ASSIGNMENT 3 POST- GRADUATE DIPLOMA IN ENVIRONMENTAL LAW AND POLICY (PGDELP) May 2016-17 Dear Participant, Assignments are a part of your continuous evaluation process. The main purpose of assignment is to test your comprehension of the study material received from us and also to help you understand the course aspects. Participants must submit a total of five assignments, one for each theory Course. Submission of Assignment: Click on the link below/copy-paste the link below in address bar – http://www.wwfindia.org/about_wwf/enablers/cel/submit_document.cfm Fill in all the required particulars i.e. name, email address, enrollment number, course name and document name (as provided in drop down options). Upon completion of all required fields, you will be prompted to upload the document/your submission, only after you finish uploading the document you have to click on 'submit'. Please note that the message indicating that your submission was 'successful' is an acknowledgement of receipt of your submission. No email will be sent as an acknowledgement for your submission. Each course shall have one assignment and will carry 40% weightage while 60% weightage is given to the term- end examinations. The assignment has to be submitted within a certain time span (see time-line for details of submission dates). It is very important to submit the assignments as per indicated dates, as late submission would lead to negative marking. Your answers should be within the approximate range of the word-limit set for each question. COURSE III- INTERNATIONAL ENVIRONMENTAL LAW AND POLICY

1. The Principle of Common But Differentiated Responsibility (CBDR) was brought in

to the sphere of international environmental conservation in the Rio Declaration in 1992. It lays down that while there is a common global responsibility to protect and conserve the environment and promote sustainable development, the burden for bearing the same has to be different for each country based on its historic context. CBDR has now been brought in as one of the guiding principles of the Paris Agreement and is going to be the crux to its implementation.

Do you think that CBDR should find a place within the international environmental law framework? Keeping in mind that rates of pollution are growing at the fastest rate in developing nations including India and China, do you feel that differentiating responsibility and placing a lower responsibility on them is a responsible idea moving forward? Answer providing reasons.

2. The Ramsar Convention was signed in 1971 for the protection of wetlands and waterfowl habitat. The text of the convention is available at the link below:

http://www.ramsar.org/sites/default/files/documents/library/current_convention_text_e.pdf While the convention makes it necessary for each contracting party to designate at least one Ramsar site within its borders, and looks to provide for the protection of such sites, it also leaves many with the feeling that it lacks in its protection motive in certain ways.

Please read the text of the convention and highlight the shortfalls that take away from its protection motive. (600-750 words, 10 marks)

3. A lot of international environmental law has developed through cases that have come

up over the years. Kindly write notes on the following cases highlighting the major principles of law and environmental protection that arose from them.
