Background

FTCA Medical Malpractice Liability Coverage in Free Clinics

• In 2004, Congress made effective FTCA medical malpractice protection for volunteer free clinic health professionals.

• Free Clinic volunteers who meet all the requirements of the program may be sponsored by the Free Clinic and "deemed" a Public Health Service Federal employee for the purpose of FTCA medical malpractice coverage.

• In 2010, Congress extended FTCA medical malpractice protection to eligible Board Members, Officers, Employees, and Contractors.
