IA/MH/IND2/36650/2013 dated 29 th December, 2015 along with project documents including Form I, Terms of References, Pre-feasibility Report, EIA/EMP Report along with Public Hearing Report regarding the above mentioned project. 2. The Ministry of Environment, Forest and Climate Change has examined the application. It is noted that the proposal is for Expansion of sugar capacity from 3500 TCD to 5000 TCD and establishment of 24 MW Co-Generation power plant at village & Tehsil Walwa, District - Sangli, Maharashtra by M/s Padmabhushan Krantiveer Dr. Nagnath Anna Nayakawadi Hutatma Kisan Ahir Sahakari Sakhar Karkhana Ltd. As informed and as per the documents submitted by the Project proponent (PP), the total area available with the factory is 26.0 Hectares. Out of which 8.667 Hectares will be used for green belt development. The total project cost is ? 196 Crores. It is reported that no national park/ wildlife sanctuary/ coral formation reserve is located within 10 km distance from the project site. River Krishna is flowing at a distance of 2.2 Km. The following is the configuration of the proposed unit: 3. All Sugar industry are listed at S.N. 5 (j) of Schedule of Environmental Impact Assessment (EIA) Notification under category 'B'. considered under Category 'A' and are appraised at Central Level by Expert Appraisal Committee (EAC).

4. The project proposal was considered by the Expert Appraisal Committee (Industry-2) i n its 1 1 t h meeting held during 26 t h and 27th August, 2013; 6 t h

meeting held dur ing 30 t h March to 0 2 n d April , 2016 and 14 t h meeting held during 26 t h -27 t h October, 2016. The Project Proponent and the accredited consultant M/s Water and waste water research Centre, Sangli (Dr. Subbarao's Environment Centre), gave a detailed presentation on the salient features of the project and proposed environmental protection measures to be undertaken, as per Terms of References (TORs) awarded in the 1 1 t h meeting of the EAC held during 26 t h and 27th August, 2013 for preparation of EIA-EMP report. The TOR has been issued vide Ministry's letter of even no. dated 14 t h November, 2013.

5. Public Hearing for the proposed project has been conducted by the Maharashtra Pollution Control Board on 26 t h August, 2015. The EAC has deliberated upon the issues raised during the public hearing. The concerns were raised regarding impact of wastewater discharge, ash management plan, water pollution control measures, etc. The EAC noted that the issues have satisfactorily been responded by the project proponent and incorporated in the final EIA-EMP report.

6. The PP received the Environmental Clearance vide File J - l 1011/661/2007-IA II(I) dated 17* September 2007 for establishing 30 KLPD Distillery, expansion of sugar factory capacity from 2500 TCD to 3500 TCD and establishing 18 MW cogeneration plant. Regional Office of Ministry at Nagpur vide letter dated 5-51/2007 (ENV)-759 dated 10.08.2016 has submitted the certified compliance report.

7. The PP has informed the EAC that the ambient air quality (AAQ) monitoring was carried out at 6 locations during December 2012-February 2013. The baseline data indicates that the ranges of concentrations as:- PM10 (34 )ug/m3 to 55 |jg/rri3), PM2.5 (12 ng/m3 to 20 Hg/m3), S02 (6 ng/m3 to 12 ug/m3) and NOx (10 Hg/m3 to 16 |ig/m3). AAQ modelling study for point source emissions indicates that the maximum incremental GLCs after the proposed project would be 60.77 |ig/m3 and 25.01 jjg/m.3 with respect to PM and NOx respectively. The resultant concentrations are wi th in the National Ambient Air Quality Standards (NAAQS).

8. The PP has confirmed to the EAC that Wet Scrubber system wil l be installed in the flue gas in order to reduce suspended particulate matter. However, the EAC suggested PP to install ESP having 99.9 % efficiency shall be provided as air pollution control equipment to meet emission standards. I t is proposed to have 1 No. of 140 TPH capacity Bagasse fired Boiler. Boiler shall be provided wi th a stack of 3500 mm dia. and 70 m. Height. The total water requirement for the expansion project of Sugar and Cogeneration is 3670 m 3/Day (i.e. Industr ial use - 3570 m3/day and Domestic - 100 m 3/day) and wi l l be drawn from Krishna River. The total quantity of waste water generated per day shall not exceed 1180 m 3/day. The domestic effluent of 30 m 3/day is treated in septic tanks followed by filters and used for irrigation/ gardening. Thus the process effluent of 440 cum/day only require treatment. The industry has already provided full fledged Effluent Treatment Plant facilities for 440 cum/day which would be adequate for the proposed sugar factory of the expanded capacity of 5000 TCD. media of anaerobic filter in ETP shall be replaced wi th plastic media to improve the efficiency of anaerobic filter. PP confirmed that they wil l spend 5 % of the project cost for Corporate social responsibility. As per the revised water balance chart submitted by the PP, the fresh water consumption dur ing the season wil l be 586.13 m 3/day and in the off season fresh water requirement wi l l be 492.55 m.3/day and effluent generation wil l be 494.20 Cum/day and 246.74 Cum/day during season and off season respectively.

