CHAPTER 1.0: EXECUTIVE SUMMARY The National Environment Management Council (NEMC) came into being in 1983 when the Government of Tanzania enacted the National Environment Management Act No. 19 of 1983. NEMC was established with a broad mandate in response to the national need for such an institution to oversee environmental management issues and also implement the resolutions of the Stockholm conference (1972) , which called upon all nations to establish and strengthen National Environmental Councils to advise governments and the international community on environmental issues. The enactment of Environmental Management Act No. 20 of 2004 (EMA, 2004) by Parliament in October 2004, repealed the National Environmental Management Act No.19 of 1983 and re-established NEMC. EMA 2004 gives NEMC mandates to undertake enforcement, compliance , review and monitoring of environmental impact assessments, research, raise environmental awareness and collect and disseminate environmental information. This document presents the statistics and information on Statutory Environmental Impact Assessment (EIA) certificates before and after enactment of EMA No.20 of 2004. The document comprises of all EIA certificates approved by the Minister for issuing to proponents from 2005/6 to 2009/10. It also contains the Conditional Environmental Clearance (CEC) letters which were issued by the Council up to 2004. From 2005, NEMC is now charged to recommend and prepare terms and conditions for issuance of the EIA Certificate by the Minister, as stipulate in EMA 2004 section 92 (1). Approval/disapproval of the EIA Certificate is done by the Minister responsible for Environment This is a second comprehensive report on the state of the environmental certification in Tanzania Mainland following the first release in 2009. This 2010 release has 40 entries for printed CEC up to year 2004 of which 39 were issued by the said year. The report also contains 287 certificates of which 274 are Enviromental Impact Assessment (EIA) and 13 are Environmental Audit (EA) certificates printed by May 2010. Among the printed certificates, 220 certificates (211-EIA) and (9-EA ) were issued to project proponents up to May 2010. This report includes also general and specific conditions for issued EIA certificates. Such information were not included in the 2009 release, thus making this release more enriched and useful compared to the latter. The content of this document is largely organized in figures (Fig. 1-3) and tables (Tables 1-12) so as to smoothen the reading and grasping of information. Sources of this data are largely from EIA filing system as well as EIA database of the Council. It is hoped that this document will act as a one stop reference for executives and other officials to readily answer most of the questions which are raised relating to EIA /Audit of investments in Tanzania Mainland. It is also expected that the document will act as a reference guide for technical staff at NEMC and environmental inspectors while preparing and undertaking monitoring and enforcement activities. Since we update and expand the entries throughout the year, the objective is to publish a report of this type every year.

CHAPTER 2.0: STAGES OF ENVIRONMENTAL IMPACT ASSESSMENT (EIA) PROCESS IN TANZANIA Given below are key steps of EIA process according to the Law: 1. Registration The proponent is required to register a project with NEMC by submitting duly filled EIA application form. The forms are available at NEMC. 2. Screening Screening is an initial review step in the EIA process. Thus, the EIA application forms and Project Brief are screened in order to assess and establish the category of project and determine the level of EIA required. This is done by NEMC within 5 working days after submission of EIA application forms. 3. Scoping If the screening indicates that a full EIA is required, identification of main issues of concern through scoping will be conducted by the developer through his Consultant. This is done by consulting all the relevant concerned parties. Draft terms of references (ToR) will then be prepared to guide the impact assessment study. A Scoping Report and draft Terms of Reference (ToR ) are submitted to NEMC for review and approval. This is done within 10 days after submission of the Scoping Report. 4. Impact Assessment Conducting EIA study is done after approval of ToR by NEMC. The Consultant uses the ToR to conduct the actual EIA study. The crucial task is to identify likely impacts, assess and evaluate their severity and magnitude and propose mitigation measures to minimise potential negative impacts and enhance positive benefits.

The output of this stage is an EIA report , also known as Environmental Impact Statement (EIS). This includes an Environmental Management plan (EMP) as well as a Monitoring Plan (MP) that outline management and monitoring of anticipated impacts, including those, which affect local communities in the project area. Public consultation is mandatory when conducting an EIA and the proponent (through his consultant) must meet key stakeholders to get their views. 5. Review Once the proponent has submitted an EIA report (EIS), NEMC conducts site verification visit . The site visit is conducted to verify information provided in the EIS report.

