veraniegos a orillas
Buenos comienzos

Sometimes the beginning forebodes a good ending. This is the
case this summer in Sotogrande, where new initiativesare revealed
every day, which will undoubtedly improve a place that is already
exceptional in itself, with summer ac-tivities now multiplying. In
addition to the customary golf, polo and padel tournaments, as well
as all the nautical activities, social events take
place every day so that residents and visitors can have fun on
long summer days.A good example of this is the craft market which,
since July 16, will bring to life the summer promenades on the
seafront
at Ribera del Marlin. It will be a unique opportunity to find
some very attractive objects without having to leave
Sotogran-de.
Another initiative that recently got underway, and which is
expected to expand its area of operation, is the tourist trainthat
currently acts as courtesy transport within the harbour complex, an
original way to visit Sotograndes fantastic marinaon board a
tourist train that will no doubt delight both children and
grownups, in addition to offering a public service.
On top of all of this there will be summer parties, activities
for the kids at the beach clubs, fashion shows, new
businessesopening and other activities like the after polo
festivities. Together they will ensure that the needs of those who
choose to co-me to Sotogrande year after year for a few days
relaxation are met, with plenty of alternatives to days of sun and
beach, which are of course another fantastic option during this
holiday period.

Cuanto y cuantas veces
The actions of our governing bodies in proposing, launching and
then hal-ting the work on the San Enrique de Guadiaro medical
centre can only belabelled as ridiculous. The fact that we have to
take our families to a me-dical centre from the seventies in this
age of new technology and communicationis as if we are watching a
Paco Martnez Soria film. We had condemned the si-tuation through
this medium on countless occasions, until finally, in a fit of
poli-ticking on the eve of elections, a proposal was made to plan
and implement a me-dical centre in an appropriate location, which
could attend to the needs of all tho-se in Valle del Guadiaro. We
all applauded this initiative, which in reality vindi-cated the
permanent fight shown by the neighbourhood. I still recall,
however, that they didn't even consult those involved, with the
doctors themselves com-menting that the planning of the centre
suffered a series of issues such as access tothe surgeries and the
emergency area. Now that the restart of the work is immi-nent, an
issue we have denounced both actively and passively, it remains to
beseen whether or not the work and these issues will be finished.
Even thoughthings have to be said, it must be completed, even it
means that the emergency
entrance is accessed through the adjacent orange groves. All the
same, the attitude taken by the new governing body of the San
Roque
Council, led by the mayor, Juan Carlos Ruiz Boix, should be
valued, as they con-sidered this to be a priority issue. In the
end, the affected population wishes for mo-dern services to be
available, we aren't going into whether or not the minimum
andnecessary services are available during the excessive demand of
summer, we trustthat it has been taken into account. We wait
expectantly for this good initiative tobe fulfilled and hope to see
it up and running on the specified date.
As for us, we commit to send the mayor a summary of all that has
been pu-blished in the media from the planning to the opening of
the centre. We wouldprefer that it could fit into a normal folder,
and not to have to make some kind ofnotary-style book, I am sure
you understand what I mean, although we must beclose to that when
it comes to the amount of sheets. Luckily for the region
thissummer, the Humanline Medical Centre, which has only be
operative for a littleover a year, is finalising the basics to
offer a 24 hour service in their own centre, which is great news for
all residents and visitors.

Humanline would like toremind you of the valuable be-nefits
provided by medicinal
plants, in this case in the field ofcosmetic medicine, and
wewould like to introduce to youone of them in particular: da-mask
rose.
The damask rose is conside-red to be the queen of flowersdue to
its properties and it iscultivated in the beautiful va-lley of
Kazanlak in Bulgaria. Its valuable petals, from whichits oil is
extracted, is collectedby hand at dawn in early May.
It is a custom that the Bulga-rians are so proud of that it
ispart of their national folklore.
Its use in cosmetics is littleknown in our country; howe-ver,
elsewhere, in countries likeRussia, Greece, Egypt, Turkeyand
Rumania, there is a tradi-tion of using the damask rosethat goes
back hundreds of ye-ars (Cleopatra herself usedit)
It has a great many proper-
ties: regenerative, healing, nu-tritional, antiseptic,
antioxi-dant it even has harmonicand relaxing properties. It
istherefore recommended formany conditions: wrinkles,dryness,
blemishes, scars,burns, stretch marks...
It works through its abilityto revitalise the skins
fibroblast, which is responsible for collagenand elastin
production.
Its benefits have been veri-fied in numerous clinical trialsand
it is considered by some asa magical elixir.

