There must be 2 or more parties which have

conflict or disagreement.

There must be a perceived conflict of needsand interests.

Reservation policy in India

Indian government provides a Quota system:

1) employment in government & public sector

units.2) admissions in public & private educational

institutions.

But except in the religious & linguisticminority educational.

Why Quota system ?

In order to mitigate backwardness of the

socially & educationally backward

communities .

The SCHEDULED CASTES & TRIBES who do not

have adequate representation in these

services & institutions.

Caste based.

Religion based.

Gender based. Management quota.

State of domiciles.

Physically handicapped..

Sports personalities/freedom fighters.

In educational institutions & govt jobs

In AIIMS ,14% of seats are reserved for SCs & 8% forSTs.

Women s reservation bill:

- women get 33% reservation in GRAM

PANCHYAT & MUNICIPAL ELECTIONS.In law schools in India ,have a 30% reservation

for females.

Based on economic status irrespective of

caste, race & religion as anybody who has

money can buy his seat.

In PEC Chandigarh, earlier 80% of seats were

reserved for Chandigarh domiciles & now it is

50%.

Negotiation starts

On April 11,2008,they demand 5% reservation

in government jobs.

At present classified as an O

BCS,want 5%exclusive reservation for themselves.

Reservation point

As per the rulings given by the SUPREME

COURT OF INDIA , reservation cannot be

exceeded 50%

Two main elements of this:

a) size of the proposals

b) frequency of proposals.

Size of the proposal

ROOP SINGH said

if the state government does not want to

exceed the reservation limit of 50 % , it canprovide us with reservation through a sub-

category within the existing quota for the

OBCS or the scheduled tribes ( ST),.

Frequency of the proposals.

In July 2009,Rajashtan government

announced:

1) 5% reservation to gujjars2) 14% reservation to economically backward

classes .

But the total reservation in the state to 68% .

In October 2009, Rajasthan high court stayed

the order as the reservations had exceeded

the cap of 50%, put by the SUPREME COURT.

March of agitation

Gujjars launch agitation from last 21st

December 2010 to 3rd January 2011.

They demanded the government should comeout with a solution.

Union minister SACHIN PILOT

the country should revisit the issue of

reservation to scrutinize if quota benefits haveaccrued to deserving social groups.

"Reservation is a sensitive issue. We have to

look at today's reality and address those

communities which deserved it the most but

did not get," he said.

Pilot assured it was not a permanent problem

but happened again because the legislation

giving it quota got stuck in legal hurdles. "We

are confident that the Rajasthan government

will produce the necessary statistical data to

convince the high court for 5% quota for the

Gujjars," he said.
