WeMAR-kable Speakers Celebrate Their First Year June 17, 2009 brings smiles to the faces of the twenty four active members of the WeMAR‐kable Speakers Toastmasters Club. Their one year anniversary marks many accomplishments for these REALTORS® and WeMAR Affiliates. In their first year, they were awarded the Presidents Distinguished Club. This is the highest possible award given by Toastmasters International. Other accomplishments for this thriving group are:

It is hard to believe that we are almost to the end of summer 2009. As the year advances, it is becoming clear that our roles as REALTORS® are changing. We are faced with many challenges, with one of the most difficult being the negative influence of the media. As REALTORS®, we now must work more and make less. Consumers are more savvy, yet it seems everyone is having a difficult time making decisions and fearful of making the wrong one. We find it necessary to go back to real estate fundamentals and counter balance negative media. Recently, I was asked if I could do one thing to move the process along, what would it be? That was easy, “I would tell everyone to turn off their TV, turn off their radio and stop reading the newspaper and we could do what we do best – MOVE REAL ESTATE.” A few of the challenges we face today include short sales, foreclosures, bank ineptness, delays on transactions, and buyers trying to steal properties. To add to the mix, financing is harder to get, and ethics are becoming questionable. How many times have you tried to contact an agent who may be working part‐time and/or states in the Plano that they only want to be contacted by email or by text, and you still do not receive a response? What has happened to fiduciary responsibility? Is it any wonder that it is hard to keep focused and maintain a positive attitude. I had the privilege of attending the President’s Round Table Luncheon in March. It was obvious to me that the award recipients know what it takes to succeed in this economy. These top producers decided not to buy‐in to negative thinking. If we can keep a positive attitude and play nice with
our fellow agents, we may prove that 2009 is the year that REALTORS® can make a difference in our economy… for our clients… and in our communities.

For those of you who do not know me, I want to give you insight into my desire to serve you as a member of the Board of Directors. I first became a licensed REALTOR® in the State of Washington. In my years of activity there, I served on numerous committees for my local and state associations. This included two terms as local Board President. In addition to local and state positions, I was privileged to serve as Chairman of the State Political Affairs Committee for WAR.
Upon relocating to Arizona, I had pretty well made up my mind to “let someone else do it.” That changed after being exposed to the effective leadership and active committee members of the Glendale Board. I became involved and have never regretted it. I, again, have been privileged to serve on the Government Affairs Committee and become its’ Chairman thru three exciting and growing years. During this time, the Committee has been successful in many local arenas stopping and/or modifying local issues that affect both REALTORS® and private property rights. With the merger of the two associations, and the tremendous growth in our area, a new set of “marching orders” needed to be written for our Government Affairs KRA Committee. I am pleased to be a part of the group working to bring our strengths and resources together to effectively facilitate the monitoring and reacting to local government decisions in our area. Since a highly competent and qualified replacement for the Chairmanship of this committee has been secured, I feel it is time for me to serve on the Board of Directors of your Association.
If elected to this position, I will sit on the Board but not on my HANDS. I ask you to vote for Joe Aimone, Director for WeMAR.
*** From the beginning of my real estate career in 2000, I have been active in its community. My involvement launched in 2001, when I began coordinating the Southwest Tour for the Glendale Board. In December of 2002, I became the branch manager for a local real estate office, and obtained my broker’s license in 2004. I became broker/owner of a real estate company in January of 2007.
Although real estate kept me busy, I volunteered for the MLS Advisory Committee where I served for one year until I was asked to serve on the ARMLS Board of Directors from 2004 to 2006. As a Director, I was part of the team who's primary objective was to find a new tax vendor for our MLS system. When my term ended, I started my own real estate radio show, “Real Estate from A to Z”, airing once a week for the past 3 years. I volunteered again for the ARMLS Board of Directors in 2007. The following year, I achieved the office of Treasurer. In 2007, I was also elected to the WeMAR Board of Directors, where I presently serve. Currently, I volunteer on the Technical and Communications Committee for the Arizona Association of REALTORS® and will chair the committee in 2010. My commitment to AAR also includes 2 years of service on the Industry Partners Conference Committee.
With my industry and leadership experiences, and the relationships I have developed through my involvement in real estate, I believe I will best represent the needs and wants of my fellow REALTORS®. I would be honored to serve another term as one of your WeMAR Directors.

