Companion Animal Inspectors Erin Carter and Colin Benell were accompanied by Amanda Reitz, Ken Reitz, and Lois Reitz during the inspection.

HEA is a no-kill Animal Sanctuary. This facility imports dogs into Wisconsin from the SCMPD Animal Control, 7211 Sallie Mood Drive, Savannah, GA 31406. All dogs are accompanied by a valid Interstate Certificate of Veterinary Inspection (CVI). HEA also accepts owner surrendered dogs and strays from the Town of Bear Creek after the initial mandatory holding period. HEA also operates an adoption facility located at 2065 Holmgren Way, Green Bay, WI. Some dogs are available here for viewing on the weekends. The records for those dogs are available at the Green Bay location for the weekend and then come back to HEA.

HEA keeps dogs in three (3) separate locations within a converted barn. One room on the upper level of the barn houses the dogs in stacked crate enclosures. Another room also on the upper level of the barn is composed of individual rooms with doors. The third area is located on the lower level of the barn. These enclosures house groups of dogs and include dog doors that allow access to an outdoor, fenced exercise area at all times. All dogs at HEA receive 120 minutes of exercise daily in the outdoor exercise areas in addition to walks and playtime in the field with volunteers. An indoor meeting room is used for exercise during cold weather.

All dogs had toys in their enclosures and access to clean water. All dogs appeared to be in good condition at the time of inspection. The facility was clean and in good repair, except as noted, at the time of inspection.

Violations:

1. ATCP 16.14(3)(h)—Dog Records Operator failed to keep complete health records related to the dog including vaccination, observation and treatment records and whether the health care was administered by the license holder or by a veterinarian.

Operator does keep records of vaccinations and treatments, but it is not recorded who administers

vaccinations or treatments. Observations are not recorded.

2. ATCP 16.20(1)(e)—Dog Care; General Operator failed to provide food and water in durable containers.

The operator uses plastic buckets for food and water in the enclosures located on the lower level of the

barn. The dogs have chewed on the edges of several of these buckets (see picture1). Ingesting the pieces of plastic could be harmful to the dogs and the buckets cannot be effectively cleaned and sanitized.

3. s. 173.41(10)(d)(2), Wis. Stats, and ATCP 16.22(1)(b)(4) —Dogs Kept Indoors

The enclosure is not maintained in good repair to protect the dog from injury. Floors and interior surfaces are not constructed and maintained to keep the dogs safe from injury. Some surfaces are not able to be cleaned and sanitized.

In the location on the upper level of the barn the dogs have scratched and chewed the paint and wood on

the backs of the doors, the door frames, and strips of wood located between the floors and the walls in all of these rooms (see pictures 2 and 3). These surfaces are unable to be cleaned and sanitized and ingesting the wood could cause injury to the dogs.

Some of the rooms have doors with strips of metal on the bottom that have become jagged and could

cause injury to the dogs (see picture 4).

The floor in Room 5 is damaged and has jagged edges that could cause injury (see picture 5).

All four enclosures on the lower level of the barn contain unpainted, unsealed wooden posts, sheets of

plywood and other wooden surfaces such as dog doors and platforms that cannot be cleaned and sanitized. Some of these wooden surfaces have also been chewed and scratched. Ingesting wood could cause injury to the dogs (see pictures 6-10).

There are also areas in the enclosures on the lower level of the barn where the wire fencing has become

loose and the sharp ends of the wire are protruding (see picture 11). These wires could cause injury to the dogs.

4. ATCP 16.22(1)(a)—Dogs Kept Indoors The size and configuration of indoor primary enclosures does not comply with ATCP 16.22(3)

HEA has one room on the upper level of the barn where 20 dogs are kept in 19 stacked crates against two

(2) walls (see pictures 12 and 13). The stacking arrangement complies with ATCP 16.22(1)(c).

Eighteen (18) of the crates have a floor area of 10 ft2. Two (2) of the crates have a floor area of 8 ft2.

According to ATCP 16.22(3), a floor area of 8 ft2 is adequate for a dog measuring up to 16 inches in length. The dogs kept in these enclosures measured 16 inches long or less. 10 ft2 is adequate only for a dog measuring 17-22 inches from the tip of the nose to the base of the tail. Several dogs measuring over 22 inches in length were observed in these enclosures at the time of inspection (see picture 13 above and picture 14 below).

