Subject: VS. Joint Forces Command (USJFCOM) Intelligence Oversight Report for the 1* Quarter FY-07

1. Illegal or improper activities:

No intelligence activity has been identified which is reasonably believed to be illegal or contrary to Executive Order of Department of Defense instructions concerned with intelligence oversight.

2. Significant Intelligence Oversight activities: .

a. SJFHQ determined that 84% of their personnel in intelligence related positions have completed intelligence oversight refresher training. The remaining 16% have been identified and a training plan is in place to have them appropriately trained by the end of the quarter. •

b. J9 identified an intelligence oversight conccra m the Noble Resolve and Unified Quest exercises that involves the storage, sharing and modeling of U-S. citizens, corporations, assets and infrastructure, for DoD purposes. These concerns were addressed with the J9 legal advisor, Daniel Donovan, as a legal and training issue for DoD participation in these exercises. Mr. Donovan provided legal guidance and training based on the exercise requirements to the J9 planners and participants to insure compliance with all appropriate regulations.

3. Results of Intelligence Oversight Inspections:

a. The USJFCOM Inspector General's Office conducted a unit command inspection of the Joint Communication Support Element (JCSE) in Tampa, Florida from 30 October to 3 November 2006 that included intelligence oversight. The intelligence oversight officer, Mr. Quinton Gordon, was in compliance with all appropriate regulation and maintained accurate training records for the command's intelligence oversight program.

SUBJECT: US NORTHERN COMMAND (USNORTHCOM) Intelligence Oversight Report for First Quarter FY07

1. Illegal or Improper Activities:

No intelligence activity has been identified which is reasonably believed to be illegal or contrary to Executive Order or Department of Defense directives concerned with Intelligence Oversight for USNORTHCOM or its subordinate joint commands.

2. Significant Intelligence Oversight Activities:

a. The N-NCIG completed Intelligence Oversight Inspections of SJFHQ-N and the N-NC J2. Both organizations were well versed in their duties and responsibilities, understanding constitutional constraints, and the laws and directives which govern the collection, dissemination and storage of sensitive information, especially that data which is constrained by Intelligence Oversight guidance or acquired on non-DoD persons. Their programs are • very strong, with only minor recommendations for improvement.

The re-inspection of JFHQ-NCFfMDW was also conducted during this quarter. Good accountability and integration of Law Enforcement Sensitive (LES) and other U.S. Persons information was demonstrated throughout the re-inspection. The confusion and misunderstanding cf the requirements and constraints involved in the storage, marking, and fusion of U.S. Persons information displayed during the last inspection (Aug 06) was no longer present. It was apparent that a good awareness of the legal constraints involved in lO/Sensitive Data permeated the command, and that a focused training regimen was being conducted on a frequent basis.

b. Training: All N-NC Intelligence Directorates and subordinate commands have conducted initial and refresher training for personnel. The percentage of personnel trained in the command is currently 100%, and ail efforts will be made to maintain this level.

3. Changes to 10 Program:

All N-NC Intelligence Directorates and subordinate commands have implemented more frequent database information review processes (30-60 day reviews) to ensure data repositories have effective follow-up assessments concerning the need to retain various forms of information.

4. Significant Intelligence Oversight policy changes:

N-NC Instruction 14-103 (Intelligence Oversight) revision currently in staffing. Expect to be approved and published fn 2nd quarter FY 07. Major changes include: implementation of a more frequent self-inspection process, conducting additional key word searches on N-NC computer systems, defining several nebulous terms used in the current Implementing regulations, and Increasing the depth of IO training within the command.

5. Other pertinent 10 actions:

N-NC IG is still awaiting a dose-out letter from ATSD{JO) reference the Procedure 15 Investigation conducted on JFHQ-NCR/MDW during 3"1 QTR 06. Any assistance the Joint Staff FG office can provide in this matter is appreciated.

