The Agencies/Contractors should fulfill the following
requirements
1. The Contractors having annual turnover of Rs. 25,04,450/- and
above, continuously during the preceding 3
financial years (2015-16,2016-17 & 2017-18) holding valid
registration and licence under Contract Labour
(Regulation & Abolition) Act, 1970; ESI Act 1948 and EPF Act
1952 and having GST registration and have
undertaken/executed One/two/three similar works (providing
housekeeping service) each in a single contract
of 1 year duration within last three years as follows:-
One Contract of value 80% of the estimated cost i.e. 62,61,126/-
Rs.50,08,900/-
Two Contracts of Value 50% of the estimated cost i.e.
62,61,126/- Rs. 31,30,563/-
Three Contracts of Value 40% of the estimated cost i.e.
62,61,126/- Rs. 25,04,450/-
2. In case the contract prevailed for duration more than one
year, the average value of work done in a year may
be worked out accordingly. The contract for duration of less
than one year shall not be considered.
1. Prospective tenderers are advised to get registered
themselves at NIC CPP portal, obtain ‘Login ID & ‘Password’ and
go through the instructions available in the Home Page after loging
into the CPP- portal parallel which is essentially required for
submission of their tender.

2. The tenderer shall be required to submit the bids in two bids
system and a hard copy of tender shall not be entertained in that
case.
For information, window NIT is also available in website
http://www.etenders.gov.in & www.nio.org Interested and
eligible contractors may download and go through the tender
document.
3. Evaluation of Tenders - For evaluation of bids under this
contract, the lowest tenderer (L-1) will be decided keeping in view
the component of profit margin in the form of Service Charges
quoted by the prospective bidders, as the Contractor is liable to
pay minimum wages (as notified by Govt. of Goa/Govt of India which
is higher) plus the Statutory taxes / dues like ESI, EPF, Bonus,
etc and GST as applicable. In case, the Service Charges quoted by
two or more agencies are equal, L1 will be decided based on highest
turnover (Average of 3 years), as described in Annexure-A, as
submitted by the bidders in a separate sheet.
4. Tenderers must ensure that all the uploaded documents should
be of quality. Vague/poor quality of printed documents and
incomplete documents will not be accepted.
5. The tenderers must note if a firm quotes NIL
charges/consideration, the bid shall be treated as unresponsive and
will not be considered. L-1 will be decided keeping in view the
component of profit margin in the form of service charges quoted by
the prospective bidders, as the Contractor is liable to pay minimum
wages as fixed by Central Government or State Government, whichever
is higher, plus the statutory dues like ESI, EPF, Bonus. Service
Tax etc.
6. The Successful bidder, after getting the LOI (letter of
intent), has to sign in each and every page of contract documents
(hard copies) with date and seal downloaded from
https://etenders.gov.in.
7. The Director, CSIR-NIO reserve the right to disallow issue of
tender document to working agencies whose
ongoing performance is below par and usually poor.e.g invoking
of penalty clause/notice issues for non- compliance of terms and
conditions of agreement and any other irregularities in execution
of contract He also reserves the right to verify the credentials
submitted by the agency at any stage (before or after the award of
work). If at any stage, any information/documents submitted by the
tenders is found to be incorrect/false or have some discrepancy
which disqualifies the contractor then the following action will
taken :
a) Forfeit the entire amount of EMD submitted by the firm. b)
The agency shall be liable for debarment from tendering in
CSIR-NIO, apart from any other appropriate
contractual/legal action. The Director, CSIR-NIO reserves the
right of accepting or rejecting any or all tenders or any part
thereof without assigning any reason.