NEMC then coordinates a cross-sectoral Technical Advisory Committee (TAC) to review the EIS. The TAC is composed of members from sectors responsible for environment and resource management . Review of EIS is completed by NEMC within 60 days from the date it was received by NEMC, and this is as required by EMA 2004. The Minister may within 30 days, upon receipt of recommendations of the Council approve or disapprove the EIS. 6. Public hearing As part of the review process a public hearing may be necessary to address public concerns over a proposed activity or project. Normally this takes place when major concerns have been raised by the public and potential negative impacts of the proposed project are perceived to be far reaching. Other critical factors that may necessitate public hearing are sensitivity of the site location, type and scale of project, technology used, multiple land use considerations, presence of relocation and resettlement issues, cumulative impacts and any other factor related to a particular project that might cause public concern. 7. Environmental decision-making After submission of the final version of the EIS, NEMC assesses it in order to ascertain whether all the TAC comments and recommendations have been adequately addressed by the consultant. Thereafter terms and conditions for issuance of the EIA Certificate are prepared by NEMC. Approval/disapproval of the EIS is done by the Minister responsible for Environment as stipulated in EMA 2004 section 92 (1).

8. Appeals Both the proponent and the affected or interested parties have the right to appeal. If there is dissatisfaction on the decision reached, provision for appeal to the Environmental Tribunal or Court of law is provided by law. 9. Project implementation This is conducted according to the terms and conditions of approval and is guided by the Environmental Management and Monitoring Plans. 10. Monitoring It is the collection of data through a series of repetitive measurements of environmental parameters (or more generally, a process of systematic observation) over a long period to provide information on characteristics and functioning of environmental and social variables in space and time. Day to day internal monitoring (also known as routine monitoring) is done by the developer (project management team), but compliance monitoring is done by NEMC in collaboration with key stakeholders and regulatory bodies. 11. Environmental Audit Environmental audit is an independent and objective oriented examination of whether the practice complies with expected standards. Broadly, environmental audit means a check on some aspects of environmental management, and implies some kind of testing and verification. There are two levels of Environmental Audits, i.e. Environmental Impact Audit and Environmental Management Audit. Environmental Impact Audit involves comparing the impacts predicted in an EIS with those that actually occur after implementation of the project while Environmental Management Audit involves checks against adherence to plans, mitigation measures and general compliance of terms and conditions. 12. Decommissioning This is done at the end of the project life i.e. during the phase out and closure periods. The developer prepares a decommissioning report, which includes a comprehensive decommissioning plan (DP). This DP is reviewed and approved by NEMC. The decommissioning report indicates commitment into rehabilitating the site and restoring it to its original or better state; and utilising it for other useful activities.

CHAPTER 3.0: SUMMARY OF PROCESSED CERTIFICATES UP TO June 2010. 3.1: Conditional Environmental Clearance (CEC) Before implementation of EMA 2004, the Council was issuing Conditional Environmental Clearances (CEC) to projects that had been subjected to environmental assessment . Until year 2004, conditional clearances amounting to 39 were issued to development projects. 3.2: Environnmental Impact Assessment (EIA) certificates. The Council reviews Environmental Impact Statements (EIS) with assistance of the Technical Advissory Committee (TAC) and recommends to the Minister to issue or not issue the EIA certificate . This is done in accordance with EMA (2004) section 91. From July 2005 to May 2010, the Council submitted 274 recommendations to the Minister for consideration of issuing EIA certificates to projects. Among the 274 recommended projects, 211 projects were approved by the Minister and hence issued with EIA certificates by May 2010. 3.3: Environmental Audit (EA) certificates According to EMA 2004 Section 100 and 101, the Council is mandated to conduct monitoring and auditing of development projects. Likewise, Regulation 46(2) of EIA and Audit Regulations of 2005 requires that environmental audit be carried out on development projects which commenced prior to the coming into force of the EIA and Audit Regulation of 2005 and are likely to have adverse environmental impacts. From July 2005 to May 2010, the Council reviewed a number of audit reports and submitted 13 of them to the Minister for consideration of issuing EA certificates to the projects. Until the date of compilation of this report, nine ( 9) projects were approved by the Minister and hence issued with EA certificates by May 2010. Table 1 below gives statistics for all recommendations made by the Council for issuance of certificates in each year while Table 3 shows EIA statistics disaggregated by region.

