LUZERNE COUNTY DISTRICT ATTORNEY’S OFFICE

ASSISTANT DISTRICT ATTORNEY JOB DESCRIPTION

Position: Full-Time Assistant District Attorney

Department: Luzerne County District Attorney’s Office

Employment Status: Regular, Full-Time, Union, Non-Exempt

Salary: $43,000 (non-negotiable)

Summary:An Assistant District Attorney (ADA) is responsible for rep-resenting the Commonwealth’s position and interest when individuals are charged with committing a criminal act. In-volvement in the cases assigned to the ADA begins with the initial stages of the investigation and continues through all stages of the investigation and prosecution, up to and includ-ing the sentencing and any post-sentence motions.

Minimum Qualifications:Minimum requirements include being in good standing and admitted to practice before the Bar of the Commonwealth of Pennsylvania. The applicant must also be willing to un-dergo PA and FBI Criminal History Background Checks and PA Child Abuse History Clearance.

Essential Functions:

1. The Assistant District Attorney may be responsible for specific types of crime prosecution such as domestic disputes, child abuse, narcotics, sexual assaults, major crimes, elder abuse and DUI.

2. The Assistant District Attorney must formulate trial strat- egy, determine sentence to be sought, conduct plea negotiations and research applicable case law.

3. The Assistant District Attorney is responsible for ascer- taining the facts of the case, work closely with law enforce- ment, secure expert testimony and prepare witnesses for trial.

4. The Assistant District Attorney will act as a resource for law enforcement, other Assistant District Attorneys, Detectives and lawyers, and attend community outreach programs when asked by the District Attorney.

5. The Assistant District Attorney must advise police on matters of filing complaints when asked, attend write-ups and/or preliminary hearings, and secure additional infor- mation from law enforcement personnel when required.

6. The Assistant District Attorney must communicate infor- mation on case status to all involved parties such as de- fense attorneys, law enforcement and victims.

7. The Assistant District Attorney must be proficient at legal research, provide necessary training in his/her desig- nated specialty, and be able to communicate effectively and work closely with all support staff and detectives within the office.

8. Additional responsibilities are at the discretion of the District Attorney.

No application will be accepted in instances where the ap-plicant has any pending criminal charges filed against him/her, other than minor traffic violations, in this or any other jurisdiction. No applicant shall have any pending disciplinary complaints or proceedings brought against him/her by the Disciplinary Board of the Supreme Court of Pennsylvania or the Disciplinary Board of any other jurisdiction. An applicant is obligated to disclose any prior criminal charges and convic-tions, other than minor traffic violations, as well as any disci-plinary complaints and proceedings brought against him/her by the Disciplinary Board of the Supreme Court of Pennsyl-vania or the Disciplinary Board of any other jurisdiction.

Charitable Bar Foundation Board Meetingon Zoom—June 29, 2020

William F. Anzalone, Sr., Fred Howe, James Shoemaker, Diana Collins, Angel Mae Webby Zola, Jaime Anzalone, Lee Ann Palubinsky, Girard Mecadon, Cathy O’Donnell, P.J. Adonizio, Sr., Matthew Clemente, Steph Fernandes, Gail Kopiak and Joe Burke.

The President called the meeting to order, and called on Steph Fernandes and Matt Clemente to present a request for the Low Bono Program that was developed by the Bar Association Pro Bono Committee. They discussed their meet-ings with John Hurtt of North Penn (North Penn) Legal Services, Pittson.

North Penn represents people who meet low-income qualifications. Prior to representation, all people who apply are vetted by North Penn to be sure that they meet this stan-dard. North Penn is overwhelmed with the current need for PFA and custody representation, especially in light of the pandemic. This need was also expressed by members of the Luzerne County Bench. North Penn is also anticipating a need for representation in eviction matters, once the Gover-nor’s stay expires on July 10th. This is also the concern of many of the County’s District Justices, and one of the reasons District Justices Haggerty, Kravitz and Webby presented their Landlord/Tenant CLE at the end of May.

Matt and Steph also reviewed their meetings with Lacka-wanna County Pro Bono, Inc. and Tobey Oxholm, Esq., who created the Philadelphia and then the Wayne County Pro Bono programs.

As a result of those meetings, the Committee would like to mirror the Wayne County Low Bono program. The Pro Bono Committee asked the Foundation for $10,000 to be

used only to pay Luzerne County Bar members flat fees for representation of low-income Luzerne County residents with either PFA, custody or eviction who: are vetted by North Penn and who North Penn cannot represent due to either its limited staff availability or a conflict.

An advertisement for all attorneys interested in such rep-resentations would appear in The Legal Register. The Low Bono Flat Fee schedule will also be included in the advertise-ment. All attorneys who apply must present a certificate of their own adequate legal malpractice insurance. Steph has agreed to be the unpaid liaison. When she receives the refer-ral from North Penn, she will assign one of these attorneys. Upon completion, the attorney assigned would have to pro-vide an invoice and all work will be verified prior to receipt of the flat fee. Matt and Steph then excused themselves from the meeting.

The Board discussed the matter, after Steph and Matt left the Zoom connection, and voted to approve the allocation of the $10,000. It was made clear that this is a one-time imme-diate funding start since there is clearly an immediate need. The understanding is that any future funding would have to come from grants.

A meeting is to be scheduled for the election of the next Foundation President, which by practice, would be Jane Acri, with a full regular meeting to be scheduled no later than May 2021.

KIRSCHNER, by and through his attorney, Matthew P. Kelly, Es-quire, files the following Com-plaint in Divorce against the Defendant, UNCHU KIRSCHNER, and in support thereof avers as follows:

1. The Plaintiff, FRANCIS F. KIRSCHNER, is an adult indi-vidual who currently resides at 37 Rear Orchard Street, Glen Lyon, Pennsylvania 18617.

2. The Defendant, UNCHU KIRSCHNER, is an adult indi-vidual who currently resides at unknown address.

3. The Plaintiff and the Defen-dant were married on July 23, 1993 in Seoul, Korea.

4. The Plaintiff and Defendant have been bona fide residents of the Commonwealth of Pennsyl-vania for at least six (6) months immediately prior to the filing of this Complaint.

5. There has been no prior ac-tion for divorce or annulment of the marriage between the parties in this or in any other jurisdic-tion.
