AN ACT PROI!ING FOR THE MAGNA CARTA OF "OMEN

CHAPTER I

General Pro#i$ion$

SECTION 1. Short Title. This Act shall be known as The Magna Carta of Woen!.

It shall )rootee)owerent of woen an* )+rs+e e+al o))ort+nities for woen an* en an* ens+re e+alaccess to reso+rces an* to *e-elo)ent res+lts an* o+tcoe. /+rther( the State reali'es thate+alit% of en an* woen entails the abolition of the +ne+al str+ct+res an* )ractices that)er)et+ate *iscriination an* ine+alit%. To reali'e this( the State shall en*ea-or to *e-elo))lans( )olicies( )rogras( eas+res( an* echaniss to a**ress *iscriination an* ine+alit%in the econoic( )olitical( social( an* c+lt+ral life of woen an* en.

The State affirs woen,s rights as h+an rights an* shall intensif% its efforts to f+lfill its *+ties+n*er international an* *oestic law to recogni'e( res)ect( )rotect( f+lfill( an* )roote allh+an rights an* f+n*aental free*os of woen( es)eciall% arginali'e* woen( in theeconoic( social( )olitical( c+lt+ral( an* other fiel*s witho+t *istinction or *iscriination onacco+nt of class( age( se2( gen*er( lang+age( ethnicit%( religion( i*eolog%( *isabilit%( e*+cation(an* stat+s.

The State shall )ro-i*e the necessar% echaniss to enforce woen,s rights an* a*o)t an*+n*ertake all legal eas+res necessar% to foster an* )roote the e+al o))ort+nit% for woen

to )artici)ate in an* contrib+te to the *e-elo)ent of the )olitical( econoic( social( an* c+lt+ralreals.

The State( in ens+ring the f+ll integration of woen,s concerns in the ainstrea of*e-elo)ent( shall )ro-i*e a)le o))ort+nities to enhance an* *e-elo) their skills( ac+ire)ro*+cti-e e)lo%ent an* contrib+te to their failies an* co+nities to the f+llest of theirca)abilities.

In )+rs+ance of this )olic%( the State reaffirs the right of woen in all sectors to )artici)ate in)olic% for+lation( )lanning( organi'ation( i)leentation( anageent( onitoring( an*e-al+ation of all )rogras( )ro3ects( an* ser-ices. It shall s+))ort )olicies( researches(technolog%( an* training )rogras an* other s+))ort ser-ices s+ch as financing( )ro*+ction(an* arketing to enco+rage acti-e )artici)ation of woen in national *e-elo)ent.

SECTION 4. $rinci)les of 5+an &ights of Woen. 5+an rights are +ni-ersal an*inalienable. All )eo)le in the worl* are entitle* to the. The +ni-ersalit% of h+an rights isenco)asse* in the wor*s of Article 1 of the 6ni-ersal #eclaration of 5+an &ights( whichstates that all h+an beings are free an* e+al in *ignit% an* rights.

5+an rights are in*i-isible. 5+an rights are inherent to the *ignit% of e-er% h+an beingwhether the% relate to ci-il( c+lt+ral( econoic( )olitical( or social iss+es.

5+an rights are inter*e)en*ent an* interrelate*. The f+lfillent of one right often *e)en*s(wholl% or in )art( +)on the f+lfillent of others.

All in*i-i*+als are e+al as h+an beings b% -irt+e of the inherent *ignit% of each h+an)erson. No one( therefore( sho+l* s+ffer *iscriination on the basis of ethnicit%( gen*er( age(lang+age( se2+al orientation( race( color( religion( )olitical( or other o)inion( national( social( orgeogra)hical origin( *isabilit%( )ro)ert%( birth( or other stat+s as establishe* b% h+an rightsstan*ar*s.

All )eo)le ha-e the right to )artici)ate in an* access inforation relating to the *ecision7aking)rocesses that affect their li-es an* well7being. &ights7base* a))roaches re+ire a high *egreeof )artici)ation b% co+nities( ci-il societ%( inorities( woen( %o+ng )eo)le( in*igeno+s)eo)les( an* other i*entifie* gro+)s.

States an* other *+t%7bearers are answerable for the obser-ance of h+an rights. The% ha-e to

co)l% with the legal nors an* stan*ar*s enshrine* in international h+an rights instr+entsin accor*ance with the $hili))ine Constit+tion. Where the% fail to *o so( aggrie-e* rights7hol*ersare entitle* to instit+te )rocee*ings for a))ro)riate re*ress before a co)etent co+rt or othera*3+*icator in accor*ance with the r+les an* )roce*+res )ro-i*e* b% law.

