“GOPAL RATNA AWARD SCHEME”

Introduction.— The Government of Goa hasdesigned this scheme in order to honour theeminent personalities in the field of DairyFarming. This scheme intends to appreciate theachievement of Dairy Farmers for highestindividual milk production by undertakingscientific Dairy Farming in the State of Goa andencourage youth to take up Dairy Business.

(2) To felicitate and appreciate the dairyfarmers for achieving highest milk productionby undertaking scientific Dairy Farming inthe State.

(3) To encourage the dairy farmers toundertake Dairy activities as a Business.

(4) To make State self sufficient in milkproduction.

Eligibility.— (1) Any individual dairy farmer,who has given extraordinary contribution inthe field of dairy farming by achieving highestmilk production in the State, shall be eligibleto receive “Gopal Ratna Award” under thisscheme.

(2) The scheme applies to dairy farmersfrom Goa who shall be the members of DairyCo-operative Society/Bachat Gat/Self HelpGroup, registered with the concernedDepartment.

(3) The Individual Goan dairy farmer has toregister his dairy farm with the department ofAnimal Husbandry and Veterinary Servicesthrough the respective Area Officers ofVeterinary Dispensary/Hospital.

(4) The dairy farmer shall maintain andsubmit the record showing details of numberof animals, stage of lactation of each animal,milk yield, date of calving, address of cattleshed etc.

(5) He should be a bonafide resident of Goafor at least preceding five years, own cattleshed with milch animals in the State of Goa.

(6) Any dairy farmer intending to apply forthe Gopal Ratna Award shall produce evidenceof his membership from a registered DairyCo-operative Society/Bachat Gat/Self HelpGroups, as required by the Department ofAnimal Husbandry & Veterinary Services.

(7) No Award shall be presentedposthumously under this scheme. However ifdeath of the applicant occurs after submission

of the application and if he/she qualifies forthe award then the award may be consideredfor posthumous presentation to his/her legalheir.

(8) He shall produce and pour minimum 1 lakhlitres of milk in the preceding year (April toMarch) with minimum average of 250 litres ofmilk per day, to the Dairy Co-operative Society//Bachat Gat/Self Help Group.

Nature of Assistance.— The eligible selecteddairy farmer shall be honored with “GopalRatna Award” constituting a Certificate ofappreciation, Memento and cash prize ofRs. 1 lakh only.

Procedure.— (1) The eligible applicant shallapply for the award through the concernedArea Officer of the Department in prescribedformat of application.

(2) On verification of the content, the AreaOfficer shall recommend the same to theDirector of AH & VS, Panaji-Goa for furthernecessary action.

(3) On receipt of the application from theeligible applicant they will be scrutinized bythe Task Force Committee constituted for thepurpose by the Government.

(4) After scrutiny of the application, theCommittee shall visit the selected applicantand also at the related Dairy Co-operativeSociety/Bachat Gat/Self Help Group, for thenecessary confirmation of the records.

(5) The Task Force Committee, after completescrutiny and confirmation of the informationgiven by the applicant shall recommend thename of the Awardee for necessary approvalby the Department.

(6) On approval from the Department of AH& VS the Gopal Ratna Award will be declaredand conferred upon the selected beneficiaryon Independence Day i.e. 15th August at thehands of Honourable Chief Minister of theState.

Committee.— For better implementation ofthe scheme the Government shall constitute aCommittee of the members which shall meetas and when required and shall consider therecommendation received from the field AreaOfficer of the Department.

Felicitation of eligible Awardee.— (1) Oncerecommendation is received from theCommittee the Director of Animal Husbandry& Veterinary Services shall obtain theacceptance of the concerned milk producer toreceive the “Gopal Ratna Award”.

(2) After obtaining such acceptance from therespective milk producer the Department shallobtain due approval of the State Governmentfor awarding the said Awardee at the hand ofHon’ble Chief Minister of the State onIndependence Day i.e. on 15th August.

Framing of Guidelines.— For betterimplementation of the scheme Governmentmay change guidelines from time to time ifrequired.

Relaxation.— The Government isempowered to relax all or any of the clauseprovided in the scheme, if found deemed fitfor reason to be recorded.

Interpretation.— If any question arisesregarding interpretation of clause, word,expression on entire scheme, then the decisionabout the interpretation shall be with theGovernment.

Redressal of Grievances and Dispute.— If anygrievances arise out of implementation of thisscheme the Secretary for Animal Husbandryshall hear and decide such matter and thedecision of the Secretary for Animal Husbandryin this regard shall be final.