*** I am asking for your vote in the upcoming elections as Director for West Maricopa County Regional Association of REALTORS®.
As a REALTOR® since 1984, I have seen many similar problems we are having today. My past experiences have helped my understanding of current difficulties and allows me insight on how to help our members face them. My past two years on the Board of Directors have been eventful. The board has done an excellent job addressing many issues, managing the membership’s investments, and providing exceptional educational opportunities at no charge for the membership. I am proud to be a Director of the current board and look forward to continuing to serve our members.
Although my real estate career started in 1984, my love of the Valley of the Sun started long before that. I was raised in Avondale from the time I was two and was one of the first people to drive on the Black Canyon Freeway. I have witnessed the Valley’s explosive growth and have no doubt we will recover from today’s market.
I have been through the chairs of our local association and am a past president. I feel I have a lot to give with my experience and knowledge, and can be a key figure in directing the association towards our better future. Thank you for your time and your vote.

Rowdy Dawson
When it comes to understanding the bottom line, Rowdy is no stranger to big numbers. In fact, he set his pace in real estate sales between 1990 and 1995 as a significant multi‐million dollar producer. When he switched over to managing real estate teams in 1995, he had already experienced true success on the sales side, and understood the needs and desires of real estate sales agents first hand.
As a long‐time Arizona resident (since 1950), Rowdy first served in the U.S. Army from 1967 through 1970, achieving the rank of E4 Quartermaster. After returning home he decided to cut his teeth on sales in his first post‐military career as a Department Store Buyer/Purchasing Agent for Goldwater’s Department Store for 9 1/2 years, and then became a Mortgage Loan Officer from 1985 to 1990. But it would be in Real Estate that Rowdy would truly make his name.
Rowdy has served as the Branch Manager for a large real estate firm for several years, has served as a Designated REALTOR® for two large real estate companies in the Valley, has been a Certified Arizona Real Estate Trainer since 1999, is serving as an instructor in three real estate schools and two Arizona Boards of REALTORS®. He trains new agents on what it takes to be a REALTOR® in any market.
Rowdy loves his family, sports, puzzles, travel and watching his agents’ businesses grow as they apply the principles of success that are tried and true in his own career.

I have been active in WeMAR since I joined the association in January 2006. I soon became a member of the Government Affairs Key Results Area, now known as the Government Affairs and Public Policy Committee. Realizing the importance of this committee, I dedicated my efforts to leading this group as vice‐chairperson in 2007 and as committee chair in 2008.
During my tenure, we focused on increasing the committee’s active participant’s levels, incorporated new policies with the assistance of Roger Nelson and Liz Recchia, we began interaction with local municipalities to aid REALTORS® and the public in real estate related matters, and we recently added a government affairs consulting organization to strengthen our political voice.
In 2008, I was selected to become one of your three WeMAR Arizona Regional Multiple Listing Service Board Directors. I currently serve on the ARMLS Board of Directors and on the ARMLS Policy Committee. Throughout my time serving with ARMLS, I have been a dutiful Director and feel I have been a valuable asset, contributor and representative of my fellow REALTORS®.
It is my honor to participate in and represent WeMAR at various REALTOR® and association related functions. In 2007, I had the privilege of representing WeMAR at the National Association of REALTORS® Conference in Washington, DC as the Government Affairs Key Result Area Chairperson. Other contributions I made to WeMAR are instruction of Parliamentary Procedures in 2007, and I participated in both the 2007 and 2008 WeMAR Strategic Planning sessions.
My involvement in WeMAR, Government Affairs and ARMLS awards me with significant opportunities to represent association members and the REALTOR® community. It would be my pleasure to serve, on your behalf, as a 2010 – 2011 WeMAR Director.

I have been a REALTOR® since 2001, with focus of my business in residential resale. The most important thing to me is that my clients are satisfied with the result at the end of the process. I see my role as being the educator of my clients so that they can make informed decisions during the home buying and selling process.
In order to do my job well, it is imperative that I stay informed and educated about what is going on in our ever‐changing industry. I believe that continuing education and personal involvement in the organizations of our industry are the means to being the best possible real estate agent.
I joined the Women’s Council of REALTORS® in 2003 and almost immediately became the newsletter chair. This led to service in many positions in the Northwest Valley Chapter, including Vice‐President of Membership (2004) and President (2006). I am currently the acting President‐Elect for 2009. In addition to my work at the local chapter level, I have chaired committees at the Arizona State Chapter of WCR – Audit (2007), Team AZ (2008) and Bylaws (2009). It has been my privilege to attend numerous state and national meetings in my service to WCR.
As a Director of WeMAR, it is my goal to serve all members by staying on top of the current issues in our industry. I pledge to always be true to myself and express my beliefs. I will welcome input from the membership and do my best to bring your concerns, questions and requests to the attention of the Board of Directors.