SUMMARY OF ISSUED EIA CERTIFICATES BY REGIONS Table below shows the trend of EIA certificates issued in each region per year up to the June 2010 . From the table, the first three regions with highest statistics are DSM , Arusha and Pwani. The regions with least statistics are Dodoma and Rukwa. CHAPTER 7.0: GENERAL CONDITIONS FOR CERTIFICATES 7(a) GENERAL CONDITIONS FOR EIA CERTIFICATES 1. This Certificate is valid during the whole lifecycle of this specific project unless henceforth revoked or suspended. 2. The Minister shall be notified of any transfer/variation/surrender of this certificate. 3. Observe all relevant national policies and legislation that guide this specific project throughout its life cycle. 4. Ensure safe disposal of all types of wastes (solid or liquid) in specified sites. 5. Ensure environmental sustainability by avoiding any form of pollution by using most viable management techniques. 6. Adhere to the Environmental Management Plan (EMP) and Monitoring plan (MP) and constantly improve and update them by taking into account any new development. 7. Constantly liaise with relevent authorities and consult stakeholders including local communities in case of any new development or changes as regards to implementation of your project plan activities. 8. Adhere to all proposed mitigation measures as specified in the Environmental Management Plan contained in the Environmental Impact Statement. 9. Abide to all national social and environmental safeguard policies and standards and strive to maintain and constantly improve standards. 10. 1. The characteristics of impacts likely to happen during the construction of gas pipeline and power transmission lines should be analysed and actuated after establishing the centerline and finalization of detailed engineering design. The Environmental and social Management Plan (ESMP) should be revisited to accommodate these impacts.

2. The construction contractor should prepare a separate Impact Management Plan to address social and environmental problems likely to emerge during construction activities. The comprehensive Environmental Impact Management and Monitoring Plan prepared by the contarctor should be submitted to NEMC for approval.

5. Conduct a Risk Assessment (RA) study leading to formulation of Emergency Preparedness Plan (EPP) to combat any accidental fire outbreak in the Gas Field Facility (GFF); Gas Fired Power Plant (GFPP) at Tanzania Port Authority (TPA) and the gas pipeline route.

1. Ensure to implement the Environmental Management Plan and the Monitoring Plan according to the EIA and Audit Regulation. Engage an Environmental Expert to guide you in implementing the plans and should submit reports to the Council.

1. The developer must identify proper solid waste disposal site for non decomposable wastes such as tins/cans, metals, wood, plastics, etc that are to be generated throughout project construction and operations.

2. The proponent should consider signing a memorandum of understanding with Saadani Village and obtain Water Use Right from Ministry of Water and Livestock development.

11. 2005/6

1. Ensure that storm water from the factory is well managed to avoid introduction of pollutants into lake Victoria 2. Ensure that effluent discharge permit and other necessary permits are secured from mandated authorities 3. 5. GGM exploration activities will touch Nyamalembo and Katoma areas that had already allocated for Geita Town Planning and Development, therefore GGM should consult Geita District Authorities before remarking of its boundaries.

6. Fire preventation is essential, local authority (District Forest Officer) should be consulted to determine fire risk status and fire bans in the Geita Forest Reserve.

7. Ensure that all equipment are in good working order and operated correctly to minimize fire risks or accidental leakage of oiuls, fuels and drilling fluids.

13. 2006/7

1. Ensure appropriate compensation to all the affected individuals in accordance with the laid down regulations. 2. In case of any further expansion of the project components ensure to comply with EMA (2004) and EIA and Audit

Regulations (2005). 3. Ensure implementation of the Environmental and social Management Plan and Monitoring Plan.

