John E. O’Connor, Sr. (1940-2019)

John E. O’Connor, Sr. passed into the next life on Decem-ber 21, 2019.

A lifelong resident of Luzerne County, John was born the eldest son of twelve to the late Atty. Patrick J. and Helen McAndrew O’Connor, who served eight terms as the Regis-ter of Wills of Luzerne County. John was a member of the first graduating class of Central Catholic in 1958. After Cen-tral Catholic, John graduated from King’s College, where he held numerous student leadership roles, in 1962 with honors. John received his legal education at the Georgetown Univer-sity Law Center, where he graduated in 1965. Soon after graduation, John became the legal clerk to the late Pennsyl-vania Supreme Court Justice Benjamin R. Jones. It was also during this time that John became a member of the Wilkes-Barre Law & Library Association.

John returned to his roots after finishing his clerkship and embarked on a legal career that would span over fifty years in the Luzerne County legal community, first starting as a founding partner of Flanagan, Doran, Biscontini & Shaffer. During this time he very much enjoyed his relationships with all of his law partners and especially his very close friend, the Hon. Hugh F. Mundy. He later joined Thomas F. Burke, Jr., now Judge Thomas F. Burke, Jr. and Joseph D. Burke. John practiced a style of law all his own. John’s career can be marked by him simply doing what he knew best, interacting with people.

Beyond numerous prestigious solicitor positions, John most enjoyed engaging with those clients who some may call the “common man.” To those who knew John, they would know that his representation of his clients was anything but com-mon. Equipped with a brilliant legal mind, a booming voice and a steadfast conviction to reach a just resolution, John represented his clients’ interests in a manner worthy of the

highest legal praise. Among his colleagues in the law, John was known for his honor and treating the profession exactly as that, a profession which deserved the respect of those that practiced. John was also known for his quick wit, always ready to come off with a humorous retort or a counterpoint which would take the wind out from under your sails. It was these tools which earned him a reputation as a tough, but fair, at-torney.

John the lawyer was only one facet of the man though. John was also a man of faith and a family man. John took great pride in serving as a deacon at his lifelong parish, St. Igna-tius, since 1999. John also devoted himself to service in CCD classes, service on numerous religious boards in the Diocese of Scranton as well as feeding and hosting the homeless at his local parish. John also was particularly well known for his passionate homilies during the Annual Red Mass, where his message routinely focused on the duty of lawyers to inject mercy and compassion for others in their daily practice of the law. Also, of particular importance to John was the blending of faith and family. Before receiving a master’s degree in Marriage & Family Therapy from Kutztown University, and especially after, John was noted for being a close confidant to many to discuss issues of faith and the relationships we have with others.

Finally, but most importantly, a discussion of John would be remiss without his family. John’s loving wife of 55 years, Mary Moran O’Connor, his seven children (Moira, Patrick, John, Michael, Megan, Timothy and Matthew) as well as nine grandchildren, all reflect what mattered most to John in life. A family devoted to their faith, their careers and service to others, were no doubt the true light of John’s eye. Since his passing, countless stories and memories of children growing up, family vacations and day-to-day events have been shared. The common thread being what mattered most to John, that everyone was together and that everyone was happy.

In closing, the committee who undertook writing this me-morial wish to encourage those who read this memorial to honor John’s memory by embracing those clients who are at their lowest. To treat those clients who are in need of com-passion and empathy with just that. To prepare diligently and be strong in your convictions on behalf of your client. And most importantly, to remember our role as attorneys goes beyond just assisting with our clients’ legal issues, but also being a resource in all times of need.

Cheers to you John, until we meet again, may God hold you in the palm of His hand.

Investment Committee Meetingby Zoom—August 4, 2020

There was a discussion of the current Market and Market projections, including low interest rates, the effect of the stimulus in the economy, and the potential for a Bull Market.

The current portfolio has continued to make back some of the losses from the end of the First Quarter. The cash alloca-tion will remain higher to be sure the Bar Association has

sufficient cash for cash flow requirements in lieu of Sheriff ’s Sale advertisement proceeds. A request was made for a trans-action report for tracking of profits.

There is a decrease in Bar Association budget needs be-cause of the decrease in expenses and the receipt of the most recent Sheriff ’s Sale advertisement payment for the June sale. The August sale has been cancelled. So, there will be no August Sheriff ’s Sale.

