As you would no doubt be aware there has been a change in NSW Fair Trading, with the third new minister since the government took office. We met recently with the new minister, The Hon. Matthew Mason-Cox, to discuss current industry issues and while he had only just taken over the portfolio he was aware of the issues we raised and I feel confident he will continue to seek industry opinion and feedback. Geoff Hunter continues to have regular contact directly with the department to keep us abreast of any and all industry issues.

The other issue that may undergo some long overdue change is internet marketing.

The current wave of criticism, comment and anger around REA’s latest fee increases is as strong as I have ever seen, prompting many sectors, including EAC to look at alternatives to what has clearly become a case of “gouging” the industry on who they rely. In a show of arrogance REA have confirmed in recent statements

that they will continue to implement 2015 “depth product” price rises and have refused to negotiate with major groups of agents saying “talk of boycotts and group negotiations will fizzle out”.

The timing of their new Arnold Schwarzenegger ad has many asking “is that what the increased fees are to pay for.”

EAC is currently working on some “regional” solutions that if effective will create areas where REA is less relevant saving the agents thousands of dollars per year while still delivering the enquiry levels required by agents.

Many agents are finally understanding that REA needs the agents more than the agent needs REA, there are other sites and if the agents in ANY area can concentrate their content on an industry owned site and starve REA of content then the general public will soon follow.

Things are always changing in Real Estate and at the moment I am feeling it on a number of fronts.

As mentioned in my last update a review of the Property, Stock and Business Agents Regulation is currently being performed by NSW Fair Trading. We reviewed the draft regulation and had no real issues with the proposed changes in the main and a submission was sent to Fair Trading on behalf of our members. One of the changes that we did take issue with was the possible deregulation of certain commercial transactions which Geoff Hunter will comment on in his article in this edition. This issue was also discussed in some depth when EAC Chairman Dale Whittaker, Industry Liaison Officer Geoff Hunter, Jock Kreitals Real Estate Institute of Australia (REIA) Manager Policy and I met with the new Minister for Fair Trading, Matthew Mason-Cox in July.

On Tuesday, 24th of June, we co-hosted the NSW finals of the Australasian Real Estate Institutes’ Auctioneering Championships with the REIA. This was the second year of our involvement with this event which saw eleven of the state’s top auctioneers fight it out to go through to the Finals. This year’s winner was once again Gavin Croft of Bresic Whitney who won the NSW Final last year and the runner-up was Clarence White of McGrath Estate Agents. Gavin and Clarence will now go onto the National Championships to join contestants from around Australia & New Zealand at the final event which is being held in Auckland, New Zealand from the 21st-23rd October 2014. We wish them luck and would love to see them take out the title for NSW.

Our new eForms solution was released in early June, there were a couple of small issues experienced by some users but the feedback has been extremely positive. We are now working with My Desktop to integrate our forms with their software and will be approaching other CRM and software providers once we have completed the integration with My Desktop. If you are not using our printed and online forms then I suggest you take a look. Our forms are constantly checked and updated to ensure that they are compliant. With savings of as much as $40.00 (compared to one competitor for one single pad of printed forms based on the equivalent pad size) you would be crazy not to take a look.

The new eac.com.au website that I spoke about previously is now undergoing final testing and we are getting closer to a launch date. The new site will see a change to a totally new platform that will provide us with the foundation to build on for years to come.On the realestateworld.com.au front, traffic and content on the site continues to grow. In July we brought on all First National offices across Australia onto the site and are currently finalising a feed from Century 21 which will see all the group’s offices come on board.

realestate.com.au’s recent change to area based pricing has sure created some discussion in the industry. We have seen groups being formed to try to negotiate better rates with realestate.com.au. Several new so called industry portals and other new portals are popping up along with some revamps of existing portals, all looking to capitalise on what is going on. EAC has been working quietly in the background on several initiatives with agents in different areas of the state but has also been sitting back to see how all the cards fall; it is a very interesting time so stay tuned. Ross Graham will discuss this topic in more depth later in his article.

Finally I would like to take the time to recognise two members of the EAC team who have been with us for some time and are leaving us. First is Damien McDonald who was responsible for marketing who left us after 8 years in July to pursue the next stage in his career. The second is Sandy Eime who has worked in various roles including Publications, Red Square Support and more recently Communications who is leaving us this month after 17 years. We wish both Damien and Sandy all the best in their future endeavours.

Proposed deregulation of certain high value transactionsBy Geoff Hunter, EAC Industry Liaison Officer

As part of the statutory review currently being conducted of the Property, Stock and Business Agents Act Regulation the Office of Fair Trading is considering a proposal to deregulate commercial leasing and management transactions that involve property that has a total gross floor area of at least 10,000 square metres and a sales transaction when the property has an estimated value of at least $10m.