Visit Summary

General; The NORAD-USNORTHCOM (N-NC) inspector General conducted an Intelligence Oversight (IO) Re-Inspection of Joint Force Headquarters National Capita! Region, Military District of Washington (JFHQ-NCR/MDW), Fort McNaif, DC, on 5 December 2006, which consists of members of the US Navy, US Air Force, USMC. and the US A/my as well as government civilian personnel and contractor®. The J32 is organiied under the J3 in the command, and works very dosely with the J34 m the production and dissemination of daily and weekly Threat Sriets and intelligence Updates.

The purpose of the visit was to ensure compliance with aH Feoeral and DoD directives, capture best practices, and review/discuss the corrective actions taken to correct weaknesses or deficiencies identified during the previous inspection (August 2006). The inspection team consisted of Mr, Scott Southard, Intelligence Oversight Officer for NORAD-USNORTHCOM IG.

After an initial inspection of the IO Program Continuity Book, an inspedion of computer files was conducted on drives assigned to the J32 (Intelligence) shop.

Good accountability and integration of Law Enforcement Sensitive (L£S) and other U.S. Persons information was demonstrated throughout the 10 Inspection. The confusion and misunderstanding at the requirements and constraints irvoJved in the storage, marking, and fusion of U S, Persons information displayed dumg the last inspection was no longer present. NOTABLES

• Although not required by current regulation to generate their own Operating Instruction (Ot)x the J32 generated, and have been using an outstanding Oi that they created. The use of this detailed local J32 Operating Instruction will he!p to ensure the standardization of daily operating procedures and activities within the command. This standardization will help avert a possible 10 violation or incident in the future.

• Additional documents were included in the unit's 10 bocks that will facilitate an efficient and detailed 10 Program if used (various memorandums, slide presentations, and point papers on 10 topics).

1.1. Training Records - Satisfactory

AREA FOR IMPROVEMENT

• Currently, the training records simply consist of a "sign in sheet* from the training session. Although this does provide the names of the persons involved in training, it does not allow the tracking of those that did not attend, or the annotation of why individuals are not trained. It was suggested that an Excel spreadsheet be used to maintain the training information (or better yet, have additional columns placed on a spreadsheet already being used in the oommand, Le. one already in use by the J l ) .

1.3. Appointment Orders - Satisfactory

• Numerous flyers that denote the Intelligence Oversight Officer (fOO) for tho command were readily visible in conspicuous places throughout the area. Not onfy were the primary and alternate 100s contact information included, but also their pictures. These flyers wilf enhance the availability of the IOO to personnel within th« unit.

• A very robust training pian is in placa for the analysts, During the in-processing of new personnel 10/Sensitive Data training ts required as part of the in-processing checklist Furthermore, before the analyst is issued their permanent access badge they must show proof of their 10/Sensitive Data training to the badging authority. As part of the internai J32 training, the analysts must take a written tesi and pass ft with an 80% grade or higher, They also incorporate an interactive question and answer period in their training sessions, utilizing common examples of the types of information that they routinely handle/see. 3. Self Inspection - Satisfactory

COMMENDABLE

The J32 has implemented a very strong "Self Inspection" program. They currently conduct self-inspections weekly, as well as every 30, 60, and 90 days. This frequent schedule will help ensure U.S. Persons information will not be maintained longer then allowed by current directives (if it meets the required caveats). They also have a minimum of two people conducting each level of self inspection, providing for a dual filter of all data being collected, used, and maintained. (OPR; J32, (b)(6) I .-J, a

• Information kept on the J32 shared drive was kept to an absolute minimum. This not only makes it much easier to conduct self-inspections, but also minimizes the risk of questionable or offending data being overlooked- Data stored on individual hard-drives was almost non-existent as well.

4. J A Involvement-Satisfactory

COMMENDABLE

• The J32 - JA relationship has become extremely strong. Throughout the inspection it was clear to the inspection team that J32 - JA personnel currently have a robust relationship, and that this allows the analysts to utilize available expertise and make informed 10 decisions. The command has also implemented a Sensitive information Working Group (SfWG), This group consists of J32, JA, and J34 personnel, and meets on a monthly basis, or more often as required. The purpose of the SIWG is to ensure compliance with ail appiicable rules, regulations and taws in reaards to iO and Sensitive Data handling. (OPR: J 3 2 , (b)(6) | _ y

1. The USTRANSCOM Inspector General (TOG) conducted a quarterly review of USTRANSCOM (O programs. There were no questionable activities or violations reported this quarter.

