Ensuring children participation in development of child friendly city/regency

•Indonesia has ratified the Convention on the Rights of the Child in September 1990, affirming Indonesia’s commitment to respect and fulfill the rights of child. •Indonesia’s national policy is reflected, most notably, in the Law No. 23 Year 2002 on Child Protection, which has been amended through Law No. 35 Year 2014 and most recently through Goverment Regulation in lieu of Law No. 1 Year 2016

Other regulations include

•Law no. 2 Year 2015 on National Development Plan 2015 – 2019

•Law no. 23 Year 2014 on Regional Government

•Law no. 12 Year 2011 on Mechanism for Criminal Code related to Children

•Presidential Decree no. 5 Year 2014 on National Movement against Sexual Violence to Children

•To fully implement Indonesia’s commitment for the rights of child, amidst moves to decentralize power to local government, it is necessary to take regional governments, i.e. Cities and Regencies, on board

•Regional governance in Indonesia consists of two tiers: Provinces in the first tier, while the second comprises Cities and Regencies

•Indonesia has 414 Regencies and 1 administrative Regency, as well as 92 Cities and 5 administrative Cities

•To induce participation of regional governments in implementation of the national commitment, in 2009 the State Ministry for Women Empowerment and Child Protection introduced policy for creating Child Friendly City/Regency

•The policy aimed to accelerate the implementation of Indonesia’s commitment for the rights of child by translating the legal framework into development strategy and intervention at the regional level

•Response from governments of Regencies and Cities to the Child Friendly City/Regency policy has been positive

•As many as 264 Regencies and Cities has initiated its effort to attain child friendly status, and among those, 120 has gained official recognition as City/Regency Toward Child Friendly City/Regency in 2015

•The national Child Friendly City/Regency policy assigns four classes for regional governments in its effort to become Child Friendly City/Regency, before it obtains the status as a Child Friendly City/Regency

•Up to now, there is no city or regency which has attained Child Friendly status, or even City/Regency Toward Child Friendly City/Regency in Utama (highest) class

•There are three main approaches for government of Regencies or Cities to develop its region to attain child friendly status:

with assistance from the Ministry of Women Empowerment and Child Protection

with assistance from the Provincial Government

developing with its own initiative

•To develop a City or Regency toward Child Friendly City/Regency, attention should be given to three main issues: stages of development, indicator and categories

•Formulation and development of the Regional Plan of Action of respective City/Regency toward Child Friendly City/Regency plays crucial role

•Regional Plan of Action serves as reference in developing a City or Regency toward Child Friendly City/Regency in systematic, focused and effective manner

City of Magelang toward Child Friendly City: a study

•The City of Magelang is one of six Cities in the Central Java Province

•It has 18.12 sq km in area, consists of 3 districts and 17 sub districts

•It is bordered on all sides by the Magelang Regency, to which it was the seat of government before 1950

•The City of Magelang has population of 132,261 in 2015

•That number includes children population of 31,569, comprising 15,835 male and 15,734 female

•The City of Magelang in 2011 officially started its development into Child Friendly City on its own initiative

•Since 2012 the City of Magelang has been among Cities and Regencies which has attained City/Regency Toward Child Friendly City/Regency in Madya class, i.e. the third class assigned

Policies on making Magelang a child friendly city are set in regional bylaws, among others:

•City regulation no 11/2012 on protection from violence against women and children

•City regulation no 12/2012 on prevention of human trafficking

•City regulation no 14/2015 on facilities for lactating mothers

•City regulation no 11/2015 on education

•Much of the City’s efforts are directed into developing infrastructure, for example improving community health centres and establishing day care centres, as well as raising awareness, for example for road safety and for child friendly school policy

•The City of Magelang stands out in its development into Child Friendly City for formulating regional plan of action which involves children participation in determining policies and program in developing a Child Friendly City

•Inputs for determining programs in special protection for children, child participation, child health, child welfare and child education are also obtained from children forums in the City of Magelang

•Substance of the regional plan of action for the City of Magelang consists of clusters in accordance with indicators in Child Friendly City/Regency development

•There are six clusters of indicators, as elaborated in the next slide

2. Civil rights and freedom

3. Family and alternative child care

4. Basic health and welfare

5. Education and cultural activities

6. Special protection

•Success of the regional plan of action may be seen from the accomplishment of programs in every cluster

•This regional plan of action may be evaluated annually and if necessary may be altered with more innovative programs in fulfilling children rights and ensuring child protection