In addition it is proposed that an entity that carries on the business of a real estate agent in relation to commercial assets that are directly, or indirectly, owned by a related (loosely defined) entity will be exempt from the provisions of the Property, Stock and Business Agents Act. Such entities will have:

This same proposal was put forward in 2002 when the current Act was introduced, again in 2008 in the Statutory Review of that Act and revived a third time within the proposal, although in the much broader context of total deregulation of all commercial property transactions, of national licensing proposed by the then National Occupational Licensing Authority (NOLA).

On all three occasions these proposals to deregulate some, or all, commercial property transactions were very strenuously, and successfully, resisted by all industry bodies and NOLA was disbanded in late 2013 and the national licensing proposal discontinued. Despite this very chequered past the proposal has once again been raised for no better reason than to satisfy the demands of large commercial property interests who desire to conduct property transactions outside the existing regulatory environment.

EAC has attended several stakeholder meetings to discuss this proposal and has provided two written submissions. The following is a summary of just some of the salient matters.

The proposed exemptions are in two parts, transactions between related entities and the more general exemption to apply to all leasing and management of property with a total gross floor area of at least 10,000 square metres and to all sales of properties with an estimated value of at least $10m.

There is no logic or reason to link the proposed expansion to related entities of the existing right of property owners to sell/lease their own property to the proposed deregulation of all commercial transactions over certain values/areas. They are simply not related in any way and have significantly different impacts on the market place.

This proposal has not come from the real estate industry, nor has it come from consumers but it has come from those

property owners with extensive self- interests who are of the view that they should be above the law which applies to all others in the property industry.

The members of the Shopping Centre Council of Australia are proposing that the larger property owners should have the additional right to act as property agents for certain high worth transactions and to act outside the compliance laws over and above their existing right to lease and sell their own properties, in effect, creating a two tier licensing environment - some with licenses and compliance rules and some without, some consumers with protection and some without.

The question has to be asked, why is this proposal even being discussed?

The further argument that has been tabled is that there is a low level of complaint in commercial transactions and therefore exemptions should exist. The simple fact is that there is a low level of complaint because there is a licensing and compliance regime which is working.

We would further note that the proposed exemptions to certain commercial transactions were not included in the Regulatory Impact Statement (RIS) but were circulated to stakeholders inviting comment noting however, that the proposals were “outside the draft Regulation”.They were then, and still should be, outside the draft Regulation, and very clearly, and most unfortunately, due process as required under the Subordinate Legislation Act 1989, Schedules 1 and 2 did not take place.

The legislative Draft Exemption document provided to stakeholders is not the result of broad consultation and diligent analysis. It simply reflects the stated desires of a very limited number of property owners with very fundamental self interests. It in no way reflects the needs or opinions of recognised industry bodies, their members or other property stakeholders. It was tabled almost as a “fait accompli” with timing limitations simply because due process was not followed and we are now told that it must be included. Why?

The draft proposal was obviously prepared in haste. It lacks detail, accuracy, definition, has errors of omission and fails to recognise the transactional process that it is seeking to exempt. It is not capable of proper interpretation and consequently cannot properly be administered. Clearly there will be no way of regulating those people who would recognise the numerous gaps in the structure, content and application of this piece of legislation, if enacted.

EAC is of the view that this proposal is entirely without merit and representations on behalf of our members will continue.

Q. How did you first get started in the real estate industry?

Greg moved from Darlington Point to Urunga in 1974 to open a menswear business. During the time in Urunga he was introduced to Mr Andy Sanger of H W Kirkland & Co, one of the oldest real estate firms in the Bellinger Valley who invited Greg to join the firm at Urunga in 1976 and continued until Mr Sanger sadly passed away. As the business was growing fast Greg was joined by his brother Grant in 1987 and the business grew from 1 employee to currently 26.

In September 2013 the name was changed to “Cardow & Partners Property” to raise the profile and align the agency with Cardow & Partners Property Woolgoolga & Cardow & Partners Property Bellingen. All of our Cardow & Partners Property offices are located in prominent positions which have been selected due to their large & well lit window displays.

Q. Can you describe the most memorable moment of your career so far?

The most memorable moment was when we sold a 25 lot land subdivision at Hungry Head for $1.8 million in 1989; our first million plus sale.

Q. So we can get to know you better, what are your personal interests or hobbies?

Our hobbies are golf, travel, caravanning, tennis, fishing and enjoying our families and grandchildren.

Q. Who would you rate as your biggest inspiration in your life?

The biggest inspiration in our lives were our shopkeeper parents who instilled in us a strong work ethic, and in real estate Mr Andy Sanger of H W Kirkland & Co with whom Greg started his career.

Behind this we have a number of systems and personnel maintaining, fixing and monitoring these systems to make sure the process is as smooth as possible. All of this with one purpose in mind: exposure of your listings to as many people as possible on the internet with a single point of entry.