Cynthia Marin
With seventeen years as a REALTOR®, GRI® and Associate Broker, combined with 25 years as a building contractor, I find the real estate profession and building industry to be very challenging and rewarding. It was my pleasure to have the opportunity to serve on the Board of Directors of the North Idaho Building Contractors Association (NIBCA), and have the honor to serve as President in 2006. I had the opportunity to serve Kootenai County (Idaho) as a Planning and Zoning Commissioner for 2006‐2007. During this tenure, the commission was charged with the revision of the County Comprehensive Plan along with other growth and development issues. The real estate business aligns us directly with the homeowner and their emotions from conceptual design through completion of the project or the closing of escrow. Buying and/or building a new home are emotionally charged events. Because of the roll we play in people’s lives, it is imperative that we as REALTORS® strive to expand our education, promote best business practices, and contagiously raise the bar of our professionalism. I am confident that my professional history, work ethics and goals are in parallel with that of our association. With a Master’s degree in Financial and Tax Planning (San Diego State University, 1998), I have worked as a Controller for several years in California and India. Real estate has always been of interest to me. After I moved to Arizona, I decided to make real estate my career. I have worked as a REALTOR® for over 4 years; I enjoy working with people, and helping them find their dream home or some good investment property. Recently, more of my time is spent helping people in foreclosure, showing them options available to stay in their homes and the various agencies that are ready to assist them. Beginning at an early age, volunteering has been my passion. I began as a Boy Scout, then Scout Master and volunteered for various community organizations as a member, secretary, and chairperson. The spirit of volunteering continued even after I moved to the United States. I have been and am presently involved in several community organizations, including food banks. This year, my goal is to be the recipient of the President’s Award. Being a Director in WeMAR will allow me to use my education and experience to help my fellow REALTORS®. I believe I have the qualifications and background to be able to contribute and make a difference to the association members.

The Government Relations Committee released a Request for Proposals for government relations and lobbying service in May. The committee received several responses and in‐terviewed each of the applicants. Mario E Diaz & Associates was selected. Mario E Diaz & Associates is a full‐service, bipartisan government relations and public affairs firm that was founded in 2001 by President, Mario E Diaz. Mario began his career working for such notable individuals as US Senator Dennis Deconcini, Congressman Ed Pastor and as the Law Enforcement Liaison for United States Attorney Janet Napolitano. The Janet Napolitano for Governor Committee was Mario E Diaz & Associate's first premier client. In 2002, Napolitano won her election and Mario was appointed to Governor‐Elect Napolitano’s Transition Team. He later served as Deputy Chief of Staff to Governor Napolitano. The firm also includes Lee Miller, Manny Tarango, Wendy Villa and Amanda Wright. Without a trace This group of REALTORS® lack an online presence. When you search their names on Google or Yahoo, their names turn up only on genealogy sites. They don’t have a website. They may have a web page on their broker’s site, but it only includes their name and phone number. Over 90 percent of all clients use the web when searching for a home. Sadly for this group of agents, their business will steadily decline as their client base shrinks from attrition and failure to attract the next generation of clients.
Follow me! There was a rather obnoxious, but funny spoof on YouTube about a woman who is addicted to using Twitter. http://www.youtube.com/watch?v=ALbH63Ali9U0 She does hundreds of tweets (posts on Twitter) each day detailing such events as walking her dog and making a sandwich. Her contribution to the online conversation is, “I like mayonnaise on my sandwiches. Do you like mayonnaise on your sandwiches?” Although it seems obvious that this is poor use of the social networking space, much of what posted on Twitter and other social networking sites falls into this category. If you are using social networking as part of your marketing plan, avoid posting a constant stream of updates about you and the trivial events in your life. If you don’t, your followers will soon be hitting the “unfollow” button.
Party animal Early adopters of MySpace and Facebook used these sites to keep up with their friends. A foolproof way to ruin your business is to post pictures of yourself playing the role of the party animal doing stupid pet tricks. If you use Facebook and Twitter for this purpose, it’s smart to set up two separate identities. Use one for your personal posts including family pictures or other personal data about what you are doing. Keep your business identity separate and professional. This also means that you must

