Firearms (Amendment) Bill 1997
A BILL FOR
An Act to amend the Firearms Act 1996 The Legislative Assembly for the Australian Capital Territory enacts as
follows:
Short title 1. This Act may be cited as the Firearms (Amendment) Act 1997.
5 Commencement 2. (1) Sections 1, 2 and 3 commence on the day on which this Act is
notified in the Gazette.
(2) The remaining provisions commence on the day on which Part XII of the Principal Act as amended by this Act commences.
10 Principal Act 3. In this Act, "Principal Act" means the Firearms Act 1996.1

Insertion 4. After section 135 of the Principal Act the following sections are
inserted:
Amnesty 5 "135A. No proceeding lies against a person in respect of the possession
of a firearm surrendered to a police officer dunng the penod commencing on the commencement of this section and ending at the expiration of 30 September 1997.
Compensation 10 "135B. (1) Where the owner of a prohibited firearm—
(a) had that firearm lawfully in his or her possession on 16 May 1996; and
(b) since that date has sunendered it to a police officer or does so before 1 October 1997;
15 he or she is entitled to compensation from the Territory by force of this section and not otherwise.
"(2) The amount of compensation is—
(a) if—
(i) before 14 April 1997 the owner of the firearm has instituted 20 proceedings in a court to recover an amount of
compensation greater than that ascertained by the application of paragraph (b) or (c), as the case requires, and
(n) the court determines that the market value of the firearm was an amount greater than that so ascertained;
25 that greater amount;
(b) (unless paragraph (d) applies) if the firearm is of a make or model described in Schedule 2A and is not new—the amount specified in column 2 of that Schedule opposite that descnption;
(c) (unless paragraph (d) applies) if the firearm is of a make or model 30 described in Schedule 2A and is new—the amount specified in
column 3 of that Schedule opposite that descnption;
(d) if the firearm—
(i) is of a make or model described in Schedule 2A (not being a military-style self-loading nfle) and the amount specified
35 in the relevant column of that Schedule opposite that description exceeds $2,500; or

(ii) is of a make or model described in Schedule 2A but has been so modified that, in the opinion of the Chief Executive of the Attorney-General's Department, its market value is substantially more than the amount specified in the relevant
5 column of that Schedule;
such greater amount as the Chief Executive of the Attorney-General's Department determines; or
(e) is of a make or model not described in Schedule 2A—such amount as the Chief Executive of the Attorney-General's Department
10 determines.
"(3) For the purposes of this section and Schedule 2A, a firearm shall be taken to be new only if it has not been discharged otherwise than by way of testing in the course of manufacture.".
Insertion 15 5. After Schedule 2 to the Principal Act the Schedule set out in the
Schedule to this Act is inserted.