In exercise of the powers conferred by sub-rule (2) of Rule 24 of the Goa, Daman & Diu ForestRules, 1964 and all other powers enabling in this behalf and in supersession of the GovernmentOrder No. 21/1/2003-FD dated 4-4-2003, published in the Official Gazette, Series I No. 3 dated17-4-2003 and all other Notifications/Orders etc. if any, issued in this regard, the Government ofGoa, hereby prescribed that, the colour of, and the sum to be paid in respect of, the forest passas specified in column (1) of the Schedule below, shall be as specified in the correspondingentries in columns (2) and (3) respectively of the said Schedule.

The following draft regulations which areproposed to be made under sub-sections (1)and (2) of section 4 of the Goa (Regulation ofLand Development and Building Construction)Act, 2008 (Goa Act No. 6 of 2008) (hereinafterreferred to as the “said Act”), so as to furtheramend the Goa Land Development andBuilding Construction Regulations, 2010, arehereby pre-published as required by section 5of the said Act for information of the personslikely to be affected thereby and notice ishereby given that the said draft regulationswill be taken into consideration by theGovernment on the expiry of a period of 30days from the date of publication of thisnotification in the Official Gazette.

All objections and suggestions to the saiddraft regulations may be forwarded to theChief Town Planner, Town and CountryPlanning Department, 2nd Floor, DempoTower, Patto Plaza, Panaji, Goa, before theexpiry of the said period of 30 days, so thatthey may be taken into consideration at thetime of finalization of the said regulations.

DRAFT REGULATIONS

In exercise of the powers conferred bysub-sections (1) and (2) of section 4 of the Goa(Regulation of Land Development and BuildingConstruction) Act, 2008 (Goa Act No. 6 of2008), and all other powers enabling it in thisbehalf, the Government of Goa hereby makesthe following regulations so as to furtheramend the Goa Land Development andBuilding Construction Regulations, 2010,namely:—

1. Short title and commencement.— (1) Theseregulations may be called the Goa LandDevelopment and Building Construction(Amendment) Regulations, 2016.

(2) They shall come into force from the dateof their publication in the Official Gazette.

2. Amendment of regulation 2.— In regulation2 of the Goa Land Development and BuildingConstruction Regulations, 2010 (hereinafterreferred to as the “principal Regulations”),—

(i) for clause (16), the following clause shallbe substituted, namely:—

“(16) “Balcony” means a floor projectionor recess beyond internal or external wallhaving handrail or balustrade or parapetat least on one side, open either tointernal courtyard or external air spaceor sitting out place. The said opening maybe provided with a grill or sliding glasspanel shutters;”;

(ii) in clause (43), for sub-clause (a), thefollowing sub-clause shall be substituted,namely:—

“(a) Area of balconies, provided theyare at a minimum clear height of 2.25meters from the ground level;”;

(iii) in clause (63),—

(a) after sub-clause (b), the followingsub-clause shall be inserted, namely:—

“(bb) Balcony projection shall bepermitted to the extent of 1.5 metersand length of the balcony shall belimited to half the perimeter of thebuilding. Balcony projection of 3.00meters shall be allowed only when thebalcony immediately above is at least6 meter above and length of such abovebalcony is limited to half the perimeterof the building. Any balcony area morethan half the perimeter of building shallbe counted in FAR;”;

(b) for sub-clause (q), the followingsub-clause shall be substituted, namely:—

“(q) Terraces at intermediate floorsnot more than 3.00 meters in depth andhaving a roof at over 6 meters height.Total of such intermediate terraces shallnot exceed 10% of FAR proposed;”.

3. Amendment of regulation 3.— In regulation3 of the principal Regulations, for the title, thefollowing title shall be substituted, namely:—

“Procedure and Requirements forSecuring Development Permission, Sub--division permission, Technical Clearancesand Completion Certificate/OccupancyCertificate.—”.

4. Amendment of regulation 4.4.1.— Inregulation 4.4.1 of the principal Regulations,for the existing Note, the following Note shallbe substituted, namely:—

“Note: Whenever any use, other thanresidential, is proposed in S1, S2, S3 or S4 zone//Settlement zone, the front set-back shall beminimum 5.00 meters if the plot is located on aroad having right of way between 8.00 meters to10.00 meters.”.

5. Amendment of regulation 4.4.2.— Inregulation 4.4.2. of the principal Regulations,for clause (a), the following clause shall besubstituted, namely:—

“(a) In plots having minimum width of15.00 meters, within Municipal areas, thebuilding may be allowed, with the sideset-backs less than those specified inTable-IV and limited to a minimum of 1.50meters, provided that no light andventilation is taken from that side. However,in such Municipal areas where building inadjoining plot or building existing within theapplicant’s plot, is touching the boundary,the building may be allowed to touchthe boundary or keep 1.50 meters or less onone or both sides, provided that no light andventilation is taken from that side.”.

