Sweden – Implemented long before EPBD• EPBD was Implemented through SFS2006:985 and building

energy certificates mandatory after jan 2009. • BFS 2007 introduced Energy and IAQ (minimum intake of

fresh air required) certification of buildings and compulsory control of ventilation systems OVK was in place since 1991.

• Public buildings must display certificate visible to the users. Certificates are based on operational rating and must be renewed every 2, 3, 6 or 9 years according to the building use – recommendations for improvement need to be included in the diagnosis

Finland – Full tranposition In place End 2008

13 April 2007 Finland revised the Land Use and Building Act and created two new acts:

› the Act on Energy Certification of Buildings (487/2007)› the Act on Inspection of Air-conditioning Systems (489/2007)

New legislation came into force 01 Jan 2008

According to the Act on Inspection of Air-conditioning Systems, inspections will be compulsory for cooling equipment with a nominal cooling efficiency of at least 12 kilowatts, and will only be needed where cooling systems are based on the use of compressors. Such equipment must be duly inspected at least every ten years. The procedures for inspection of air-conditioning systems have beendeveloped and the training of experts started in autumn 2008. Air-conditioning inspections can be done by qualified experts who are authorized to carry out leakage control of AC systems. The Safety Technology Authority (TUKES) accredits inspection companies and persons

Norway – Inspection scheme not finalised

New minimum requirements for new buildings were issued 01.02.2007 with a 2.5 year transition period.

In 2008 the certification and inspection schemes are under preparation. For Air Conditioners there are proposed schemes based upon new regulations from the Ministry of Environment (f-gas), in addition to voluntarily schemes.

The main change is to enhance the schemes and to make them mandatory schemes, including companies that have service agreements.Inspection reports must be registered in a central register using the webbased tool for self assessment of energy performance in buildings (EMS)Energy Marking System.

Denmark – In place Jan 2008

Inspection of air conditioning and ventilation systems was implementedfrom January 1, 2008. The Danish scheme for inspection of air conditioning systems (Article 9) also includes inspection of large ventilation systems.The requirements regarding air conditioning and ventilation systems(Article 9) are stated in Decree no 1104 of September 20, 2007. The air conditioning and ventilation systems have to be inspected every fifth year,and the scheme is implemented gradually over 5 years, starting with theplants installed in large buildings. The inspections are performed by certified firms.The energy consultant is supposed to identify two types of energy saving measures:

• immediately feasible energy saving measures and• measures that are only feasible if carried out as supplement to ongoing

renovation.

Belgium – EPBD is a regional responsibility

Flemish region :Minimum requirements and calculations had been transposed in 2004; revised in 2006Energy performance certificates has come into force in 2007 and is spreading from public to residential buildings in 2008In the Flemish Region, the Flemish Energy Agency is responsible for Articles3, 4, 5, 6 and 7. The Department of Environment, Nature and Energytogether with the Flemish Energy Agency, are responsible for Articles 8 and9.The regulation relating to inspection of air-conditioning system is also stillbeing drafted. There will probably be two types of inspections:› the assessment of the efficiency by a trained technician who is incharge of the maintenance of the installation (every two years);› the assessment of the sizing of the installation in relation to thecooling demand of the building.Inspections will start : 2009

Belgium – EPBD is a regional responsibilityBrussels region :Minimum requirements and calculation have been transposed 2007 and 2008Scheme for building certification and further inspection of HVAC was still under preparation and due for summer 2009 . Same with certifiers training and accredditation framework.

Walloon region : Since January 2004, “Construire avec l'énergie” (build with energy) and since september 2006 Energy Advise Procedure wera 2 voluntary actions for new dwellings Aimed to provide the building sector with future statutory requirements and certification. So far, the EPBD transposition is still ongoing.2011 is the due date for Buildings minimum requirements, calculation (a software is currently beeing developped) and certification, under responsibility of Ministry of Energy and sustainable buildings . Inspection of air conditioning systems is under responsibility of envionment ministry and been developped earlier 2007. The energy aspect (still missing) will come into force in 2009.

SpainEPBD has been transposed through 3 royal decrees :

•Approval of Technical code of building march 2006•Basis procedure for energy performance certification of new and existing buildings Jan 2007•Regulation for thermal installations in buildings RITE July 2007

The CTE covers minimum indoor air quality requirements and specifies ventilation rates according to building space.

Technical procedure for inspection of HVAC are included in the RITE

The regional governments are in charge of the practical implementation

• limited to energy performance certificates and minimum requirements for new/renovated and every buildings sale– no periodical survey required. –no training required to get “expert” accreditation just a test –no mandatory need for the customer to perform any energy survey during the building life time – Inspections are still under discussion – RT2005…2010

• Energy saving ordinance 2007. Minimum requirements in place and certification scheme was preexisting since 2002. In Germany every air conditioning unit more than 12 kw rated thermal output has to undergo an inspection by a specialized engineer every 10 year. Expert need to make recommendations for cost effective improvements to the owner. No specific system for expert accreditation

Mandatory Energy performance assessment for every HVAC system in public buildings, every 5 years with improvement evidence of system performance by energy evaluation expert ( trained + accreditation).

Recast of EPBD

The Commission of the European Union has recently proposed a recast of the EPBD (Energy Performance in Buildings Directive, 2002/91/EC). The objective is to further strengthen the effectiveness and impact of the existing Directive regarding

•Energy certificates•Inspection framework and installation energy efficiency improvement.

Recast should be adopted early in 2010 leaving 2 years for state adoption

CEN standards to support the EPBD

– European Commission Mandate 343 to CEN (Jan.2004):…the elaboration and adoption of standards for a methodology calculating the integrated energy performance of buildingsin accordance with the EPBD

• Energy management is developing due to EPBD, taxation frameworks on energy efficiency and development of energy services.

• Customer’s Energy manager, who develops corporate strategies for energy savings, is key contact person to meet

July 2009 CEN released EN 16001 Energy management systems — Requirements with guidance for use. (based on PDCA logic as other management systems standards (ISO9001 Quality, ISO 14001Environment,..)

In UK a certification scheme has been soon implemented by BSI

ISO 50001 Energy management system. The standard is beeing developped and will provide recommendation to implement Energy management systems

and Eco-design, Eco labelling, environmental declaration• Design of HVAC devices should integrate lower energy consumption

criteria, according to eco-design directive.

• Eco labelling frameworks integrate energy consumption reduction for products to get the certification

• Environmental declarations for such devices will have to disclose on energy consumption.

Side effects of the application of thoses directives will impact air filters and fosters on air filtration energy efficiency.
