In 2006 Croatia requested the extradition of Mr Dragan Vasiljkovic (also known as Daniel

Snedden) to face prosecution for war crimes allegedly committed in the conflict in the Former

Yugoslavia.

If asked: Will Mr Snedden be prosecuted under Aust ralian war crimeslegislation i f he is not extradited?

Investigation and prosecution decisions are matters for the AustralianFederal Police and CDPP as independent statutory authorities.

Allegations of war crimes committed overseas can give rise to complexlegal and factual issues that would need careful consideration by lawenforcement agencies.

As a matter of general policy, Australia supports prosecution of offences inthe country in which the offence occurs. However, if Mr Snedden is notextradited it would be for Australias independent law enforcementagencies to consider matters relating to any prosecution of Mr Snedden in

Australia.

Background

In 2006, Croatia requested the extradition of Dragan Vasiljkovic (also known as DanielSnedden). He is wanted to face prosecution in Croatia for three counts of war crimesoffences allegedly committed during the conflict in the former Yugoslavia.

Snedden was provisionally arrested by Australian authorities on 19 January 2006. On18 March 2006, the then Minister for Justice and Customs issued a notice under section 16of the Extradition Act 1988(Cth), formally receiving the request for Sneddens extraditionfor these offences.

If special leave is granted, and any appeal to the High Court is successful, the matter willreturn to you to determine whether to surrender Snedden to Croatia. We expect there willbe significant public pressure both for and against Sneddens extradition.

[NOT FOR PUBLIC]AGD is seeking advice as to whether Australian authorities havejurisdiction to prosecute Snedden for war crimes offences under Australian law.
