Frequently Asked Questions

Emergency Management (Public Activities No.

2) (COVID-19) Direction 2020

What is the maximum number of people I can have over at my house?

You can have a maximum of 75 people at your house as a gathering, provided there is compliance with density requirements. People present must not exceed more than 1 person per 4 square metres and the 1.5 metres physical distancing must be adhered to.

Who needs to complete the COVID-Safe Plan? All defined public activities allowed under the previous step (Step 2) can apply the new limits once they

have completed a new Step 2 Plus COVID-Safe Plan.

The COVID-Safe Plan will help you, your staff, patrons and others understand and follow your capacity

and other COVID-Safe requirements. Your COVID-Safe Plan must be kept available for inspection by

authorised officers.

For more information and to complete the COVID-Safe Plan visit the Create a COVID-Safe Plan page

The new limits of people do not apply to my business. Do I need to complete a new COVID-Safe

Plan?

No. If the new limits in Step 2 Plus do not apply to your business, you can use your existing COVID-Safe

Plan.

I submitted a COVID-Safe Plan for Step 2 already. Do I need another one for Step 2 Plus?

Businesses that have already submitted a COVID-Safe Plan will be emailed an automatic update later

today. It will apply the new capacity numbers using the dimensions of rooms and venues from your

original plan.

If you have not yet submitted a COVID-Safe Plan or will only re-open from 19 June, you should plan for

re-opening and submit your plan once the updated version is available.

What is a defined public activity?

A defined public activity means:

onsite purchase and consumption of food or beverages (whether occurring in an indoor or outdoor area)

sport (including sports training), fitness or recreation activities;

indoor public meetings;

public assemblies;

ceremonies;

provision of personal care services;

Page 2: Frequently Asked Questions Emergency ... - SA.GOV.AU: COVID-19€¦ · The new limits of people do not apply to my business. Do I need to complete a new COVID-Safe Plan? No. If the

provision of public entertainment;

auctions and inspections of premises for the purpose of sale or rental of any property; or

driver instruction. I have completed by COVID-Safe Plan, what are my obligations? You are obliged to keep the Plan available for inspection by an authorised officer, if you are required to retain records of contact details you must make those available upon request of an authorised officer. This can be in a printed or electronic format. The COVID-Safe Plan contains a lot of obligations and recommendations, what does this mean? Obligations are those areas of the plan you must do. Failure to undertake the obligations may result in a $5,000 fine. Recommendations are designed to guide you in creating an environment which is as COVID19 safe as possible. It is however acknowledged that it may not be possible to achieve all of the recommended actions, but you should attempt to comply to the best of your ability. I only have a PO Box for my business address that the plan does not accept. What should I

include in the address field?

If you do not have street address, the form should allow you to leave the address field empty or you can

use your home address.

I work at multiple venues. Do I need to complete my own plan in addition to the venue?

If the work you do comes under the list of ‘defined public activities’ you need to do your own plan once to

use at multiple venues. You should also be aware of the plans of any venues you use. This may be as

simple as ensuring they have a plan in place and that you follow the requirements when using the venue.

Who will be going to venues to check on the way businesses are re-opening?

Local councils and police are monitoring compliance based on the normal requirements for your type of

activity or business. For example, Environmental Health Officers in local government conduct regular

inspections at restaurants and cafes and are now also checking on COVID-Safe Plans at the same time.

They are working with the SA Police and SA Health where needed for advice and support. Police officers

may also undertake compliance reviews and will be talking to businesses and services to help them

become and remain compliant as we continue to ease restrictions in SA.

What is contact tracing? A person is required to make and retain contact tracing records for people attending a public activity, those records must include the following details in relation to each person attending the time and date of the activity, the name of person attending (unless the person refuses to provide their name) and the phone number or email address of person attending (unless the person refuses to provide a phone number or email address). This must be produced for inspection at the request of an authorised officer and may only be used for the purpose of contact tracing in relation to COVID-19 and must not be used for any other purpose. How many patrons can I have in my restaurant/café/winery/pub/brewery/bar? You can have a maximum of 300 patrons across all dining areas whether enclosed or outdoors with a maximum of 75 in each dining area, provided there is compliance with density requirements. People present must not exceed more than 1 person per 4 square metres and the 1.5 metres physical distancing must be adhered to.