9. The EAC, i n its 14* meeting held during 26 t h -27 t h October, 2016, has found that the final EIA/EMP report submitted by the PP is adequate. The EAC after detailed deliberations, on the basis of the information and presentation made by the PP, has recommended the project for environmental clearance wi th certain conditions.

10. Based on the proposal and information submitted by the Project Proponent, and based on the recommendation by the Expert Appraisal Committee (Industry-2), the Ministry of Environment, Forest and Climate Change hereby accords Environmental Clearance to the above project under the provisions of EIA Notification dated 14 t h September 2006, subject to the compliance of the following Specific and General Conditions:

A . S p e c i f i c C o n d i t i o n s :

i) ESP alongwith stack of adequate height shall be provided to bagasse fired boiler to control particulate emission wi th in 50mg/Nm 3 .

ii) An action taken note (duly certified by the'RO, MoEF&CC) on the non-complied points of Compliance Report of Regional Office, MoEF&CC dated 10* August, 2016 be submitted.

iii) Total fresh water requirement from Krishna River shall not exceed 3670 m 3/day dur ing season. No ground water shall be used.

iv) Water consumption also to be restricted to 100 liters / ton initially and further to 50 Liters/ton cane crushed in a time bound manner as per the CPCB guidelines.

v) Effluent generation shall not exceed 1180 m 3 /day during season. Effluent shall be treated in ETP treated and domestic waste water wi l l be treated i n STP only. ETP should be designed to treat the BOD upto 30 mg/lit of effluent standard even in case of land disposal.

vi) Process effluent/any wastewater shall not be allowed to mix w i th storm water. Storm water drain shall be passed through guard pond.

vii) Adequate numbers of ground water quality monitoring stations by providing piezometers around the project area and compost yard shall be set up. Sampling and trend analysis monitoring must be made on monthly a basis and report submitted to SPCB and this Ministry. The ground water quality monitoring for pH, BOD, COD, Chloride, Sulphate and total dissolved solids shall be monitored. Sampling and trend analysis monitoring must be made on monthly basis and report submitted to the Ministry's Regional Office at Nagpur and SPCB.

viii) Bagasse storage shall be done in such a way that i t does not get air borne or fly around due to wind.

ix) Boiler ash shall be stored separately as per CPCB guidelines so that i t shall not adversely affect the air quality, becoming air borne by wind or water regime during rainy season by flowing alongwith the storm water.

Direct exposure of workers to fly ash & dust shall be avoided. Bagasse ash shall be stored separately.

x) Fire fighting system shall be as per the norms and cover all areas where alcohol is produced, handled and stored. Provision of foam system for fire fighting shall be made to control fire from the alcohol storage tank. DMP shall be implemented.

xi) Occupational health surveillance programme shall be undertaken as regular exercise for all the employees. The first aid facilities in the occupational health centre shall be strengthened and the regular medical test records of each employee shall be maintained separately.

xii) Dedicated parking facility for loading and unloading of materials shall be provided in the factory premises. Unit shall develop and implement good traffic management system for their incoming and outgoing vehicles to avoid congestion on the public road.

xiii) As proposed, green belt over 33% of the total project area shall be developed wi th in plant premises w i th at least 10 meter wide green belt on all sides along the periphery of the project area, in downward direction, and along road sides etc. Selection of plant species shall be as per the CPCB guidelines in consultation wi th the DFO.

xiv) All the commitments made during the Public Hearing/Public Consultation meeting held on 26 t h August, 2015 shall be satisfactorily implemented and adequate budget provision shall be made accordingly.

xv) At least 5 % of the total cost of the project shall be earmarked towards the Enterprise Social Commitment (ESC) based on local needs and action plan wi th financial and physical breakup /details shall be prepared and submitted to the Ministry's Regional Office at Nagpur. Implementation of such program shall be ensured accordingly in a time bound manner.

xvi) Zero Liquid Discharge shall be ensured. xvii) Continuous online (24 x7) monitoring to be installed. Data to be

uploaded on company's website and provided to the respective RO of MEF&CC, CPCB and SPCB.