Water quality
The bathingwaters on allof SanRoques bea-ches are ofs u f f i c
i e n tquality interms ofhealth condi-tions, as the report
compiledby the Regional HealthMinistry on the state of thecoast
reveals. This study isbased on the analyses con-ducted on the
beaches by theGeneral Secretariat for PublicHealth and
Participation. The Regional Health Ministryhas inspected a total of
341sampling points on 253 bea-ches in 61 municipalities onthe
Andalusian coast. Thewater samples were analysedto determine the
level of thevarious parameters requiredby the regulations in
force,including microbiological cri-teria, transparency,
colour, mineral oils, the presence ofpersistent foaming and
floa-ting solids. The six San Roque beaches, according to these
reports, are within the establishedquality levels, so their
watersare suitable for bathing.

sea mayoritaria.
Summer is underway and it is time to make predictions.
Sotogrande has prepared a full programme of activities, hoping that
the influx of people will be better than in pre-vious years. To
find out whether local businesspeople are fearful of the situation
or, to the contrary, they are confident that it will be a great
summer, El Peridico de Soto-grande asked some of them for their
views to get an idea of what might happen this summer. In general,
they all confess to being confident that Sotogrande will be busy.
The predictions are very good and the work done by local businesses
will mean that visitorsand residents are unlikely to notice the
recession in the activities on offer, because everyone has made an
effort to provide plenty of entertainment, leisure and sport in
So-togrande.Everyone hopes the predictions will be fulfilled and
that there will be a good turnout for the planned events.
Qu previsiones tiene de cara aeste verano?
What are your predictions for thesummer?
MANUEL CRESPO
he
It looks like it will be a good season. Dueto the crisis,
tourists will tend to remain inthe area rather than go abroad.
This, toge-
ther with the problems in North Africa, means that the forecast
for Sotogrande isgood. In fact, the estate agents I have spo-
ken to have told me that rental figures ha-ve increased compared
to last year, so itwill be even better..
It looks like it will be a good season

Opinin22
Luis BabianoAsesora legal
acontecimientos. An recuerdo las palabras delentonces
In the first article of this series, we conducted a critical
examination of theconstitution and organisation of Spanish
democracy, focusing on three as-pects in particular: a) the
grandiloquent statement of Article One of theconstitution which
declares that all powers of the State derive from the peo-ple; b)
the failure to take into account the evolution of the structure of
society, and c) the establishment of a division of powers that are
not properly differen-tiated, so that the controlling function of
this division is completely nonsensi-
cal.The first asser-
tion that nationalsovereignty residesin the Spanish peo-ple,
from whom thepowers of the Statederive is a magnifi-
cent theoretical statement of principle which is not
subsequently reflected inthe regulation of the various
relationships between the powers existing in to-days society.
However, it has acted and it will always act as a pretext to
jus-tify whatever outrages the politicians who are elected and
designated by thepeople want to commit. We have had plenty of
examples of this throughoutour modern democratic history. Being
elected by the people appears to justifyany atrocity that one
wishes to perpetrate, precisely for the good of the
country. I still remember the strong impact on my fledgling
legal mentality ofthe Rumasa law of expropriation. At that time, I
was Chief Public Prosecu-tor in Cadiz and Jerez de la Frontera and
I experienced all those events first-hand. I remember the words of
the Vice-President of Spain at the time justif-ying the legal
aberration of the expropriation with the legitimacy that comesfrom
being elected by the people: a government elected by the people
canflout any existing law because, as a representative of the
people, it is empowe-red to do whatever it deems necessary.
The fact that the constitution was pronounced without bearing in
mindthe evolution of the social structure and the disappearance of
the three po-wers of the 19th Century on which the theory of their
division was based, hasleft the powers that be on the outside. And
the democratic experience underthe protection of our constitution
of 1978 has shown that these powers thatbe often have more power
than the socalled political powers. The referencesto them that do
exist in the constitution are very vague, with Article 7, for
ins-tance, stating: that the workers unions and business
associations contributeto the protection and promotion of the
economic and social interests that per-tain to them. Or Section 1
of Article 20, which refers to the media, limits it-self to
asserting that the right to freely express and disseminate
thoughts, ide-as and opinions through the spoken word, writing or
any other means of re-production is recognised and protected. Or
Article 38, which establishes thatfree enterprise is recognised
within the framework of the market economy.

Luxembur-go.

