Doug, I know we spoke briefly earlier this year that Congressman DeSantis was interested in introducing a reform-minded transportation bill. We’ve teamed up with Senator Mike Lee from Utah on an approach similar to what Rep. Tom Graves introduced in the House last year, the Transportation Empowerment Act. We recognize that the bill is a longer-term solution for the HTF, but the Congressman believes that the aim of this bill would greatly benefit Florida and its transportation system while allowing it to have the flexibility and quicker timeframes to move on infrastructure projects. S.____ Transportation Empowerment Act: Section by Section Section 1 – Short Title Section 2 – Findings and Purposes Findings: The objective of the Federal highway program – to facilitate construction of a modern freeway system – is near completion, and, in many cases, has already been achieved. However, the Federal government continues to use Federal motor fuels taxes to implement one-size-fits-all programs that are not necessarily appropriate for individual states. States should bear the responsibility for and have flexibility in building transportation infrastructure, while not having the federal government apply uniform mandates that fail to acknowledge the unique circumstances of each State. Purpose: The Transportation Empowerment Act (TEA) seeks to provide a new policy blueprint to govern the Federal role in transportation once existing and prior obligations are met, and the Highway Trust Fund (HTF) is solvent. Specifically, this will involve returning to the States maximum discretionary authority and fiscal responsibility for all transportation systems that are not within the direct purview of the Federal government, but preserving and responsibly funding areas where there is a direct Federal role, such as the Dwight D. Eisenhower National System of Interstate and Defense Highways, national programs and transportation research, and emergency assistance, among others. Section 3 – Funding Limitation Notwithstanding any other provision of law, if transportation authorizations under TEA exceed available funds in the HTF, proportional cuts will be made to authorizations to prevent HTF subsidies from being required. Section 4 – Funding for Core Highway Programs Core Highway Programs TEA funds the following Core Highway Programs: • National Highway Performance Program (NHPP)
o Provides funding to States to “preserve and improve” the National Highway System, which includes the Interstate System highways and bridges as well as nearly all other major highways. NHPP includes projects to achieve national performance goals for infrastructure condition, safety, reconstruction, rehabilitation, etc. Eligibility is removed for bicycle transportation and pedestrian walkways, environmental restoration and pollution abatement. States can still use the excess tax receipts provided under the bill to fund these programs if they choose.
• Surface Transportation Program (STP)
o Provides funding for States to repair and maintain any Federal-aid highways and bridges on any public road. Funds can also be used on transit capital projects or on routes for non-motorized transportation. Eligibility is removed for transportation alternatives projects, as
well as environmental mitigation, restoration and pollution abatement. States can still use the excess tax receipts provided under the bill to fund these programs if they choose.
• Highway Safety Improvement Program (HSIP)
o Focused on reducing fatalities and road injuries by correcting hazardous road locations, such as dangerous intersections, or making road improvements such as adding rumble strips. HSIP requires each State to utilize a Strategic Highway Safety Plan to meet reduction goals in fatalities and injuries.
TEA eliminates authorization for the Transportation Alternatives Program (TA), which funds highway beautification, routes for non-motorized transportation and recreational trails. Some of the projects funded under TA, such as bicycle facilities and pedestrian walkways, are eligible to be funded under the National Highway Performance Program, the Surface Transportation Program, and the Highway Safety Improvement Program. TEA still permits states to transfer up to 50% of any apportionment to any other apportionment program, consistent with current law. Funding Formula for Core Highway Programs Section 4 funds the Core Highway Programs by percentage allocation. Specifically, for the years authorized by the bill (2016-2020) not more than 10% of the balance of the HTF at the beginning of the fiscal year, accounting for estimated revenues, may be allocated to fund these core programs. The amounts allocated from the HTF will decrease proportionately as the tax revenues are phased down and certain transportation responsibilities are devolved to the states. Additional Programs Funded • Emergency Relief: $100 million provided for each fiscal year, 2016-2020; consistent with FY15
enacted amounts.
• Federal Lands Programs
o Federal Lands Transportation Program - $300 million provided for each fiscal year, 2016-2020, which is the same as FY15 enacted amounts. Consistent with current law, $240 million shall be for the National Park Service, and $30 million for the Fish and Wildlife Service. The rest will be allocated among the Forest Service, the Corps of Engineers, and the Bureau of Land Management. This program provides funding for these agencies to construct roads, bridges and perform other transportation activities.
o Federal Lands Access Program - $250 million for each fiscal year, 2016-2020, consistent with FY15 enacted amounts. This program funds projects that are on, or adjacent to, or provide access to, federal lands.