B . G e n e r a l C o n d i t i o n s :

i . The project authorities must strictly adhere to the stipulations made by the Maharashtra Pollution Control Board, State Government and any other statutory authority.

i i . No further expansion or modifications in the plant shall be carried out without prior approval of the Ministry of Environment, Forest and Climate Change. In case of deviations or alterations in the project proposal from those submitted to this Ministry for clearance, a fresh reference shall be made to the Ministry to assess the adequacy of conditions imposed and to add additional environmental protection measures required, i f any.

i i i . The locations of ambient air quality monitoring stations shall be decided in consultation wi th the State Pollution Control Board (SPCB) and it shall be ensured that at least one stations is installed in the upwind and downwind direction as well as where maximum ground level concentrations are anticipated.

iv. The National Ambient Air Quality Emission Standards issued by the Ministry vide G.S.R. No. 826(E) dated 16* November, 2009 shall be followed.

v. The overall noise levels in and around the plant area shall be kept well w i th in the standards by providing noise control measures including acoustic

hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels shall conform to the standards prescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time).

vi. The Company shall harvest rainwater from the roof tops of the buildings and storm water drains to recharge the ground water and use the same water for the process activities of the project to conserve fresh water.

vi i . Training shall be imparted to all employees on safety and health aspects of chemicals handling. Pre-employment and routine periodical medical examinations for all employees shall be undertaken on regular basis. Training to all employees on handling of chemicals shall be imparted.

vii i . The company shall also comply with all the environmental protection measures and safeguards proposed in the documents submitted to the Ministry. All the recommendations made in the EIA/EMP in respect of environmental management, risk mitigation measures and public hearing relating to the project shall be implemented.

ix. The company shall undertake all relevant measures for improving the socio­economic conditions of the surrounding area. CSR activities shall be undertaken by involving local villages and administration.

x. The company shall undertake eco-developmental measures including community welfare measures in the project area for the overall improvement of the environment.

xi . A separate Environmental Management Cell equipped wi th full fledged laboratory facilities shall be set up to carry out the Environmental Management and Monitoring functions.

x i i . The company shall earmark sufficient funds towards capital cost and recurring cost per annum to implement the conditions stipulated by the Ministry of Environment, Forest and Climate Change as well as the State Government along wi th the implementation schedule for all the conditions stipulated herein. The funds so earmarked for environment management/ pollution control measures shall not be diverted for any other purpose.

x i i i . A copy of the clearance letter shall be sent by the project proponent to concerned Panchayat, Zilla Parishad/Municipal Corporation, Urban local Body and the local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal.

xiv. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated Environmental Clearance conditions including results of monitored data (both in hard copies as well as by e-mail) to the respective Regional Office of MoEF&CC, the respective Zonal Office of CPCB and SPCB. A copy of Environmental Clearance and six monthly compliance status report shall be posted on the website of the company.

xv. The environmental statement for each financial year ending 3 1 s t March in Form-V as is mandated shall be submitted to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along wi th the status of compliance of environmental clearance conditions and shall also be sent to the respective Regional Offices of MoEF&CC by e-mail.

xvi. The project proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the SPCB/Committee and may also be seen at Website of the Ministry at http: / /moef.nic.in. This shall be

xv i i . The project au thor i t i e s sha l l i n f o rm the Regional Office as we l l as the M in i s t r y , the date of f inanc ia l c losure and f ina l approva l of the project by the concerned au thor i t i e s and the date of s tar t of the project.

11 . The M in i s t r y may revoke or suspend the clearance, i f imp lementa t i on of any of the above condi t ions is no t satisfactory.

12. The M in i s t r y reserves the r i gh t to st ipulate add i t i ona l condi t ions, i f f ound necessary. The company i n a t ime b o u n d manner w i l l imp l ement these condit ions.

13. The above condi t ions w i l l be enforced, i n t e r a l i a u n d e r the provis ions of the Water (Prevention & Contro l of Pollution) Act, 1974, A i r (Prevention &. Cont ro l of Water Pol lution) Act, 1 9 8 1 , the Env i r onment (Protection) Act, 1986, Hazardous Waste (Management, H a n d l i n g and T rans -boundary Movement) Rules, 2008 and the Publ ic L iab i l i t y Insurance Act, 1991 along w i t h the i r amendments and rules.