5. ATCP 16.22(3)(c)—Dogs kept indoors

The height of the primary enclosure is not at least 12 inches taller than the dog that is kept in the enclosure.

Dog “Kingston”, a male German-Shepherd-type, did not have adequate head space of at least 12 inches

in his indoor primary enclosure (see picture 14 above). 10

6. ATCP 16.22(3)(a)—Dogs kept Indoors More than one dog that receives 120 minutes of exercise per day is being kept in an indoor primary enclosure at one time.

The individual rooms at HEA measure 27 ft2. This floor area is adequate for one dog exceeding 30 inches

in length as required under ATCP 16.22(3)(b). HEA is housing two (2) dogs in three (3) of these individual rooms:

o “Rufus, a brindle male Labrador mix, and “Lucas”, a male Yellow Labrador mix. o “Sammy”, a male Rottweiler/Pitbull Mix, and”Rainy”, a female black and tan coonhound o “Dutch”, a male Rottweiler mix, and “Misty”, a female Labrador mix

Summary of Discussion with Operator:

Carter and Benell discussed the violations with the Reitzs following the inspection. The following changes will be made to correct the violations:

Record who administers vaccinations or treatments along with observations and who makes them. Replace damaged water and food containers used in the lower level barn enclosures. Carter recommended either stainless steel or galvanized metal pails. Plastic pails can be used but they will need to be maintained in good condition or replaced as often as necessary to keep them in good condition.

Repair damage to the individual room enclosures on the upper floor of the barn. All wood needs to be painted or sealed and able to be cleaned and sanitized or replaced with a material that will prevent injury to the dogs and is able to be cleaned and sanitized. The jagged metal strips on the back of some of the doors needs to be removed and repaired. The damaged floor in Room 5 needs to be repaired.

Carter and Benell discussed other options for the doors in the individual room enclosures. Benell suggested a door constructed of material that would allow the dogs to see out of the room enclosures. The Reitzs feel the dogs are calmer and there is less aggression if they cannot see each other. Carter and Benell also discussed options for sealing wood such as Thompson’s Water Seal. Benell suggested mixing in Cayenne Pepper to discourage the dogs from chewing on the wood. Carter suggested trying out a few different construction options to find materials that are not easily damaged and can be maintained to prevent injury to the dogs.

Seal or paint wooden surfaces located in the lower level barn enclosures so that they are able to be

cleaned and sanitized, or replace these surfaces with another construction material that will prevent injury to the dogs and is able to be cleaned and sanitized. Areas where wood has been chewed and damaged require repair or replacement. Benell suggested wrapping wooden posts in chain link so that the dogs cannot access them. Carter suggested wrapping sheets of aluminum around wooden posts or strips as seen at another facility.

Repair areas where sharp ends of wire fence material are protruding in the lower level barn enclosures.

Cease use of crate enclosures that are not of adequate size for dogs based on length. Construct new

enclosures that comply with ATCP 16.22(3)(b) for dogs receiving 120 minutes of daily exercise. All dogs must have at least 12 inches of head space within the indoor primary enclosure as required by ATCP 16.22(3)(c).

Amanda had some ideas about how she would like to construct new enclosures that would be in compliance with ATCP 16.22(3). Carter recommended consulting the regulations for specifications to keep in mind as the new enclosures are constructed, and managing the use of the enclosures by measuring the length of dogs kept inside.

Remove one dog from the individual room enclosures where two (2) dogs are currently being kept and move to another enclosure of adequate floor area.

“Dutch” and “Misty” are kept together because according to Amanda “Dutch” shows signs of depression if “Misty” is not with him. Carter discussed applying for a variance for this particular case.

According to Amanda, pregnant mothers or litters of puppies are rarely held at HEA. Carter discussed whelping and nursery enclosure requirements. Carter also informed Amanda of the requirement for a statement that the dog was born under HEA’s custody and control in the records if puppies are ever born at HEA.

The Reitz’s requested 60-90 days to make the necessary changes as it will take time to construct new enclosures.

Recommendation:

Based on inspection findings, it is recommended that the Conditional License be extended for 90 days in order for the required corrections to be made. A re-inspection will be conducted in 90 days to ensure that all violations have been corrected.