CHAPTER II

!e%inition o% Ter&$

SECTION 8. #efinitions. /or )+r)oses of this Act( the following ters shall ean9

0a Woen E)owerent! refers to the )ro-ision( a-ailabilit%( an* accessibilit% of

o))ort+nities( ser-ices( an* obser-ance of h+an rights which enable woen to acti-el%)artici)ate an* contrib+te to the )olitical( econoic( social( an* c+lt+ral *e-elo)ent of thenation as well as those which shall )ro-i*e the e+al access to ownershi)( anageent( an*control of )ro*+ction( an* of aterial an* inforational reso+rces an* benefits in the fail%(co+nit%( an* societ%.

0b #iscriination Against Woen! refers to an% gen*er7base* *istinction( e2cl+sion( orrestriction which has the effect or )+r)ose of i)airing or n+llif%ing the recognition( en3o%ent(or e2ercise b% woen( irres)ecti-e of their arital stat+s( on a basis of e+alit% of en an*

woen( of h+an rights an* f+n*aental free*os in the )olitical( econoic( social( c+lt+ral(ci-il( or an% other fiel*.

A eas+re or )ractice of general a))lication is *iscriination against woen if it fails to )ro-i*efor echaniss to offset or a**ress se2 or gen*er7base* *isa*-antages or liitations ofwoen( as a res+lt of which woen are *enie* or restricte* in the recognition an* )rotection oftheir rights an* in their access to an* en3o%ent of o))ort+nities( benefits( or )ri-ileges: orwoen( ore than en( are shown to ha-e s+ffere* the greater a*-erse effects of thoseeas+res or )ractices.

0* Marginali'e*! refers to the basic( *isa*-antage*( or -+lnerable )ersons or gro+)s whoare ostl% li-ing in )o-ert% an* ha-e little or no access to lan* an* other reso+rces( basic socialan* econoic ser-ices s+ch as health care( e*+cation( water an* sanitation( e)lo%ent an*li-elihoo* o))ort+nities( ho+sing( social sec+rit%( )h%sical infrastr+ct+re( an* the 3+stice s%ste.

CHAPTER I

Ri*)t$ an( E&+o,er&ent

SECTION >. 5+an &ights of Woen. All rights in the Constit+tion an* those rightsrecogni'e* +n*er international instr+ents *+l% signe* an* ratifie* b% the $hili))ines( inconsonance with $hili))ine law( shall be rights of woen +n*er this Act to be en3o%e* witho+t*iscriination.

SECTION ?. $rotection fro Biolence. The State shall ens+re that all woen shall be)rotecte* fro all fors of -iolence as )ro-i*e* for in e2isting laws. Agencies of go-ernentshall gi-e )riorit% to the *efense an* )rotection of woen against gen*er7base* offenses an*hel) woen attain 3+stice an* healing.

Towar*s this en*( eas+res to )rosec+te an* refor offen*ers shall likewise be )+rs+e*. 0aWithin the ne2t fi-e 0; %ears( there shall be an increental increase in the recr+itent an*training of woen in the )olice force( forensics an* e*ico7legal( legal ser-ices( an* social workser-ices a-aile* of b% woen who are -ictis of gen*er7relate* offenses +ntil fift% )ercent0;@ of the )ersonnel thereof shall be woen.

0b Woen shall ha-e the right to )rotection an* sec+rit% in sit+ations of are* conflictan* ilitari'ation. Towar*s this en*( the% shall be )rotecte* fro all fors of gen*er7base*-iolence( )artic+larl% ra)e an* other fors of se2+al ab+se( an* all fors of -iolence insit+ations of are* conflict. The State shall obser-e international stan*ar*s for the )rotection ofci-ilian )o)+lation in circ+stances of eergenc% an* are* conflict. It shall not force woen(

es)eciall% in*igeno+s )eo)les( to aban*on their lan*s( territories( an* eans of s+bsistence( orrelocate the in s)ecial centers for ilitar% )+r)oses +n*er an% *iscriinator% con*ition.

0c All go-ernent )ersonnel in-ol-e* in the )rotection an* *efense of woen againstgen*er7base* -iolence shall +n*ergo a an*ator% training on h+an rights an* gen*ersensiti-it% )+rs+ant to this Act.

0* All local go-ernent +nits shall establish a Biolence Against Woen,s #esk in e-er%baranga% to ens+re that -iolence against woen cases are f+ll% a**resse* in a gen*er7res)onsi-e anner.

SECTION 1@. Woen Affecte* b% #isasters( Calaities( an* Other Crisis Sit+ations.