Administrative Expenses
Administrative expenses have historically amounted to approximately 1% of the Federal Highway Administration Budget, which totaled approximately $412 million in FY15. TEA maintains the 1% allocation for Administrative expenses, which will reduce proportionally as revenues to the HTF, and subsequently, federal responsibilities, decline. A Point of Order is provided for any measure that would authorize less than 1% of funds for administrative expenses during any fiscal year. Transferability of Funds Full transferability of funds for any surface transportation project (including mass transit/rail) may be made at the discretion of individual States. If a State uses these funds for purposes that are not related to surface transportation, the amount that is improperly transferred will be deducted from any amount the State would otherwise receive from the HTF. Modifications to the Federal-aid System Technical corrections are made, and code citations and dates are updated. Beginning on October 1, 2016, a highway construction/improvement program will not be considered Federal highway construction/improvement unless/until a State expends Federal funds for the construction portion of the project. However, a State can spend Federal dollars before the construction phase for related expenses (environmental documentation or design work) without being considered a Federal highway project. If the State reimburses the Federal government for Federal dollars spent on a highway construction/improvement cost, it will no longer be considered a Federal highway project. As of October 1, 2016, no new reporting requirements shall apply in order to use Federal funds for highway projects by a public-private partnership. Core Programs Financing Rate The amount of federal gasoline taxes available to fund core highway programs is as follows: 2016-2017: 18.3/gallon 2017-2018: 9.6/gallon 2018-2019: 6.4/gallon 2019-2020: 5.0/gallon 2020-beyond: 3.7/gallon The amount of federal diesel fuel tax available to fund core highway programs is as follows: 2016-2017: 24.3/gallon 2017-2018: 12.7/gallon 2018-2019: 8.5/gallon
2019-2020: 6.6/gallon 2020-beyond: 5.0/gallon Mass Transit The Mass Transit account is terminated and remaining revenues are transferred to the Highway Account. However, as detailed above, States will still be allowed to use their excess tax receipts for mass transit, if they choose. Section 5 – Funding for Highway Research & Development Program Changes to the core federal highway programs are made, eligibilities repealed as referenced in the program descriptions in Section 4, laid out above, and conforming amendments are made. The Metropolitan Transportation Planning Program is repealed. The Congestion Mitigation and Air Quality Improvement Program is repealed. Historic Bridges program is repealed. Transportation Alternatives Program is repealed (see Funding for Core Federal Highways section above). The Highway Research and Development Program is funded at $115 million for each fiscal year, 2016-2020, consistent with FY15 enacted amounts. This program funds investment in research activities that address current and emerging highway transportation needs. Consistent with current law, the Federal share of the cost of these activities shall not exceed 80%. Section 6 – Return of Excess Tax Receipts To States Beginning on the first day of each fiscal year, 2016-2019, the Secretary will determine the difference between the fuel taxes used to fund the Core Highway Program (See Section 4) and total fuel taxes collected and allocate the excess revenue to the States, in proportion equal to their HTF contributions, to be used for transportation programs at the discretion of the States. If a State uses these funds for purposes that are not related to surface transportation, the amount that is improperly transferred will be deducted from any amount the State would otherwise receive from the HTF. Section 7: Reduction in Taxes on Gasoline, Diesel Fuel, Kerosene, and Special Fuels Funding Highway Trust Fund The reduction in gas taxes is made permanent on September 30, 2020. Gasoline taxes are brought down from 18.3 cents per gallon to 3.7 cents per gallon. Diesel fuel and kerosene would be taxed at 5 cents per gallon, down from 24.3 cents per gallon. The entireties of the taxes collected are dedicated to financing the Core Highway Programs.

Washington, DC 20460 Dear Ms. McCarthy: Florida has clean and healthy air to breathe. Therefore, the Environmental Protection Agency should designate Florida in attainment of the 2012 National Ambient Air Quality Standard for fine particulate matter (PM2 5). Florida’s Department of Environmental Protection has provided a range of data, laboratory studies, and technical information that clearly demonstrate Florida is achieving the PM2 5 standard in all areas of the state. In its oversight of states’ air quality monitoring systems, EPA is expected to base its conclusions on sound regulatory requirements and science, and wield its authority responsibly. In this case, however, EPA appears to prefer form over substance. Though EPA has not identified any evidence upon which to base a finding that any area of the state is not achieving the 2012 PM2 5 standard, the agency chose to defer its attainment designation. This is a disservice to the citizens of the state and its many visitors, who deserve to know that Florida is in fact meeting this standard. As you know, tourism is a huge driver of Florida’s economy. The state proudly boasts 171 state parks and trails, 35 state forests, three national parks, and three national forests, along with hundreds of city and county parks, providing recreational opportunities for the 20 million Floridians and over 97 million visitors each year. Ensuring that Florida’s air is healthy is a critical component of our tourism industry and the high quality of life that Floridians enjoy. That is one reason we designed and invested in a very robust air monitoring network, which covers over 92% of the population. Florida is widely recognized for its excellent air quality. In the American Lung Association’s latest “State of the Air” report (May 2015), Florida had 28 cities ranked as the cleanest in the nation. The entire State of Florida was designated in attainment for the 1997 PM2 5 standard and the 2006 PM2 5 standard, and has never had a violation of either of those standards. Attainment of these and the 2012 standards is further supported by records showing that emissions of particulate matter precursors, including sulfur dioxide and nitrogen dioxide, have declined significantly in recent years. EPA’s decision to defer attainment for PM2 5 overlooks the robust information provided by the monitoring network, laboratory studies, and other science-based information. EPA’s deferral decision was based primarily on its rejection of data collected in late 2012, which EPA asserts did not meet the humidity requirements listed in the federal register [40 CFR Part 50, Appendix L, §8.2]. The decision to reject those data ignored specific provisions that allow laboratory managers to consider multiple lines of evidence before rejecting data [40 CFR Part 50, Appendix L, §13 reference 2, EPA Quality Assurance Guidance Document 2:12, Section 7.6]. The verified duplicative quality control data
collected during measurements, as well as additional supportive studies, demonstrate conclusively that the data generated during that period were reliable, usable, and scientifically sound. I strongly encourage you to consider this information with an open mind and finalize the attainment designation for Florida.