carefully monitor both your own posts as well as what others post about you as well.
Blogger connect An interesting pattern among some bloggers is to be in conversation almost exclusively with other bloggers. While it may be great to have a high score on ActiveRain and interesting to be involved in agent‐to‐agent conversations, they often do little to develop relationships with potential clients. If you are not getting results from blogging, an important question to ask is whether your time would be better spent reaching out to your community rather than to other bloggers.
Lights on, nobody home Have you started and then abandoned a blog? Have you filled out a Facebook or LinkedIn profile and then never done anything else with it? While having a profile on major sites is important in terms of protecting your online identity, when younger clients see that you are not actively involved in the online conversation, they will move on to an agent who is.
Twammers “Twammers” probably isn’t a word yet. It refers to those who use Twitter to spam their marketing messages. Some companies are using “bots” to sign up with new users and to automatically send them messages. If you read Twitter on a regular basis, you will see that there is a tremendous backlash against this type of activity. People and companies who do this lose business. For companies who are doing posts on social networking sites, consumers respond well when there is a real person’s name connected to the post. For example, “[email protected]” will be much more effective at garnering responses as opposed to just using the company name.
Everyone has an online reputation. The question is how are you showing up online?
The younger your potential client is, the more likely they are to search you out on Google, Facebook, Twitter, and other social media sites. Today’s column takes a fun look at some of the ways that people are positioning themselves in the social media space.

Infotainers There was an interesting thread on Twitter during the middle of March. Guy Kawasaki is one of the most followed people on Twitter. Kawasaki, however, does not engage in the conversation by responding to other people’s tweets. A number of “Tweeple” (people on Twitter) elected not to follow him because of this. On the other hand, the information that he posts is often useful and entertaining.
Who will you be? What online persona will you choose? The smart move is to join groups that serve your community rather than having conversations exclusively with other REALTORS®. Remember, those born after 1964 will want to get to know you online. That means, they want to learn about what interests you, what roles you play in the community, as well as how you can potentially help them buy or sell real estate.

Help St. Mary’s Food Bank Alliance fulfill their mission of promoting the elimination of hunger through the gathering and distribution of food while encouraging self‐sufficiency through advocacy and education. Now more than ever before, more and more moms and dads are unable to provide for their families. Bountiful donations are received by local food banks during the holidays; however many times, the need for year round donations is forgotten. The Helping Hands—Helping Hearts division of the Member Benefits and Community Involvement Committee made our first donations to some terrific non‐profit organizations in April. Thanks to our WeMAR Members and Affiliates for your much appreciated donations. We were able to give to Maggie's Place, New Life Center, and Eve's Place.
When we delivered some of the donations to Maggie's Place at the Michael House, we were given a tour of their house and the opportunity to meet some of the "moms‐to‐be". It is a great home and we loved learning about their house and what they do. Maggie's Place is a community of homes that provide hospitality for pregnant
women that are alone or on the streets.
New Life Center and Eve's Place picked up their donations due to privacy related issues. New Life Center provides a temporary safe haven for families fleeing domestic violence. Eve's Place provides safety and empowerment based‐programs to victims of domestic violence.
These non‐profit organizations are still in great need of donations, especially with the heat of the summer. Please visit MaggiesPlace.org, newlifectr.org, and safetyatevesplace.org to see what these places are all about and what types of donations that they need the most.

The Ken Meade Greenway Office continues to help enhance the lives of those less fortunate. On March 21, 2009, the members of this Ken Meade office held their 3rd annual Greenway Rummage Sale in the rear parking lot of the office. This is just one of the several fundraising events Priscilla Richie’s team undertakes each year. From 8:00 – 1:00 PM, these REALTORS® proceeded to sell unused donated items from the 2008 REALTORS® Helping Seniors Day, and collected items from fellow REALTORS® and associates. Financial aid to homeowners installing energy‐saving devices is tax free, according to the new private letter ruling. Payments of up to $500 that a state makes to low and middle‐income homeowners to help them install energy efficient furnaces and boilers are not taxed as income and are not required to be listed on 1099 forms.

