At a time when larger-than- life heroes strode the screen this charming common man went on to steal hearts with Chitchor, Chhoti Si Baat, Gol- maal, Naram Garam, Baton Baton Mein, Bhumika, Baat Ban Jaye, etc. Amol, now a full-time di- rector, says he became an ac- tor by accident. All the same he believes the craft needs discipline. “No one is a born actor. It is a skill which can be learnt like any other and fine-tuned,” he says. So would he subscribe to the principles of method acting? “I don’t mean that. No one is a born singer. One has to learn music, the ragas, the sur. Likewise, acting too is learnt,” he says. “Take pot-making. You need mitti, the right amount of water. You mould it and run the wheel at a particular speed. Mitti is not the pot.” Why hasn’t he acted in the last two decades? “I acted in Aks. It was a blink-you-will- miss-me role. My character was killed in a jiffy... I strayed into acting. While doing my masters at JJ School of Art, I’d watch a lot of plays. Once the legendary Satyadev Dubey saw me hanging around there and asked me if I would act. I said yes. Then he told me sternly: ‘I have asked you to act not because I saw a spark in you but because you were hanging around my sets and you seem to have plenty of time on hand.’ Recently I acted in the Marathi film Samantar.” Why is he so against Bol- lywood, the mainstream cine- ma, you want to know. “Which mainstream cine- ma are you talking about? The cinema which flops 95% of the time? Why do you keep talk- ing about the cinema not want- ed by the audience? Otherwise, they wouldn’t flop. Yet, every- one calls it mainstream cine- ma, entertaining. Entertain- ment means different things to different people. Filmmak- ers fool the audience by dish- ing out insipid fare and say that’s what the audience wants.” Acting Was Never His Calling, Says Veteran Palekar Poor murder convict could escape gallows D h a n a n j a y M a h a p a t r a | TNN New Delhi: Law is supposed to be enforced uniformly, and with- out sorting the guilty on the ba- sis of their economic and social background. On Monday, how- ever, the Supreme Court said that economic status of a mur- der convict needs to be taken into account to determine whether he should be awarded death penalty or life sentence even in respect of offences falling in the “rarest of rare” category. In an order that is sure to spark a debate, the court said poor background of the accused should, along with old age and years spent behind bars while awaiting death sentence, be con- sidered as mitigating factors when courts ponder whether life sentence should be used in an otherwise fit case for death penalty. The order was passed by a Bench comprising Justices P Sathasivam and H L Dattu while hearing an appeal against death penalty awarded by the trial court as well as Allahabad High Court to two members of a gang of bandits convicted for killing four persons in December 1995. The Bench noted that apart from being old, the convicts had been in custody since 1996 and death penalty had hung over their heads since 2005, when the trial court gave its verdict. The Bench further said, “The convicts (Mulla and Guddu) be- long to an extremely poor back- ground. One thing which is clear to us is that they have commit- ted these crimes for want of money. Though we are shocked by their deeds, we find no rea- son why they cannot be re- formed over a period of time.” Courts have always treated old age and the duration of in- carceration as attenuating con- siderations while settling ‘life sentence or death penalty’ ques- tion, but it is the first time that the top court has introduced af- fluence or lack of it in play. Justice Sathasivam, writing the judgment for the Bench, stressed that the SC was not sug- gesting that economic depriva- tion could be a justification for moral depravity as shown by the two convicts. But he also said that “we certainly recognize that in the real world, such factors may lead a person to crime”. “Therefore, we believe, socio- economic factors might not di- lute guilt, but they may amount to mitigating circumstances. So- cio-economic factors lead us to another related mitigating fac- tor, that is, the ability of the guilty to reform,” the Bench said. The court also seemed to sug- gest that since poor commit crimes because of compulsion, they are more likely to mend. “It may not be misplaced to note that a criminal who com- mits crimes due to his econom- ic backwardness is most likely to reform. This court on many previous occasions has held that