(A) Eligibility Criteria for Technical Qualification:

11 Financial e- bid through CPP portal:-: (Envelope-II) 12 All
rates shall be quoted in the format provided and no other format is
acceptable. If the price bid has been given as standard BOQ format
with the tender document, then the same to be downloaded and to be
filled by the bidders. Bidders are required to download the BOQ
file is open it and complete the unprotected cells with their
financial quotes and other details (such as name of the bidder) No
other cells should be changed/tempered. Once the details have been
completed; the bidder should save it and submit online, without
changing the file name. If the BOQ file is found to be modified or
tampered by the bidder, the bid will be rejected.
The rates to be quoted should be in the prescribed format as per
ANNEXURE –I and should be valid for
period of 90 days Interim enquiries will not be entertained. The
contractor will be required to provide housekeeping services at
CSIR-NIO Dona Paula- Goa the
minimum wages rate will be applicable. The Director, NIO,
reserves the right to accept or reject any or all the tenders
either in full or part thereof
without assigning any reason whatsoever, and his decision on all

GENERAL TERMS AND CONDITIONS
The Director, National Institute of Oceanography, Dona Paula,
Goa (a constituent institute of the Council of Scientific &
Industrial Research, New Delhi), invites competitive offers from
Agencies/Contractors for providing “ANNUAL HOUSEKEEPING (SCHEDULED
EMPLOYMENT & SWEEPING AND CLEANING ) WORKS AT NIO, DONA PAULA –
GOA. NOTE. The tenderer shall not be permitted to tender in the
concerned unit of CSIR i.e. NIO in which his/her relative is posted
in a supervisory capacity. He shall also intimate the names of
persons who are working with him in any capacity or subsequently
employed by him and who relatives are as defined below. The
tenderer should not be related to any of the staff members working,
posted in a supervisory capacity in the tendering unit of CSIR , in
this case National Institute of Oceanography. The tenderer is also
required to furnish the information regarding the ex-employee of
NIO if has been subsequently employed by them. A declaration in
this regard will have to be furnished along with the tender. The
definition of the word “relative” is defined as below:- NOTE:- A
person shall be deemed to be relative of another if, and only if
(a) they are members of a Hindu undivided family, or (b) they are
husband and wife, or (c) the one is related to the other in the
following manner. Father, mother (including step mother) son
(including step son), son’s wife, daughter (including step
daughter) father’s father, son’s son, son’s wife, son’s daughter,
son’s daughter husband, daughter’s son, daughter’s son’s wife,
daughter’s daughter, daughter’s daughter’s husband, brother
(including step brother), brother’s wife, sister (including step*
sister), sister’s husband.
1. The tenderer submitting tender would be deemed to have
inspected the premises, considered and
accepted all the terms and conditions of contract. The areas are
purely approximate and likely to vary on either side up to any
limit. NIO through its officers, reserves the right of altering the
specifications of work of adding to or omitting any items of work
or of having portions of the same carried out in the institute by
others and such alterations and variations shall not violate this
contract.
2. The Contractor is required to have a valid Labour License
issued by the Regional Labour Commissioner
and comply with the provisions of the Contract Labour
(Regulation and Abolition) Act 1970 and rules made there under.
3. No verbal or written enquiries will be entertained in respect
of acceptance or rejection of the tender. Any
action on the part of the tenderer to influence any officer of
the NIO or canvassing in any form shall make the tender liable for
rejection. The Director, NIO reserves the right to cancel or reject
in full or part any or all tenders received, without assigning any
reasons.

