Mayor Vinis opened the February 21, 2017, meeting of the Eugene City Council.

A. EXECUTIVE SESSION: Pursuant to ORS 192.660(2)(h)

The City Council met in an executive session pursuant to ORS 192.660(2)(h).

B. WORK SESSION: Renter Protections

Grants Manager Stephanie Jennings gave a PowerPoint presentation providing an overview of Eugene’s rental housing market, conditions and trends; existing goals, local policies, and programs that affect renters; and identified priority policy areas for further exploration and next steps.

Council discussion: • More information requested on rental versus owner-occupied housing with the removal of

student housing. • Goal is to stabilize housing and reduce impacts of market forces.• People without stable housing can’t contribute to their own economic and social success.• City has an obligation to find ways to support those in nonsubsidised affordable units.• Those who spend more than 50% of income on housing can’t contribute to local economy.• Suggest developing a list of potential action items to help renters.• Greater details on emerging issues and gaps in protection are needed.• Explore exactly what students represent as percentage of the population in Eugene.• Local conditions disproportionate with the national average; encourage more home

ownership.• Interested in incentives and programs to expand workforce or middle housing.• Interested in exploring a residential MUPTE.• List of the bills in the legislature that are related to this issue requested.• Concerned about older housing stock and the owners who don’t have resources for upgrades.• Critical to protect renters’ rights now with low-cost housing stock and a 90-day no cause

eviction policy.• Investigate possible rent control based on percentages at a given time.• Home ownership is a significant stabilizing element; more opportunities needed.

Mayor Vinis opened the February 22, 2017, meeting of the Eugene City Council.

1. ACTION: Resolution Supporting Allocation of Lottery Backed Bond Funds to the EugeneCivic Alliance

Motion on the table from February 21, 2017: MOTION: Councilor Zelenka, seconded by Councilor Syrett, moved to adopt Resolution 5184 supporting allocation of $6,000,000 in lottery backed bond funds to the Eugene Civic Alliance for development of a community sports and recreation facility on the former Civic Stadium property.

MOTION TO AMEND AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to (a) amend the title of the Resolution so that it reads as follows: A resolution supporting Eugene Civic Alliance’s proposal and efforts to seek State funding and private funding to support revitalization of the former Civic Stadium site and (b) amend Section 1 of the Resolution, add Sections 2 and 3, and renumber Section 2 to Section 4, so that those sections read as presented. FAILED 3:4, Councilors Poling, Clark, and Pryor voted in support. (Councilor Evans was absent for the vote.)

Council discussion: • Outstanding proposal, but concerned about using lottery-backed funds.• Amount requested is unprecedented; potential unknown conflicts may arise.• Proposal is in line with support from Board of Commissioners and Mayor Lundberg.• Support proposal of it has no impacts on to local efforts for funding.• Proposal may have a significant economic development benefit.• City Manager and IGR Committee will have direct contact with lobbyist to help and track.• Not concerned about competing with other local economic development dollars.

MOTION TO AMEND AND VOTE with friendly: Councilor Semple, seconded by Councilor Zelenka, moved that at the end of Section 1 before the period after the word resolution, the following words are added: provided that the current video lottery proceeds for local economic development are maintained. Add a new Section 2, which would read, the City Council directs the City Manager to send a copy of this Resolution to Governor Kate Brown and the local State legislative delegation, and what had been Section 2 is renumbered to Section 3. PASSED 6:1, Councilor Taylor opposed. (Councilor Evans was absent for the vote.)

2. WORK SESSION: Report from Ad Hoc Committee Outcomes

City Manager’s Office Division Manager Mia Cariaga, Policy Systems Analyst Jason Dedrick, and City Attorney Glenn Klein, gave an overview of the Ad Hoc Committee work, primary outcomes that could be accomplished by an ordinance, and an overview of the legal framework.

