CTE: A progressive degenerative disease (Not concussion or injury?)
Caused by slow accumulation of Tau protein in the brain.
Changes in the brain can manifest years, or even decades after the last brain trauma or end of active athletic involvement.
2008-2010, Dr. Bennet Omalu performed postmortem evaluations on the brains of 12 former NFL players, and all of them showed evidence of CTE. (Since found in 99% of NFL donated brains.)

• Some policies cover ONE, BUT NOT THE OTHER
1. How to VALUE a disease whose impact hasn’t yet hit? 2. DEFENSE COSTS saved– no proof of causation, no med bills? 3. COST of claims goes down, but NUMBER OF CLAIMS goes up.
Think about other impacts on EXPOSURE:

Non-cumulative injury Many sports policies cover injury, but exclude cumulative injury.
• Example: broken leg (non-cumulative) vs. arthritis (cumulative) But if we can diagnose CTE as it develops, then:
• We can probably agree that the “final blow to the head” to end someone’s career may not be covered because there is a record of cumulative injury.
• However, at what point does a scan that shows the “progression” or “start” of CTE constitute an injury?

•Policies cover “damages on account of bodily injury”?
•Are these expensive MONITORING TESTS covered if there is no diagnosed injury to begin with?