4. Before signing the agreement, the contractor shall deposit 5
% biennial value of the contract as Security Deposit in the form of
Bank Guarantee in favour of The Director, CSIR-NIO which would be
released on expiry / termination of the contract and completing all
contractual obligations.
5. On award of contract the contractor will have to provide the
required manpower 26 (Twenty Six Nos.) at
NIO Hq Goa having sound health and who are within the age group
of 18 years to 60 years. The personnel engaged and posted at NIO
should be able to read/ talk/ understand Konkani, Hindi and
Marathi. The contractor shall be personally responsible for the
conduct of his workers deployed in the institute and in case of any
complaint against the workers the contractor will be under an
obligation to change the worker concerned when instructed by NIO
authority. The contractor & his staff shall follow the
instructions issued from time-to-time. The NIO will be free to take
action against the contractor for violating the same.
6. The contractor shall abide by all laws and regulations and
statutory obligations in force from time to time
including labour laws and shall indemnify the NIO from any
claims in this regard. It will be the sole responsibility of the
contractor to abide by the provisions of Employment of Children
Act, Worker’s Compensation Act, Employment and Labour / Contract
Labour Act, Industrial Employment Act, Contract Labour (Regulations
and Abolition Act) 1970, Minimum Wages Act, 1948, Employees
Provident Fund, ESI Fund, any other act or legislation, which may
govern the nature of the contract.
7. The contract will be for a period of TWO YEARS from the date
of operation of the contract. Normally the
contract will not be extended but in case of certain
circumstances, it may be extended for shorter period of time on the
same existing conditions mutually agreed basis.
8. Time is the essence of this contract. In case the contractor
fails in fulfilling the obligations fully and in time, the NIO
shall have the absolute right to take up the work at the
Contractor’s cost and risk and recover any and all such expenses
from the amounts due to him including Security Deposit. NIO shall
have right to impose penalty commensurate with the fault and amount
towards damages, if any, shall be recovered from the bill. In the
event of the contractor failing to execute the contract awarded to
him for NIO premises in whole or in part, an alternative
arrangement will be made by the NIO totally at the cost & risk
of contractor besides suitable penalty.
9. The contractor should note that under no circumstances the
contract is transferable i.e. on award of contract; he shall not
transfer, assign or sublet the contract. In the event of non
compliance the contract will be immediately terminated entailing
forfeiture of EMD.
10. The contractor must have a well established office at Goa
and the details such as complete address,
telephone number, both mobile and land line, furnished to NIO,
to enable the office to contact the authorized person during
emergency and as when required. Further the contractor may note
that all the correspondence posted to him at the address furnished
to the office will be considered to have been delivered in
time.

11. The contractor on award of contract should maintain a
register as per the Labour Department Format furnishing the Name,
Address, Character Certificate, Latest Photograph, Telephone Number
of the contract personnel engaged by him and posted at NIO. This
register completed in all respects furnishing the above
requirements should be handed over to the officer appointed by
office within 15 days from the date of award of contract. Any
change in respect of the above details should be informed
immediately to office. He must submit all the documents as directed
by the labour departemt.
12. The contractor should maintain duty register in the format
approved/issued by labour department
furnishing the details of attendance which is required to be
signed by the workers deployed at NIO, while reporting for duty in
the morning and in the evening at the time of departure from office
on all working days. The register should be made available for
inspection to the authorized representative of the Director
whenever called for.
13. The rates as quoted by the contractor in the tender based on
which the contract has been awarded will be applicable for entire
period of the contract and the contractor will not make any claim
for additional charges under any circumstances unless any revision
is notified by the appropriate Government Authority in the Minimum
wages and other related statutory benefits. He shall make payment
to his labourers as per the Minimum Wages Act. In case of any
default in this regard it shall be sole responsibility of the
contractor to meet the obligations under the Act.
14. The contractor should see that the workers deployed for
housing (scheduled employment & sweeping & cleaning )work
are present in the premises and carry out duty for entire eight
hours excluding meals/tea hours in shifts to attend to the duties
assigned by the office. They should maintain highest discipline and
behave politely in proper manner with the office staff and
guests.
15. On award of contract, the contractor is required to execute
all works as per detailed specifications,
requirements and as directed by an officer nominated by the
Director, NIO. He is required to guide the workers for proper
execution of the work as per the directions of the Officer
nominated by the Director. He is required to post authorized
representative at the site who should be available on all working
days during the office hours to receive the instructions from the
Officer nominated by Director from time to time. Schedule of work
carried out in the areas of work as well as daily checks should be
prepared and maintained and produced as and when required/asked by
the office. All such instructions both verbal/written
given/received by the authorized representative on behalf of the
contractor shall be deemed to have been received by the contractor
within the scope of work order.
16. Verification report from the concerned police station in
respect of all the workers deployed at NIO by
the contractor should be submitted within a period of one month
to the NIO authorities from the day of award of contract. Similarly
fitness certificate from AMO should be obtained and submitted to
office. Each worker should be issued I.D. Card with instructions to
display the same by the worker while performing duty at the
institute
17. The contractor is required to provide 2 (TWO) sets of
uniform to the workers deployed at NIO (both male and female) which
should be approved by NIO along with one pair of Safety Shoes,
Gloves, and raincoat .