2. There are three distinct elements which provide intelligence support within the USTRANSCOM headquarters:

a. Intettgence Directorate CTCJ2) b. Joint Transportation Reserve Unit (JTRU) c. Joint Transportation Intelligence Operations Center (JIOCTRANS 0169)

TOG conducts an annuaJ JO inspection on each ot these elements throughout the fiscal year, and coordinates with 10 Program Monitors in all elements to regularly assess compliance with Federal laws and national directives regarding intelligence activities. Every element is providing excellent IntefSgoncc Oversight training, and alt personnel assigned have demonstrated a sound understanding of the policies and reporting requirements. No deficiencies or questionable activities were noted in any of the 10 programs inspected.

3. Most government service civilian personnel assigned to the intelligence elements at USTRANSCOM wOT become Defense Intelligence Agency (D1A) employees in the near future. TOG ha9 already contacted DIA/IG to discuss the possibility of conducting lo inf 10 inspections in the future. In FY07 TCJG will update the current USTRANSCOM Intelligence Oversight Program Instruction to incorporate any changes in element command structure and CJCSI5901. Currently, there have been no changes to the command IO activities, directives, or training program.

1. Below is a consolidated summary of al l Combatant Commands (COCOMs) Intelligence Oversight (IO) Reports for the First Quarter, FY08. Attached are al l COCOM reports. Also, Service Components wil l report IO information through their Service.

a) USCENTCOM IG: Augmentation forces for Operation ENDURING FREEDOM assigned to USCENTCOM at Mac Di l l AFB are receiving init ial intelligence oversight training. There were no questionable activities reported.

b) USEUCOM IG: Intelligence oversight training included 103 init ial and . 133 refresher briefings.

One questionable activity was reported by US Army Europe for information purposes. US Army Europe is currently performing a Proc .15 inquiry. They wil l report results through their Service intel oversight channels w i th info copy to USEUCOM J2.

Internal assessments were conducted by EUCOM J2, SHAPE Survey, • USNIC-Pristina, Northern Region JOIC, Southern Region JOIC, Jo in t Analysis Center, Special Operations Command and Europe. 232 personnel were interviewed.

EUCOM IG inspected the Joint Analysis Center i n Molesworth, United Kingdom on October 2007 and Special Operations Command Europe on December 2007, as part of a larger command inspection of SOCEUR by the Special Operations Command IG. There were no findings in either program. Three observations were made by the EUCOM IG to the JAC.

The training programs of both organizations were wi th in standards. SOCEUR noted by EUCOM for a best practice IO training program.

EUCOM IG attended the NORTHCOM/NORAD IO Conference from 3-6 Dec 07 at Ft Bliss, TX.

c) U S J F C O M I G : USJFCOM J2 conducted a self-inspection of all • intelligence holdings for US persons' data, including items posted to command home pages, hard-copy files, proper use statements and archived imagery. All holdings were found to be within IO regulations.

The USJFCOM IG's office conducted a un i t command inspection of the Joint Warfighting Center in Suffolk, Virginia from 22-26 October 2007 and the Joint Transformation Command Intelligence in Norfolk, Virginia from 10-14 December 2007. Both inspections included intelligence oversight. Both commands were found in compliance w i th al l appropriate regulations and maintained accurate training records for the command's intelligence oversight programs.

d) USNORTHCOM IG: The N-NC IG, completed Intelligence Oversight Inspections of JTF-N, NORAD and USNORTHCOM J2. The organizations were well versed i n their duties and responsibilities, understanding constitutional constraints, and laws and directives which govern the collection, dissemination and storage of sensitive information, especially that data which is constrained . by Intelligence Oversight guidance or acquired on non-DoD persons. Their programs are very strong wi th only minor recommendations for improvement. One subordinate command (AFNORTH) did not submit their quarterly report at this time. All N-NC Intelligence Directorates and subordinate commands have conducted in i t ia l and refresher training for personnel. 99% of personnel have been trained. All efforts wil l be made to maintain/increase the level.

