Introduction

I. Purpose

The WIA Eligible Training Provider Manual provides educational institutions with updated information about the Workforce Investment Act (WIA), Louisiana’s Workforce Investment System, and provides the necessary guidance, procedures, and requirements in becoming an Eligible Training Provider (ETP) in Louisiana. The Eligible Training Provider List is a list of providers and their training programs and/or services that qualify for WIA funding eligibility. Only providers’ programs, courses or classes that meet specific criteria and requirements are listed on Louisiana’s ETPL. The ETPL provides Louisiana with its primary means of achieving the U.S. Department of Labor’s (USDOL) WIA goals and Louisiana’s Workforce Investment Strategies. Requirements used to determine the eligibility of training/education providers and their programs are found in the Workforce Investment Act of 1998 (P.L. 105-220.), the USDOL’s Training and Employment Guidance Letters (TEGLs), Louisiana State Law, and Louisiana Workforce Commission’s (LWC) Office of Workforce Development (OWD).

II. What is New with the Eligible Training Provider Manual

• The manual has been reformatted and divides up information by chapters and sub-chapters.

• The chapters and sub-chapters within the revised manual are numerically aligned for easier citation and instructional guidance.

• Additional WIA information has been added to give providers guidance on the Workforce Investment Act and Louisiana’s Workforce Investment System’s strategies and structure.

• The Eligible Training Provider Application has been removed because providers can now apply

directly within the HiRE system by selecting the appropriate option when creating an account.

• The HiRE user registration process in section 8.03 now includes step-by-step instructions for applying as a WIA training provider on LWC's website.

• A standardized fillable HiRE Access Request and Institutional Update Form have been created to assist in ensuring the most up-to-date information is in the HiRE system.

• A standardized fillable “No Finds” List Request Form and Local and State Appeal Forms have been

created to standardize the appeals process and to simplify the supplemental information request process.

• A “Student Data Security Awareness Form” has been created to emphasize the importance of the

integrity of student data and personal information.

• The Student Certification Form has been revised to request exiter and enrollee data by program and not by provider. Submitting information by provider does not help identify the completion rate for each program.

• The directions for completing student data submission clearly state that providers must submit data for non-completers as well as completers.

• A new technical HiRE walkthrough has been created to assist the provider in

application/reapplication process through the HiRE system.

• Policy citations have been added to allow further research and direction for the providers.

• Example Performance Measure Calculations have been simplified to provide a clearer understanding on performance measure calculations.

• Exhibits have been added to give a visual presentation on the Louisiana Workforce Investment Structure, the structure of the Workforce Investment Council, and the structure of the Local Workforce Investment Boards.

• LWIA maps and data have been added to provide better contact and coordination for the providers with their designated Louisiana Workforce Investment Area (LWIA), Local Workforce Investment Board (LWIB), and Business and Career Solution Centers.

III. Acronyms and Definitions

• ACINET - America's Career Info Net is a resource for making informed career decisions to support a demand-driven workforce investment system. If you are a student, jobseeker, workforce professional, or employer this site can help you assess your options, find education and training, find a job, or grow your business.

• ALMIS - America's Labor Market Information System is an initiative spawned by the Employment and Training Administration of the U.S. Department of Labor in the mid-1990’s. ALMIS includes the Job Vacancy Survey Workgroup, Employer Benefits Survey Workgroup, National Crosswalk Service Center, and administrative records research. These efforts represent leading edge research on topics that are of importance to employers and other customer groups.

• BEA - Bureau of Economic Analysis is a division of the U.S. Department of Commerce that collects and disseminates data regarding different aspects of the economy.

• BLS - Bureau of Labor Statistics is the principal fact-finding agency for the Federal Government in the broad field of labor economics and statistics. The BLS is an independent national statistical agency that collects, processes, analyzes, and disseminates essential statistical data to the American public, the U.S. Congress, other Federal agencies, State and local governments, businesses, and labor. The BLS also serves as a statistical resource to the U.S. Department of Labor.

• BOR - Louisiana Board of Regents is the state licensing agency that determines if educational providers and their programs/services need to be licensed in the state of Louisiana.

• Baseline Wage - the baseline wage is the minimum wage calculated for full time employment over

a calendar quarter of a year, which approximately 13 weeks. (Example: Minimum Wage X 40 Hours X 13 Weeks.)

• Calendar Year Quarter - is a three month period within a calendar year. There are four calendar year quarters: January through March, April through June, July through September, and October through December. These calendar year Quarters are used in the processing of program performance timelines.

• CC - Continued Claims is a request filed for waiting period credit or payment for one or more weeks of employment. Participants must respond to questions concerning their request for continued claims. These claims are usually filed by mail or telephone; the State will provide filing instructions. They are filed weekly or bi-weekly. Any earnings from work during the week(s) must be reported.

• CES - Current Employment Statistics are estimates of nonagricultural wage and salary employment and production workers hours and earnings by industry, produced as part of a nationwide program, in cooperation with BLS, for the state and each metropolitan statistical area (MSA) from a sample of employing establishments. This data is published in the monthly Labor Market Information Bulletin. (PDF)

• CEW - Covered Employment and Wages is unit in Research and Statistics that collects quarterly reports of employment from employers covered by the Employment Security Law and who pay

unemployment insurance for employees. The report, which is produced quarterly and annually, details such data as wages, industry employment by parish, number of employing units, etc.

• CFOI - Census of Fatal Occupational Injuries includes information on events or exposure causing fatalities, worker characteristics, and fatalities by occupation and industry.

• CPI - Consumer Price Index measures the average annual and monthly changes in prices via a fixed market basket of goods and services for the United States. It is also known as the Cost of Living index and is produced in two series, All Urban Consumers and Urban Wage and Clerical Workers.

• CPS - Current Population Survey is a monthly household survey of approximately 56,000 selected households in the U.S. conducted for BLS by the Census Bureau. Respondents are interviewed to obtain information on the employment status of each household member, age 16 and over, during the reference week.

• CIP CODE - Classification of Instructional Programs provides a taxonomic scheme that will support the accurate tracking, assessment, and reporting of fields of study and program completions activity. CIP was originally developed by the U.S. Department of Education's National Center for Education Statistics (NCES) in 1980; with revisions occurring in 1985, 1990, 2000 and 2010 edition (CIP-2010) is the fourth revision of the taxonomy and presents an updated taxonomy of instructional program classifications and descriptions.1

• Completer - a completer is a student that completes a providers program and obtains whatever certificate, degree, etc. from the school.

• Consumer Reporting System (CRS) - is the mechanism that tracks activities and outcomes for various programs, including but not limited to: WIA, Wagner-Peyser, LEAP, TAA, Rapid Response, and the Veterans Program, along with employer services. The CRS system in Louisiana is integrated into the Helping Individuals Reach Employment (HiRE) System.

• CFR - Code of Federal Regulations.

• Date of Program Exit - the term program exit means a participant has not received a service funded by the program or funded by a partner program for 90 consecutive calendar days, and is not scheduled for future services. The exit date is the last date of service. (Exceptions: Delay before the beginning of training, Health/medical condition or providing care for a family member with a health/ medical condition, and Temporary move from the area that prevents the individual from participating in services, including National Guard or other related military service.)

• DUA - Disaster Unemployment Assistance provides financial assistance to individuals whose employment or self-employment has been lost or interrupted as a direct result of a major disaster declared by the President of the United States.

• ETP - Eligible Training Provider is an organization, entity or institution such as a public or private college and university, community based organization, or proprietary school for which program(s) have been approved by a Louisiana Workforce Investment Boards and submitted to the state for inclusion on the statewide ETPL.

• Enrollee - is a student that is currently enrolled in a provider’s program for a state Fiscal Year.

• Enrollee Data - is data that the LWC request from providers for a WIA program year. (Example: WIA program year 2013 requires student enrollee data from data year June 1, 2011 through May 31, 2012.)

• ETA - Employment and Training Administration is a division within the U.S. Department of Labor that seeks to build up the labor market through the training of the workforce and the placement of workers in jobs through employment services.

• ETPL - Eligible Training Provider List is a list of provider programs or services that have been approved by the LWIBs and LWC by meeting the criteria outlined by the WIA, the state, and the LWC.

• Exit Quarter - is the calendar year quarter containing the exit date of a student from a program.

• Exiter - an exiter is a completer or non-completer of a program that exits a provider’s program.

• Exiter Data - is data that the LWC request from providers for a WIA program year and includes completers and non-completers and includes all participants not just WIA funded students. (Example: WIA program year 2013 requires student exiter data from data year June 1, 2010 through May 31, 2011.)

• GDP - Gross Domestic Product represents the total value of all goods and services produced within the borders of the United States. This also includes any foreign company products that are produced in the United States.

• GNP - Gross National Product represents the total value of all American national goods and services produced inside and outside the borders of the United States.

• GSP - Gross State Product is the value added in production by the labor and property located in a state. GSP for a State is derived as the sum of the gross state product originating in all industries in a State. In concept, an industry's GSP, referred to as its "value added", is equivalent to its gross output (sales or receipts and other operating income, commodity taxes, and inventory change) minus its intermediate inputs (consumption of goods and services purchased from other U.S. industries or imported). Thus, GSP is often considered the state counterpart of the nation's gross domestic product (GDP)

• HiRE - is Louisiana’s software system and mechanism to track activities and outcomes for various programs, including but not limited to: WIA, Wagner-Peyser, LEAP, TAA, Rapid Response, and the Veterans Program, along with employer services. The CRS and LAVOS system has been integrated into the Helping Individuals Reach Employment (HiRE) System.

• IAWP - International Association of Workforce Professionals formerly called IAPES is an international support group for employees of employment security agencies.

• IC - Initial Claims are any notice of unemployment to initiate a request either for a determination of entitlement to and eligibility for compensation, or for a subsequent period of unemployment within a benefit year or period of eligibility.

• ILO - International Labor Organization Brings together the governments, employers and workers of its 174 member states for the purpose of improving social protection and conditions of life and work throughout the world.

• ITA - Individual Training Account is the primary mechanism used to pay for training services for eligible students.

• IWTP - Incumbent Worker Training Program provided by the Louisiana Workforce Commission is a state training comprised of two subparts: (1) Small Business Employee Training (SBET)--The IWTP Small Business Employee Training Program (SBET) is designed to benefit business and industry by assisting in the skill development of existing employees through individual, standardized (off-the shelf) training. Employers are reimbursed for tuition and required textbooks and manuals once the training has been completed and proper documentation has been submitted to the Louisiana Workforce Commission (LWC). Training costs cannot exceed $3,000 per trainee per state fiscal year (July 1 - June 30). Funding is provided through the Workforce Development Training Account,

at 2.3% of all IWTP funds available; and (2) Customized Training--The Incumbent Worker Training Program (IWTP) is a partnership between the Louisiana Workforce Commission (LWC), business and industry, and training providers. The IWTP is designed to benefit business and industry by assisting in the skill development of existing employees and thereby increasing employee productivity and the growth of the company. These improvements are expected to result in the creation of new jobs, the retention of jobs that otherwise may have been eliminated, and an increase in wages for trained workers. The program is funded by a portion of Unemployment Insurance (UI) tax contributions dedicated solely for customized training.2

• LSA - Labor Surplus Areas are classified on the basis of civil jurisdictions rather than on a metropolitan area or labor market area basis. Civil jurisdictions are now defined as all cities with a population of at least 25,000 and all counties, and are classified as labor surplus areas when their unemployment rate was at least 20 percent above the average unemployment rate for all States (including the District of Columbia and Puerto Rico) during the previous 2 calendar years.

• LCTCS - Louisiana Community and Technical College System is the entity that oversees all community and technical colleges in the state of Louisiana.

• LLSIL - Lower Living Standard Income Level in WIA Section 101(24) defines the LLSIL as "that income level (adjusted for regional, metropolitan, urban, and rural differences and family size) determined annually by the Executive Director based on the most recent lower living family budget issued by the Executive Director."

• LOIS - Louisiana Occupational Information System is a comprehensive labor market information delivery system developed by LWC and Geographic Solutions, Inc., providing a single source of demographic, economic, and labor market information for the state, MSA's and parishes.

• Louisiana State Fiscal Year - a fiscal year in the state of Louisiana begins on June 1 of any year and ends on May 31 of the following year.