this ability to reform amounts to a mitigating factor in cases of death penalty,” it said. While substituting the death sentence awarded to Mulla and Guddu to life imprisonment, the Bench said, “The punishment of life sentence in this case must extend to their full life, subject to any remission by the govern- ment for good reason.” The significance of the order stretches beyond its repercus- sions for Mulla and Guddu. It comes after a spell when courts were seen to be going by the let- ter of law, especially on a host of issues — economic re- forms/liberalization, rights of trade unions, etc. Whether it marks, in keeping with the political zeitgist, the be- ginning of a tilt towards aam aadmi, only time will tell. [email protected] SC Says Poverty of Criminals Is a Mitigating Factor; They Can Be Easily Reformed Orkut reunites father and son TIMES NEWS NETWORK Chennai: Social networking sites are used by many to re- connect with old friends but for 60-year- old Ko- ruthu, tech- nology helped him trace his son who had left home almost 12 years ago. When Jimmy Koruthu, 31, opened an Orkut profile, he never thought that an email ID he had mentioned in it would help his relatives and father to trace him all the way to Chen- nai from Kerala. The email ID rang a bell for one of Jimmy’s relatives because it contained his fam- ily name Koruthu. The rela- tive alerted Koruthu who had been trying to trace his son all these years. The cyber cell of Kerala police traced the in- ternet protocol address to a location at Adyar and direct- ed Koruthu to approach the Chennai police who traced Jimmy’s address to a brows- ing centre. The centre had installed a CCTV which helped the po- lice to identify the youth. “We showed the video footage to Koruthu who iden- tified Jimmy,” said inspector Gajapathy. The police traced the ad- dress. But, he had shifted his residence. “But, we managed to find the new address and re- united the father and son,” Ga- japathy added. “I had men- tioned my email ID in my net- work profile. A relative saw my email ID and found out that it’s me, through the name. I had not posted my photograph in the profile,” said Jimmy who is happy to meet his father. Although it was an urge to do something on his own that prompted Jimmy to leave his house in Pathanamthitta way back in 1998, he ascribed no particular reason for not con- tacting his parents for so long. “I have been working in a call centre. Nobody in the Congress camp believes that Pawar spoke about cricket for so long and that no politics was discussed be- tween the two big leaders of Maharashtra. However, chief minister Ashok Chavan who called on Congress president and UPA chairperson Sonia Gandhi in Delhi has been ad- vised to play down the tete-a-tete between Pawar and Thackeray. After Rahul Gandhi’s suc- cessful visit to the city and the euphoria created by his jour- ney in a suburban train, the Shiv Sena’s morale is low. Pawar’s visit to Matoshree came as a relief to the Sena. Pawar, who held a two-day camp for Aurangabad workers on Saturday, had slammed Thackeray for his ban on Aus- tralian cricketers. Judges appointments: HCs’ views on RTI queries sought TIMES NEWS NETWORK New Delhi: Faced with increasing number of queries under Right to Information (RTI) Act on judges’ ap- pointment to higher judiciary, the Supreme Court on Monday sought the views of all High Courts on this issue. Responses of HCs were sought by a Bench comprising Justices B Sudershan Reddy and S S Nijjar, which was hearing a petition filed by the CPIO of the apex court challenging an order of the Central Information Commission directing mak- ing public such information. “We see that such matters frequently arise and High Courts are dealing with these problems. Why should we not issue notice to the registrar generals of all High Courts,” the Bench asked. On an application from S C Agarwal, the CIC, apart from asking the SC to give information about the ap- pointment process of judges, had also directed the apex court to furnish information under RTI about the correspondence between the Chief Justice of In- dia and the CJs of HCs. It had also allowed the plea of Agarwal asking the SC to disclose the communication between Justice R Regupathy of Madras HC to the CJI after he alleged that a central minister had tried to influence him in a case. Attorney general G E Vahanvati, who ques- tioned the CIC decision, argued that if opinions ex- pressed by judges were to be laid out in the public do- main, nobody could expect a frank opinion.