N-NC updated the command IO Instruction (NNCI-14-103). This instruction has been put into effect and changes in the new guidance wi l l be highlighted dur ing upcoming IO Inspections.

All N-NC Intelligence Directorates and JTFs have implemented more frequent database information review processes (30-60 days) to ensure data repositories have effective follow-up assessments concerning the need to retain information.

The first world wide IO Conference sponsored by USNORTHCOM took place at JTF-N Headquarters in El Paso, TX from 4 Dec to 6 Dec 07. Over 50 IO specialists representing the Joint Staff, COCOMs, DoD, Interagency and N-NC Subordinate partners participated.

e) USPACOM IG: Annual training is being conducted via computer with certificates being sent to the 10 coordinator. New members are sti l l receiving in-person indoctrination training.

f) USSOUTHCOM IG: Automated training notifications go out monthly as a reminder to al l personnel who are required to undergo training dur ing that month. Joint Task Force Bravo (JTF Bravo), Special Operation Command South {SOCSO-J2), Joint Interagency Task Force-South [JIATTSJ2 CJ), and Joint Task Force, Guantanamo Bay, Cuba (JTF-GTMOj submitted negative reports on any IO violations. Special Operation Command South (SOCSO-J2) continues to provide IO training and current resource materials to designated intelligence personnel on a regular basis. Joint Interagency Task Force-South [JIATFS J2 CJ) t ra in ing of new personnel assigned to intelligence activities are monitoring the JIATF-S WebTas Program to insure US persons data meets authorized retainability under JIATF-S mission, allowing for collection of information regarding drug trafficking. Reviewed all US persons in WebTas and either eliminated or left them in because of sustaining information. The database is current w i th known traffickers and persons w i th prior criminal histoiy.

g) U8SOCOM IG: Conducted three IO inspections, these inspections included HQ USSOCOM at MacDill AFB, Special Operations Command Pacific at Camp Smith, HI (joint inspection wi th PACOM IG), and Special Operations Command Europe at Patch Barracks, GE (joint inspection w i th EUCOM IG). There were no questionable intelligence activities discovered dur ing the inspections. There were sufficient Intelligence Oversight Programs in place. Personnel were familiar wi th the intelligence oversight requirements and were compliant w i th the laws, regulations, policies and procedures pertaining to intelligence oversight

USSOCOM-SCSO-J2 continues to operate the Intelligence Oversight Training Program through a computer based program. No changes to that program have occurred.

h) USSTRATCOM IG: Inspected three IO programs this quarter, USSTRATCOM J2, Intelligence Directorate, Joint Functional Component Command (JFCC) Global Strike and Integration (GSI) J2, Intelligence Directorate and Joint Information Operations Warfare Command (JIOWC) in Lackland AFB, TX. There were no questionable intelligence activity at any of these organizations. The IO programs inspected at USSTRATCOM J2 and JFCC GSI J2 were noted as excellent The IO program at the JIOWC was satisfactory. (a) The quarterly self-inspection requirements imposed by the local USEUCOM instruction were far more stringent thap DoD 5240.1-R requires, and reporting units were unable to meet these requirements on a consistent basis.

(b) Many personnel did not understand that a "questionable activity," as defined by Procedure 15, concerns any "conduct that constitutes, or is related to, an intelligence activity that may violate the law, any Executive order or Presidential directive...." Most personnel still believe that questionable activity refers only to matters involving US persons.

(c) The JAC needs to bring the six Joint Reserve Intelligence Support Element (JRISE) ' centers in CONUS under the JAC's intei oversight umbrella.

(3) Questionable intelligence activities discovered: None.

(4) Familiarity of personnel with intelligence oversight requirements: Personnel showed adequate evidence of basic knowledge of intel oversight as a result of their initial and refresher training.

(5) Adequacy of organization intelligence oversight training program: The training programs of both organizations were within standards. SOCEUR uses an excellent white paper as a basis for establishing left-right limits for its deployed personnel and also as an information aid for its senior leaders.