18. On award of contract if it is observed that the quality of
work is not satisfactory , the contract may be terminated and
security deposit will be forfeited. Also during the period of the
agreement the contract may be terminated by the Director, NIO if it
is found that continuation of the contract is not in Public
Interest by giving one calendar month’s notice and the contractor
is not eligible for any compensation or claim in the event of such
cancellation. Also if at any later date it is found that the
documents submitted by the contractor at the time of award of
contract are manipulated/forged, the work order issued will be
cancelled and security deposit will be forfeited without any claim
whatsoever on NIO and the contractor is liable for action as
appropriate under the extent laws. In case the contractor is not
interested in carrying on with the contract he is required to give
a written notice to the office. Further, if the work undertaken is
of inferior quality and proper action is not taken at the time of
execution of work, the contractor shall remain liable to pay
compensation to the institute for the inferior work as determined
by NIO and in the event all payments have been released to the
contractor for the work already undertaken, the amount towards
compensation will be deducted from any sum due/security deposit/EMD
to the contractor.
19. The contractor shall remove all workers deployed by him on
termination of the contract or on expiry of
the contract from the NIO premises, and ensure that no such
person shall create any disruption/hindrance/problem of any nature
in the institute either explicitly or implicitly.
20. The contractor should ensure payment of wages to the workers
deployed at NIO, strictly as per the provisions of the “Minimum
Wages Act” – 1948 and adhere to the provisions of contract labour
(Regulation & Abolition)_ Act 1970, contract labour (Regulation
& Abolition) Rules 1971. The wages of the workers should be
credited to the respective individuals bank account on or before

th of every month.
21. The monthly pre-receipted bill in duplicate drawn in favor
of the Director, NIO, towards the labour
provided should be submitted to office for reimbursement along
with EPF, ESI remittance challans for the month the reimbursement
bill pertains, specifying the names and number allotted to the
labourers deputed at NIO by the concerned authorities commencing
the second month of award of contract.. The bill should be
submitted to the officer appointed by the Director, for
verification. In case of any delay in the part of the office in
processing the monthly reimbursement bill, the contractor is
required to ensure the payment of wages to his workers deployed at
NIO, are credited to respective individuals bank account, by 7
th of every month and there should be no linkage between the
disbursement of wages and
settlement of the bill submitted to the office.
22. GST and TDS and other statutory levies as applicable from
time to time will be deducted from the monthly bills of the
contractor as per the approved government rates
23. The contractor shall furnish an Indemnity bond at his own
cost to indemnify NIO against any claim arising out of or connected
with this contract. The contractor shall indemnify the institute
against all claims out of action under the Employees State
Insurance Act, Employees Provident Fund & Miscellaneous
Provision Act, or the Workmen’s Compensation Act or any other Civil
or Criminal Law in force in so far or they related to the contract
personnel employed by him or claims arising out of such
employment.