The Investment Statement policy will be revised and cir-culated among the Committee members, including the inclu-sion of any alternative investments and those specific limita-tions. The next meeting will be near the end of October.

Interfaith Committee Meetingby Zoom—August 4, 2020

Attendees: Co-Chairs Kelly Bray Snyder and Johanna Gelb,Bernard Walters, Frank Nocito, Carl Frank, Cathy O’Donnell, Joe Burke and Gail Kopiak.

There was a discussion of the upcoming Red Mass and the need for it to be available to be virtual. Shortly after the meet-ing, it was confirmed that Father Looney of King’s College would officiate the Mass, that all Readers would be live and that a total of 35 people would be able to be present. All present would have to wear masks, except when reading, and be spaced in accordance with social distance requirements.

The Mass will be live streamed or otherwise available vir-tually, as well to all members of the Bar. There will be no lunch.

The Committee is also going to attempt to have a virtual In Memoriam for the 2019 Bar Member decedents, as re-scheduled from March of 2019. The date from the Bench is November 12th at Noon and all Memoriam presenters and family will be invited to participate by Zoom.

Finally, Charter Day was planned for March 4, 2021 as a virtual panel discussion of the Freedom of Assembly. The hope is to have different community members speak about their perspectives coupled with some legal construction. There will be another meeting in 2-3 months.

Workers’ Compensation Committee Meetingby Zoom—August 5, 2020

Attendees: Co-Chairs Timothy Belt and Michael O’Donnell, Ralph Johnston, Cathy O’Donnell, John Bednarz, Mark Bu-falino, Gerard Gaughan, Jeremy Weinstock, Angela Mae Webby Zola, Rocco Schillaci, Michael Yelen, Jeffrey Yelen, Neil O’Donnell, John Gallagher, Valerie Diaz, Don Ligorio, Joe Burke and Gail Kopiak.

This was the first meeting of this newly-formed committee. The goals of the Committee are professionalism, business and social needs in the practice of workers’ compensation in Lu-zerne County. The Committee seeks to aid in the exchange of information, growth of attorney practices and helping each other.

There was a discussion of developing mentorships for newer lawyers. A CLE from the Committee is aimed for in early 2021 potentially on impairment rating evaluations or newer medical bills cases. A records database exchange using Dropbox is going to be set up, as well. The current Covid Questionnaires for each judge, current telephonic depositions and hearing, and the transition to video was also discussed.

An e-mail chain for further development prior to the next meeting is also being established. The workers’ compensation judges are also going to be invited to be a part of the Com-mittee.

The Co-Chairs are looking for participation to make it work for all of the members. The Committee hopes to meet quar-terly and welcomes all new members.

Pro Bono Committee

Call for Letters of Interest The Wilkes-Barre Law and Library Association’s Pro Bono Committee is seeking two attorneys to represent low-income clients in landlord-tenant, contested custody, and protection from abuse cases in the Court of Common Pleas of Luzerne County on a reduced fee basis. The Pro Bono Committee is a subsidiary of the non-profit Wilkes-Barre Law and Library Association. The Pro Bono Committee seeks to raise money for and award contracts to local attorneys who are willing to provide limited representation to indigent clients in landlord-tenant, contested child custody, and protection from abuse cases, which are currently the areas of greatest unmet legal need in Luzerne County. The importance of this initiative is demonstrated by the fact that the Wilkes-Barre Law and Library Charitable Foundation graciously contributed $10,000 to this initiative. This program is in partnership with North Penn Legal Services (“North Penn”) and only available to individuals who cannot afford to hire an attorney. This initiative seeks to provide legal services to clients who would otherwise be eligible for North Penn, whose indigence has been vetted, but North Penn cannot accommodate due to a conflict of interest or overflow. While the legal service will be free to the clients, the attorneys will be compensated on a reduced fee (“low bono”) basis. Contracted attorneys will be awarded contracts of up to $5,000, with compensation paid on the basis of servicesactually provided, earned and billable upon completion in accordance with the Agreement form necessary to become an independent contractor. While some experience in the fields of custody and abuse law is preferred, it is not required, as one of the objectives of this program is to increase the number of family law practitioners willing and able to provide pro bono representation in Luzerne County. Every contracted attorney will be given the opportunity to select from a list of experienced family law practitioners who have volunteered to serve as a mentor. The contracted attorney must maintain their own malpractice insurance.