(6) Corrective actions taken: N/A.

2. Significant Intelligence Oversight Activities

a. The N-NC IG completed Intelligence Oversight Inspections of JTF-N and the NORAD and USNORTHCOM J2. The organizations were well versed in their duties and responsibilities, understanding constitutional constraints, and the laws and directives which govern the collection, dissemination and storage of sensitive, information, especially that data which is constrained by Intelligence Oversight guidance or acquired on non-DoD persons. Their programs are very strong, with only minor recommendations for improvement. One subordinate command (AFNORTH) did not submit their quarterly report at this time. An addendum will be submitted when we receive the report.

b. Training: All N-NC Intelligence Directorates and subordinate commands have conducted initial and refresher training for personnel. The percentage of personnel trained in the command is currently 99%, and all efforts will be made to maintain/Increase this level.

c. N-NC has updated and disseminated the command IO Instruction (NNCI14-103). This instruction has been implemented and changes in the new guidance have been implemented/highlighted during recent IO Inspections. Major changes include: implementation of a more frequent self-inspection process, conducting additional key word searches on N-NC computer systems, defining several nebulous terms used in the current implementing regulations, and increasing the depth of IO training within the command.

1. There were no intelligence, counterintelligence, or rntelligcnco-Telatod violations of law, regulation, or policy in USSTRATCOM this quarter.

2. During this quarter, the IO inspected three IO program*: 1) USSTRATCOM J2, Intelligence Directorate, 2) Joint Functional Component Comma»! (JFCQ Global Strike and Integration (GSI) J2, Intelligence Directorate, and 3) Joint Information Operations Warfare Command (JIOWC), Lackland AFB, TX. There was no questionable intelligence activity at any of these organizations. The IO programs in USSTRATCOM J2 and JFCC GSI J2 are excellent The JO program at the JIOWC is satisfactory. There were Some administrative deficiencies (out of date IO references and lack of training documentation) flat detracted from the JIOWCs program. All three TO programs arc meeting DoD IO program requirements and all personnel Interviewed were well aware of the requirements of the DoD IO program. The IO training programs in these organizations are sound and meet the needs of the organizations' personnel and DoD. Lastly, the IO oversight and processes at these three organizations are meeting the requirements of DoD.

3. There were no changes to the USSTRATCOM IO programs during this period.

4. There were no changes to USSTRATCOM IO directives or policies conccnrfng intelligence or intettigenc*>rel2ted activities during this period.

1. Below Is a consolidated summary of all Combatant Commands (COCOMs) Intelligence Oversight (IO) Reports for the Fourth Quarter, FY07. Attached are al l COCOM reports w i th further Information. Also, Service Components wil l report 10 Information through their Service.

a) USCENTCOMIG: Augmentation forces for Operation ENDURING FREEDOM assigned to USCENTCOM at Mac Di l l AFB are receiving init ial intelligence oversight training. There were no questionable activities reported.

b) USEUCOM IG: Intelligence oversight training included 154 Init ial and 3 4 3 refresher briefings. Internal assessments were conducted by EUCOM J2, SHAPE, Survey, USNIC-Pristlna, USNIC-Sarajevo, Special Operations Command, Europe (SOCEUR, Joint Analysis Center (JAC) and there were 3 4 3 personnel interviewed.

EUCOM IG wi l l inspect the Joint Analysis Center, Molesworth, United Kingdom, teaming w i th the Asst IG for 10, Defense Intelligence Agency, in late October 2007.

c) USJFCOM IG; Conducted a staff assistance visit (SAV) at the request of Standing Jo in t Force Headquarters (SJFH0) from 10-14 September 2007 and determined that, the intelligence officer demonstrated a clear understanding of al l regulations related to IO and had solid control measures in place to ensure compliance.