24. The contractor shall be solely responsible for all the
accidents or injuries to the contract personnel employed by him and
deployed at NIO. The NIO shall not be liable for any disability
claims/compensation due to such accident/injury, death etc. During
the period of contract. Contractor will be fully responsible for
any accident or mishaps involving workers engaged by him and it is
his responsibility for settlement/ pay claims made by these
victims. The contractor shall indemnify the NIO from any claims
arising out of accidents, disabilities of any nature, death arising
out of provisions under law or any other nature in respect of all
workers engaged by the contractor. The contractor will fully
indemnify NIO against all claims in this regard. Any compensation
of disengagement on account of death, disability of any workers/
deployed by the contractor at NIO even though such disability
manifests after the termination of the contract shall be
contractor’s exclusive liability.
25. The contractor should note that during the tenure of the
contract, water and electricity for the use of machines and for
watering the plants will be free of cost i.e. Charges will be borne
by NIO.
26. The contractor should note that the members of the contract
personnel provided by him shall be the employees of the contractor
and not of the NIO to any extent under any circumstances.
27. The contractor shall execute an agreement on stamp paper of
required value for due performance of the
contract which should be as per the approved format issued by
CSIR and the same will be handed over on award of contract. The
contractor should be aware that the agreement executed by him shall
not confer any tenancy right upon him at all times. He should be
aware that the NIO premise along with all the other items is the
sole property of the NIO/CSIR.
28. It shall be the sole responsibility of the contractor to
ensure security and safety of all the property and assets movable/
immovable of the institute, issued to carry out the jobs in the
garden. The contractor should instruct the workers to handle the
tools, diligently and any misplacement, damage, stolen/broken due
to the manhandling by the contract workers, the contractor should
report immediately in writing to the office. The NIO will be at
liberty to recover the cost of the said item from the contractor or
ask the contractor to replace the damaged item which should be of
the same quality, under approval from the officer appointed by the
Director, NIO. If there is any loss to the institute on account of
dishonesty, connivance, negligence on the part of his workers or
due to any cause, the contractor shall make good on demand the loss
to the institute.
29. The personnel of contractor should observe only three closed
holidays in a calendar year irrespective of number of the holidays
observed by the state. The 3 National closed holidays normally
cover Republic Day, Independence Day and Mahatma Gandhi’s Birthday.
The services of workers deployed by the contractor should be made
available on all days i.e. six days in a week basis i.e. 26/27 days
in a month irrespective of holidays except on Sundays. The
contractor shall be fully responsible for providing leave benefits,
weekly off, festival holidays etc., to the personnel deployed. When
any of the worker deployed at NIO comes late or proceeds on leave
or absents himself/herself it is the responsibility of the
contractor to immediately provide a suitable substitute.
30. The Contractor is required to commence the work FOR ANNUAL
HOUSEKEEPING (SCHEDULED EMPLOYEMENT & SWEEPING AND CLEANING) AT
NIO, DONA PAULA – GOA. With effect from the date of

acceptance of award letter. In case it is found that the
contractor, has not commenced the work, on the specified date the
NIO at its sole discretion may cancel the work order and the
EMD/Security Deposit shall be forfeited without any further
reference to the Contractor.
31. The contractor will have to furnish a Bank Guarantee from a
Nationalized Bank for an amount equivalent to 5 % of total value of
the contract as security within 15 days from date of taking over
which should be valid for a period of Thirty (30) months with
effect from the date of award of contract The validity of the bank
guarantee will be revalidated to the extended period of contract +
6 months and released to the contractor only after satisfactory
completion of the contract and after deducting the amount towards
damages/missing items etc as reported to the office and submitting
a proof that he has met with all the statutory obligations of the
laborers deployed by him to the satisfaction of NIO
Authorities.
32. PENALTIES/LIABILITIES:
32.1 That the Contractor shall be responsible for faithful
compliance of the terms and conditions of this agreement. In the
event of any breach of the agreement, it may be terminated and the
performance guarantee deposited with NIO will be deemed as
forfeited and further the work may be got done from another agency
at his risk and cost.
32.2 That if the Contractor violates any of the terms and
conditions of this agreement or commits any fault or his
services are not to the entire satisfaction of officer
authorized by the Director of the Lab in this behalf, a penalty
leading to a deduction up to a maximum of 10% of the total
amount of bill for a particular month will be imposed.
32.3 The performance guarantee so deposited shall be liable to
be forfeited or appropriated in the event of
unsatisfactory performance of the contractor and/or loss/damage
if any, sustained by the CSIR-NIO on account of
the failure or negligence of the workers deployed by him or in
the event of breach of the agreement by the
Contractor.
33. Termination Clause: The contract may be terminated in any of
the following conditions.
a) On expiring the contract without any notice
Or
b) On giving One month notice at any time during the current of
services, in case the service given by the
contractor is not satisfactory.
Or
c) If the contractor is not interested to continue the contract
shall give minimum 2 months notice, if the
contract does not give the required notice period ,the security
deposited will be forfeited and bank
guarantee will be invoked
34. In the event of any question, dispute or difference arising
under this agreement or in connection therewith
except as to matter the decision of which is specifically
provided under this agreement, the same shall be referred

to Delhi International Arbitration Centre (DIAC), Delhi High
Court, and New Delhi. The arbitration shall be
conducted under the Indian Arbitration and Conciliation Act 1996
and any amendments thereof.
35. The decision of the Director, NIO, regarding any disputes
whatsoever arising out of the contract will be final and binding on
the Contractor.