First‐time purchasers in 2009 can claim the homebuyer’s credit. IRS says privately, even if they get financing from tax‐exempt mortgage revenue bonds. This is not so for subsidized buyers in 2008 because they are stuck with a tighter set of rules.
This time around, first time homebuyers get a credit of up to $8,000 (or 10% of the purchase price, whichever is lower) if they buy a primary home from January 1—Dececember 1, 2009. They also can elect to claim this credit on their 2008 returns. To take this credit they would have to amend their 2008 tax return, but they would get a refund of $8,000 within six weeks rather than waiting to file in 2010. Unlike the 2008 law, this is a true credit and does not have to be paid back.
Real estate agents can claim a special tax break on their rental losses. Their rental real estate losses are exempt from the passive loss rules if they spend more than one‐half of their time and at least 750 hours per year materially involved in real estate, the Tax Court says. This is the identical rule that applies to landlords, developers and brokers. The IRS said that agents were not covered, but the Tax Court disagreed (Agarwal, TC Summ. OP 2009‐29). In this case, the agent who was audited was not licensed as a real estate broker.

Adding a co‐owner will not double the cap on deductible mortgage interest. The $1 million ceiling still applies to the mortgage, the IRS privately rules. The owner of a house with a mortgage over $1 million gave a percentage to the home to his live‐in friend and added her to the mortgage, making his share of the mortgage under $1 million. They made mortgage payments in proportion to their ownership, and both claimed a full deduction for their mortgage interest. IRS disagreed, saying the $1 million cap
applies to the mortgage, regardless of the number of borrowers. Therefore, if the mortgage was $1.5 million, two‐thirds of their interest ($1 million) would be deductible.

There is good news for the first time homebuyers who receive subsidized financing.
Sometimes the vandalism and parting gifts comes from the former owners. They may damage the house out of anger and frustration.
Squatters have been known to take up residence. Often, they come in non‐human forms. Wild animals and pests have been found including snakes, rats, mice, bees, termites, bats, skunks to name a few.
Mold is often found in these properties due to the deferred maintenance and undetected leaks.
Seller Property Disclosure Statements (SPDS) are a rare commodity for distressed proper‐ties. Much less is known about a home without them.
Short Sales, Pre‐foreclosures, Foreclosures, and REOs are the buzz words in today’s real estate market. Working with distressed properties has become an advantage to some and a big challenge for many. Courses on these subjects abound; and how to survive and succeed in this market are the topic on most real estate professionals’ minds.
Picture this‐you, the REALTOR®, have been working with the buyer to get him off the fence for months; visiting house after house; finally a decision is made; you put the offer in and then wait. Finally, it’s accepted. The buyer then says “we’re purchasing a house “as is” so why spend the money to have it inspected?” You, the REALTOR®, are thinking “great one less obstacle that could kill the deal.” Now what? Do you or don’t you have a home inspection? Foregoing an inspection is a bad move in a “normal” transaction but is riskier when dealing with distressed properties. Here are some reasons why all REALTORS® should encourage their clients to still have an inspection even if the property is being purchased “AS IS:” Now more than ever it’s “Buyer Beware.” As our buyer’s real estate professional, we too must have our eyes and ears open. Typically homes are sold “as is” and have very short inspection/due diligence timeframes. Yet, these properties often harbor unpleasant surprises that can be very costly for an uninformed or unprepared buyer. Some of the common issues include:
Deferred or neglected maintenance: if the home‐owners were having difficul‐ties paying their mortgage, they certainly will not be able to afford to properly maintain the major systems of the home. Even minor routine maintenance gets neglected. Systems can prematurely age due to neglect and can become even costlier to repair
than expected.
If the home has been vacant, often it has been broken into and vandalized.
AC units, copper wiring, appliances, electri‐cal fixtures and more have been stolen.
These conditions can often only be determined by an inspector who goes into an attic or other

The inspection process becomes essential to help lower the risk of costly unexpected repairs. The buyer can purchase the home with a greater knowledge and understanding of the property’s condition. Risk is reduced for all parties involved in the transaction. The REALTORS® involved are better protected against any future liability through the property disclosure provided by the home inspector. When selecting a home inspection company for your distressed prop‐erty inspection, there are several cautions and reminders for you and your clients. The question of cost for the inspection may come into play. Cheaper is usually not better in this area. Remember, in this situation particularly, experience is essential. A newer inspector may not have the level of knowledge and experience that is needed to determine the condition, issues and cost of repair on a distressed property. It’s also important to visit the AZ Board of Technical Registration website (www.btr.state.az.us) to be sure that the inspector has an active (AC) license with the state. Also, check to see if the inspector has full E & O insurance with indemnity for the REALTOR®. In summary, hiring a qualified home inspector prior to purchasing a distressed property is worth the investment to be sure that the bargain house is truly a bargain.
