Seems funny that I have been snooping for years and I always start my column with a weather update, and this morning as I look across the yard, the leaves are making their beautiful color changes. Short Sale? Modification? Foreclosure?These are the three questions many of us are asking in the current economy. The answer however is a very individual decision. Which choice is best for you depends on a variety of factors including your long term goals, the amount you are “upside down” in comparison to loan amount and market value.
Many more lenders are now offering modifications to homeowners in distress. These are generally what I consider more of a temporary solution as the banks seldom offer principal reductions. Usually the bank will offer to lower you payment over a fixed period of time. The problem with these terms is that without a principle reduction you are not building equity. In today’s market where a home’s value may be upside down or have a negative equity of over 70%, current appreciation projections show it would take years just to break even on the balance of the loan. This makes your situation like a long term lease.
Foreclosure or simply walking away from the home is another option. There are, of
course, pros and cons to this approach. The legal repercussions can vary depending on each individual’s situation. California is a non-recourse state and has what is called a one action rule, which basically states that if your homes is foreclosed and sold by the trustee, that is the only recourse for the lender. Which means, generally speaking, you can walk away with little or no legal consequence. These rules can apply to primary homes and second or investment property. I would definitely advise anyone seeking foreclosure to seek legal advice for their individual scenarios.
If you are considering a default, I highly suggest you look into a short sale as an option. Choosing a short sale will put you back in control of your life and when you need to move. A short sale is when the borrower/owner sells a property during a pre-foreclosure process. It is called a short sale because the owner will sell the property “short” of the balance owed on the note, not because it is quick. Because a short sale is perceived as a proactive choice by the borrower, the credit compiling agencies tend to score it higher than a foreclosure or a deed-in-lieu.
I would always advise my clients to seek advise from an attorney under bankruptcy protection as well. Many homeowners have incurred a substantial amount of debt in this economy and a bankruptcy may be a good
option to help you afford to keep your home by eliminating burdensome debt. Although legally you may not need to pursue a short sale after the bankruptcy, in regard to credit building, it is still a good option.
Let me be clear, I am not advocating to anyone to ignore their financial obligations. What I am saying is that you should look at your own situation and make the decision that is best for YOU and your family and not the bank. It is very important that you should be informed about your options and possible consequences.

DIG was founded in June 1988 by Pat Moore. It started with a membership of about fourteen and has grown to one hundred at present. Members come from all over east county and elsewhere. Anyone is eligible to join and the dues are $15.00 per year.
Our purpose is to encourage interest in gardening through education and the beautification of the community. The mission of DIG is donating garden books, tapes and videos to the local library, providing scholarships to local students, hosting informational speakers and participating in the community gardening projects. Our annual fundraiser/plant sale consists of 10,000 plants. (Annuals and perennials, flowers, trees, herbs, tomatoes, cacti and succulents. CONTRA COSTA COUNTY DISCTRICT III
Delta, Transportation Issues and County Budget Are Top PrioritiesAs implementation of the recent re-districting process moves forward I wanted to share some thoughts with you.
I’m honored to now represent Bethel Island, Oakley and the majority of the City of Antioch in District III. These communities are now joined with Blackhawk, Diablo, Byron, Discovery Bay, Brentwood and Knightsen as communities I was elected to represent in 2004.
Since re-districting took effect on September 9th, my staff and I have attended many local community events and are enjoying the very welcoming reception. I am planning a community Town Hall where we will be able to go into more detail of all that we have been working on but will share some major transportation highlights with you here.
Since my election to the Contra Costa Board of Supervisors I have focused on several critical areas of county responsibility as top priorities including the county budget, Vasco Road, Highway 4, and the Delta. My driving fundamentals are to make the county more accountable, efficient and accessible.
Vasco Road, a heavily traveled dual-commute route that links Contra Costa with Alameda County, was suffering from severe accidents and fatalities. I went to work with County staff and we implemented a safety measure called a “soft” barrier along the entire corridor.
This barrier project significantly altered driving behavior by creating the feel of a barrier while still maintaining the important public safety access on Vasco Road.
Simultaneously, with the creation of the Double- Fine Zone, we joined forces with the California Highway Patrol (CHP) and their Safety Grant to promote the “Drive Safe - Stay Alive” public awareness campaign. We made significant community outreach at community events and gatherings to promote driver safety during the life of the grant.
These efforts, and most importantly those of the drivers on Vasco Road, have significantly reduced vehicle related collisions and fatalities on this heavily traveled route. A successful outcome we can all live with!
Today, the first phase of a two-phase permanent safety barrier project is under construction with an anticipated completion date by the end of the year. This project is a permanent concrete barrier along the most heavily impacted area of accidents and includes lane widening, passing lane extensions and major bridge work. I remain committed to Vasco Road safety and am currently working to secure funding for Phase II of the Vasco Road Safety Improvement project.
As a commuter on Highway 4, I know that widening this roadway is vital to the success and economic vitality of our region. As a member of the East County transportation committee network, I have been an advocate for immediate short and long-term improvements to get commuters to work on time and back home for dinner. Local revenues secured through developer mitigation fees for transportation projects are coming together with other local, state and federal dollars. Today, we have approximately $1 billion being invested into the East County transportation corridor.
Highway 4 has been widened to 8 lanes to Pittsburg’s Loveridge Road and is now rapidly moving east to the Antioch Bridge. This lane widening will significantly benefit the overall quality of life for all East County residents who face this gauntlet every day.
With the philosophy that something is better than nothing, we are getting eBART to a station near Antioch’s Hillcrest Avenue. While I share the concern that our area of the County has paid BART taxes for decades without benefit, the eBART project will provide far East County residents direct access to the entire BART system.
The station platform exchange at Bay Point that is under construction today will combine the two train systems, regular BART and eBART. The eBART track will be built in the center median of Highway 4 and head east to Hillcrest Avenue. Recent efforts secured the study of extending the line beyond Antioch and is a work in progress.
The interchange ramps at Highway 160 North and the Highway 4 Bypass will be under construction soon. The Highway 4 Bypass interchange at Sand Creek Road is being redesigned to improve traffic flows. Both of these projects are fully funded and moving forward.