Council discussion:

• In favor of a robust justice system, but want to protect non-criminal immigrants. • Government should concern itself with actions not beliefs; collection of data on beliefs is

wrong. • Current immigration system is biased and myths about immigrants are false. • Immigrants deserve to be treated with respect; movement against immigrants based in racism. • An ordinance would still remain in place if the state law was repealed. • Appreciate the committee and the hard work done to craft language for an ordinance. • Ordinance is a due process that provides protections and defends all people. • More information on unintended outcomes would be helpful. • Proposal reaffirms our long standing local and state laws and codifies it to protect people. • Support strategy to not reference “Sanctuary City” in the ordinance. • Concerns about operational aspects of providing additional protections are relevant. • Cities should not do the job of the federal government. • Focus on what the legislation does, not what it is called; provide protections effectively. • Information on which of the direct program funds are mandated requested.

MOTION AND VOTE: Councilor Zelenka, seconded by Councilor Clark, moved to direct the city manager to bring back to Council a proposed ordinance that (a) adopts the provisions of ORS 181A.820 and 181A.250 related to law enfacement personnel, (b) expands the applicability of ORS 181A.820 to cover all other city employees, and (c) prohibits all other city employees from collecting or maintaining information about the political, religious or social views of individuals. PASSED 8:0

Mayor Vinis opened the February 27, 2017, meeting of the Eugene City Council.

A. Committee Reports and Items of Interest from Mayor, City Council, and City Manager

Council discussion: • Complaints received about religious banners over the streets; separation of church and state issue.• Fairmount Neighbors concerned about short-term rentals and potential regulations.• As world championships approach, short-term rentals could become a bigger issue; keep on

council’s radar.• The Poverty and Homeless Board has the creation of a permanent shelter as part of its strategic

plan.

B. WORK SESSION: An Ordinance Concerning Long Range Transportation Planning

Transportation Planning Manager Rob Inerfeld gave an overview of the Transportation System Plan, public process, and the changes made in response to the recommendations by the Planning Commission.

Council discussion: • Concerned with proposal to lower intersection classification; better growth planning needed.• Changing the standards will make it more expensive for builders to densify to extent desired.• Building to address growth is impractical; better communication needed.• Plan is a balancing act; should focus on limiting impacts on neighborhoods.• Going from a D to an E classification may affect travel times a little; but will offer other benefits.• Important to incorporate TDM more aggressively into the TSP to address climate impacts.• Focus on multi-modal transportation is good; incorporates Vision Zero and CRO goals.• More information needed on how the TSP is affected by the CRO and how it helps meet goals.• Clarity needed on how and where public investments are being made to address demand.• Transportation Demand Management should be the first thing we do and focus on.• Need to analyze what the future trends on transportation will be to help with planning.• More information requested on potential impacts of the lower classification on CO2 emissions.

MOTION AND VOTE: Councilor Zelenka, seconded by Councilor Evans, moved to extend the meeting 5 minutes. PASSED 5:4, Councilors Zelenka, Evans, Syrett, and Pryor in support. Mayor Vinis broke the tie in favor.

Jennifer Frenzer-Knowlton –Human Rights Commission supports Sanctuary City designation, rest stops. 2. Ian Curtis – Spoke about the dangers of climate change locally and nationally. 3. Robin Bloomgarden – Supported removal of the sunset date for rest stops and adding more rest stops. 4. Michael Carrigan – Supported removal of the sunset date for the rest stops and adding more rest stops. 5. Anya Dobrowolski – Said Eugene has a lack of housing options and supported middle housing options. 6. David Wade – Supported removal of certain R-1 requirements to help with tiny homes. 7. Dave Lemmon – Concerned about displacement of homeless; supported more efforts for homeless. 8. Jim Neu – Supported the resolution banning oil by rail in Eugene; look into House Bill 2131. 9. Council discussion: • Testimony from Whiteaker residents moving; raises concerns about consequences of

displacement. • Lack of enforcement in the free speech plaza concerning; a work session on creating a public

shelter should be scheduled soon. • Better enforcement of the laws needed; lack of jail beds and prosecution is an issue. • A comprehensive plan for safety for the entire community is warranted. • A public shelter would be the most expensive option to address issues; more practical options

needed. • Testimony appropriately focused on criminal behaviors rather than on homelessness.

