Fisheries (Fees, Royalties and Levies) Amendment Regulations 2017
The Governor in Council makes the following Regulations:

Part 1—Preliminary
1 Objectives
The objectives of these Regulations are—
(a) to amend the Fisheries (Fees, Royalties and Levies) Regulations 2008—
(i) to amend the levies for commercial fishery licences and individual quota units; and
(ii) to amend the manner in which the levies under section 151 of the Act are prescribed; and

(b) to change references in the Fisheries (Fees, Royalties and Levies) Regulations 2008 to the Secretary and Department to the Victorian Fisheries Authority from 1 July 2017; and
(c) to make a statute law revision to the Fisheries and Fisheries (Fees, Royalties and Levies) Amendment (Recreational Fishery Licences) Regulations 2016.
2 Authorising provisions
These Regulations are made under sections 151A and 153 of the Fisheries Act 1995.
3 Commencement
(1) These Regulations, except Part 3, come into operation on 1 April 2017.
(2) Part 3 comes into operation on 1 July 2017.
4 Principal Regulations
In these Regulations, the Fisheries (Fees, Royalties and Levies) Regulations 20081 are called the Principal Regulations.

5 Definitions and interpretation
In regulation 4(1) of the Principal Regulations, in the definition of Fisheries Research and Development Corporation (FRDC), for "Primary Industries and Energy Research Development Act" substitute "Primary Industries Research and Development Act".
6 Levy for making grants under section 151(5) of the Act
For regulation 20B(a) and (b) of the Principal Regulations substitute—
"(a) for each class of licence set out in Column 2 of the Table in Schedule 6, the levy corresponding to that class of licence set out in Column 3 of that Table; and
(b) for each class of individual quota unit set out in Column 2 of the Table in Schedule 6, the levy corresponding to that class of individual quota unit set out in Column 3 of that Table.".

7 Levies for access licences—Schedule 2 substituted
For Schedule 2 to the Principal Regulations substitute—
"Schedule 2—Levies for access licencesRegulations 14 and 17
In regulation 10(1)(d) of the Fisheries and Fisheries (Fees, Royalties and Levies) Amendment (Recreational Fishery Licences) Regulations 20162, for "10" substitute "$10".

——Fee Units
These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.
The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.
The value of a fee unit for the financial year commencing 1 July 2016 is $13.94. The amount of the calculated fee may be rounded to the nearest 10 cents.
The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
