GEORGIA COMPOSITE MEDICAL BOARD 1 MINUTES APRIL 1, 2011 The Georgia Composite Medical Board (GCMB) held its regular meeting on April 1, 2011, Peachtree Street, NW, 36 th Floor, Atlanta, GA 30303, to consider Medical Board matters. Board members in attendance on Friday April 1, 2011, were: Alexander S. Gross, M.D., Chairperson Charles White, D.O., Vice Chairperson John S. Dr. Gross called the meeting to order at 8:00 a.m. Dr. Perry made a motion for a continuance of the Review Hearing for Nathaniel Johnson, MD. And to authorize the staff to docket as it is the Board’s intent to extend the time for review on or about April 20, 2011. Dr. Summers seconded the motion and it carried. APRIL 1, 2011 TELECONFERENCE Dr. Weil moved to approve the minutes of the March 25, 2011, GCMB teleconference meeting. Ms. Kunes seconded the motion and it carried unanimously. MINUTES Ms. Kunes moved to approve the minutes of the March 3-4, 2011, GCMB meeting. Dr. Retterbush moved to approve the minutes of the March 3-4, 2011, GCMB meeting with amendments. EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following to the Board:

Legislative update the Board members reviewed proposed legislative that impacts the Board. For information only.

Board sent out a notice to the hospital association and medical associations about D.B. a

physician imposter. Board is now accepting transcripts form EScript. 1. Shelia Harrison asked the role of the Board in the education of a physician enrolled in

medical school: a. Does the Board approve undergraduate medical schools? b.What is the definition of an approved teaching hospital or training institute?

Send a copy of the Laws and Rules.

2. A. Cullen Richardson, MD had concerns regarding Wellcare physicians allowing medical decisions by unlicensed Georgia physicians. Board will follow up.

3. Last month Jane Puthuparampil, ESQ, asked the question if a New York physician

could give medical advice on wound care and other items. The Board advised ‘No’. Her follow up question is “Was your decision based on the fact that the physician was being compensated for the services rather than two colleagues discussing the case?” Refer to the Law.

4. Letter from Thomas Fisher regarding a multi-discipline office between Chiropractor and Physician. Can a non-physician own the center? Refer to Law regarding fee splitting.

5. Letter from Leslie Ahlers physician licensed in MN not Georgia, Internet and phone

based service to provide medical education, life coaching, and spiritual direction to clients and to help clients understand their current diagnoses and treatment

recommendation. No diagnosing or prescribing. Advised this appears to be the practice of medicine a physician must have a license to practice medicine in Georgia.

6. Asking whether a physician must be in the same room while IM injection is being

done by an unlicensed or licensed person. Advised to abide by the Laws and Rules. 7. 20090408 – Deny request to reconsider the Impairment Committee’s decision to deny

petition to change the status of consent order. Dr Weil recused. 8. The Board is advertising for the Patient Qualification Review Board information is on

our website. For information only. 9. House passes Legislation to Enhance Patient Access to Healthcare Provider

Information House Bill 147. For information only. 10. Request from Public Citizen regarding clinical privilege restrictions placed at a

hospital but no board action. Federation of State Medical Boards(FSMB) provided talking points.

11. Spotlight on Graduate Medical Education and Fact Sheet on Georgia’s Medical

Schools from the board of Physician Workforce. For information only. 12. Resolutions for vote at the FSMB annual meeting.

1. Washington – obtaining records from federal Health card facilities. 2. Minnesota – To create a study process to inform board regarding the regulatory

implications of the current state of EMR. 3. Minnesota – To support public member initiative to educate on education and

ongoing development doctors must attain and maintain and specialty boards. 4. Ohio – Fight against Prescription Drug Abuse and “Pill Mills” seeking the

Federation of State Medical Boards to facilitate development of interstate agreements, working with interested parties, federal and state law enforcement entitles to come up with collective efforts to identify and take action to combat pill mills and to stop unlawful prescribing practices.

information only. 14. Email from Alan Voss a medical device that treats excess sweating requires an

injection of lidocaine/epinephrine for comfort. Must be a Georgia licensed Physician. Dr. Sumner gave the Board a report of her trip to Washington, DC, for the Telemedicine conference. For information only.

APRIL 1, 2011 Dr. Sumner moved to go into Executive Session to conduct Investigative Interviews, Dr. Butler seconded, the motion and it carried unanimously. Dr. Perry then declared the meeting would be open session upon completion of the investigative interviews for the purpose of holding committee meetings. RECONVENED Dr. Gross called the meeting to order at 2:00 p.m. ACUPUNCTURE ADVISORY COMMITTEE Dr. White presented the report of the Acupuncture Advisory Committee. Dr. Weil seconded the Committee recommendations and it carried unanimously. Quarterly Reports Accepted:

Cupping Therapy permissible. 4. M.T.B. – Tabled. PHYSICIAN LICENSING COMMITTEE: Dr. Gross presented the report for the Physician Licensing Committee. Dr. Retterbush seconded the committee recommendations with amendments and it carried unanimously. Other Business:

1. Advised E.B. that the prior decision of the Board is still effective, and that E. B. must take the Clinical Skills exam before an application for licensure would be considered. (Dr. Butler recused.)

NURSE PROTOCOL COMMITTEE Dr. House presented the Committee recommendations report for the Nurse Protocol Committee Dr. Summers seconded the Committee recommendations and it carried unanimously. Other Business:

1. Added Nuclear Exercise Stress Test and Pharmacologic Stress as procedures to the current protocol agreement between Kanniammal Ramasamy, APRN and Louis Battey, MD.

2. Decided to maintain the current posting of Nurse Practitioners/ Protocol Agreements

on the Board’s website, to include all protocol agreements that have ever been reviewed by the Board, with a termination date for the agreements that are no longer in effect.

3. Decided that the laws/rules regarding whether an APRN can employ a physician

should be sent in response to the issue regarding an APRN-owned clinic, as the definition of employer/employment is not defined in the Board’s Laws and Rules.