• LAUS - Local Area Unemployment Statistics is a program that produces the civilian labor force estimates including the employed, unemployed and the unemployment rate for the state, MSAs, and the 64 parishes.

• LMI - Labor Market Information is data on job seekers, employment, unemployment, and changes in industrial structure, technological changes, conditions of employment, wage rates and other related statistics.

• LWIB - Local Workforce Investment Board - See the Definition of WIB.

• LWIA - Local Workforce Investment Areas are regional areas throughout the state in which Workforce Investment Act funds are distributed.

• LWC - Louisiana Workforce Commission.

• MSA - Metropolitan Statistical Area is a geographic area comprised of a county/parish generally containing a central city (or twin cities) of 50,000 inhabitants or more, plus contiguous counties/parishes that are socially and economically integrated with the central city. Louisiana has

• NAICS - North American Industry Classification System

• Non-completer – a non-completer is a student that does not complete a providers program.

• NSA - Not Seasonally Adjusted is data that reflects normal patterns for any time series. These data are unadjusted and reflect seasonal variation such as consistently higher or lower unemployment that occurs each year. A not seasonally adjusted figure for a month or quarter can only be compared with that same period from another year.

• OES - Occupational Employment Statistics is a program that manages a survey of establishments conducted in cooperation with BLS to capture detailed occupational employment and wages.

• OSH - Occupational Safety and Health Statistics provide vital statistics on fatal accidents and illnesses and non-fatal injuries and illnesses.

• OIS - Office of Informational Services.

• O*Net - The O*NET program is the nation's primary source of occupational information. Central to the project is the O*NET database, containing information on hundreds of standardized and occupation-specific descriptors. The database is continually updated by surveying a broad range of workers from each occupation. Information from this freely available database forms the heart of O*NET Online, the interactive application for exploring and searching occupations. The database also provides the basis for our Career Exploration Tools, a set of valuable assessment instruments for workers and students looking to find or change careers.

• OWD - Office of Workforce Development.

• Program Year - Refers to the calendar period between June 1 of one year and May 31 of the following year.

• Quarter After Exit - is the quarter after the exit quarter.

• QCEW - Quarterly Census of Employment and Wages is a report detailed by parish for quarterly wages, average weekly wage, monthly employment, and number of employing units. Data comes from the employers quarterly tax files and is detailed by three digit NAICS for the state and two digit NAICS for each parish.

• RLMA - Regional Labor Market Areas are an economically integrated area within which individuals can reside and find employment within a reasonable distance or can readily change jobs without changing their place of residence. RLMAs consist of all 64 parishes of the state.

• SA - Seasonally Adjusted is Data that are adjusted to remove any factors reflecting a repetitive pattern from year to year. For example, employment in retail sales is consistently high around the holiday season, and a seasonally adjusted data series would not reflect this pattern. A seasonally adjusted number can be compared with any other seasonally adjusted number in a particular series, while an unadjusted number can only be compared with another unadjusted number from that exact time in another year.

• SESA - State Employment Security Agencies are systems of over 1700 employment security offices (throughout the U.S.) provide a variety of placement-related services without charge to job seekers and employers.

• SCORECARD - is the performance data system on post-secondary training programs in the state, and is based on the employment tracking of students who exit the programs.

• SIC - Standard Industrial Classification is an industry 4-digit coding system developed in the 1930s when the economy consisted primarily of industrial manufacturing and agriculture. This system is currently being phased out and replaced by the North American Industry Classification System (NAICS).

• SOC - Standard Occupational Classification is a universal occupational classification system that is designed to cover all occupations in which work is performed for pay or profit, reflecting the current occupational structure of the United States.

• TEGL - Training and Employment Guidance Letter.

• TEUC - Temporary Extended Unemployment Compensation provides extra weeks of federally- funded unemployment benefits to unemployed workers throughout the country who have received all regular unemployment benefits available to them.

• UCFE - Unemployment Compensation for Federal Employees provides benefits for eligible unemployed former civilian federal employees.

• UCX - Unemployment Compensation for Ex Service Members program provides benefits for eligible ex-military personnel.

• UI - Unemployment Insurance is a program providing benefits to insured and eligible persons who are out of work due to conditions beyond their control.

• UIC - Unemployment Insurance Claims is a program that helps cushion the impact of economic downturns and brings economic stability to communities, states, and the nation by providing temporary income support for laid off workers.

• UI Wage Records - is a method of determining unemployment insurance (UI) benefits based on quarterly employee wage reports already filed by employers with the state's Unemployment Insurance Agency (UIA). Under federal law, employers are required to submit each employee's quarterly wage records. States, however, are not required to use that information as the basis for unemployment claims. Forty-nine states have chosen to rely on the quarterly wage records rather than requesting wage information from employers. Michigan is the 50th state to use quarterly wage records.

• Unsubsidized Employment - Employment not financed from funds provided under a grant. In the grant program the term “adequate” or “suitable” employment is also used to mean placement in unsubsidized employment which pays an income adequate to accommodate the participants’ minimum economic needs.

• USDOL - United States Department of Labor.

• The Wagner-Peyser Act - The Wagner-Peyser Act of 1933 established a nationwide system of public employment offices known as the Employment Service.

• WARN - Worker Adjustment and Retraining Notification Act. WARN is an act that offers protection to workers, their families, and communities by requiring employers to provide notice 60 days in advance of covered plant closings and covered mass layoffs. This notice must be provided to either affected workers or their representatives (e.g., a labor union), to the State Dislocated Worker Unit, and to the appropriate unit of local government.

• WIA - Workforce Investment Act of 1998 - was established as a broad-based labor market system using federal job training funds for adults, dislocated workers and youth.

• WIA Program Year - a WIA program year begins on January 1 of any year and ends on December 31 of the same year.

Chapter 1. The Workforce Investment Act

1.01 Purpose of the Workforce Investment Act1

The Workforce Investment Act (Public Law 105-220), signed into law August 7, 1998 by President Clinton, was intended to reform the current federal job training programs and to create a new comprehensive workforce investment system. This new workforce investment system incorporated the most successful aspects of the current federal labor programs and created the "One-Stop" concept; where information about and access to a wide array of job training, education, and employment services are available at a single location. As part of this new system design, representatives from business, labor, and community organizations are partnered with state and local officials (government and educational) in the creation of the local and state workforce investment boards for strategic planning, policy development, and oversight of the workforce investment system. This structural involvement of local business, labor, and community representatives creates a system that is better able to identify the needs of its citizens and its community’s workforce needs.

1.02 Key Services Delivery Principles2

The intent of the Workforce Investment Act and its policies was to create a workforce investment system where service delivery is customer-based and value added and to assist eligible Americans management of their careers and career opportunities by obtaining the necessary tools to be successful. These goals are accomplished by enhancing the customer’s choice and access through an integrated “One-Stop” delivery model. The “One Stop” delivery model was designed from the ground up to be focused on the individual and improving their ability to increase their employment opportunities, job retention abilities, earnings potential, and occupational skills obtainment. The Workforce Investment Act’s seven guiding principles are:

A. Streamlining Services - is accomplished by coordination and integration of programs and

providers with the One-Stop delivery systems;

B. Empowering Individuals - is achieved by giving eligible adults financial power by the use of Individual Training Accounts (ITAs) at qualified institutions to pay for all the costs of training or to supplement financial aid already available. In addition, through a system of consumer reports that provide information on the performance outcomes of training and the education providers; individuals are granted greater levels of information and guidance that empowers them through the advice, guidance, support, and eligible activities available at the One-Stop system locations;

C. Granting Universal Access - is accomplished by individuals having access to the One-Stop delivery system that provides the core employment-related activities that inform clients about job vacancies, career options, student financial aid, and relevant employment trends. In addition, the One-Stop system can teach individuals how to conduct a job search, write a resume, and interview with an employer. All these services are provided to help the individual advance themselves in today’s diverse workforce;

D. Increasing Accountability - is achieved by establishing core performance indicators of performance that each state and local entity managing the workforce investment system must meet and by providing incentive funds for those who exceed the performance measures. In

addition to the state and local entities performance requirements, training providers and their programs must also demonstrate successful performance to remain eligible to receive funds under the WIA. This accountability allows participants with ITA's to make training choices based on program outcomes that create a competitive system to ensure the individual gets the best possible service for the dollar;

E. Increasing the Role for Local Workforce Investment Boards and the Private Sector - is accomplished by requiring the states to create local business-led boards focusing on strategic planning, policy development, and oversight of the their local workforce investment system. Businesses, community organizations, labor unions, and the labor workforce have a mutual interest in the quality of their local workforce investment system. These organizational partnerships active involvement with state and local government help identify the skills needed, jobs available, and career fields that are expanding, to help develop the necessary services and programs that meet the needs of the workforce and ensure the success of the Workforce Investment Act;

F. Creating State and Local Flexibility - is accomplished by allowing states and localities to have significant authority to build on existing reforms to be innovative in creating workforce systems needed to meet their community needs; and

G. Improving Youth Programs - is achieved by creating Youth Councils that are linked to local labor market needs and community youth services with strong connections between academic and occupational learning.

1.03 Structure of the Law3

The Workforce Investment Act is divided into five titles.

A. Title I - Workforce Investment Systems

Title I of the WIA repeals the Job Training Partnership Act programs and creates a new workforce investment system with the intent of improving the quality of the workforce, reducing welfare dependency, and enhancing the productivity and competitiveness of the nation’s workforce. The new workforce investment system establishes:

1. Eligibility requirements for states to receive the WIA funds;

2. State and local Workforce Investment Boards; Local Workforce Investment Areas; Youth Councils; and "One-Stop" Delivery Centers (to provide customer access to services in one location);

3. State and local funding allocation requirements;

4. Policies for determining initial and subsequent provider eligibility; and

5. Links to other national labor programs and the Workforce Investment Act including: Job Corps, Native American programs, Migrant and Seasonal Farmworker programs, Veterans' Workforce Investment programs, and Youth Opportunity and National Emergency Grants.

Additionally, Title I of the WIA authorizes the state and local areas to use Workforce Investment Act funds for approved statewide activities defined in sections 129 and 134 of the WIA that provide services to eligible adults, dislocated workers and youth. Additionally, it creates statewide accountability systems that give the state and local areas flexibility in planning and implementing the state workforce investment system.

B. Title II - Adult Education and Literacy

Title II of the WIA reauthorizes and amends Adult Education and Literacy programs, and aligns these services with the workforce investment system to coordinate and link occupational skill training employers and post-secondary institutions.

C. Title III - Workforce Investment-Related Activities

Title III of the WIA amends the Wagner-Peyser Act to require that Employment Service/Job Service activities become part of the "One-Stop" system created in Title I of the WIA and links the Trade Adjustment Assistance and the North American Free Trade Agreement Transitional Adjustment Assistance programs to the Workforce Investment Act.

D. Title IV - Rehabilitation Act Amendments Of 1998

Reauthorizes the Rehabilitation Act programs and links them to the state and local workforce investment system.

E. Title V - General Provisions

Title V provides additional details on the WIA, workforce development programs, and the incentive grants for states exceeding their performance levels.

1.04 Governance Structure

The Workforce Investment Act (WIA) authorizes and mandates the creation of state and local entities to manage the new Workforce Investment System. Title I of the Workforce Investment Act requires the state to:

A. Establish a State W orkforce Investment Board - in accordance to section 111(a) of the Workforce

Investment Act;

B. Designate Local W orkforce Investment Areas - in accordance with section 116(a)(1) of the Workforce Investment Act;

C. Establish and Certify Local Workforce Investment Boards - in accordance to section 117 of the Workforce Investment Act;

D. Create Youth Councils or Alternative Youth Entities - in accordance to sections 117(h) and 117(i) of the Workforce Investment Act; and

E. Create and Maintain Local “One-Stop” Service Centers throughout the state - in accordance to section 121 of the Workforce Investment Act

1.05 State Workforce Investment Boards

The State Workforce Investment Boards (SWIBs), created by section 111(a) of the Workforce Investment Act stipulate membership requirements, as required by section 111(b) of the WIA. The SWIB is required to advise the governor and help design, implement, and provide oversight of the new workforce investment system, as described in section 111(d) of the WIA. In addition to its mandated functions, the SWIB must submit an annual report and comment annually on the measures taken by the state pursuant to section 113(b)(14) of the Carl D. Perkins Vocational and Applied Technology Education Act (20 U.S.C 2323(b)(14)) to the U.S. Labor Secretary.

