  • Industrial Cleaning Supply Mfg sold a cleaning product to an industrial manufacturing facility.A fire ensued at that facility (their client) causing water runoff from the firefighting efforts.The water runoff entered a nearby reservoir, prompting the EPA and Department of Fish and Game to become involved.As there was no pollution coverage on the clients burnt facility, the EPA solicited recovery of the cleanup costs from every company who had sold product or raw materials to that facility.The Industrial Cleaning Supply Manufacturers initial costs were upwards of $100,000.There will be much defense involved in this as well due to the number of parties involved and the discussions involving sharing of costs.

  • Industrial Detergent manufacturer responsible for cleanup of 4 miles of the LA River after water runoff from a recent fire increased the PH balance of the river from 7 to 14.

  • Oil Refinery responsible for $650,000 cleanup after wastewater discharged from the refinery was found to contain selenium levels higher than the states hazardous waste allowable levels of 1.0Mg per liter for soluble selenium.

  • Industrial Painting Contractor providing lead abatement and recoating work on bridge found responsible for $35,000 cleanup after generating hazardous waste and lead-contaminated paint residue through its work on the bridge and releasing and disposing of lead and zinc based residues on the ground.
  • Home Builder responsible for generating particle pollution via dust generated from their construction site.Allegations include aggravated asthma, and various respiratory problems due to the complex mixture of extremely small particulate matter and liquid droplets in the air.

  • Deli/Packaging plant fined $36,400 for releasing over 4,000 pounds of ammonia into the air due to equipment failure.
  • Cement batch plant facility charged with air emissions violations and exceeding nitrogen oxide limits for 2 years and emitting 1,500 tones of harmful nitrogen oxide into the air.

  • Environmental Consultant hired to determine asbestos levels in a building set for demolition deems the levels of asbestos found in the building are under the actionable level and not hazardous upon demolition.Rubble from the building is utilized for fill and path areas of a local zoo where asbestos is found in the rubble prompting a $2.4MM cleanup and refill.

  • Recycling facility responsible for $210,000 cleanup of soil contaminated with Polychlorinated biphenyls (PCBs) and metals from a site adjacent to a high school.
  • $250,000 cleanup ordered after chromium contamination found near a local plating/metal finishing company.

  • 200 people became ill and at least 32 died after being exposed to the bacteria growing in a whirlpool and humidifier at a flower show in The Netherlands.
  • 30 people became ill and at least 3 died in suburban Detroit after being exposed to the bacteria spewing from an HVAC system of a local meat market.In this first ever case of Legionella in a non-enclosed area, the local newspaper quoted a source as stating that the Legionella bacteria in the HVAC system was as thick as Legionella soup.
  • Over $1MM claim paid for Pollution Legal Liability when Legionella was found in the spa tubs of a casino and an elderly couple died.

  • CA Oil Company responsible for $1.45MM cleanup costs at 3 disposal sites where oil refinery wastes and other possible hazardous substances were sent.

  • Personal Care Product Mfg responsible $150,000 for cleanup of illegally disposed waste.
  • Chemical Distributor deemed responsible for $300,000 in their share of cleanup at drum cleaning facility.
  • Electronics Mfg allegedly responsible for disposing of Universal Waste at non-permitted facility.

31. Pollution from Transported Cargo

  • Chemical Distributor closes down the 405 freeway 1 day after the holiday when truck overturns carrying totes of anhydrous ammonia.
  • Truck carrying drums of printers ink tips over on a bridge over a stream causing cows downstream to give purple milk after drinking the water.
  • Fuel truck hits overpass and explodes shutting down 4 lanes of highway and blocking the tunnel.Runoff from the firefighters putting out the fire flows into a nearby water reservoir.

32. Liability Just Because You Were There!

    • $12.5MM Cleanup at Superfund Site
    • US EPA and US Department of Justice settle for a total of $12.5MM with 39 parties for cleanup of Superfund site.
    • 13 parties, including one with a prior No Further Action notice from the EPA, share $9.2MM (approximately $708,000 per party) based on their ability to pay and their past and present payments for the site.
    • 26 parties demonstrating limited financial means (ie no insurance) to pay for the groundwater cleanup share $3.3MM (approx. $127,000 per party).
    • Parties included family trusts, manufacturers, individuals, building owners and a utility company.
