The Georgia Composite Medical Board (GCMB) held its regular meeting on January 10, 2019 at
2 Peachtree 5th floor, Atlanta, Georgia, 30303 to consider Medical Board matters.

CALL TO ORDER
Dr. Marshall called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.
AGENDA AND MINUTES
Dr. Retterbush submitted a motion, seconded by Dr. Harbin to approve the agenda of the
January, 10, 2019 meeting. The motion carried unanimously.
Dr. Weil made a motion to approve the minutes of the December 6, 2018. Dr. Collins seconded
the motion and it carried unanimously.
OATH OF OFFICE
Dr. Marshall introduced Mr. Michael Fowler, SR, CFSP, new consumer member to the Board.
Mr. Fowler gave a brief history of his background and experience.
Dr. Marshall swore in Mr. Fowler, and the Board Members welcome him to the Medical Board.

ELECTION OF VICE CHAIR
Dr. Gross motioned to elect Dr. BK Mohan to the position of Vice Chair. Dr. Robinson seconded
the motion and it carried unanimously.
Dr. Retterbush motioned to recognition of Ronnie Wallace and thank him for his contribution to
the Medical Board. Dr. Antalis seconded the motion and it carried unanimously.
EXECUTIVE DIRECTOR’S REPORT
Ms. Hughes, Executive Director presented the report.
1. Introduced Lisa Norris. Deputy Executive Director, and Dr. Shuman. Assistant Medical
Director to the to Board.
2. PDMP Advisory Committee meeting will be held on January 17, 2019. For information,
only.
3. Federation of State Medical Boards Annual meeting in Ft. Worth TX. April 26 thru April
28. Mr. Law is registered under consumer member scholarship. For information only.
4. Physician Health News – Federation of State Physician Health Programs.
5. Reviewed a copy of the Newsletter and the Annual Report. Ms. Hughes thanked Harini
Indrakrijhnan, Intern for her work creating the newsletter and the annual report for the
Board.
Dr. Retterbush suggested to send the newsletter by mail if possible.
6. Questions from Paul Clarke for MedSpa for Botox and dermal-filler type injection.
Board approved for Dr. Gross to respond.
7. Article: “Carr Announces Lawsuit Against Opioid Manufactures and Distributors.” For
information, only.
8. Article: “Calif. Medical Board Begins Tracking Docs’ FDA Warning Letters.” For
information, only.
9. Reviewed email from the Education Commission for Foreign Medical Graduates.
Concerning Medical School Accreditation Requirement starting in 2023. Dr. Antalis will
report from the subcommittee at the next Board meeting.
10. An email from Karen Beard requesting information for regulations that cover physicians
providing diagnostic and preventive services in a mobile unit. Board responded; no
special requirements.
11. A letter from the Medical Association of Georgia regarding requirements for a retiring
physician to maintain medical records for the statutory 10-year retention period. Referred
to the Rules Committee to review.
RULES HEARING
Dr. Gross convened the Public Hearing concerning the following proposed Rules amendments:
(Rule 360-5-.05(5) “Limitations on Physician Assistant Practice.” Dr. Gross asked if anyone
was present to address the Board on the posted Rule with amendments. The Board received two
comments regarding this proposed amendment Board responded the comments do not refer to
the rule only for children in school system. Bethany Sherrer, Government Relations Medical

Association of Georgia. (MAG) was present to make comments concerning MAG’s position on
the Rule amendment.
Dr. Weil responded to Ms. Sherrer’s concerns. The concerns do not have anything to do with the
proposed Rule. The Board will send the comments to the Rules Committee for their review.
Dr. Gross made a motion to approve Rule 360-5-.05(5) “Limitations on Physician Assistant
Practice.” That the Board find the formulation and adoption of these rules do not impose
excessive regulatory cost on any licensee and any cost to comply with the rule cannot be reduced
by a less expensive alternative that fully accomplishes the objectives of the applicable laws; that
the Board finds that it is not legal or feasible to meet the objectives of the applicable laws to
adopt or implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A)
(3)(A),(B),(C), and (D).
Dr. Weil seconded the motion and it carried unanimously.
Dr. Gross convened the Public Hearing concerning the following proposed Rules amendments:
Rule 360-3-.02(5) Unprofessional Conduct Defined. Dr. Gross asked if anyone was present to
address the Board on the posted Rule with amendments. Denise Workman, DO, was present to
voice concerns regarding proposed Rule 360-3-.02(5) “Unprofessional Conduct Defined.”
Dr. Weil responded to the concerns addressed do not have anything to do with the proposed
Rule. The Board will send her concerns to the Rules Committee for their review.
Dr. Gross made a motion to approve Rule 360-3-.02(5) Unprofessional Conduct Defined. That the
Board find the formulation and adoption of these rules do not impose excessive regulatory cost

13. Brent Hall, MD requested information concerning: is a medical license required to
eviscerate a body for pathologic examination? Board response; Yes, it has to be a
licensed physician.
Dr. Robinson motioned to go into closed session. Dr. Antalis seconded the motion and it carried
unanimously.

Senior Assistant Attorney General D. Williams-McNeely presented an Orientation for the Board
members.
RECESS
Dr. Marshall declared the meeting in recess for the purpose of holding committee meetings.
RECONVENE
Dr. Marshall reconvened the meeting at 2:00 p.m.
Dr. Simmons motioned to go into closed session. Dr. Collins seconded the motion and it carried
unanimously.
Dr. Marshall declared open session.
APPEARANCE BEFORE THE BOARD
Somnath Roy, MD, requested an appearance before the Board. Dr. Roy made a statement
concerning losing his license in Ohio. The Board members asked questions. Dr. Roy made
statements regarding his plans for employment. Dr. Marshall asked for clarification of Dr. Roy’s
Statement.
APPEARANCE BEFORE THE BOARD
Umesh Singla, MD requested an appearance before the Board. Dr. Singla made comments
concerning his application for licensure. The Board members asked questions. Dr. Singla made
oral arguments concerning his request for licensure. The Board members asked questions
concerning his future employment plans.
Dr. Antalis motioned to go into closed session Dr. Harbin seconded the motion and it carried
unanimously.
Dr. Marshall declared open session.
Dr. Retterbush motioned to deny Somnath Roy, MD request for licensure. He may reapply for
licensure when he gets Ohio cleared up. Dr. Weil seconded the motion and it carried
unanimously.
Dr. Antalis motioned to deny Dr. Umesh Singla’s application for licensure. Dr. Retterbush
seconded the motion and it carried unanimously.
LICENSURE COMMITTEE
Dr. Retterbush presented the Licensure Committee report as a motion. The Board accepted the
report by unanimous vote.
