TITLE 2. VOTER QUALIFICATIONS AND REGISTRATION

CHAPTER 11. QUALIFICATIONS AND REQUIREMENTS FOR VOTING

Sec. 11.001. ELIGIBILITY TO VOTE. (a) Except as otherwise provided

by law, to be eligible to vote in an election in this state, a person must:

(1) be a qualified voter as defined by Section 11.002 on the day

the person offers to vote;

(2) be a resident of the territory covered by the election for

the office or measure on which the person desires to vote; and

(3) satisfy all other requirements for voting prescribed by law

for the particular election.

(b) For a person who resides on property located in more than one

territory described by Subsection (a) (2), the person shall choose in which

territory the residence of the person is located.

Sec. 11.002. QUALIFIED VOTER. (a) In this code, "qualified voter"

means a person who:

(1) is 18 years of age or older;

(2) is a United States citizen;

(3) has not been determined by a final judgment of a court

exercising probate jurisdiction to be:

(A) totally mentally incapacitated; or

(B) partially mentally incapacitated without the right to

vote;

(4) has not been finally convicted of a felony or, if so

convicted, has:

(A) fully discharged the person's sentence, including any

term of incarceration, parole, or supervision, or completed a period of

probation ordered by any court; or

(B) been pardoned or otherwise released from the resulting

disability to vote;

(5) is a resident of this state; and

(6) is a registered voter.

(b) For purposes of Subsection (a) (4), a person is not considered to

have been finally convicted of an offense for which the criminal

proceedings are deferred without an adjudication of guilt.

Sec. 11.003. PLACE FOR VOTING. Except as otherwise provided by this

code, a person may vote only in the election precinct in which the person

resides.

Sec. 11.004. VOTING IN PRECINCT OF FORMER RESIDENCE. A registered

voter who changes residence to another election precinct in the same

county, if otherwise eligible, may vote a full ballot in the election

precinct of former residence until the voter's registration becomes

effective in the new precinct if the voter satisfies the residence

requirements prescribed by Section 63.0011 and submits a statement of

residence in accordance with that section.

the voter does not reside is permitted to vote by an election officer who

does not know of the erroneous registration, the votes for the offices and

measures on which the voter would have been eligible to vote in the voter's

precinct of residence are valid unless the voter intentionally gave false

information to procure the erroneous registration.

Cities Language Charter

Provision Arlington Charter does not contain a section addressing the recall of Council N/A

Carrollton The petition shall be signed by registered voters of the city equal in number to at

least thirty percent (30%) of the number of votes cast in the last regular municipal

election of the city, but in no event less than 500 such petitioners.

Article IX

Section 9.02

Fort Worth A petition signed by the qualified voters entitled to vote for a successor to the councilperson

sought to be removed, equal in number to at least twenty (20)

per centum of the entire number of persons entitled to vote for a successor to said

councilperson at said time

Chapter XIX

Section 1

Frisco Before the question of recall of such officer shall be submitted to the qualified voters of

the City, a petition demanding such question to be so submitted shall first be filed with

the person performing duties of City Secretary, which said petition must be signed by

qualified voters of the City of at least thirty percent (30%) of the number of votes cast at

the last regular mayoral election, or one hundred and fifty (150), whichever is greater.

Article VI

Section 6.02

Garland The petition must be signed by qualified voters entitled to vote for a successor to each

member sought to be removed, equal in number to twenty-five (25) percent of the number of

votes cast at the last regular municipal election for that office which is the subject of the

petition; provided, that not less than eight hundred (800) signatures shall be required in the

case of the Councilmembers and not less than two thousand (2,000) signatures shall be

required in the case of the Mayor.

Article XII

Section 8

Grand Prairie In order to demand a recall election the petition must be signed by registered voters in the

City of Grand Prairie equal in number to fifteen (15) per cent of the registered voters entitled

to vote for that council place, or forty (40) per cent of those who voted for that council place

in the last municipal election of councilmembers, whichever is greater

Irving A recall petition to be effective must be returned and filed with the city secretary within

forty-five (45) days after the filing of the affidavit about a council member in a single

member district or within sixty (60) days after the filing of the affidavit about a council

member in an at-large district, and must bear the signatures of qualified voters of the district

equal in number to at least 10 percent (10%) of those who were qualified voters for the

person sought to be removed on the date of the last regular municipal election.

Article VI

Section 1

Lewisville Before the question of recall of such officers shall be submitted to the qualified voters of the

city, a petition demanding such question to be so submitted shall first be filed with the person

performing the duties of city secretary; which said petition shall be signed by qualified voters

of the city equal in number to at least five percent (5%) of those who were qualified voters on

the date of the last regular municipal election.

Article 6

Section 6.02

McKinney The recall petition to be effective must be returned and filed with the City Secretary within

thirty (30) days after the filing of the affidavit required for initiative and referendum

petitions, and it must be signed by registered voters of the City equal in number to at least

twenty-five (25) percent of the total number of votes cast at the last regular municipal

election; provided, however, that the petition shall contain the signatures of at least fifteen

(15) percent of the qualified voters of the City and shall conform to the provisions of

initiative and referendum petitions. No petition papers shall be accepted as part of petition

unless it bears the signature of the City Secretary as required in initiative and referendum

petitions.

Chapter XVIII

Section 145

Mesquite A recall petition to be effective must be returned and filed with the secretary within thirty

(30) days after the filing of the affidavit, must bear the signatures of qualified voters of the

city equal in number to at least forty (40) percent of those who were qualified voters on the

date of the last regular municipal election, and at least one-half of the qualified voters voting

for the person to be recalled constituting such forty (40) percent signing the petition shall

make affidavit, to be filed with the petition, to the effect that they voted for the person whose

recall is sought at the election at which he was last chosen

Plano Before the question of recall of such officer shall be submitted to the qualified voters of the

city, a petition demanding such question to be so submitted shall first be filed with the person

performing the duties of city secretary; which said petition shall be signed by qualified voters

of the city equal in number to at least thirty (30) per cent of the number of votes cast at the

regular municipal election of the city, but in no event less than one hundred fifty (150) such

petitioners.

Richardson The petition shall be signed by qualified voters equal in number to at least ten (10) percent of

the total number of qualified voters on the date of the last regular municipal election of the

city.