1.06 Local Area Designations Requirements

In accordance with section 116(a) of the Workforce Investment Act (WIA), the state must create Local Workforce Investment Areas taking into consideration the state’s geographic areas, population distributions, customer access to services, locations relative to local labor markets, and financial sustainability of the LWIAs; however, section 116(a)(2) of WIA requires the state to grant temporary automatic local area designations to the following:

A. Any regional entity, area, or locality with a population of 500,000 or more;

B. Any regional entity, area, or locality that request to be designated as a local workforce investment area; has a population of 200,000 or more; served as a service delivery area or sub-state area under the Job Training Partnership Act (JTPA); and met the required JTPA’s performance measures during the preceding two years; and

C. Any regional entity, area, or locality that has served as a service delivery area under Section 101 of the JTPA before the enactment of the Workforce Investment Act; has a population of less than 1,100,000; and a population density greater than 900 persons per square mile.

The temporary local area designations are for two-year terms after which the state must review the designated areas performance to ensure compliance with the state’s workforce investment board’s performance standards; and to ensure the area has maintained the fiscal integrity of their appropriated WIA funds.4

1.07 Local Workforce Investment Boards

In each designated Local Workforce Investment Area in the state, Local Workforce Investment Boards (LWIBs) must be established and certified by the Governor, as stipulated by section 117(a) of the WIA. These LWIBs are designed and are responsible for setting policy, coordinating the WIA approved activities, creating “One-Stop” partnerships, and performing all other required functions as mandated by section 117(d) of WIA.

1.08 “One Stop” Delivery System

The "One-Stop" delivery system concept created by section 121 of the Workforce Investment Act (WIA), is in essence a local center where customers and employers can access a wide array of information about job training, education, and employment services in a single location. This “One Stop” center concept effectively provides the customer with a single designated access location for Core, Intensive, and Training Services pursuant to sections 128 and 133 of the WIA; and other services described in title II, III, and IV of the WIA. The “One-Stop” delivery system gives the customer and prospective employers a single point of contact that can help all parties reach their individual goals and develop the workforce in their LWIA.

1.09 State Allocations

The Workforce Investment Act defines three funding streams that are distributed to the states for Adults, Dislocated Workers, and Youth.

A. Adult Funds - are allocated to the states in accordance with the following formula, as specified in

section 133 of the Workforce Investment Act:

• 33 1/3 percent on the basis of the relative number of unemployed individuals in areas of substantial unemployment in the local workforce investment area, compared to the total

number of unemployed individuals in areas of substantial unemployment in all local workforce investment areas in the state;

• 33 1/3 percent on the basis of the relative excess number of unemployed individuals in the local workforce investment area, compared to the total excess number of unemployed individuals in all local workforce areas in the state; and

• 33 1/3 percent on the basis of the relative number of disadvantaged adults in the local

workforce investment area, compared to the total number of disadvantaged adults in all local workforce investment areas in the state.

B. Dislocated Workers Funds - are allocated to the states in accordance with the following formula,

as specified in section 133 of the Workforce Investment Act:

• 33 1/3 percent on the basis of the relative number of unemployed individuals in each State, compared to the total number of unemployed individuals in all States;

• 33 1/3 percent on the basis of the relative excess number of unemployed individuals in each State, compared to the total excess number of unemployed individuals in all States; and

• 33 1/3 percent on the basis of the relative number of individuals in each State who have been unemployed for 15 weeks or more, compared to the total number of individuals in all States who have been unemployed for 15 weeks or more.

C. Youth Funds - are allocated to the state according to the following formula, as specified in section

128 of the Workforce investment Act.

• 33 1/3 percent on the basis of the relative number of unemployed individuals in areas of substantial unemployment in the local workforce investment area, compared to the total number of unemployed individuals in areas of substantial unemployment in the state;

• 33 1/3 percent on the basis of the relative excess number of unemployed individuals in the local workforce investment area, compared to the total excess number of unemployed individuals in the state; and

• 33 1/3 percent on the basis of the relative number of disadvantaged youth in the local

workforce investment area, compared to the total number of disadvantaged youth in the state.

1.10 In-State Allocations

The Workforce Investment Act (WIA) requires states to maintain a percentage of each WIA funding stream and to distribute the remaining amounts to the Local Workforce Investment Areas, as specified in sections 128 and 133 of the WIA. The following are the WIA mandated state and local area distribution requirements according to each defined funding stream.

A. WIA State Funding Distributions:

• Adult Funding Stream. The state retains 15 percent of the adult funding stream allocation

and it is reserved for statewide activities, which includes incentive grants, technical assistance aid, management information system cost, evaluation cost, and "One-Stop" system building cost;

• Dislocated Worker Funding Stream. The state retains 40 percent of the dislocated worker funding stream. The state may use 15 percent for WIA approved statewide activities and 25 percent is held in reserve for rapid response activities; and

• Youth Funding Streams. The state retains 15 percent of the youth funding stream for WIA approved statewide activities.

Allowable state activities include incumbent worker projects, authorized youth and adult activities, and additional system building cost. The state’s 15 percent reserve amounts from each stream may be merged to increase services to one of the three groups (adults, dislocated workers, or youth.) in manner identified in section 128(a)(2) of the WIA.

B. Local Workforce Investment Area Distributions:

• Adult Stream. The state is required to allocate 85 percent of the adult stream funds

received to the local workforce investment areas for use in WIA approved activities;

• Dislocated Worker Stream. The state is required to allocate 60 percent of the dislocated worker stream funds received to the local workforce investment areas for use in WIA approved activities; and

• Youth Funding Streams. The state is required to allocate 85 percent of the youth stream funds received to the local workforce investment areas for use in WIA approved activities.

1.11 Services for Adults and Dislocated Workers

Pursuant to section 134 of the WIA, “Adult” and “Dislocated Worker” services range from information about careers, the local labor market, job search assistance, case management, skills assessments, and the development of employment plans for training services. The employment plans for training services include occupational skills training, on-the-job training, customized training, and adult education and literacy services in combination with other training services. The WIA services should be provided in the following layers: core, leading to intensive, then to training; however, individuals do not have to pass through all the layers of service to demonstrate a need for training services. An individual can enter training if an assessment or an individual employment plan identifies the need for skill development. The WIA divides the employment and training services that can be funded into three categories of services:

A. Core services. Include information about jobs in demand, assistance with applications for

programs of financial aid, initial assessment, and intake;

B. Intensive services. Include comprehensive assessment, case management, group and individual counseling, work experience, and short-term pre-vocational services to prepare individuals for unsubsidized employment or training; and

C. Training services. Include occupational skills training, on-the-job training, customized training, job readiness training, and adult education and literacy activities when combined with other training.

1.12 Services for Youth

Youth Services include preparation for postsecondary educational opportunities or unsubsidized employment (as appropriate), tutoring, study skills training, instruction leading to completion of secondary school including dropout prevention, alternative school services, adult mentoring, paid and unpaid work experiences (including internships and job shadowing), occupational skills training, leadership development opportunities, supportive services, follow-up services for not less than 12 months (as appropriate), and comprehensive guidance and counseling.

1.13 Target Populations and Eligibility Requirements

The target populations for the Workforce Investment Act are Adults, Dislocated Workers, and Youth. Each one of these groups has eligibility requirements that must be met to receive specific services and funding. The following are the target populations and their eligibility requirements.

A. Adults. Pursuant to sections 101, 134, and 189 of the Workforce Investment Act the eligibility requirements to qualify as an “Adult” include the following: (1) the Job Seeker must be 18 years of age and older; (2) be in compliance with citizenship and/or resident alien requirements; and (3) have met the selective service requirements. The adult funding stream incorporates a priority of service for public assistance recipients and other low-income individuals when funds are limited. In addition, as a result of the Jobs for Veterans Act of 2002 veterans have been added as a priority population.

B. Dislocated Workers. Defined by sections 101, 134, and 189 of the WIA, “Dislocated Workers” are individuals that have been: (1) terminated or laid off, or have received a notice of termination or layoff from employment; (2) are eligible for or have exhausted unemployment insurance; (3) have demonstrated an appropriate attachment to the workforce, but are not eligible for unemployment insurance and are unlikely to return to a previous industry or occupation; (4) have been terminated or laid off or received notification of termination or layoff from employment, as a result of a permanent closure or substantial layoff; (5) are employed at a facility, where the employer has made the general announcement that the facility will close within 180 days; (6) were self- employed (including employment as a farmer, a rancher, or a fisherman), but is now unemployed, as a result of general economic conditions in the community or because of a natural disaster; and/or (7) is a displaced homemaker who is no longer supported by another family member.

C. Youth. In accordance to section 101 and 189 of WIA, eligible “Youth” must be of the ages 14 through 21, low-income, and have one or more of the following conditions: (1) deficient in basic literacy skills; (2) a school dropout; (3) be homeless, (4) a runaway, or foster child; (5) pregnant or a parent; (6) an offender; or (7) require additional assistance to complete an educational program or to secure and hold employment.

Note:

Priority for intensive and training services must be given to recipients of public assistance and other low-income individuals when funds are limited.

Chapter 2. Louisiana Workforce Investment System

2.01 Louisiana Workforce Investment Goals

Louisiana’s Workforce Investment goals in the implementation of the Workforce Investment Act are to align the workforce with market demands, create better job opportunities for workers currently in low- paying positions, reduce reliance on public assistance programs, and to increase graduation rates at high schools and post-secondary institutions. In order to meet these goals, the state of Louisiana has implemented the following priorities:

A. To strengthen and prioritize community and technical colleges to match workforce needs, meet

market demand, and fill available jobs;

B. Develop “centers of excellence” at Louisiana Community and Technical College System (LCTCS) campuses to focus on key industries in each economic region and coordinate workforce development planning and activities across relevant public and private sector entities. Regular interaction among business leaders, the community and technical college system, workforce investment boards, state agencies, local stakeholders, and four-year universities that will consolidate sector-specific information and translate research into curriculum development, flexible workforce training, and quality practice in high-demand fields;

C. Immediately respond to urgent workforce opportunities and challenges;

D. Maximize the input of business and industry to realign and integrate Louisiana’s workforce strategy at the statewide and regional levels; and

E. Expand career options of high school students. 2.02 Louisiana’s Workforce Investment System’s Governance Structure

The workforce investment structure implemented in Louisiana brings together many private, public, and government resources, to effectively and efficiently meet the Louisiana workforce investment goals. The state agencies involved in the workforce investment system in Louisiana are comprised of the Louisiana Workforce commission (LWC), the Office of Louisiana Economic Development (LED), the Department of Children and Family Services (DCFS), the Louisiana Community Technical College System (LCTCS), the Louisiana Department of Education (LDOE), Department of Public Safety and Corrections (DPSC), the Office of Elderly Affairs (OEA), the Workforce Investment Council (WIC), Louisiana Workforce Investment Boards (LWIBs), and the Business and Career Solution Centers (BCSCs). All of these entities play a direct or indirect role in the implementation of the Workforce Investment Act in Louisiana. (See Exhibit 2.1 for a chart of Louisiana Workforce Investment Structure)

2.03 Louisiana Workforce Commission

The Louisiana Workforce Commission (LWC), formerly the Louisiana Department of Labor, was created by Governor Jindal’s legislative plan, Act 743; and its strategic objective is to put people to work. The LWC has been designated as the state agency to make provider eligibility determination and is the agency that maintains the Eligible Training Provider list in accordance to section 122(i) of the WIA. The LWC coordinates with other state agencies in the integration and delivery of all education, training, employment, and apprenticeship programs across the state. The LWC while continuing to perform its

prior duties has added the task of coordinating and integrating administration functions and funding streams, for more efficient and effective delivery of Workforce Investment Act funds.

2.04 Louisiana Workforce Commission’s Goals

The LWC’s goals have been aligned with Governor Jindal’s legislative plan Act 743; and its strategic objective is to be proactive in responding to economic indicators and changes in workforce needs. To achieve these goals the LWC has implemented service delivery strategies to:

A. Eliminate the duplication of services and reduce administrative overhead through the integration

of delivery systems and services;

B. Ensure that the needs of businesses are the driving force for its systems design;

C. Ensure that structures are in place so that a quality connection is made between businesses looking for qualified workers and individuals seeking gainful employment; and

D. Provide value-added workforce development services that build the skills necessary for individuals to enter or advance in the labor market.