14. 2005/6

1. Prepare a Kiswahili version of the non-technical executive summary and distribute it to all key stakeholders. 2. Since the project uses a state-of-the-art technology, emphasis should be on engineering control and safe working

environment. Provision of PPEs and self contained breathing apparatus should only be complementary measures. 3. Priodic consultations with some stakeholders are essential. Involvement of stakeholders such as the Ministry of

Health and Social Welfare, Tanzania Food and Drugs Authority, and Occupational Safety and Health Authority in monitoring activities is of utmost importance.

4. Pollution of air and water by ethylene oxide and carbon dioxide is of a major concern in this project. The effects of these emissions on the workers health and aquatic life are detrimental and therefore stricter measures to prevent/control this pollution should be taken diligently.

5. Air pollution resulting from odours in the ink formulation and printing sections needs to be adequately controlled as some of them can be toxic

1. Plans to expand the above mentioned project, if any, should be subjected to EIA process as per Environmental Management Act No. 20 of 2004 and EIA and Audit Regulations of 2005.

2. Risk assessment study should be conducted and the Company’s fire outbreak preparedness plan developed. 3. A systematic monitoring plan should be prepared to ensure that any possible LPG leakages are detected at very early

stage. 4. A contingency plan to combat oil spills and fire outbreaks should be finalized and made operational. 5. Initiatives to make neighbouring communities aware of the project activities should be made. People should be

made aware of the dangers of tampering with the pipes and tanks.

1. Taking into account that the proposed project site is in a World Heritage Site, ensure that the Operational Guidelines of World Heritage Convention are strictly adhered to.

2. Ensure compliance with regulations set by Selous Game Reserve Authorities. 3. Should the developer plan to establish a dump site in Mloka Village, he will have to acquire the site adhering to the

laid-down regulations and also to comply with the requirements of Environmental Impact Assessment. 4. The developer should maintain close cooperation with the Local Government Authorities and shall give first priority

to neighbouring villages with regard to employment opportunities. 5. Ensure implementation of the Environmental Management Plan and Monitoring Plan according to the EIA and Audit

Regulations.

32. 2007/8

1. The developer should preserve indigenous tree species in the areas which constitute catchment areas. 2. Ensure to adhere to all relevant Regulations of the Forestry Sector. 3. the developer should maintain close cooperation with the Local Government Authorities and should consider giving

first priotity to neighbouring villagers with regard to employment opportunities. 4. Ensure compliance with the Environmental Management Plan and the Monitoring Plan according to EIA and Audit

Regulations.

3. Ensure implementation of the Monitoring Plan at all stages of the project. 4. Ensure provision of alternative sources of water as the current water source for the communities will be affected by

the project and ensure periodic monitoring of its quality and quantity. The new water sources to be handled over to the community before the project starts.

5. Prepare an Employment Plan and submit it to the Ministry of Labour for approval. 6. A comprehensive Decommissioning Plan should be prepared and submitted to the National Environment

Management Council and the Ministry of Energy and Minerals for approval before the actual process starts.

35. 2007/8

1. According to the recent Government directive, ensure that toilet/sanitary facilities are constructed along the road. 2. Full wildlife warning signage should be erected in areas where wildlife is prevalent. 3. During the pre-construction and construction phases, measures for wildlife areas related to signage, speed limits,

rare and endangered species, migration patterns, animal behaviour, excessive noise due to blasting, use of machinery and works in dangerous sites should be planned and implemented in consultation with Wildlife Authorities.

4. The location of the borrow pits should be according to the Environmental Code of practice for road design and construction. At the end of the operations, borrow pits and quarry sites should be restored as per Environmental Management Plan.

5. Where possible and appropriate, use the existing borrow pits which should be rehabilitated after the construction phase.

