(8) A grazing fee shall be payable at the rates set out in the Swendr Schdu!e in mpct of all animals allowed to graze in a nahonat fomt.

(9) The forest stumpge fee at the rate set out in the Fifth Schedule for non-commercial or other s p i e s , the training fee and ihe reforesbfion fee shall be payable in refcpect of all timber of species classes I, I1 and 111 which hm become unmerchantable through no fault or neglect of any p m mpired by these rcptations to pay any such fee, to lrhe extent lhat such timber remains merchantable as fuel.

(10) Any person who wilfully or negligently damages or destroys any merchantable timbcr shall bear the same obli@tions under these reguhiom and any app!icable licence, contract of saledro~nc~asion agreement ss if such timber had been re1ted or extracted in merchantable condition.

(11) All fees and Royalties shall be $justed annually to accommodate for inflation and other market fluctuatlona according to the following formula-

PART V -TIMBER WCFNCE

12. (1 ) Upon application in the form set out in the First Issued Schedule, a licensing ollicer may issue alicence to fell and extmct timber ::!U' in a national lbrest under the following conditions-

(a) that thc area covered by the licence from which t imkr ahnll kp ~ w t r n r t o d rlcpa nnt ~ y r p . p x i Mn =rev,

(b) either that the applicant is an inhabitant of the Chiefdom in whch the timber is situated or that the applicant is in the Chiefdom Council of the Chiefdom in which the timber is situated and requires the timber for public pupotw;

(C) that the amount of feeu estimated by the licensing officer to be due Ior the first ninety days of operations have been paid;

(4 that .the grant of the licence would be consistent with any applicabie fwrst management plan and licensing instructions.

( 2 ) A timber licence shall be in the fonn set out in the Eighth Schedule.

13, ( I ) A timber licence shall be subject ta the following Codiiions conditions, in addition to any other conditions that may be specified in an* fees.

(a) only trees of the species and sizes specified in the licence shall be felled;

(6) no tree shall be felled until it has been marked far fellifig by a forestry officer;

(d) no tree shall be moved f m the place where it has been felled until i t has been marked by a forest officer:

PART VI-OTHER LICENCES

(d) the forest severance fee and the minnor fomt produce fca calculated in accordancc with regulation 10 shall be paid in respect of all merchantable fore% produce which may be removed from Ule area compatibly with the aulhorissd clearing operations.

(4) A minor forest produce licence ahall'be subject to the fvlluwing conditions, in addition to any othcr conditiom that thc licensing officer may 8pcify therein -

(a) only the kind and quantity of minor forest produce stated in the licence may be taken ;

(b) minor forest produce shall be taken only from the locations stated in the licence.

(I) The sale may be conduckd eithw by auc~ion or by prlvve agreement. The sale shall be based on a bonus, either by bid or negotiated,per hoppus fool orprcubicmetre in addition to the regular lees and royalbes paid.

(3) Thc contract of sale may be executed by a licensing officer, subject to thc following conditions and suchadditional procedures and inqh-uctinns as the ChisfCnnsfr\;atnr may establish-

(a) wherestanding timber is the produceinquestion, the area which shalt bc thc subject of such sale shslll not be more than ten square mllcs or 6,400 acres;

(B) the total stumpage value, if i t is tim bcr or prevailing markci value in the C~LSC of other forest pnduoc shall be assessed and $hall wn.c as thc h s a uf conlract sale negotiation or the minimum bid amount i f thc p r d ~ is auctioned:

(3) Any person who fells, takes or extracts any forest produce in excess of h e quantity permitted by a contract of sale and for which an inslalment as defined in paragraph (l) bap been paid shall be required to pay ten times the price agreed in the contract of sale. in respect or such excess.

26, ( l ) A contract of sale shall be .subject to the following Condition or conditions in addition to any other cond;tions that may be stated therein-

(a) only trees of the s p i e s and sins specified in the contract shall be cut.

( b ) a register shall be maintained by thewnuactor in whch shall be cccorded each day thc speclea, and scaling data of each tree cbt, dahaged or destroyed;

(C) no tree shall be moved from the place where i t has k e n felled until i t has been marked by a forest officer;

Id) a copy of the contract of sale and the re isrer required under paragraph 0) shall be pmfuced for inspection whenever requested by a lorest offier.

(e) failure to fell trees under the terms of a coptracr of sale shall be an offence under Rut 1 V of these regulations.

(2) If standing timber is sold, the contract of sale shall provide for the Ibllawing-

(a) the location, species and quantity of timber sold

Vdidift' 27. (1) A contract ofsale shall be valid for such period no( exceeding M five years as may be stated therein: mnlract.

(2) For every Contraqt of Sale a Performance Bond of ten thousand lwnes shall be rcquiied as a guilrantee for the fincly execution or the contnct of sale.

Tenders. 28. (c) tenders for cmcessions shall be in the form of a mu$ bid per cubic meter in addition to regular fees and royalties.