2.05 Louisiana Workforce Commission’s Duties

The Louisiana Workforce Commission, by statute, is the leader of the statewide workforce investment efforts with the authority to carry out integration activities across all state agencies. This ensures that the impact of all activities is aimed at meeting the needs of our customers, employers, and taxpayers. The LWC, in coordination with the WIC, provide the LWIBs, BCSCs, Training Providers, and all WIA involved entities with guidance and direction, based on federal requirements and regulations. In addition, LWC has been designated as the agency responsible for the SCORECARD system that determines the performance outcomes of post- secondary training programs; and is used in the Eligible Training Provider List eligibility determinations.

2.06 Workforce Investment Council

Pursuant to requirements of sections 111(a),(b),and (d) of the Workforce Investment Act, the Governor created the Louisiana’s Workforce Investment Council (WIC); this 41-member council serving as the State Workforce Investment Board meets six times a year to discuss broad policy issues. (See Exhibit 2.2 for the Structure of the WIC) The WIC in addition to its functions under section 111(d) serves as the statewide body to:

A. Advise the governor on the needs of Louisiana employers and its workforce;

B. Create a common vision, a strategic state plan, and strategies that coordinate and integrate a workforce investment delivery system to ensure cooperation between public and private entities;

C. Certifying Local Workforce Investment Areas and Boards; and

D. Direct the Occupational Forecasting Conference in determining the official information that is necessary for planning and budgeting.

2.07 Occupational Forecasting Conference

In accordance with section 112(b)(4) of the WIA, State Plans must address current and future workforce needs; therefore, the Occupational Forecasting Conference (OFC)) was created and implemented by the Louisiana’s Workforce Investment Council and is comprised of 10 principals appointed by the governor. The Occupational Forecasting Conference projects job growth and in-demand jobs for the purposes of state planning and budgeting. The official information disseminated by the OFC includes projections for the state and the eight Louisiana Workforce Investment Areas (LWIAs). The official forecast and final report of the ”Top Demand Occupations List” serves as a tool for developing long-term strategies in providing appropriate training to meet the needs of a skilled labor force. The OFC provides information that allows for data-driven strategies for promoting and disseminating the final report to the appropriate stakeholders, as determined by the OFC. 2.08 Louisiana Workforce Investment Areas

In 1999, eight Local Workforce Investment Areas (LWIAs) were developed within the state in accordance to section 116(a) of the Workforce Investment Act. These eight Areas under the Job Training Partnership Act (JTPA) were grandfathered in accordance to section 116(a)(2) of the WIA, by the Workforce Investment Council (WIC).

2.09 Louisiana Workforce Investment Boards

Within these eight Local Workforce Investment Areas, eighteen Workforce Investment Boards were created, pursuant to the creation and membership regulations set forth in section 117(a) & (b) of the WIA and Act 743 of the 2008 Louisiana Regular Legislative Session. (See Exhibit 2.3 for the Structure of the LWIB) These 18 boards are located throughout the eight LWIAs (former RLMA under JTPA) to ensure regional coordination and collaboration. The Workforce Investment Boards duties in coordination with the LWC, WIC, and BCSCs include, but are not limited to:

A. Providing oversight for WIA programs and the workforce investment system in their local areas;

B. Setting policy and the vision for the operation of programs in the Business and Career Solutions Centers in their jurisdiction, within WIA and Wagner-Peyser regulations including developing a policy regarding priority of service for the provision of intensive and training services to Adults and Dislocated Workers under Title I of the WIA;

C. Selecting Business & Career Solutions Center operators and certifying the operators within each area they represent, either through a competitive process or under an agreement with a consortium of entities that includes at least three of the required One-Stop partners;

D. Selecting youth providers;

E. Negotiating local/regional performance measures;

F. Developing employer linkages with local businesses;

G. Promoting economic development and employment-generating activities that enhance the employment opportunities in their LWIA;

H. Creating a local plan; and

I. Approving or Denying Eligible Training Provider Programs under the state minimum eligibility requirements.

Note:

Effective August 4, 2005, LWIBs may use training providers from the Statewide Eligible Training Provider List (ETPL) and may issue Individual Training Accounts (ITAs) to provide training services to older youth and out-of- school youth. LWIBs must still identify eligible providers of younger youth activities based on recommendations

of the Local Youth Council and award grants or contracts in accordance with the WIA, TEGL 9-00, Federal Regulations and state/local policy.

2.10 Business and Career Solution Centers

In accordance with section 121 of the WIA, Louisiana mandated that the Business and Career Solutions Centers (BCSCs) provide the WIA core, intensive, and training services for adults and dislocated workers; and provide a wide range of youth services in coordination with the LWIBs and the Youth Councils. The BCSCs provide services to both job seekers and employers to ensure consistency in the quality of service delivery. The LWC has developed standardized guidelines that BCSCs are responsible for following when developing their respective regional service delivery models. The following are the specifics regarding the delivery of BCSCs mandated services.

A. Core Services: are provided at each center and are delivered through facilitated self-help and/or

group activities. Customers that do not need staff assistance can access core services outside of the centers through the universally accessible HiRE system.

B. Intensive Services: are provided to unemployed or underemployed individuals having difficulty securing appropriate employment through core services. The individual must demonstrate difficulty overcoming obstacles that prevent him/her from retaining or securing self-sufficient employment.

C. Training Services: are provided to unemployed or underemployed individuals having difficulty securing appropriate employment through intensive services. However, the individual must demonstrate difficulty in overcoming obstacles that prevent him/her from retaining or securing self-sufficient employment.

1. A program of training, as defined by Title 20 CFR Part 663.508 is one or more courses or

classes that, upon successful completion, lead to:

a) A certificate, diploma, associate degree, or bachelor’s degree;

b) A competency or skill recognized by employers; or

c) A training regimen that provides individuals with additional skills or competencies generally recognized by employers.

2. Training services include, but are not limited to:

a) Occupational skills;

b) On the Job Training (OJT);

c) Cooperative education programs;

d) Private sector upgrading;

e) Apprenticeships programs,

f) Entrepreneurial training; Job readiness; and

g) Adult education combined with other training and customized training.

Note:

The Apprenticeship state law and administrative rules have been revised to attain compliance with recent changes in federal regulations 29 CFR Part 29. The amendments to the law (Louisiana R.S. 23:381-392) were made official in August 2010 by Gov. Jindal. The substantial modifications to the administrative rules have also been made and are currently moving through the Louisiana Division of Administration’s process for promulgating new or amended rules. The revised rules were modified to require the integration of apprenticeship programs with BCSCs.

D. Youth Services: are provided by the BCSCs and are coordinated with state agencies, the LWIBs, Youth Councils, and local youth contractors. The services provided to youth are intended to assist their development and to create linkages to academic/career services and high demand/growth occupations. In addition, the BCSCs assist youth in building career plans that provide training and entry to jobs with career ladders.

2.11 Individual Training Accounts

As defined in section 134 (d)(4)(G) of the WIA, an Individual Training Account (ITA) is essentially a voucher given by a Business and Career Solution Center (BCSC) to a customer who needs occupational skills training to become gainfully employed or re-employed. The Individual Training Account represents a cornerstone of self-determination established by the Workforce Investment Act and allows customers to "purchase" the training they determine best for themselves, based on the training accountability system provided by LWC’s SCORECARD system. An ITA is provided after an assessment of eligibility factors and customer needs has been completed by the BCSC; and that the requested training by the customer meets the Louisiana workforce investment system’s goals and the training requested is in an in demand occupation.

The occupational training services that may be obtained through the use of an ITA may not be so extensive. The selection of a program of training services must be directly linked to the employment opportunities either in the local area or in another area to which the individual is willing to relocate. Furthermore, training should be limited to demand occupations, as determined by the LWC, the WIC and the local regional areas. The LWIB should determine which demand occupations to invest scarce WIA training dollars based on their local/regional economy. Use of training through the ETPL should be incorporated into the cohort strategy under LWC’s Integrated Service Delivery Model. Demand occupations for each Louisiana Workforce Investment Area have been incorporated into the application process.

In accordance with section 134(d)(4)(G)(ii) of the WIA, contracts for services may be used in lieu of ITAs only for OJT, customized training, services to special populations that face multiple barriers to employment, and when the Local Workforce Investment Board determines that there are an insufficient number of eligible providers in the local area to accomplish the purpose of a system of ITAs. Stand-alone programs such as job readiness, basic skills, career exploration, and reading literacy programs are not considered as training programs eligible for ITAs. Educational programs that are not occupational specific and are less than 90 days in duration are considered to be WIA intensive service activities. These programs provide instruction wherein the knowledge obtained can be used in many different jobs and are therefore not industry or job specific. They are designed to provide participants with short-term skill upgrade assistance to enable them to become job ready or advance up the career ladder. Examples of these types of programs include keyboarding computer services, STCW (Standards of Training and Certificates of Watch Keeping) certification or OSHA certifications. This exception does not include short- term training programs for specific occupations such as nursing assistant, phlebotomist and truck driving. If you have any questions concerning whether a particular program meets this criteria please contact your Program Advisor.

2.12 Helping Individuals Reach Employment (HiRE) System

The HiRE system is an advanced and comprehensive workforce development software system created by Geographic Solutions, Inc. in coordination with the Louisiana Workforce Commission. This system integrates services via the Internet for individuals, employers, training providers, workforce staff, and one- stop partners. The HiRE system has improved customer satisfaction and services, staff and partners work efficiency and overall performance in the implementation of the Workforce Investment Act. The Louisiana HiRE system helps to ensure the effective delivery of the core and intensive services provided by the LWC and its partners and offers easier access in reporting and management of workforce development programs. The system offers access to key reporting features to provide management and government

officials with valuable information for improved service delivery and enhanced performance. The LWC’s HiRE system provides:

1. A powerful job search engine with thousands of unduplicated job postings in the state of

Louisiana;

2. Career tools to allow job seekers to effectively find jobs that match their skills, values, and interests providing customers with seamless service delivery;

3. User-friendly interface for employers looking to advertise jobs and recruit talent;

4. Information on education, training programs, and financial aid;

5. Case management, reports, and financial tracking tools for LWC staff and its partners;

6. Tools that help in the efficient management of federal workforce programs including the WIA, Wagner-Peyser, LEAP, TAA, Rapid Response, and the Veterans Program, along with employer services;

7. USDOL-funded programs the capacity to share information and leverage resources;

8. Integration with America's Labor Market Information System (ALMIS) and other electronic tools to help job seekers match workforce information with career tools;

9. Integration with the SCORECARD system that is used to calculate performance outcomes of post- secondary training programs and is used in the Eligible Training Provider List certification process;

10. Integration of the state of Louisiana’s Eligible Training Provider System that is accessible in real time to all involved parties online;

11. Integration with the Office of Information Service’s Louisiana Occupational Information System (LOIS) that provide invaluable Labor Market Information; and

12. Integration with the Louisiana Occupational Forecasting Conference’s occupational forecasting conference that forecasts new and replacement needs of occupations for industries, businesses, and communities throughout the state of Louisiana.

The benefits of the HiRE system allow Louisiana to provide its customers and partners a complete picture of Louisiana’s Labor Market by: (1) providing the necessary tools to make informed and knowledgeable decisions; (2) providing an integrated One-stop location that is accessible in real time to all involved or interested entities; and (3) enables Louisiana to fully implement the “comprehensive labor market information system,” called for in Act 743 of the 2008 Louisiana Legislature.

2.13 Louisiana Occupational Information System (LOIS)

The Louisiana Occupational Information System (LOIS) is a comprehensive labor market information system created by Act 1 of the 1997 legislative session to meet the requirements of section 111(d)(8) of the WIA (that requires states to create a statewide employment statistics system, as described in section 15(e) of the Wagner-Peyser Act.) LOIS and its enhancements were developed by the Louisiana Workforce Commission’s (LWC’s) Office of Occupational Information Services and Geographic Solutions, Inc., of Palm Harbor, Florida. It was designed to provide a broad range of labor market information, including information about post-secondary training providers, as well as program performance data (referred to as “SCORECARD”).

