a) Einführung
Auf der Balkanhalbinsel wirkte das römische Recht durch
den politischen Einfluß des Byzantinischen Reiches (Pars
Orientis Imperii Romani) in Form des byzantinisch-römischen
Rechts (ius Graeco-Romanum oder ius Byzantinum) fort. Auch auf
den Gebieten des heutigen Griechenlands (Hellenische
Montenegro wurde im Jahre 1499 zunächst formal, im
Jahre 1528 unmittelbar als Sandschak dem Osmanischen Reich
angegliedert. Die Osmanen konnten aber keine faktische
Kontrolle über die Bergregionen Montenegros ausüben.
Seit dem Jahre 1516 war Montenegro ein theokratischer
Staat. Dieses Fürstentum wurde durch den Vladika (orthodoxer
Fürstbischof) regiert. In Montenegro war die staatliche Gewalt
(imperium oder basileia) von der kirchlichen Gewalt (sacerdotium
oder hierosyne) nicht getrennt. Das System der Erbdynastie
wurde durch den Vladika (Fürstbischof) Danilo Petrović Njegoš
(1672–1735) im Jahre 1697 eingeführt.
Das Verwobensein bzw. Einheit (symphonia) zwischen der
kirchlichen (geistlichen) und der staatlichen (weltlichen) Gewalt
schlug sich auch in der Gerichtsorganisation (Gerichtsstruktur)
und in den Rechtsquellen (fontes iuris) nieder. Die
Rechtskenntnisse wurden durch die orthodoxe Kirche in den
Klosterschulen vermittelt.

Die erste Revolution Serbiens, die später zur
Unabhängigkeit des Landes führte, fing am 15. Februar 1804 an.
Die erste Verfassung des modernen Serbiens wurde am 15.
Februar 1835 verabschiedet.
Im Zuge der erlangten Autonomie wurde auch die
Kodifikation des serbischen Privatrechts möglich. Mit der
Kodifikation des serbischen Privatrechts wurde im Jahre 1829
G. Zachariades betraut. Der von ihm redigierte
Gesetzesentwurf erhielt jedoch nie Gesetzeskraft. Im Jahre 1834
wurde das erste serbische Zivilgesetzbuch fertiggestellt, das
sich am französischen Code civil orientierte. Dieser Kodex
erwies sich jedoch nicht zuletzt wegen der unpassenden
Übersetzung als für die Praxis kaum brauchbar.
Im Jahre 1844 wurde unter dem Fürsten Alexander
Karadjordjević (1842–1859) hauptsächlich als Ergebnis der
Arbeit von J. Hadžić (1799–1869)8 und V. Lazarević das nach
8 Hadžić standen lediglich knapp zwei Jahre für die Erstellung bzw.
Redaktion des Zivilgesetzbuches zur Verfügung. Erwähnung verdient,
dass er auch eine bedeutende Rolle bei der Vorbereitung der im Jahre 1838
promulgierten serbischen Verfassung und deren Ergänzungsgesetze
spielte. Im Gegensatz zu Valtazar Bogišić, der den Allgemeinen
Einfluß des deutschen BGB und des schweizerischen ZGB
besonders deutlich.
Im serbischen Handelsgesetzbuch vom Jahre 1860, das
unter Fürst Michael Karadjordjević (1860–1868) promulgiert
wurde, ist hingegen eindeutig die Wirkung des französischen
Code de commerce vom Jahre 1807 ersichtlich.

Die im Jahre 1992 gegründete Bundesrepublik
Jugoslawien (Savezna Republika Jugoslavija) bestand aus den
zwei Teilrepubliken Serbien und Montenegro, die am 29. April
1992 die Rechtsnachfolge der Sozialistischen Föderativen
Republik Jugoslawien (FSRJ) als Bundesrepublik Jugoslawien
antraten.11 Die jugoslawische Verfassung wurde am 27. April