The USJFCOM IG's office also conducted a uni t command inspection of the Joint Warflghting Center i n Suffolk, Virginia from 23-27 Ju ly 2007 that included intelligence oversight. H ie intelligence officer, was in compliance with al l appropriate regulations and maintained accurate training records for the command's IO program.

d) USNORTHCOM IG: The N-NC IG, completed IO Inspections at JTF-AK and JTF-CS. The organizations were well versed in their duties and

responsibilities, understanding constitutional constraints the laws and directives which govern the collection, dissemination and storage of sensitive information, especially the data this Is constrained by 10 guidance or acquired on non-DOD persons. Their programs are veiy strong w i th only minor recommendations for improvement.

All N-NC Intelligence Directorates and subordinate commands have conducted ini t ia l and refresher training for personnel. 99% of personnel have been trained in the command and all efforts wi l l be made to maintain/increase the level.

N-NC has also updated and disseminated the command IO Instruction (NNCI-14-103). This instruct ion has been implemented and changed, new guidance wi l l be highlighted during upcoming IO Inspections.

Al l N-NC Intelligence Directorates and JTFs have Implemented more frequent database Information review processes (30-60 day reviews) to ensure data repositories have effective follow-up assessments concerning the need to retain information.

e) USPACOM IG: Annual training is being conducted v ia computer wi th certificates being sent to IO coordinator, new members are st i l l receiving in-person indoctrination training. ALCOM computer drives are being reconfigured. Al l reporting commands are conducting indoctr ination and refresher training. N-NC IG Procedure 15 investigation into potential JTF-AK-IO violations is i n progress as an outcome of their inspection of ALCOM/ JTF-AK J2 conducted on 6-8 March 07. Final report from N-NC is forthcoming.

i) USSOUTHCOM IG: Automated training notifications go out monthly as a reminder to al l personnel who are required to undergo tra in ing during that month. Jo int Task Force Bravo (JTF Bravo), Special Operation Command South (SOCSO-J2), Jo int Interagency Task Force-South (< J I A T F S J 2 CD, and Joint Task Force, Guantanamo Bay. Cuba {JTF-GTMO) al l submitted a negative report to any IO violations.

g) US SO COM IG: There were no IO inspections conducted dur ing this quarter.

h) USSTRATCOM IG: There were no IO inspections conducted during this quarter. USSTRATCOM IG had an IO inspection scheduled at the Joint Information Operations Warfare Command (JIOWC), Lackland AFB, but had to postpone due to other Command priorities. The IO Inspection wi l l be rescheduled, as well as scheduling other units* IO inspections, as soon as priorities allow.

1) USTRANSCOMIG (TCIG): Conducted the USTOANSCOM quarterly 10 program inspection of the Joint Reserve Directorate CTCJ9)/Joint Transportation Reserve Unit (JTRU), i n coordination w i th the JTRU IO Program Monitor on 8 September 07. The inspection consisted of a review of IO program administration, to include required in i t ia l /annual IO training of TCJ9/JTRU personnel, and an evaluation of the effectiveness of that IO training. 100% of assigned personnel are trained, and al l personnel who were evaluated demonstrated appropriate knowledge of IO regulations and procedures. Two JTRU personnel are currently deployed from the unit , but they have completed annual IO refresher training. •

Subject: US. Joint Forces Command (USJFCOM) Intelligence Oversight Report foi the Quarter FY-07

1. IHegd or improper activities:

No intelligence activity has been identified which is reasonably believed to be ille|»3l or contrary to Executive Qrdet of Department of Defense injunctions concerned with intelligence oversight.

2, Significant Intelligence Oversight activities:

a. The Joint Forces Command Inspector General conducted a staff assistance visit {SAV} at the request of Standing Joint Force Headquarters (SJFHQ) from I 0 to 14 September 2007. Mr. Etey Canbanas, ibe intelligence oversight officer for SJFHQ, demonstrated a clear understanding of ail regulations related to IO and hid solid control measures in place lo ensure compliance.

Results of Intelligence Oversight Inspections:

a. The US JFCOM Inspector General's Office conducted a unit command inspection of the Joint Warfighting Center in Suflblk, Virginia fhmt 23-27 July 2007 that included intelligence oversight. The intelligence overeigit officer, LTC Tim Brandon, USAF, was in comp I lance with ¿it) appropriaie rogu 1 aEion and maintained accunte training records for the command's intelligence oversight program