ANNEXURE I
SCOPE OF WORK OF THE CONTRACT
Tender Document for Annual Housekeeping (Scheduled Employment
& Sweeping and Cleaning Works
at CSIR-NIO, Dona Paula –Goa.
The institute is of international repute and is being visited by
dignitaries both local and international in
connection with the seminars and meeting organized at CSIR-NIO.
As such the aesthetic of the institute/laboratory
and surrounding areas is to be maintained.
Keeping this in the mind the contractor is required to clean the
building premises and the surrounding
areas and maintain hygienic and sanitary conditions. Cleaning of
rooms and bathrooms has to be ensured during
the morning shift taking into account the convenience of the
occupants/ users. Unoccupied rooms/premises
should be clean every day.
The workers deployed by the contractor should be highly
disciplined and behave politely with the guests
and staff members . the contractor should instruct them not to
indulge in arguments with staff members and
guests .
The contractor should note that the laborers deployed for the
housekeeping work should be present in the NIO premises for eight
hours on all working days excluding meals/tea to carry out the
duties assigned by the officer nominated by NIO.
Housekeeping work to be attended daily. The contractor /workers
are required to undertake twice daily the sweeping and mopping of
all the
institute floors inclusive the lifts. Cleaning, removal of
stains, cob webs etc from the walls, railings, corridors and lifts
should be attended daily.
Cleaning of waste paper baskets, sanitation bin & spittoon
set & disposing of garbage/refuse as directed.
Cleaning glasses of windows, doors and partitions. Dusting of
furniture, cupboards, phones, partition walls, doors, windows,
notice boards, flower vases and pieces of decoration and other
materials available in the institute.
Cleaning the common toilets and urinals regularly every two
hours throughout the day with phenyl and
other disinfectants. Suitable number of female cleaners should
be deployed for cleaning the ladies toilets and gents toilets
should be cleaned only by male cleaners. Porcelain fixtures are to
cleaned with vim or other approved cleaner. Cleaning of vertical
marble and mosaic surfaces. The rooms should be thoroughly cleaned
with dettol and other approved disinfectant and the rooms should be
sprayed with room fresheners/perfume to maintain pleasant odor.

Drains, sanitary fixtures, manholes and sewer lines should be
attended/cleaned whenever required for
smooth functioning. Bleaching powder, hit, should be sprayed on
regular basis to prevent breeding of flies, mosquitoes, lizards
etc.
The contractor will provide heavy duty bags for collection and
disposal of classified garbage from the
institute premises as per the instruction of officer nominated
by the office. The infectious and non infectious waste should be
collected and disposed as directed by the officer nominated by the
office.
Housekeeping work to be attended weekly.
- Cleaning of carpets, fans, AC, Grills, tube lights and other
electrical fitting, ceiling, walls, O2 and CO2 pipes, venetian
blinds.
- Cutting and removal of road side bushes, tree branches, etc at
the institute as instructed by the officer nominated by the
office.
- Cleaning of NIO Staff Club premises at NIO Colony.
Housekeeping works to be fortnightly
- Cleaning of ceiling and electrical fitting and roofs.
- Cleaning, scrubbing and washing of floor with automatic
machines with required cleaning material.
- Cleaning of storm water drains, water pipes and overhead
tanks.

- Wax polishing of floor and furniture and carpet
shampooing.
- Sweeping and cleaning of service ducts, service rooms, and
service shafts.
- Cleaning of drains and manhole lines from all type of building
to the main drain and sewer line.
- Washing of building from outside with prior permission from