The benefits of LOIS are that its integration with the HiRE system allows training providers to display current information about their programs. This component is comprised of data entry screens, accessible via the Internet, in which training providers maintain the school’s profile and program information. Through a joint effort between LWC’s Office of Occupational Information Services and Office of Workforce Development these on-line data entry screens evolved into a statewide application used in the certification process for program eligibility under the Workforce Investment Act of 1998.

As an electronic resource for the state of Louisiana, LOIS is linked to the HiRE, ALMIS, and O*Net systems to enhance the integration of Louisiana’s Workforce Investment System activities and information. These system integrations help provide workforce information to all parties involved through maintaining and improving the electronic delivery of labor market information. Through automated email notifications any data added to the LMI website is accessible to the Business and Career Solutions Centers, Workforce Investment Boards, employment and training planners, providers, economic development agencies, researchers, grant writers, government officials, employers, job seekers, dislocated workers, libraries, educators, community and technical colleges, universities, proprietary schools, rehabilitation facilities, career planners, and guidance professionals.

2.14 SCORECARD

The SCORECARD system is a part of the LOIS and HiRE system integration and is used to collect providers’ student data and to calculate performance outcomes of post-secondary training programs that are used in the certification process of eligible training providers. The SCORECARD system provides users and the LWC with individual program completer information including completion rates, employment rate wages at job placement, job retention, and earning change information using the state’s UI wage records. The Board of Regents along with the Louisiana Community and Technical College System, the Proprietary Schools, Community Based Organizations, and/or Apprenticeship program providers submit student data records each year to LWC for processing through the SCOREDCARD system to evaluate program performance measures for initial and subsequent training provider eligibility determinations. SCORECARD ensures provider programs are held accountable and ensure customers can make informed decisions based on a school’s performance and their individual needs.

Chapter 3. Training Provider Eligibility Requirements

3.01 Training Providers that Qualify for Workforce Investment Act Funds

The following types of providers and/or provider programs qualify for WIA Funds in accordance to section 122(a) of the Workforce Investment Act and LWC’s Office of Workforce Development:

A. Post-Secondary educational programs that are:

1. Eligible to receive funds under Title IV of the Higher Education Act of 1965 and

2. Provide a program that leads to an Associate Degree, Bachelor’s Degree or Certificate;

B. Post-Secondary educational institutions seeking training funds for a program(s) that does not lead to an associate or baccalaureate degree, certification, or is not funded under Title IV of the Higher Education Act of 1965; Public and Private providers of a program of training services, which includes entities such as some vocational-technical schools, community based organizations (CBO’s), private training companies, labor organizations, employer organizations;

C. Entities that carry out programs under the National Apprenticeship Act of 1937. These include universities, colleges, some community colleges, some vocational-technical colleges, some proprietary schools, and apprenticeship programs registered with the Bureau of Apprenticeship Training, U.S. Department of Labor;

D. Apprenticeship programs wishing to receive training funds for a program not registered with the Federal Bureau of Apprenticeship Training; and

E. A local WIB that has applied for and been granted a waiver by the Governor, as outlined in Section 117(f) (B) of the Act.

3.02 Initial Eligibility Determination

In compliance with section 122 of the Workforce Investment Act (WIA), the state has mandated that the LWIBs, in conjunction with the Louisiana Workforce Commission, identify eligible training service providers. The eligible training providers defined in section 122(a) of the WIA have different initial eligibility requirements for inclusion to the state’s ETPL. The eligibility requirements for initial eligibility, certification, and inclusion on the state’s ETPL are divided into the following eligibility types, as defined by section 122 (b)(1) and (b)(2) of the WIA.

A. Providers Eligible under Title IV of the Higher Education Act of 1965 (HEA) and/or the

National Apprenticeship Act of 1937 (NAA) - Pursuant to section 122(b)(1) of the WIA and 20 CFR 663.515, providers eligible under Title IV of (HEA) and NAA are exempt and are not required to submit performance data and undergo a state review during the initial eligibility determination by the state. However, the provider MUST submit a completed application on the HiRE website and other required documentation at such time, in such manner, and containing such information, as required by section 122(b)(1)(a)(2) of the WIA, the LWIBs and/or LWC.. Once the application and requested documentation is received by the state and approved by the LWIBs, the provider’s programs are considered certified and are added to the state’s ETPL for the first year of provider eligibility.

B. Providers NOT Eligible Under Title IV of the Higher Education Act of 1965 (HEA) and/or the

National Apprenticeship Act of 1937 (NAA) - Pursuant to section 122(b)(2) of the WIA, the

initial eligibility determination of providers not eligible or exempt under Title IV of the HEA and/or NAA are to be determined by the state. These non-exempt providers include:

1. Post-secondary educational institutions that provide training programs that do not lead to an

associate’s degree, baccalaureate degree, or certificate;

2. Entities that provide apprenticeship programs that are not registered by USDOL’s Bureau of Apprenticeship and Training under the National Apprenticeship Act; and

3. Any other public or private providers of training programs that do not meet the definitions under Title IV of the HEA and NAA.

3.03 State Implemented Initial Eligibility Requirements

The initial eligibility requirements for providers depend on if the provider meets the required criteria defined in section 122(b)(2) of the WIA. Providers that are not eligible under Title IV of the HEA and/or NAA must meet the application process requirements determined by the state of Louisiana and are stipulated by LWC’s Office of Workforce Development. OWD policy requires the following:

1. Submission of an application on the HiRE website and other required information, as determined

for processing by the Local Workforce Investment Board and/or the LWC;

2. That each provider submit information relating to their program costs (such as tuition and fees) for participants of each program, as required by section 122 (b)(D)(2)(i) of the WIA;

3. Performance data only if the provider has offered the training program on or before the date of application submission (some types of programs are exempt from providing performance data, see Chapter 4 for further details); and

4. Complete, sign, and submit a Student Data Certification Statement (Appendix 1, Form C) and the applicable data requested on it for each program being applied for inclusion on the state’s ETPL. 3.04 WIA Subsequent Eligibility Policy

Eligible Training Providers that are not described under the initial eligibility requirements in section 122(b) of the WIA and want to remain on the ETPL for subsequent program years must meet the state of Louisiana’s subsequent eligibility requirements, as authorized by section 122(c) and 136 of the WIA and defined by LWC’s Office of Workforce Development. These policies have been implemented to determine if the Eligible Training Provider is:

A. Still offering the program;

B. Wishes to continue the program’s eligibility and receive WIA funds;

C. Providing accurate program cost information;

D. Meeting Louisiana’s minimum performance standards;

E. Maintaining accurate consumer information in the HiRE System; and

F. Providing the most recent program performance data. 3.05 Subsequent Eligibility Requirements

In accordance to section 122(d)(1) of the WIA that requires the state to implement subsequent eligibility policies for providers, the LWC’s Office of Workforce Development has implemented the following policies. The subsequent eligibility requirements are divided into the following two criteria based on if the

providers are eligible or are not eligible under Title IV of the HEA and/or NAA in accordance to section 122 (b)(1) and (b)(2) of the WIA:

A. Providers Eligible under Title IV of the HEA and/or NAA MUST:

1. Provide the programs cost information for each WIA program through the HiRE system;

2. Submit each eligible program for approval through the HiRE System;

3. Submit student data (if applicable), as outlined in Chapter 7 or the Student Record Layout (Appendix 2). This information can be located at www.laworks.net > Workforce Development > Eligible Training Provider Information or www.laworks.net > My HiRE Account > Training Provider Information (Under the General Resources and Services Tab); and

4. Meet Louisiana’s Minimum Performance Standards.

B. Providers NOT Eligible under Title IV of the HEA and/or NAA MUST:

1. Provide the programs cost information for each WIA program through the HiRE system;

2. Submit each eligible program for approval through the HiRE System;

3. Submit Student Data, as outlined located in Chapter 7 or the Student Record Layout (Appendix 2). This information is available at www.laworks.net > Workforce Development > Eligible Training Provider Information or www.laworks.net > My HiRE Account > Training Provider Information (Under the General Resources and Services Tab);

4. Complete sign, and submit a signed Student Data Certification Statement (Appendix 1, Form C) for each program that the provider wants to be considered for inclusion on the state’s ETPL. This form is available at www.laworks.net > Workforce Development > Eligible Training Provider Information or www.laworks.net > My HiRE Account > Training Provider Information (Under the General Resources and Services Tab); and

5. Meet Louisiana’s Minimum Performance Standards.

Note:

LWC has been granted by the U.S. Department of Labor (USDOL) a waiver of the provisions of section 122(2) of the WIA, regarding the requirements for eligible training providers subsequent eligibility based on performance data and reserves the right to implement this waiver, if needed.

3.06 Performance Data Submission Requirements

Providers are required to submit their programs student data to LWC for calculation of program performance. The LWC receives provider program performance data in two methods depending on how the provider is defined in section 122 (b)(1) and (b)(2) of the WIA. The following are the two methods that the LWC receives program performance data:

A. The Louisiana Board of Regents (BOR), in cooperation with the Louisiana Community Technical

College System (LCTCS), submits performance data for public institutions, community colleges and technical schools to LWC for the program performance assessment; or

B. Proprietary schools, community organization providers, apprenticeship program providers, and all other providers that the BOR does not submit information to LWC. 3.07 Subsequent Eligibility Waiver

Pursuant to the section 192 of the WIA, LWC has asked for and has been granted by the U.S. Department of Labor (USDOL), a waiver of the provisions of section 122(2) of the WIA, regarding the requirements for eligible training providers subsequent eligibility based on performance data and allows the state to use the initial eligibility determination of section 122 (b) of the WIA, if needed. The purpose of this waiver is for the state to have the flexibility to take into account any internal or external event that might affect the completion or performance rates for training providers during a particular program year. The state’s ability to return to the initial eligible training provider requirements for eligibility for at least one year will provide areas with sufficient providers to ensure training is available in demand occupations in relevant sectors in their region. Enactment of this waiver will be conditional based on the calculation of training provider performance during any base period for an ETPL program year. Under this waiver the state is able to provide an opportunity for training providers to re-enroll and be considered as initially eligible training providers.

Chapter 4. State Minimum Performance Standards

4.01 Minimum Performance Standards Implementation Requirements

The creation of performance standards by the state is required under section 122(c) of the WIA and must include the performance measures stipulated in sections 122(d)(1)(A)(ii)(I) and 133 of the WIA. All training provider programs must meet the state performance standards implemented by LWC’s Office of Workforce Development unless exempted by section 122(h) of the WIA (On-the-Job Training Program, Customized Training Programs, and Youth Services) and/or waived under certain circumstances defined in this chapter.

4.02 Program Minimum Performance Requirements

The Current State Minimum Performance Standards implemented by LWC’s Office of Workforce Development in accordance with the requirements stipulated by sections 122(d)(1)(A)(ii)(I) and 133 of the WIA for eligible training provider programs inclusion to the state’s ETPL are:

A. Program Completion Rate (state minimum performance level: 30%). Is the total number of

students (not just WIA funded students) completing the applicable program divided by the total number of individuals exiting the program (completers and non-completers.) This measure allows LWC and the LWIBs to gauge the completion rates of a program and the effectiveness of a program to maintain students until completion.

B. Employment Rate (state minimum performance level: 50%). Is the number of all exiting (completers/non-completers) from the applicable program (not just WIA funded students) that obtained unsubsidized employment in the 1st or 2nd quarters subsequent to the exit quarter (the calendar quarter containing the exit or completion date), divided by the total number of exiters (not just WIA funded students.) This measure allows LWC and the LWIBs to gauge the number of students that exit a program and are able to obtain unsubsidized employment.

C. Wages at placement (state minimum performance level: $8.00.) Is the average wage expressed as an hourly rate for all the exiters (not just WIA funded students) that exit a provider’s program and obtained unsubsidized employment. This measure allows LWC and the LWIBs to gauge the hourly earning potentials obtained at placement by students that exit a program.