6. Borrow pits and other construction works should not be excavated in the wildlife corridor. 7. Drainage and erosion resulting from road construction activities and thereafter should be properly managed. 8. During the construction phase, safety and health hazards to workers are of major concern. Appropriate measures

should be taken in accordance with Occupational Safety and Health regulations. 9. As a result of influx of job seekers and the social interactions between the construction workers and the surrounding

communities, HIV/AIDS incidences are likely to increase. There should be awareness programmes in and around the campsites.

38. 2009/10

1. The location of the borrow pits should be according to the Environment Code of practice for road design and construction. At the end of the operations, borrow pits and quarry sites should be restored as per ESMP.

2. Drainage and erosion resulting from road construction activities and thereafter should be properly managed. 3. During the construction phase, safety and health hazards to workers are of major concerns. Appropriate measures

should be taken. 4. As a result of influx of job seekers and the social interaction between the construction workers and the surrounding

communities, HIV/AIDS incidences are likely to increase. There should be awareness campaigns in and around the camp sites.

5. Waste that is generated especially during the construction phase should be properly managed. Disposal sites should be clearly identified.

6. Due to solid wastes like used tyres and scrapers and soil contamination resulting from used oils, camps should be cleaned up and rehabilitated during the decommissioning [phase.

7. For purposes of environmental sanitation, there should be toilets at all strategic points of points of the road route.

1. Ensure compensation for relocation is effected prior to construction phase begins. This should be done in consultation with the Ministry of Lands and Human Settlements Development.

2. Consult the Ministry of Water regarding Water Use Permit for abstracting water from Lake Nyasa and Rivers Ketawaka, Mchuchuma and others. If possible the use of Lake Nyasa that has trans-boundary implications could be avoided.

3. The agreements made and demarcated between the project and local communities must be respected. The District Legal officer should assist the District and respective Villages to be affected by the project, in drawing up the legally binding Memorandum of Understanding (MoU) in order ensure the Developer fulfills the agreed obligations.

4. Introduce Community Relations Programmes. The project could employ Community Relations Officer to liaise with local people on issues pertaining to environfmental management and socio-economic issues;

5. Keep 60 meters from the riverbanks as stipulated in the Section 57(1) of Environmental Management Acts (2004) and Land Act of 1999 which prohibit human activities in certain areas including riverbanks, water dam, natural lakes or reservoirs.

6. Ensure that the Lake Nyasa, rivers and streams close to the project sites are not polluted in any way by project activities;

7. Ensure that the mining pits or borrow pits are rewstores at least to the original state. 8. Assist TANROADS in road rehabilitation before project implementation in order to accommodate the expected

increase in traffic level of heavy trucks and small vehicles between Mchuchuma, Kimelembe and Amani (About 150 kilometers);

9. Prepare an Employment Plan and submit it to the Ministry of Labour and ensure implementation of the Monitoring Plan at all stages of the project;

10. A comprehensive Decommissioning Plan should be prepare and submitted to the National Environment Management Council (NEMC) and Ministry of Energy and Minerals for approval before the actual operation starts.

11. Establish baseline conditions for the both ground and surface water quality and air qualities within the project area.

1. Should the Jatropha seed processing take place in Kilwa, a separate EIA will be required. 2. Village land use plans may have some influence on the project. Revise the EIS as necessary when the plans are ready

and inform NEMC accordingly. 3. Guidelines for biofuel development in Tanzania are being prepared. The EIS might need to be revised to address the

requirement s of the guidelines when they become operational. 4. Issues related to land acquisition and compensation should be settled preferably at the planning stage. 5. Legal requirements of other relevant authorities should be complied with and necessary permits sought. 6. Waste that is generated at different stages of the project development should be properly managed.

Prepare monitoring and audit reports in accordance with the Regulations, and submit to the Council as required. 3. Prepare annual risk assessment and emergency preparedness plans. 4. Ensure that, cyanide content in the tailings is within the threshold limits and that it complies with Tanzanian

standards where such standards exist and/or are more stringent (tailings for backfill should have cyanide content not exceeding 0.5 ppm).

5. Ensure that the transportation and handling of cyanide in any form is safe and is at all times in compliance with relevant laws and regulations.

6. Undertake regular awareness programmes on cyanide to the communities around the project area and to those along the transportation route.
