint made against said Smt. Santosh Khatri, Sh. Dilbag Singh, the then DEO,
Sonepat and Sh. D. K. Gupta, Principal, Hindu Sr. Sec. School, Court Road, Sonepat.A
ccordingly, she submitted her enquiry report dated 12.09.2012, wherein, it was heldthat experience certificate submitted by Ms. Santosh Khatri as PGT is not genuinebecause she has been appointed as TGT, English in April, 2003. As .a consequence ofthe same, a show cause notice dated 08.04.20 13/15.05.2013 on the following groundswas served upon Smt. Santosh
No appointment letter to the post of PGT English in Hindu Senior Secondary
School, Sonepat has been made available and only joining report dated
21.07.1998 has been submitted by her on the verbal directions of Manager of theschool, as stated.
In the experience certificates dated 22.12.2006 and 09.10.2007, it has been
stated that she has been working in Hindu Senior Secondary School, New Court
Road, Sonepat as PGT English since 21.07.1998 in the pay scale of 6500-200-
10500, whereas the same school vide reference No. HS/195/NCR dated01.04.2003 have issued you an a ppointment letter as TGT to teach classes 6 th to9th w.e.f. 01.04.2003 in th,e grade of Rs.6500-10500 and further confirmed on thesaid post w.e.f. 01.04.2004 vide letter No. HS/513/NCR dated 03.06.2004.
3. In the attendance register of the school for the month of July, 2000, your name
has been shown at Sr. No. 33 with the designation of TGT English, whereas in
the application form dated 19.07.2007, experience has been shown to the extentof nine years, without specific mention of category/designation.
The said notice was to be replied within 15 days. Accordingly, the incumbent
submitted her reply on 21.05.2013, wherein, she submitted that she has submitted the
experience certificate from 21.07.1998 to 20.07.2007 as PGT in English and not as
TGT, English. She further submitted that she has passed M.A. (English) in July, 1998,whereas, the examination was held in May, 1998. She em phasized that she has taughtXI & XII classes of English subject from 21.07.1998 till 2007. She further made it clear
,
that by just showing as TGT in the attendance register does. not prove completely
she has not been teaching XI and XII classes and in fact she has been teaching XI thatandXII classes since 21.07.1998 and keeping in view her performance results, she hasbeen given grade of PGT i.e. 6
600-10500, in August, 2008. She stated in reply that
y hethere is no post of TGT English in School Education Department Haryana. Finall
sprayed that the said show cause notice be withdrawn. She was also heard in person on24.07.2013 and reiterated the submissions already made in the reply and contended asunder:-
That she was called orally to work as Lecturer/ PGT English by Manager, HinduSr. Sec. School, Sonepat on 21.07.1998. Accordingly, she submitted her joiningreport on 21.07.1998 as Lecturer in English.That on 2
1.08.1998, a post of Lecturer/ PGT in English was advertised in the
Tribune by SMS Hindu Sr. Sec. School, Sonepat. She was called for interviewon 1
2.09.1998. She was selected as Lecturer/ PGT,she had taught Class XI and
XII, but salary was given equal to TGT. Later on, on the basis of her previous
two years results, she was given the pay scale of PGT in August, 2000 andcontinuously worked in this scale upto July, 2008. Her CPF was
continuousldeducted since 1998 to 2008. y
That school was affiliated to CBSE and only PGT is entitled to taught Class XIand XII as per norms of CBSE.
That before offering her appointment letter as Principal by the EducationDepartment, her experience certificate was duly examined and verified b the
then DEO and BEO. y
I have gone through the contents of complaint made to Hon'ble Lokayukta,Haryana, report submitted by DEO, Sonepat, contents of the show cause notice, replythere, submissions made at the time of personal hearing and relevant contents of the
file. Before arriving at a conclusion the following issues need to be decided:-
Whether, the incumbent fulfills the qualifications prescribed for the post ofPrincipal as enunciated in the Haryana State Education (School and
Inspection)Cadre (Group B) Service Rules, 1998 as applicable to the said
recruitment?Whether, the experience gained by the incumbent can be termed as fulfilling therequisite experience of 8 years teaching experience as Lecturer?
So far as, Ist issue is concerned, it is clear that the incumbent has passed M.A. inEnglish with 57% in 1998, whereas, she has passed B.Ed with 58% in 1996.
Regardingexperience from the perusal of various certificates in the matter, there is not a scintilla ofdoubt that the i
ncumbent has been teaching XI and XII Classes since July, 1998. It istrue, as is the practice in private recognized schools, that normally these institutions do
not give regular pay scales of appropriate level of teaching the classes and place thepersons in lower grade especially in view of financial constraints. But this does imply
that the person has not been tea
ching the appropriate classes and gained experienceaccordingly. Mere giving appointment letter dated 01.04.2003 as TGT in the
grade of
6500-10500 and marking of attendance as English
Teacher do not infer that, the
incumbent has not been teaching
classes XI and XII. Hence from the perusal of various
documents it is clear that ,the
incumbeht has been teaching c
lasses XI and XII sinceJuly, 1998 and has been
having the requisite 8 years experience as Lecturer while
applying for the post of Principal in Sr. Sec. School in direct recruitment
quota in the
year 2007. The issue is decided accordingly.So far as, issue no. 2 is concerned as detailed in issue no.1, no inference can be
drawn from the'appointment letter dated 01.04.2003 and desig
nation as English teacherin attendance register that the
incumbent has not been teaching
classes XI and XII.
Further, results of Central Board Edu
cation of the said classes pertaining to the said
school fortifies the submissions made by the
incumbent in her reply to the show causenotice and submissions made at the time of personal hearing. It is pertinent to mention
here that even the school lecturers of Govt. Schools in Haryana have been
getting the
scale of 6500-10500, whereas,
TGTs have been getting the scale of 55009000 before
the introduction of sixth pay commission scales.
Hence, the said scale 6500-10500,
which the incumbent has been getting, is equivalent to that of PGT.
Accordingly, the
experience gained by the incumbent can be termed as requisite terms of 8 years as
Lecturer without any ambiguity in the matter. The issue is decided accordingly.
In the light
of above, show cause notice dated 08.04.2012 is hereby withdrawn,being devoid of merit.

Memo No. 19/9-2013 PS(3) Dated 07.08.2013In exercise of powers conferred under Rule 29(3) read with Rule 3 of Haryana School
Rules-2003 Education Department, Haryana permission is hereby granted to establish a newproposed school on the terms and conditions mentioned below:-
(1) The Proposed School shall have the required infrastructure regarding land and Building i.e.number & size of class rooms with varanda and other rooms for Head ofInstitution/Office, Library, Laboratory, Stairs, Ramp and Toilets etc. as per Rule 30.The Management of the school shall have to apply for permanent recognition within thestipulated time in the prescribed form-II with documents as per rule 31.The Management shall not make admission beyond Class-III before the sanction of itsrecognition or in its anticipation.
(iv) The letter of permission is based on the undertaking given by the applicant as per detailsgiven overleaf. Any violation of the undertaking automatically nullifies the permission.This permission is further subject to 'No Objection certificate' from the 'CompetentAuthority' regarding the land use of the proposed site.
This is only a formal permission to establish a New School or Start Classes and does not enableyour school to get recognition automatically for which physical verification of infrastructure andrecords in this respect shall be made by District Inspection Committee.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Reels 2011 and amendments it any thereafter. The Managing shall be liable fordisciplinary action in case of violation of any provisions of the rules.