4.03 Performance Standards and Data Collection Methodologies

The Louisiana Workforce Commission (LWC) must collect data to submit to the U.S. Department of Labor. This information is used to calculate the performance of the state’s workforce investment system, the statistical results of funds invested, and the overall effectiveness of the state’s use of WIA funds. In gathering data for quantification, the LWC must collect information from the Eligible Training Providers that is used in reporting to the USDOL and in the calculations of the performance measures of the Eligible Training Provider programs/services. Using a uniform system of evaluation, as directed by the USDOL, the LWC has implemented the SCORECARD system that processes student data for quantification and maintains the state’s ETPL. This ensures that limited WIA funds are going to programs that are high performing. The following is information that will explain the performance Standards that providers are required to meet under the definition of section 122(b)(2) and 122(d)(1) of the WIA and defined by LWC’s Office of Workforce Development.

1. Data Collection Timeframe - for any program year, the data that LWC collects from the providers is based on the state’s fiscal year for two separate time periods, one for Exiters (Completers and Non-Completers) and one for Enrollees. The data collected is for all students of a program and not just the WIA funded students.

2. Definitions – the following definitions are used in the calculation of performance measures and

apply to the data that is collected and analyzed by the SCORECARD system for any WIA program year:

a. Baseline Wage - the baseline wage is the wage calculated for full time employment over

a calendar year quarter, which is approximately 13 weeks. (Example: Wage X 40 Hours X 13 Weeks);

b. Calendar Year Quarter - is a three month period within a calendar year. There are four calendar quarters: January through March, April through June, July through September, and October through December;

c. Date of Program Exit - the term program exit means a participant has not received a service funded by the program or funded by a partner program for 90 consecutive calendar days, and is not scheduled for future services. The exit date is the last date of service. (Exceptions: Delay before the beginning of training, Health/medical condition or providing care for a family member with a health/ medical condition, and Temporary move from the area that prevents the individual from participating in services, including National Guard or other related military service);

d. Enrollee - is a student that is enrolled in a provider’s program;

e. Enrollee Data - is data that the LWC request from providers for a WIA program year. (Example: WIA program year 2013 requires student enrollee data from data year June 1, 2011 through May 31, 2012.);

f. Exiter - is a completer of a program or non-completer who leaves a program;

g. Exiter Data - is data that the LWC request from providers for a WIA program year and includes completers and non-completers and includes all participants not just WIA funded students. (Example: WIA program year 2013 requires student exiter data from data year June 1, 2010 through May 31, 2011);

h. Exit Quarter – is the calendar quarter containing the exit or completion date of a student;

i. Quarter After Exit - is the calendar quarter after the exit quarter;

j. Unsubsidized Employment – is employment not financed from funds provided under a grant. In the grant program the term “adequate” or “suitable” employment is also used to mean placement in unsubsidized employment which pays an income adequate to accommodate the participants’ minimum economic needs; and

k. WIA Program Year – a WIA program year begins on January 1 of any year and ends on December 31 of the same year.

3. Program Completion - this measure is used to determine a program’s completion/graduation rate. The state of Louisiana’s Minimum completion measure is 30%. This means that out of all students (not just WIA funded students) that exit a particular program at least 30% must complete that program in the collection time periods.

ABC Program has 100 students exit a program during the requested collection period and out of those 100 only 50 complete the program during the collection period the example calculation formula is:

Note:

Students that transfer from one program to a different program are counted as transfers or continuing education students and the follow-up on these students will occur in the transfer program and will not be computed in the completion rate for the original program.

4. Employment Rate - this measure includes all students, not just WIA funded students, and is

used to calculate the rate of exiters (completers/non-completers) from a provider’s program that obtain unsubsidized employment in the 1st or 2nd quarters after the exit quarter (the calendar quarter containing the exit or completion date.) The state of Louisiana’s minimum employment standard measure is 50%. The individual is considered employed if the Unemployment Insurance (UI) wage records for the 1st or 2nd quarter subsequent to the exit quarter (the calendar quarter containing the exit or completion date.) show any earnings. UI Wage records are the primary data source for tracking employment in the 1st or 2nd quarter after exit. This measure shows the effectiveness of students gaining unsubsidized employment after the exit from a provider’s program.

ABC program has 31 students (not just WIA funded students) that exit (completers/non- completers) a program. 16 students completed and 15 students did not. To calculate the employment rate the SCORECARD system takes the SSNs from the 31 students who exited and runs them through the UI Wage Records Database for the 1st and 2nd quarters subsequent to the exit quarter (the calendar quarter containing the exit or completion date). If the exiters have unsubsidized employment and earnings, they are counted as employed. If out of 31 of the exiters (completers/non-completers), only 18 of them have obtained unsubsidized employment, with earnings in the 1st or 2nd quarter after the exit quarter the example employment rate calculation formula is:

5. Wages at Placement Methodology - this measure is used to calculate the wage at placement

for an institution’s program and the students that exit (not just WIA funded students) and obtain unsubsidized employment. This measure includes all exiters (completers/non-completers) and their average wages in the 1st or 2rd quarters after the exit quarter (the calendar quarter containing the exit or completion date); and is solely based on the UI wage records regardless of employment status at registration. The current baseline wage for Louisiana is $7.25 X 520 (number of hours for full time employment during a calendar year quarter), or $3,770. The current minimum average wage at placement measure requirement for a program in Louisiana is a minimum of $8.00 an hour.

In order to calculate this measure, the following validation processes are completed first to determine if the exiter and his/her wages are included into the Wage at Placement Calculation formula:

a. Validation 1: Standard Deviation Inclusion/Exclusion – The SCORECARD system calculates the average wage in the state of Louisiana for that particular year, and individuals with wages greater than three standard deviations above the average

will not have their wages included in the calculations.

b. Validation 2: Minimum Wage Inclusion/Exclusion - Once a determination has been

made to include or exclude the wages for the 1st or 2nd quarters based on the standard deviations of wage data, the wages from the 1st and 2nd quarters are compared to the baseline minimum wage (the wage calculated for full time employment over a calendar year quarter, which is approximately 13 weeks) as determined by the state of Louisiana. If the wages in the 1st or 2nd quarter after the exit quarter (the calendar quarter containing the exit or completion date) are not greater than or equal to the baseline wage (the wage calculated for full time employment over a calendar year quarter) that individual is not included in the calculation.

Step 1: Run Validation 1

Examples of Validation 1 (based on the standard deviations of wage data for an exiter and their wages in the 1st and/or 2nd quarters of wages after the exit/completion quarter):

a. Example when both quarters of wage data pass validation 1 - If exiter A’s (completer/non-completer) 1st and 2nd quarter wages after exit/completion fall within three standard deviations from the average wage for each quarter then the exiter and his/her wages for both quarters after exit move to the next validation step.

b. Example when one quarter of wage data passes validation 1 - If exiter B’s

(completer/non-completer) 1st quarter wages after exit/completion fall within three standard deviations from the mean, the 2nd quarter wages do not, then the exiter and his/her wages for 1st quarter are used in the Wage at Placement Rate Calculation and the 2nd quarter data is not and this exiter’s 1st

quarter wages move to the next validation step.

c. Example when both quarters of wage data do not pass validation 1 - If exiter C’s (completer/non-completer) 1st and 2nd quarter wages after exit/completion do not fall within three standard deviations of the mean for both quarters then this exiter and his/her wages for both quarters after exit are excluded from the Wage at Placement Rate Calculation.

Examples of Validation 2 (based on 1st and/or 2nd quarter exiter and wages meeting the minimum wage for a calendar quarter, which is the wage calculated for full time employment over a calendar year quarter):

a. Example when both quarters of wage data pass validation 2 - exiter A’s

(completer/non-completer) wages fall within three standard deviations of the mean and has wages in the 1st quarter after exit of $4,000 and wages in the 2nd quarter after exit of $5,000. The wages in each quarter are compared to the baseline minimum wage for a calendar year quarter. If the wages for the 1st and 2nd quarters after exit are greater than and/or equal to the 2014 quarterly minimum wage of $3,770 then the wages for the 1st

and 2nd quarters are averaged together. This exiter and their average wages of $4,500 are included in the Wage at Placement Rate Calculation.

b. Example when one quarter of wage data passes validation 2 - exiter B’s

(completer/non-completer) wages fall within three standard deviations of the mean and has wages in the 1st quarter after exit of $1,500 and wages in the 2nd quarter after exit of $5,000. The wages in each quarter are compared to the minimum wage for a calendar year quarter. If the average wages for the 1st quarter after exit do not meet the baseline wage of $3,700 then it is not used. If the average wage for the 2nd

quarter is greater than or equal to the 2014 quarterly minimum wage of $3,770 then the 2nd quarter wage is used. This exiter and their average wages in the 2nd quarter after exit of $5,000 are included in the Wage at Placement Rate Calculation.

c. Example when both quarters of wage data do not pass validation 2 - exiter C’s

(completer/non-completer) wages are within three standard deviations and wages in the 1st quarter after exit of $1,500 and average wages in the 2nd quarter after exit of $2,000. The wages in each quarter are compared to the minimum wage for a calendar year quarter. If the wages in each quarter are less than the 2014 quarterly minimum wage of $3,770 then the average wage for the 1st and 2nd quarter after exit are not used. This exiter and their average wages are excluded from the Wage at Placement Rate Calculation.

Step 3: Calculation of the Hourly Wage at Placement Measure ABC program has 31 students that exit a program (completers/non-completers). Of these 31 students that have exited the program, only 7 have gained unsubsidized employment, have wages within three standard deviations of the mean, and have wages equal to or greater than the baseline wage for the 1st and/or 2nd quarters subsequent to the exit quarter (the calendar quarter containing the exit or completion date).

To determine if the program meets the minimum Wage at Placement requirement of $8.00 an hour, we take the 7 exiters with employment and their combined wages of $49,310 and divide the total wages by the 7 total exiters that have been included in this measure. This gives us an exiter average wage, which in this example is $7,044.29. Once we have our exiter average wage, we divide the average exiter wage by 520 (the number of hours of fulltime employment for a calendar year quarter). The example calculation formula for the Wage at Placement Measure is:

6. Enrollee Information - the enrollment information is used to determine if exiters are continuing educational or transfer students and must be submitted in the format described in Chapter 7 and can be located at www.laworks.net > Workforce Development > Eligible Training Provider Information or www.laworks.net > My HiRE Account > Training Provider Information (Under the General Resources and Services Tab.)

4.04 Waivers and Exemptions

Some providers and/or program types are exempt from meeting the minimum performance standards and Student Data submission requirements, as stipulated in section 122 and 133 of the WIA; title 20 CFR 663.700 – 663.730; and LWC’s Office of Workforce Development.

A. Performance Exemptions - the following Workforce Investment Act providers and programs are

exempt from the state Minimum Performance Standards, as stated above.

1. On-the-Job Training Programs - the designated Business and Career Solutions Center in each local area collects performance information and determines whether the OJT program meets the required performance criteria, as outlined in the LWIA local plan.

2. Customized Training Programs - the designated Business and Career Solutions Center in each local area collects performance information and determines whether the Customized Training Program meets the required performance criteria, as outlined in the LWIA local plan.

3. Youth Services - the designated Business and Career Solutions Center in coordination with the LWIB and Youth Councils collect and determine whether the Youth Services meet the required performance criteria, as outlined in the LWIA local plan.

4. Intensive Services - commercially available off the shelf skill refresher programs designed to assist individuals who have completed training but need courses of study to renew their license are considered to be WIA intensive service activities. Examples of these types of programs include RN or LPN refresher courses. Such programs do not need to be certified for inclusion on the statewide ETPL, but must follow local WIA procurement procedures. These programs are included in the ETPL section of the HiRE system.

Note:

Intensive Services are exempt from the ETPL performance requirements, however, providers must still submit their most recent enrollment information in format provided in Chapter 7 or Appendix 2 located at www.laworks.net > Workforce Development > Eligible Training Provider Information or www.laworks.net > My HiRE Account > Training Provider Information (Under the General Resources and Services Tab.) In addition, local programmatic performance should be considered as part of the procurement process.)

B. New Provider Waiver - the requirement for performance data may be waived by LWC for new providers only upon a show of good cause.

C. New Program Waiver - a “new program” has been defined by the Louisiana Workforce

Commission as: (1) a program that did not exist in the previous year for a unique training provider, Classification of Instructional Program (CIP) code and degree type. These programs would be exempt from meeting eligibility performance until such time as the training cycle has been completed and performance data compiled based on the timeline established for reporting to LWC has been met. A “New Program” is required to submit performance data for the first year in which adequate performance data is available. (The reporting timeline would include the end of a training cycle plus the necessary time it takes to gather and process the performance data.); (2) a program that did not have any exiters because there was no graduating class during the reporting period that performance data is compiled based on the timeline established for reporting by LWC; and (3) existing private and non-private training providers that are applying for eligibility for the first time and have not previously collected individual records based on Social Security Numbers shall also be considered “New Programs”.

