Action Requested
● ADOPT Resolution R-18-108; and ● Execute County Deed to release 1.14 acres of County owned land to Gateway Commons of Manatee,
LLC, and Gateway Commons East, LLC; and ● Accept Warranty Deed from Gateway Commons of Manatee, LLC, and Gateway Commons East, LLC;
and ● Accept Stormwater Drainage Easement granting the County new stormwater discharge for the future
buildout of Buffalo Road.
Enabling/Regulating Authority Section 125.37, Florida Statutes, Exchange of County Property Background Discussion
● The Public Works Department and the Property Management Department recommend that the County exchange real property with Gateway Commons of Manatee, LLC, and Gateway Commons East, LLC.
● In July 2017, the Board executed The Agreement for Relocation and Improvement of Buffalo Road/Moccasin Wallow Road with the Developer to improve the intersection at Buffalo Road and Moccasin Wallow Road.
● The Developer is building a new shopping center known as Imperial Lakes Commercial that is adjacent to the intersection of Buffalo Road and Moccasin Wallow Road. The Developer and the County have agreed that the relocation of Buffalo Road and certain intersection improvements will benefit the Developer's project and the greater community by improving the traffic circulation.
● In April 2018, the Developer received final site plan approval and requests that the formal exchange of

property occur per agreement. ● In the exchange, the Developer will convey a new Right-of-Way and the County will convey real
property that is not needed for County purposes. The Developer will also dedicate a Stormwater Drainage Easement granting the County new stormwater discharge for the future build out of Buffalo Road. The County shall have the right to modify this easement area for expansion of the pond to receive additional future stormwater if needed.
● The Developer will be responsible for the cost associated with design, permitting, construction, and continued maintenance of the stormwater pond.
● The subject Resolution, Deed, and Stormwater Drainage Easement documents have been reviewed by the County Attorney and are legally sufficient. The Developer's legal counsel has approved the County Attorney's recommended changes to these documents as well.
● A Notice of Exchange of County Property was published once a week for two (2) weeks in accordance with Florida Statute 125.37.