6. Amendment of regulation 4.11.— Inregulation 4.11 of the principal Regulations,for clause (c), clause shall be substituted,namely:—

“(c) If any property is made accessible byan access through a property of differentowner by his voluntary consent, the areaused for such access shall not be deductedfrom the effective area of the plot in which itis provided, for the purpose of coverage andFAR calculations provided that the width ofsuch access is 3.00 meters or more and hasconcurrence of the Authority/Council//Panchayat.”.

7. Amendment of Regulation 5.— Inregulation 5 of the principal Regulations, forclause (a), the following clause shall besubstituted, namely:—

“(a) When a plot, having an area of morethan 4000M2 but less than 20000M2, is usedfor construction of building/group ofbuildings, an open space, as per theprovisions in sub-division Regulations (12)shall be provided, in addition to the parkingrequirements. However, for calculating thecoverage and FAR, the area of the entireplot, inclusive of the open space, shall betaken as effective plot area. However, thisprovision shall not be applicable to singlefamily dwelling unit.”.

8. Amendment of Regulation 6A.3.1.— Inregulation 6A.3.1 of the principal Regulations,—

(a) for clause (i), the following clause shallbe substituted, namely:—

“(i) Uses such as retail trade, banks,post offices, administrative offices,tailoring shops, laundry, hair cuttingsaloons, beauty salons, IT/ITESestablishments, kindergarten/crèche,abutting on main street and professionaloffices including IT/ITES shall bepermitted as auxiliary to the main use:

Provided, that the total covered areaoccupied for such uses, shall not exceed50% of the proposed covered area, if theproperty derives access from a roadhaving 8.00 meters right of way or more:

Provided further that if more than onebuilding is proposed, then all the proposedarea for commercial use as above, may belocated either in one building or more thanone buildings, as desired by the owner.”.

(b) for clause (v), the following clause shallbe substituted, namely:—

“(v) In case of group housing, thecommercial use may be allowed in one ormore buildings on upper floors restrictedto 50% of the proposed coverage, providedbuilding is abutting the public road.”.

9. Amendment of regulation 6A.4.— In theregulation 6A.4 of the principal Regulations,in Table-VIII, for all the entries under the word“COMMERCIAL”, the following shall besubstituted, namely:—

“COMMERCIAL:

10. Amendment of regulation 12.4.— Inregulation 12.4 of the principal Regulations, forclause (b), the following clause shall besubstituted, namely:—

“(b) The open spaces can be provided inmore than one parcel. However, the area ofeach such parcel shall not be less than 500square meters and the minimum length ofany side shall not be less than 15.00 meters.(In case of odd shaped/irregular shapedplots, the length may be relaxed to 13.00meters). Further, in case of triangular openspace/any open space having irregularshape, the minimum dimension shall be thatof a circle, having 15 meters diameter,inscribed within such an irregular shape(refer sketch No. 7).”.

11. Amendment of regulation 12.8.— Forregulation 12.8 of the principal Regulations, thefollowing regulation shall be substituted,namely:—

“12.8 Amalgamation of sub-divided plots:In case where sub-divided plots are amalga-mated, except for those in Industrial zone GoaIndustrial Development Corporation’s plots,the FAR permissible shall be reduced by 20%of the permissible FAR in respective zone.”.

12. Insertion of new regulation 14.1.5.— Afterregulation 14.1.4 of the principal Regulations,the following regulation shall be inserted,namely:—

“14.1.5. Sewerage Treatment Plant:Sewerage Treatment Plant is mandatory forresidential complexes having 40 flats//residential units and above.”.

13. Amendment of Annexure XIII.— InAnnexure XIII of the principal Regulations, inclause (2), for item (xii), the following item shallbe substituted, namely:—

“(xii) The payment of Rs. 20,000/- persquare meter for additional FAR shall bedeposited within 30 days of issue of demandnote for payment.”.

14. Insertion of sketch No. 7.— After sketchNo. 6 of the principal Regulations, the followingsketch shall be inserted, namely:—

With a view to improving the livelihoodopportunities for the poor in Urban areas,Government of India, Ministry of Housing andUrban Poverty Alleviation (UPA Division) by aOffice Memorandum No. K-14011/2/2012-UPA//FTS–5196 dated 19-2-2016 has decided toextend the scope of National Urban LivelihoodsMission to all the Statutory Towns based ontheir local capacity and requirements. TheMission with enhanced scope is renamed as“Deendayal Antyodaya Yojana (DAY) - NationalUrban Livelihoods Mission”.