The KID and the UCITS IV Directive
On July 1, the Directive aimedat harmonising the Europeanmarkets
in matters of collectiveinvestment entered into force. The renowned
UCITS IV hasarrived.Although this day will be re-membered as a key
date for Eu-ropean administration, in rea-lity only one country has
adop-ted the directive in its legal re-gulations. That country is
Lu-xemburg. Spain is on its way todoing so. In the wake of
manydoubts among agents in the sec-tor, the modification of the
CIIlaw which will enable thetransposition of the European
regulation has taken its firststeps and, on Friday June 24,the
Cabinet Council approvedthe submission to the courts ofthe draft
bill to modify Law35/2003 on CIIs. Now it is ti-me for the
parliamentary pro-cess (the Congress and Senate)which will give
rise to the modi-fications proposed by the va-rious political
parties to produ-ce a final text which, foresee-ably, could enter
into the cu-rrent legislation if the electionsare not brought
forward. In any event, from now on, in-vestment fund managers
opera-ting in Spain will be able to
start using the KID, the harmo-nised key information docu-ment
for investors, proposed aspart of the UCITS IV Europe-an
regulations, which replacesthe simplified document. Thefund
managers have until July2012 to adapt the simplifieddocuments for
their funds tothese regulations. The KID or new key informa-tion
document for investorsmust include the name of thefund, the ISIN
code and infor-mation on the fund manage-ment organisation and the
com-pany or group to which it be-longs. This new document will
provide investors with simpler, more practical and, above
all, more standardised informationon their funds, their
investmentobjectives and policy, risks etc.The difference
introduced bythis new format compared tothe simplified document is
thatit summarises the key informa-tion on the fund in two
pages, divided into five sections: in-vestment objectives and
policy, payout and risk profile, fees, re-turns offered by the fund
to dateand practical information likethe name of the escrow
agent. As they have until now, inves-tors will also receive a
detailed
document on their fund.In addition to the KID, theother key
tools that the regula-tions include are: - the fund manager
passport(enables organisations to ma-nage their products in any
otherEuropean Union membercountry without having to re-gister a
manager in eachcountry where their product issold);- the
cross-border master-feeder(possibility of managing a sin-gle
primary or master fundand to create subordinate fee-der funds in
each jurisdiction);and

deSotogrande, cambi.
Gracias a Dios
podria haber suce-dido.Esta gente, quienes ya hemos reconocido, son
unos cobardes y esto por supues-
to no se va a quedar asi.

obras.
There has been much talk over the last twoand a half years, in
which the building workon San Enrique Health Centre has been
onhold, on the healthcare situation of the Gua-diaro Valley and
nearby towns and villages.Local residents are the worst hit by this
situa-tion, which is why, now that the upcoming re-sumption of
building work on the centre hasbeen announced, El Peridico de
Sotograndedecided to ask residents for their opinions onthe
announcement. As one would expect, theyall applaud the fact that
the work is to be resu-med, but many of them say that until they
seethe company working in the area once again, they will not believe
the promises. They arguethat they have already been promised that
the
work will resume on several occasions. They also criticise the
fact that it has taken solong, because the centre was supposed to
havebeen completed years ago, and they do not un-
derstand how the regional government hassuddenly decided to
facilitate the continuationof the project now that there is a new
munici-pal government.

havebeen demanding a decent he-alth centre for local residentsfor
some time, I am delighted atthis announcement. However,I think we
should wait to seewhat finally happens, becausewe dont know what
the agree-ment will be nor how long thebuilding work will take; we
willhave to wait until the beginningof August to see.

Esta situacin me pareceterrible. Los responsablespolticos gastan

terrible.

This situation is awful. Thepolitical leaders spend moneyon
other projects and mean-while the building on work onthe San

Idont live in San Enrique, Imin Sotogrande, but the healthcentre
would be very good forall the localities in the area.Lets hope the

hacen nada.
San Enrique eslo ms dejado deSan Roque
Until I see them getting down towork there I wont believe it
becausewe have already seen how they star-ted it and then left it
half done. I thinkthis shows how San Enrique is themost neglected
part of San Roque, and we pay the same taxes here so Ithink we
should have the same rightsand the centre we have is not in thebest
of states, to be honest. Its notright that we should have to
changegovernment so that the work can be-gin, but it seems that
this is the onlyway to get things done because, to allappearances,
after four years they areburned out and in the end they dontdo
anything.
San Enrique isthe most neglec-ted part
EMILENE AGUILERA
portodas.
Me gustaraque fuera cierto
I think its great if the work is resu-med; I dont believe it but
I hope itstrue because for any little thing wehave to go to San
Roque, becauseat the centre we have here they onlydo the bare
minimum. Its not rightthat we should have to change ma-yor in order
to reactivate the buil-ding work; it should not have mat-tered
which party was in power be-cause for us it would be great newsif
this health centre is completed on-ce and for all.
I hope its true
MANUEL DOMNGUEZ
I think its fantastic but it shouldalready have been started and
finis-hed by now. However, I cant seehow the building work will
resumenow because it has already beenpromised many times. I dont
thinkwe should have to change govern-ment in order to get things
done.We residents have put a lot of effortinto demanding that they
completethe building work because the cen-tre we have is awful and
I think thenew one would be very good foreveryone. We have to bear
in mindthat this is not just for San Enri-que.
It should already havebeen startedand finished
EVA MARCOS
No
parti-do y s se pueda terminar.
Lo que quieroes que se acabe
The bargaining chip that all theparties used in the elections
wasthat the centre would be comple-ted. Thats great, I couldnt
careless which party does it, I just wantit to be completed,
because withevery year that goes by it deteriora-tes and its sad to
see a project thathas cost and will cost so much mo-ney put on hold
for three years. One thing that is hard to unders-tand is that the
speed at whichthings are done should depend onwhich party is in
office in the mu-nicipality and in central govern-ment. The worst
thing is that we,the public, are those who really lo-se out in
these things.
I just want it to be completed