D. Wage Placement Waiver - to ensure that adequate training opportunities are available for all job

seekers that receive WIA training dollars, the LWC has authorized each LWIB to approve programs that offer training in demand occupations in their region below $8.00 an hour. Each LWIB must determine if these training programs that lead to employment in demand occupations are Pell eligible, non-credit or registered apprenticeship and are essential to the economy in their region. If the LWIB determines that specific training programs below $8.00 wages at placement should be included on the ETPL, the LWIB Director must contact OWD’s MIS Director as well as the Research and Statistics Division to ensure these programs are included on the ETPL. Each LWIB must document the rationale for inclusion of each program below $8.00 an hour wage at placement on the ETPL. Inclusion of a program on the ETPL only signifies that the program is eligible to receive WIA funding; enrollment of participants into a specific training program is a decision of the LWIB based on the job seeker’s skills, interests and abilities, the occupations relationship to career ladders/lattices, and the LWIB’s determination of which demand occupations to target with their limited WIA resources.

Chapter 5. Application and Subsequent Application Process

5.01 Initial Application/Certification Process

Eligible Training Providers initial application requirements depend on classification under section 122 (b)(1) or (b)(2) of the Workforce Investment Act. The following is the initial application process for both provider types.

A. Prospective Training Providers eligible under title IV of the Higher Education Act of 1965 and/or

an entity that carries out programs under the Act of August 16, 1937 (commonly known as the “National Apprenticeship Act or NAA”) that want to apply to have their programs and/or services WIA Certified and considered for Louisiana’s Eligible Training Provider List MUST complete the following steps:

1. Register as a new user with a new institution in the HiRE system at

https://www.louisianaworks.net/hire/vosnet/Default.aspx (See Chapter 8 for Instructions.)

2. Submit a copy of the Institution’s Louisiana Board of Regent’s license or documentation of licensure exemption. If the provider is a school of Cosmetology, Real Estate, etc., the appropriate license must be provided in Lieu of a Board of Regent’s License.

5.02 Subsequent Application/Certification Process

Programs that are not described under initial eligibility in section 122 (b)(1) or (b)(2) of the Workforce Investment Act and want to remain on the Eligible Training Provider List for subsequent program years MUST:

1. Update the HiRE institutional profile and contact information sections. (See Chapter 8 for

instructions.) If the provider has multiple independent locations throughout the state then they must update information for each location, if needed. 2. Update any data including cost information for each program and/or service that the institution wants to submit for WIA approval (See Chapter 8 for instructions.)

5.03 Initial and Subsequent Application Geographic Requirements

The following are Louisiana Workforce Commission’s geographic requirements for training provider Initial and Subsequent Application:

A. In-state Training Providers - WIA requires providers to apply to the local board in each area in

which the provider desires to provide training services. To avoid placing undue burden on the LWIBs for duplicative approval, an application will be considered by the applicable LWIBs within the Local Workforce Investment Area in which the program is geographically located. Clients with ITAs from any local area may attend a program, once certified and included on the statewide Eligible Training Provider List (ETPL). The ETPL list is available through the HiRE System at

B. Out-of-State Training Providers - if a program has already been certified by the state in which the program is physically administered; these programs will be accessible to Louisiana participants, if an agreement between Louisiana and the state the program is located in has been made.

C. Distance Learning - the provider of a program that is offered through distance learning will apply to the Louisiana Workforce Investment Areas (LWIA) from which it anticipates receiving the most students. For subsequent re-certification, the provider will apply to the LWIA from which it received the most WIA Title 1-B participants.

Chapter 6. Program Review Process

6.01 Initial Eligibility Review Process

The LWIBs initial eligibility determinations must be made no later than 60 days from receipt of the provider’s program applications and performance measures (if applicable) from LWC. Upon completion of the provider’s application, submission of requested documents, and submission of the provider’s program applications through the HiRE system; the provider’s programs are submitted to the appropriate LWIB for review. The LWIB within the geographic area in which the program is physically located records its approval or denial, including the reason(s) why the programs were approved or denied. Once the LWIB has completed the process, the LWIB must submit a list of approval or denial outcomes to LWC.

6.02 Subsequent Eligibility Review Process

The LWIBs subsequent eligibility determinations must be made no later than 60 days from receipt of the provider’s program applications and performance measures (if applicable) from LWC. Upon completion of the provider’s subsequent application process, submission of the requested forms, submission of student data (if applicable), and submission of the provider’s program applications through the HiRE system, LWC processes the student data through the SCORECARD system, to calculate the performance measures for the each provider’s program. The performance measure results and the provider’s subsequent program applications are submitted to the LWIBs for review. The LWIBs within the geographic area in which the program is physically located records its approval or denial, including the reason(s) the programs were approved or denied. Once the LWIB has completed the process, the LWIB must submit a list of approval or denial outcomes to LWC.

6.03 Program Approval Process

The LWIBs list of Approved Eligible Training Provider programs submitted to LWC are added to the statewide Eligible Training Provider List (ETPL) after LWC eligibility verification and/or 30 days have elapsed, whichever occurs first. The LWC compiles and publishes the list through the HiRE system. Once a program is approved it will remain on the state’s ETPL for the remainder of the WIA program year (end date is December 31st of any year), unless removed by LWC for documented program violations noted in Chapter 6.06.

6.04 Program Denial Process

A. Local Level Denial (LWIBs) - upon determination by a LWIB that a provider program application does not meet the eligibility requirements (as set forth in the WIA, Public Law 105/220, Final Regulation dated August 11, 2000 or state policy), the LWIB issues a denial notice to the provider for each training program being denied within 30 days of the LWIBs decision. The LWIB must send a denial notice by certified mail, return receipt requested, to the training provider at the address and to the contact person listed in HiRE. In addition, it is recommended that a copy of the letter is maintained for documentation purposes. The denial notice MUST clearly state: (1) the reason for denial of eligibility; and (2) notify the training provider that they have the right to appeal the LWIBs decision within 30 days of the date the denial notice is received in accordance to the appeal rights outlined in Chapter 6.10.

B. State Level Denial Process (LWC) - upon LWC receipt of the LWIB training provider/program list. The LWC evaluates each program to ensure compliance with the WIA. If the LWC determines that a provider program application does not meet the eligibility requirements (as set forth in the WIA, Public Law 105/220, Final Regulation dated August 11, 2000 or state policy) it will promptly issue denial notifications to the training provider that the state removes from the LWIB training provider/program approval list. If the state denies a provider’s program application the state notifies the provider for each training program being denied within 30 days of determination and issues denial notices that clearly state the reason for denial of eligibility; and informs the training provider that they have the right to appeal the LWC’s decision within 30 days of the date the denial notice is received in accordance to the appeal rights outlined in Chapter 6.

If the state does not notify the provider of a program denial within 30 days after notification by the LWIB’s training provider/program approvals or denials, the training program is automatically approved and is published in the state approved ETPL, accessible through the HiRE system at http://www.laworks.net. Either register with the system or access it through the Education and Training link (Under the General Resources and Services tab) > Training Providers or Schools to access the list by provider or the Training and Educational Programs link to access the list by program.

6.05 Reasons for Program Denial

A training provider’s program may be denied inclusion on the state’s ETPL for the following reasons:

A. The application was not complete;

B. The HiRE program application process was not completed or was missing required information

C. Performance data was not submitted;

D. Minimum performance requirements of 30% for Program Completion Rate were not met;

E. Minimum performance requirements of 50% for Employment Rate were not met (supplemental information may be submitted for this measure);

F. Minimum performance requirements of $8.00 Average Wages at Placement were not met; and

G. Any additional requirement for training providers listed under the WIA or established by state policy has not been met.

6.06 Reasons for Removal from the State’s Eligible Training Provider List

The Louisiana Workforce Commission also has the responsibility to remove training providers/programs from the Eligible Training Provider List under the following conditions (documented proof that these conditions exist must be provided by the LWIB):

A. If it is determined that the training provider intentionally supplied inaccurate information (This

termination will remain in effect for a minimum of two years);

B. If it is determined that the training provider substantially violated any requirement under WIA or state policy; and

C. For failure to reapply under Subsequent Eligibility Procedures. 6.07 Status of Students Attending Programs No Longer on the ETPL

Students already enrolled in provider program(s) are permitted to continue even though the program may no longer be on the state’s Eligible Training Provider List (ETPL). This is an acceptable use of WIA dollars since the participant(s) could be adversely impacted if they are not allowed to continue and without other alternative programs, the money initially spent would be wasted. Additionally, because of

the travel and transportation problems, participants might not find other programs in the same field available on the current ETPL. This provision does not apply to programs/institutions removed from the ETPL due to violations of the WIA law and regulations. This provision does not apply to students who have been issued an ITA by the WIA Title I program operator under the prior year’s ETPL, but have never been enrolled and attended the program in the previous session. The LWIA should assist these students in identifying alternative training provider programs on the ETPL.

6.08 Supplemental Data Provision

If a training program meets the minimum completion rate and hourly wage rate, but does not meet the employment rate and is denied based upon its failure to meet the 50% required minimum level of performance for employment, the training provider will have the opportunity to provide the LWIB with acceptable and verifiable documentation regarding the employment status of students who exited the program. The employment documentation must be for the two calendar quarters immediately following the quarter in which the student exited the program. Providers may only provide supplemental data for the employment measure. No supplemental data is allowed for completion rate or Wage at Placement in accordance to U.S. Department of Labor’s Training and Employment Guidance Letter (TEGL) 17-05.

6.09 Supplemental Data Submission Process

If a provider meets the minimum completion rate and hourly wage rate and desires to submit supplemental data for the employment rate measure to become eligible, the provider must complete a “No Finds” List Request Form (Appendix 1, Form D) from the Eligible Training Provider Manual and submit it to LWC’s Research and Statistics Division. Once received by the LWC compiles a, “No Finds” list for the Eligible Training Provider. A “No Finds” list is a list of students that exited (Completers/Non-Completers) a program, but did not show employment based upon income pulled from the state’s Unemployment Insurance Wage Record Database. (See Chapter 4 for more details on how the performance measures are calculated.) The time it takes to compile and forward a, “No Finds” list depends on if a school is a proprietary school that submits its data directly to LWC or if the school’s data is submitted to LWC by the Board of Regents. The “No Finds” list that is compiled and forwarded to the training provider contains the Social Security numbers of those students who could not be found, as employed through the state’s Unemployment Insurance Wage Record Database. This information will be password encrypted, as to protect the integrity of the students Social Security Number and information.

The training provider may provide acceptable supplemental information on the employment status of the students found on the “No Finds” list. In accordance with USDOL’s TEGL 17-05 Supplemental Sources of Data the following verifiable information is acceptable documentation:

1. A paycheck stub;

2. W-2 form;

3. A written letter from the employer on letterhead stating employment; and/or

4. Form 1099.

When supplemental sources are used, individuals should be counted as employed if in the calendar quarter after the exit quarter, they did any work at all as paid employees (i.e., received at least some earnings), worked in their own business, profession, or worked on their own farm. Please remember that the supplemental information MUST show employment or employment wages in the quarter following exit quarter from the program. For Example, if the student exited a program on February 2, 2012 (1st Quarter in the Calendar year = January 1, 2012 → March 31, 2012) then the provider must provide acceptable documentation showing employment or employment wages for the 2nd Quarter of the year or the quarter after the exit quarter (2nd Quarter of the Calendar year = April 1, 2012 → June 30, 2012).

Supplemental information from the Provider should be forwarded directly to the LWIB that originally reviewed the application. The LWIB determines if they believe the information is sufficient and then

forwards the employment documentation to LWC’s Research and Statistics Division for preliminary review and submission to the Deputy Director of the Office of Workforce Development for final determination and possible inclusion to the Employment Rate performance measure.

6.10 Appeals Process for Denied Provider Programs

Training Providers can have a training program denied inclusion on the statewide Eligible Training provider List by either the LWIBs or by the state (LWC). The training provider has appeal rights in either case.