MOTION AND VOTE: Councilor Zelenka, seconded by Councilor Clark, moved to adopt Council Bill 5166, an ordinance adopting hazardous substance user fees for the fiscal year commencing July 1, 2017. PASSED 8:0

4. ACTION: An Ordinance Removing the Sunset Dates of the Rest Stop and Dusk-to-Dawn Programs

MOTION AND VOTE: Councilor Zelenka, seconded by Councilor Clark, moved to adopt Council Bill 5168, an ordinance removing the sunset dates of the rest stop and Dusk-to-Dawn programs. PASSED 8:0

Council discussion:

• An additional a work session to discuss expansion of these programs is needed. • Rest stops have proven they are worthwhile and help many people. • Neighborhood leaders for every area should work with rest stop organizers on siting.

Public Works Engineering Team Leader Jennifer Wiler gave a brief update on the annual report on the 2016 implementation on the bond measure, Street Review Repair Panel annual report, and 2017 pavement management report.

Council discussion: • Impressed and pleased with progress, especially the bike/ped options.• Support another bond measure to continue work.• Thankful for staff and citizen volunteers; citizens can be proud of what has been done.• Would like to look into adding an increase to the maintenance overlay fund.• Success was due to the specific list of projects, review panel and auditor; great model to use.• Would like to increase portion for bike/ped projects in a new bond.• Consideration of railroad quiet zone outside urban renewal district should be added.• Need to ensure stable operations and maintenance budget to help eliminate bonds.• Ice storm repairs should also be considered and factored into future needs.• Inspired by new techniques on fixing roads; helps with climate goals.

C. WORK SESSION: Commercial Setback Code Requirements for Downtown

Associate Planner Zach Galloway gave a PowerPoint presentation discussing downtown within the community vision; existing standards and available tools, walkable streets, landscaping, and current projects.

dog prohibition. • Two-way streets are move lively that one-way streets; look into converting 6th and 7th. • MUPTE should have requirements on planting, sidewalks and desired outcomes. • Look into ground floor use requirements such as retail to avoid another Capstone. • Over-regulating how to build out property may make development too expensive. • Interested in seeing design books used at the beginning of the development process.

Council discussion: • Concerned about to what degree council should regulate commerce or competition.• Valuable to talk about protections for schools from a policy standpoint.• Compelling need would be established if the whole community wanted it.• Proposed criteria for exemptions are valuable; fair, clear and workable.• Other cities do not have a 1,000 ft. zone requirement.• Treat marijuana business like any other business; State has rigorous regulations in place.• Unfair to compare them to other businesses as the City already taxes them.• Market will determine who succeeds; not supportive of buffer zones from daycare centers.

Management Analyst Joann Eppli gave a brief summary of House Bill 2669 related to Toxics Right-To-Know fees and its potential effects on local programs.

Council discussion: • Proposed legislation changes fee structure; hesitant to support.• Legislation does not obligate City to raise or change its fee structure.• Community supports this program; but, how much more regulation is desired?• Need to look at appropriate amount versus the maximum collection potential.• Needs to be as easy and burden free as possible to comply.• Greater protection from harmful toxins should be extended statewide.• Proposal will open the door for other communities to do replicate Eugene’s

program.

ISSUE STATEMENT This is a routine item to approve City Council Tentative Working Agenda.

BACKGROUND On July 31, 2000, the City Council held a process session and discussed the Operating Agreements. Section 2, notes in part that, “The City Manager shall recommend monthly to the council which items should be placed on the council agenda. This recommendation shall be placed on the consent calendar at the regular City Council meetings (regular meetings are those meetings held on the second and fourth Monday of each month in the Council Chamber). If the recommendation contained in the consent calendar is approved, the items shall be brought before the council on a future agenda. If there are concerns about an item, the item may be pulled from the consent calendar at the request of any councilor or the Mayor. A vote shall occur to determine if the item should be included as future council business.” Scheduling of this item is in accordance with the Council Operating Agreements.

COUNCIL OPTIONS The council may choose to approve, amend or not approve the tentative agenda.
