CALL TO ORDER
Dr. Collins called the meeting of the Georgia Composite Medical Board to order at 7:37 a.m.
AGENDA
Dr. Retterbush submitted a motion, seconded by Dr. Antalis to approve the agenda of the
June 4, 2020 meeting. The motion carried unanimously.
MINUTES
Dr. Harbin made a motion to approve the minutes of the May 7, 2020 meeting. Dr. Antalis
seconded the motion and it carried unanimously.
ELECTION OF OFFICERS
Dr. Retterbush made a motion to appoint Dr. Simmons, DO as the Chairperson and Dr. Harbin,
MD as the Vice Chairperson. Dr. Marshall seconded the motion and it carried unanimously.

Dr. Collins made the following report:

3. Tight schedule for today, but we can get it all done in one day.

EXECUTIVE DIRECTOR’S REPORT
Ms. Hughes made the following report. The report was accepted as information:
Congratulated Mr. McGehee on being accepted in the upcoming Emerging Leaders Class
Dr. Gross is going to be the doctor of the day at the legislature on June 25, 2020.
Ms. Hughes discussed the budget cuts approved by the Board and the impact. The Board
accepted as information.
Ms. Hughes updated the Board that there has been 861 Emergency Practice Permits have been
issued to date.
Mr. Changus, the Board’s attorney, reviewed O.C.G.A. s. 43-34-25(g)(8), which is the
exemption section where it notes the general limit of four, and then identifies the exemption as
(8) "In any local board of education which has a school nurse program." .

The American Association of Medical Assistants has established a three year eligibility
pilot program.
Prescription Drug Monitoring Program (PDMP) Workgroup Minutes/Update.

with Exceptional Outcome
FSMB - Information on USMLE Step 2 Clinical Skills
Physician Specialties ranked by annual compensation.
National Board of Medical Examiners.NBOME – update on testing availability.
Mary Daniels, asking if the board would accept scores without USMLE Step 2, Clinical Skills.
The Board responded it would follow the guidelines of the testing company.
Email from Jennifer Pike regarding Physician Standing Orders, the Board asked for additional
information.

The Board asked Dr. Downey to assist with the rewrite of the Guidelines for the Prescription Use
of Opioids, the Board asked for the guidelines be added to the Rules agenda for next month.
Radiology Technicians would like to expand the language in the current rules. Provided some
sample language from MS/TN. Not seeking licensure, refer to the Rules Committee.

CLOSED SESSION
Dr. DeLoach motioned seconded by Dr. Harbin to go into closed session to discuss applications,
investigations and disciplinary matters. The motion carried unanimously.
APPEARANCE BEFORE THE BOARD
Thomas Lyons, MD met with the Board to appeal the offer for a Volunteer in Medicine license,
he wanted to reinstate his full license. The Board voted to deny licensure.

Briand Bounkeu, MD met with the Board to appeal the denial of his application. The Board
voted to uphold original decision to deny licensure.

NURSE PROTOCOL ADVISORY COMMITTEE
Dr. Gross presented the Nurse Protocol Report:
The Board took the following actions:
1. A question regarding refilling-controlled substances, if patients are getting refills that require my
DEA (such as phentermine, etc.), are there physical assessment requirements? Yes. Refer to Rule
360-2-7. The Delegating is also required.
2. Brandi Miller, Pediatric acute care Nurse Practitioner. I am very interested in doing some
telemedicine health during these most uncertain times. Initially GA required providers to have an in-
person encounter with a physical examination prior to being allowed to assess and prescribe
medication electronically. Would I be able to have telemedicine visits while here in Georgia to
patient’s in New York? What documentation is needed through the State of Georgia to get started?
Refer to telehealth rule. NP needs to contact other states. Needs a license for each state and
some states required you to both RN and Advance Practice License. The General Rule is you
need license in other states.
3. Since I have a GA Nurse Practitioner Licensure does this permit me to do Telemedicine from GA but
treating patients in different states via phone or live video specifically and only for Workers
Compensation in Occupational Medicine? Is there anything else in relation to my licensure that I
need to have to practice? Need to contact other state boards.
4. The physicians that we need to add as designated are general surgeons and the delegating physician is
a Gastroenterologist. They will be utilizing the midlevel for procedures that are within both
specialties’ scope of practice. May we utilize the general surgeons as designated physicians’ or does a
new protocol have to be issued? As long as both Physicians are within scope of the APRN.
5. The Department of Correctional Healthcare does not require NPs to have DEA since they do not
prescribe independently but we have physicians sign off their prescriptions and for that reason our
NPs do not file APRN agreement for approval with the medical board. Does this still limit the number
of NPs a physician can supervise? The ratio number is still the same.
6. The questions are as follows: 1) Since I have a GA Nurse Practitioner Licensure does this permit me
to do Telemedicine from GA but treating patients in different states via phone or live video
specifically and only for Workers Compensation in Occupational Medicine? For Workers Comp we
DO NOT treat patients in Group Health meaning NO Medicaid/ Medicare patients or any other
commercial grade health entities. I mention this because it is thought by the physicians and
companies employing us that because it is specifically Workers Compensation, we do not require
additional Licensure for those States. For example, If I am in Georgia doing Telemedicine and a
patient call from Virginia, am I able to treat that patient without a Virginia NP Licensure? Please
elaborate. Must contact other state board. 2) If my delegating and designated physician have
unencumbered license and can practice in any State does that allow me as an NP to also practice in
any state without obtaining my NP licensure from those states? Contact other Boards for their
requirements. 3) If I am employed as an Independent Contractor for Telemedicine can I use the
physicians hiring me as my Delegating and Designated physicians? Or do I have to find a different
Delegating and Designated Physician outside of that agreement? Is there anything else in relation to

my licensure that I need to have to practice as an Independent Contractor? Must practice in the same