A. Denial of Training Programs by the LWIB

1. Local Level Review - training providers have 30 days from the receipt of the denial notice in which to file an appeal to the LWIB. The provider must complete and submit an Appeal Request Form (Appendix 1, Form E-1) to the LWIB. The provider’s request for appeal must clearly identify the program that was denied and is being appealed and the reason(s) for the appeal. (The list of reasons a training provider may be denied certification may be found in Chapter 6.05) Such appeals must be submitted in writing. The LWIB must issue a decision within 60 days after the appeal is received. The LWIA must provide opportunity for a hearing and send the decision to the training provider by certified mail or hand delivered with a signature verifying receipt. If the training provider is not satisfied with the LWIB decision, an appeal may be filed with LWC.

Within 60 days of receipt of the appeal, an opportunity for a hearing will be provided and a decision will be issued to the training provider and a copy sent to the LWIA. All appeals must be forwarded, in writing, to the following address:

The provider has 30 days in which to submit an appeal, to LWC. Within 60 days of the receipt by LWC of the appeal an opportunity for a hearing will be provided and a decision rendered to the training provider. All appeals must be forwarded, in writing, to the following address:

7.01 Student Data Submission Requirements

The reporting periods needed for student data are related to the corresponding WIA Program Year. The provider must submit student Exiter and Enrollee data for the appropriate WIA program year in order for the correct program performance measures to be calculated and submitted to the LWIB for provider program review. (See Figure 7.1) Remember that “exiters” include both completers and non-completers.

7.02 Student Data Requirements

The student data information is required for SCORECARD processing to determine a provider’s program performance measures for inclusion on the state’s ETPL or in the collection of required enrollee data needed for federal reporting, as stipulated in sections 122 and 133 of the WIA. The provider MUST submit student data in the format provided in this chapter. If a provider does not submit the required student data and/or in the format provided it may delay the processing of the measures, which may result in a provider being denied or removed from the state’s Eligible Training Provider List.

7.03 Student Data Spreadsheet Set-up

A Provider’s Student Data should be submitted in Microsoft Excel format unless the provider is unable to do so. The Excel Spreadsheet should be formatted as follows:

1. Ariel Font 10 pt. should be used for all fields.

2. All entries should be aligned left.

3. The formatting for all entries must be set to “text.”

4. No symbols such as periods, commas, dashes, back or forward slashes, semi-colons, and/or colons should be used in the spreadsheet.

1. INST CODE - is the providers institutional Code and can be only 10 characters, it is assigned by LWC for training institutions and may be located in your HiRE account under Provider Profile > CRS Provider Detail > Institutional Code. This is a required field.

The provider may submit their student data electronically via email or on a disc mailed to LWC. All information submitted electronically or on disc should be password encrypted to preserve the integrity of the students Social Security Numbers and other personal information. The Louisiana Workforce Commission takes student data security very seriously and requires all transmissions of personal information including Social Security Numbers to be password encrypted. An email containing a SSN should never be submitted unencrypted to LWC. The proper method of student data submission is:

1. To password encrypt the data and send the document as an attachment; and

2. To send in a separate transmission the password to access the encrypted document.

Step 3: Provide the time of the program classes. There are 3 choices Day, Night, and Day and Night.

INSTRUCTIONS:

Step 1: Input the class time involved in the program/services. Class time is considered lecture work in a class room setting.

Step 2: Input the lab time for the program (if applicable.)

Step 3: Other Time is other work involved in course for training outside of class and lab time.

Step 4: Input the weekly class schedule, if possible.

Step 5: Input the minimum class size for the program (class minimum size must be at least 5.)

Step 6: Input the maximum class size for the program (class maximum size must be no greater than 25.)

Step 7: Input the number of instructors for this program or course.

Step 8: Input the programs class frequency. The choices are Daily, Bi-Weekly, Weekly, Monthly, Quarterly, Semester, Tri-Semester, Annual, Bi-Annual, and Bi-monthly.

INSTRUCTIONS: While logged in to HiRE with your HiRE provider account, select the Manage Provider Profile link to get to your provider profile. Step 1: Click on the “Contacts” Tab. Step 2: Click “Edit” next to a contact name to modify the contact or remove a contact. Changing the status of a contact to “Inactive” will remove the contact from display. Persons managing the HiRE profile for an institution are highly encouraged to list themselves as a contact, as that will ensure they receive email communication updates from LWC. Additionally, it is a good practice to list several contacts if possible. That will ensure that your institution continues to receive updates even if one person leaves, changes positions, takes a vacation, or is otherwise unavailable. Email addresses are the most important information to keep up to date, and phone numbers are also important. Please list extension numbers if you have one.

General Information

I. Eligible Training Providers “NOT” eligible under title IV of the HEA or registered under the NAA that want to apply for Initial and/or Subsequent Eligibility are required to submit Student Data for each program in the format required in Chapter 7 of this manual. The Student Data Layout can be obtained from our website at www.laworks.net > Workforce Development > Eligible Training Provider Information. The Student Data must be for the appropriate WIA Program Year and should include the following:

A. Exiters Data (Completers and Non-Completers); and

B. Student Enrollee Data.

II. There are instances where Providers may be exempt from Student Data Requirements. (See

Chapter 3 of the Eligible Training Manual for further details.)

III. The Louisiana Workforce Commission requires that student data be submitted securely. (See Chapter 7 for details on how to secure your Student Data for submission to the LWC.)

IV. Please refer to Figure 1: Student Data Requirements by WIA program Year to understand the data

that is collected and analyzed by the SCORECARD system for the appropriate WIA program year.

V. A Louisiana State Fiscal Year begins on June 1 of any year and ends on May 31 of the following year.

General Information

I. If a provider meets the minimum completion rate and hourly wage rate and desires to submit supplemental data for the Employment Rate Measure to become eligible. The provider may request a, “No Finds” list. A “No Finds” list is a list of students that exited (Completers/Non-Completers) a program, but did not show employment based upon income pulled from the state Unemployment Insurance Wage Records. (See Chapter 4 for more details on how the performance measures are calculated.) The time it takes to compile a, “No Finds” list will depend on if the school is a proprietary school that submits its data directly to LWC or if their data is submitted to LWC from the Board of Regents. The “No Finds” list that is compiled and forwarded to the training provider contains the Social Security numbers of those students who could not be found as employed through the Unemployment Insurance Wage record data. This information will be encrypted, as to protect the integrity of the students Social Security Numbers and information.

II. The training provider may provide acceptable supplemental information on the employment status of

the students found on the “No Finds” list. In accordance with USDOL’s TEGL 17-05 Supplemental Sources of Data the following verifiable information is acceptable documentation:

1. A paycheck stub; 2. W-2 form; 3. A written letter from the employer on letterhead stating employment; and/or 4. Form 1099.

III. When supplemental sources are used, individuals should be counted as employed if, in the calendar

quarter after the exit quarter, they did any work at all as paid employees (i.e., received at least some earnings), worked in their own business, profession, or worked on their own farm. Please remember that the supplemental information MUST show employment or employment wages in the quarter following exit quarter from the program. For Example, if the student exited a program on February 2, 2012 (1st Quarter in the Calendar year = January 1, 2012 → March 31, 2012) then the provider must provide acceptable documentation showing employment or employment wages for the 2nd Quarter of the year or the quarter after the exit quarter (2nd Quarter of the Calendar year = April 1, 2012 → June 30, 2012).

IV. Supplemental information should be forwarded directly to the LWIB that had reviewed the application.

Upon verification of the documentation, the LWIB will forward the employment documentation to LWC for preliminary review. The Research and Statistics Division will submit the information to the Deputy Director of the Office of Workforce Development for final determination and possible inclusion to the Employment Rate performance measure.

B. If it is determined that the training provider substantially violated any requirement under WIA or state policy; and

C. For failure to reapply under Subsequent Eligibility Procedures.

Training Providers can have a training program denied inclusion on the statewide Eligible Training provider List by either the LWIBs or by the state (LWC). The training provider has appeal rights in either case.

Denial of Training Programs by the LWIB

Local Level Review - training providers have 30 days from the receipt of the denial notice in which to file an appeal to the LWIB. The request for appeal must clearly identify the program that was denied and is being appealed and the reason(s) for the appeal. (The list of reasons a training provider may be denied certification may be found in Chapter 6.05) Such appeals must be submitted in writing. The LWIB must issue a decision within 60 days after the appeal is received. The LWIA must provide opportunity for a hearing and send the decision to the training provider by certified mail or hand

I. The Louisiana Workforce Commission takes student data security very seriously and requires all transmissions of personal information including Social Security Numbers to be password encrypted. An email containing a SSN should never be submitted unencrypted to LWC. The proper method of student data submission is:

The Louisiana Workforce Commission (LWC) requires Providers, Schools, Institutions, Community Organizations, Apprenticeship Providers or any other entity not mentioned (inclusively hereinafter referred to as “Provider”), to submit sensitive data, including Social Security Numbers obtained from their programs participants that must be protected. The Louisiana Workforce Commission access to this information is based on a need to determine a Provider’s program performance for application/reapplication to the state of Louisiana’s Eligible Training Provider List (ETPL), as required by Policy 20 Addendum 1 of LWC’s Office of Workforce Development (OWD) and in accordance with the requirements stipulated by sections 122 and 133 of the Workforce Investment Act.

The Louisiana Workforce Commission has implemented internal security protocols to ensure an adequate level of protection is afforded to any student information received, stored, processed, and transmitted. The LWC uses Provider student data only for the purposes that are defined by the Workforce Investment Act and the U.S. Department of Labor.

The Provider is to ensure that an adequate level of protection is afforded to any student information obtained, stored, processed and transmitted to the Louisiana Workforce Commission. To assist the Provider in protecting their students’ private information the following Security Guidelines have been created.

These Security Guidelines serve as an administrative safeguard in determining the proper protections needed in maintaining and transmitting sensitive student information to the Louisiana Workforce Commission.

Security Guidelines

As a Provider, you are responsible for the confidentiality and security of a student’s personal information and are accountable for all activity relating to the use and transmission of this information and you should:

a) Implement written policies and procedures in relation to retention, maintenance, security, and disposal of files (both paper and electronic) containing personal data;

b) Obtain and process personal data fairly;

c) Keep it only for one or more specified and explicit lawful purposes;

d) Process it only in ways compatible with the purposes for which it was given initially;

e) Keep personal data safe and secure;

f) Keep data accurate, complete and up-to-date;

g) Ensure that it is adequate, relevant and not excessive;

h) Retain it no longer than is necessary for the specified purpose or purposes;

I. Dates to Remember:

July 31 of any WIA Program Year - is the deadline to submit student Exiter and Enrollee data to the Louisiana Workforce Commission (LWC) for the subsequent program year. The Appendix 1, Form F: Student Data Security Awareness Form and the “Appendix 1, Form C: Student Data Certification Statement must accompany the data submission. These forms may be found at in Appendix 1 of the Eligible Training Provider Manual or at www.laworks.net > Workforce Development > Eligible Training Provider Information.

August of any WIA Program Year - The Board of Regents submits student performance data it has collected to the LWC for processing.

July 31 - September 30 of any WIA Program Year - the LWC prepares program performance reports, based on all participants, for review by the Louisiana Workforce Investment Boards.

October 31 of any WIA Program Year (Change) - is the deadline for approved providers to update theirprograms and submit them for reapproval through the HiRE system. This is an earlier date beginning 2014.

October 1 of any WIA Program Year - the LWC uploads the performance results to the HiRE system.

October 1 - December 31 of any WIA Program Year - the training providers may submit supplemental employment data to the LWIBs and LWC (only for the Employment Rate Measure.)

September 1 - December 31 of any WIA Program Year - the LWC includes supplemental employment data in performance calculations and posts revised performance data in CRS.

August 1 - December 31 of any WIA Program Year - the Local Workforce Investment Boards (LWIBs) review and approve training providers or programs for the subsequent WIA Program Year’s Eligible Training Provider List (ETPL.)

December 31 of any WIA Program Year - the current WIA Program Year’s ETPL expires.

January 1 of any WIA Program Year - The Subsequent WIA Program Year ETPL becomes effective (The ETPL is effective from January 1 - December 31 of any WIA Program Year.)
