Failure to furnish all information required by the RFP documents or submission of a proposal not substantially responsive to the RFP documents in every respect will be at the Bidder’s risk and may result in rejection of the proposal and forfeiture of the Earnest Money Deposit (EMD).

1.5 Amendment of RFP Document
At any time till one day before the deadline for submission of bids, the University may, for any reason, whether at own initiative or in response to a clarification requested by a prospective Bidder, modify the Bid Document by amendment. All the amendments made in the document would be informed through the e-tender Portal https://etender.up.nic.in . All such amendments shall be binding on all the Bidders. The Bidders are also advised to visit the aforementioned website on regular basis for checking necessary updates. The University also reserves the rights to amend the dates mentioned in the section 1.4 of the RFP for Bid process.
1.6 Selection criteria and conditions of technical bid for empanelment of supply of e-Books. 1. The firm should be having PAN (Permanent Account Number) allotted by the Income Tax Department; document proof of the same has to be enclosed.
2. The firm / Agency should be a member of the Good Office Committee (Government of India) of the Federation of Publishers Association of India or any other National Association and proof to this effect has to be enclosed along with the offer for empanelment 3. The e-Books supplier(s) must have experience of supplying such library materials for the last three years. Documentary proof of the same has to be enclosed. 4. Conditional tender shall not be accepted. 5. Tender should enclosed earnest money in the form of Bank Draft/Banker’s Cheque worth Rs.40,500=00 (Rs. Forty thousand five hundred only) favouring Finance Controller, HBTU, Kanpur, Payable at Kanpur. The tender without earnest money shall not be entertained. 6. For supplying e-Books, tenderer shall have to provide 100% Bank Guarantee of the amount to be advanced subscription of e-Books. 7. The supplier(s) whose tenders are approved shall appear in the university within one week for execution of an agreement. 8. The university reserves the right to reject any or all the tender without assigning any reason thereof. 9. Supporting documents must have signature of the supplier with office seal.
1.7 Final Evaluation of Bids-
The final selection of the supplier/agency will be based on maximum discount offered on publisher’s price by supplier/agency who has successfully qualified technical bid.

GENERAL TERMS AND CONDITIONS
1. e-Books are to be supplied F.O.R. Harcourt Butler Technical University, Kanpur ,Uttar Pradesh.
2. Details of the e-Books like title, Author, Name of publisher, year of publication, Edition/volume number, and price etc. should be clearly mentioned for each e-Book in the approval memo and the respective bill.
3. Only latest editions and Low Priced editions should be supplied unless otherwise specified. 4. Indian edition of the foreign books available in the market should be supplied. 5. The e-Books available in dual currencies should be billed in the currency by which the
converted cost is the lowest in Indian rupees with supporting proof. 6. The supplier shall be responsible for continued and smooth supply of e-Books. 7. All the e-Books are to be supplied within time limit from the date of purchase order. 8. The Competent authority, reserve the right to extend the prescribed period. 9. Conversion rates of foreign currency into Indian currency will be decided according to the
date of the bill with the supporting proof. 10. The bill should be sent in triplicate (three copies) with publisher’s invoice as the price
proof. The following certificate(s) be recorded on the bill: a. Certified that the authorized publishers’ prices have been charged.
b. Certified that the latest editions have been supplied and these are not remaindered titles. c. Recording the Pan number
11. List of e-Books is enclosed but a few e-Books may be added/ deleted, in/from the list as per the requirement(s) of the University.
12. The e-Books supplier shall take the responsibility of delivering the ordered titles to the HBTU Kanpur without any additional charges.
13. The e-Books supplier will be required to ensure timely supply. 14. The e-Books supplier will mention the Title, Author, Name of publisher, year of publication,
edition/volume number, and price etc. in the invoice, which may please be sent in triplicate for payment.
15. In case of Print version of e-book is available free, the supplier shall make necessary arrangements for its access in the central library, H.B.T.U., Kanpur.
16. Partial payment is to be made after the supply of e-Books satisfactorily; therefore, e-Books supplier should start the supply with immediate effect. If supplied satisfactorily, the payment for subsequent supply will be done as per decision of competent authority. In case, advance payment is necessary 100% Bank guarantee shall be furnished by the e-Books supplier for the advance amount.
17. Refund of the unsupplied titles has to be made by the e-Books supplier and to be settled in the same financial year.
18. Penalty for delay: if e-Book are not delivered within the approved delivery period, the University reserves the right to impose penalty ½% of the purchase order amount per week subject to a maximum of 5% of the value of order, provided it is not cancelled.
