A Phase I ESA Is:
Provides the “innocent landowner” defense from CERCLA liability to purchasers who perform “All Appropriate Inquiry”
A Phase I ESA:
• Intrusive investigation (borings)
• Collection or analysis of samples
• Evaluation for asbestos, LBP, wetlands, or other non-ASTM issues
A Phase I ESA Is NOT:
The presence or likely presence of any hazardous substance or petroleum product under conditions that indicate an existing release, a past release, or a material threat of a release.
Does not include de minimis conditions that do not present a threat to human health or the environment.