Woen ha-e the right to )rotection an* sec+rit% in ties of *isasters( calaities( an* othercrisis sit+ations es)eciall% in all )hases of relief( reco-er%( rehabilitation( an* constr+ctionefforts. The State shall )ro-i*e for ie*iate h+anitarian assistance( allocation of reso+rces(an* earl% resettleent( if necessar%. It shall also a**ress the )artic+lar nee*s of woen fro agen*er )ers)ecti-e to ens+re their f+ll )rotection fro se2+al e2)loitation an* other se2+al an*gen*er7base* -iolence coitte* against the. &es)onses to *isaster sit+ations shall incl+*ethe )ro-ision of ser-ices( s+ch as )s%chosocial s+))ort( li-elihoo* s+))ort( e*+cation()s%chological health( an* co)rehensi-e health ser-ices( incl+*ing )rotection *+ring)regnanc%.

SECTION 11. $artici)ation an* &e)resentation. The State shall +n*ertake te)orar%s)ecial eas+res to accelerate the )artici)ation an* e+itable re)resentation of woen in alls)heres of societ% )artic+larl% in the *ecision7aking an* )olic%7aking )rocesses ingo-ernent an* )ri-ate entities to f+ll% reali'e their role as agents an* beneficiaries of*e-elo)ent.

The State shall instit+te the following affirati-e action echaniss so that woen can)artici)ate eaningf+ll% in the for+lation( i)leentation( an* e-al+ation of )olicies( )lans(an* )rogras for national( regional( an* local *e-elo)ent9

0a E)owerent within the Ci-il Ser-ice. Within the ne2t fi-e 0; %ears( the n+ber ofwoen in thir* 04r* le-el )ositions in go-ernent shall be increentall% increase* to achie-e afift%7fift% 0;@7;@ gen*er balance:

their lea*ershi) hierarch%( internal )olic%7aking str+ct+res( a))ointi-e( an* electoralnoinating )rocesses: an*

0f $ri-ate Sector. The State shall take eas+res to enco+rage woen lea*ershi) inthe )ri-ate sector in the for of incenti-es.

SECTION 1". E+al Treatent Defore the Faw. The State shall take ste)s to re-iew an*(when necessar%( aen* an*or re)eal e2isting laws that are *iscriinator% to woen withinthree 04 %ears fro the effecti-it% of this Act.

SECTION 14. E+al Access an* Eliination of #iscriination in E*+cation( Scholarshi)s(an* Training. 0a The State shall ens+re that gen*er stereot%)es an* iages in e*+cational

aterials an* c+rric+la are a*e+atel% an* a))ro)riatel% re-ise*. en*er7sensiti-e lang+ageshall be +se* at all ties. Ca)acit%7b+il*ing on gen*er an* *e-elo)ent 0A#( )eace an*h+an rights( e*+cation for teachers( an* all those in-ol-e* in the e*+cation sector shall be)+rs+e* towar* this en*. $artnershi)s between an* aong )la%ers of the e*+cation sector(incl+*ing the )ri-ate sector( ch+rches( an* faith gro+)s shall be enco+rage*.

SECTION 18. Woen in S)orts. The State shall *e-elo)( establish( an* strengthen

)rogras for the )artici)ation of woen an* girl7chil*ren in co)etiti-e an* nonco)etiti-es)orts as a eans to achie-e e2cellence( )roote )h%sical an* social well7being( eliinategen*er7role stereot%)ing( an* )ro-i*e e+al access to the f+ll benefits of *e-elo)ent for all)ersons regar*less of se2( gen*er i*entit%( an* other siilar factors.

The State will also )ro-i*e aterial an* nonaterial incenti-es to local go-ernent +nits( e*iaorgani'ations( an* the )ri-ate sector for )rooting( training( an* )re)aring woen an* girls for)artici)ation in co)etiti-e an* nonco)etiti-e s)orts( es)eciall% in local an* internationale-ents( incl+*ing( b+t not liite* to( the $alarong $abansa( So+theast Asian aes( Asianaes( an* the Ol%)ics.

The State shall also ens+re the safet% an* well7being of all woen an* girls )artici)ating ins)orts( es)eciall%( b+t not liite* to( trainees( reser-e ebers( ebers( coaches( an*entors of national s)orts teas( whether in st+*%ing( training( or )erforance )hases( b%)ro-i*ing the co)rehensi-e health an* e*ical ins+rance co-erage( as well as integrate*e*ical( n+tritional( an* healthcare ser-ices.

Schools( colleges( +ni-ersities( or an% other learning instit+tion shall take into acco+nt its totalwoen st+*ent )o)+lation in granting athletic scholarshi). There shall be a )ro ratare)resentation of woen in the athletic scholarshi) )rogra base* on the )ercentage of woenin the whole st+*ent )o)+lation.