Over the years EAC has expanded the number of websites, groups and systems that we can upload your listings to. We currently have close to 30 websites or systems that we can upload to on your behalf and have recently introduced two new websites; www.onthehouse.com.au and www.homely.com.au. The next system that we are implementing an XML Export to is the Listglobally website and system.

Listglobally offers a single point of entry for your listings to then be represented in the international section of over 100 websites across the globe potentially reaching over 140 million potential buyers. EAC will be making this service available to its clients as an additional service.

While EAC has a number of international websites that we upload listings to, none of the other sites offer the connections to established international websites and there browser base like the Listglobally system does.

The Listglobally network covers websites from 6 continents across the globe, giving your listings the greatest possible exposure to a worldwide audience. Each site within the network develops and maintains an international listings portion on their website which links to all listings within the Listglobally system.

EAC will be integrating the Listglobally system into its offerings of XML exports in the coming months. As part of the integrations we will be placing an international search option on our website realestateworld.com.au that will allow the searching of all the other portals that form part of the Listglobally network of sites and countries. If you would like to know more, keep an eye out for more information about this exciting new service.

If you would like to use EAC’s XML export service for any of our current uploads, please contact Support on 1300 137 161 and they will be able to instruct you on the appropriate procedure to get this happening for your office.

XML exports, listing feeds, listing uploads. These are just some of the many names that are tacked onto your listings being distributed to a number of different websites. This process involves taking the information that you have entered into our system, putting that information into a relevant format that a third party can interpret and then sending your listings onto your chosen portals.

Australasian Auctioneering Championships 2014

The Australasian Real Estate Institutes’ Auctioneering Championships, which was held at Sydney Olympic Park on Tuesday 24th of June 2014.

Gavin Croft from the Darlinghurst office of Bresic Whitney once again took out the top prize in the NSW heats with Clarence White from McGrath Estate Agents taking out the Runner Up prize.

Both Gavin and Clarence will go on to represent NSW in the finals held in Auckland New Zealand on the 21st and 22nd of October 2014.

Awards for Excellence 2014

Estate Agents Co-operative Ltd (EAC) and the Real Estate Institute of Australia (REIA) will be hosting the New South Wales Awards for Excellence recognising the real estate industry’s top performers from the NSW Affiliate Council Members of the REIA.

These awards provide an opportunity to be recognised at both a state and national level and winners from the New South Awards for Excellence will progress to REIA National Awards for Excellence in Perth on 12 March 2015.

Eligibility:

Entry to the Awards for Excellence is open to and needs to be made through the NSW Affiliate Council Members of the REIA including Estate Agents Co-operative, LJ Hooker, Professionals and First National.

There are a total of fifteen separate categories in the 2014 EAC/REIA NSW Awards for Excellence.

After the success of the 2014 NSW Australasian Auctioneering Championship, sights are firmly set on the finals. Has the time come to take back control?

I joined EAC in 1990 and was fortunate to witness the introduction of the World Wide Web to the industry. In retrospect, I believe that everyone underestimated its impact on the industry; how could we have foreseen all the advances internet technologies would bring? Today we are so dependent on the internet that separating from it is devastating to our daily lives and fatal to our businesses. So it is with no surprise that for the first time I can see the industry uniting to regain control of a key element of everyone’s business.

Recently, a meeting was held to discuss EAC’s response to the new pricing structure realestate.com.au (REA) was attempting to impose on the industry. It was called to give members an understanding of the situation and discuss a strategy.

The key points discussed and the observations made at the meeting were:

What REA did when it announced the new pricing, was to focus the industry’s attention on its lack of control over an essential business cost. This recognition has galvanised agents like never before, not even deregulation could stir such resentment. But what we must remind ourselves is REA’s market dominance relies on the support of its customers; real estate agents.

Has the time arrived when the industry will take back control?

REA’s new pricing structure is driven by its shareholders’ expectation of profits. Indeed, both Fairfax Media and Real Estate Group (REA) are under great pressure to generate profits and cash flows from their real estate businesses. Being public companies this will not change and when the new pricing cannot squeeze another cent from the industry, new ways to do so will be found.

Negotiating as a group is short term. Ultimately, the same priorities will emerge and agents will again be discussing how to regain control of the industry. There is a group of 300+ agents in Victoria currently trying to bargain collectively but to date without success.

An industry owned real estate portal has been discussed since the early ‘90s and even if it can be created it will not be able to gain any significant support in the short term. Due to the number of stakeholders involved competing objectives will surface at some time to undermine any joint effort.

Developing a national portal from scratch is not financially viable or necessary given there are a number of portals who will take a feed from agents. The development and maintenance costs of a portal are prohibitive.

On the other hand, leveraging the existing infrastructure of realestateworld.com.au (an industry owned portal) offers an inexpensive, effective and fast option.

It is not clear that the benefits a national portal has traditionally offered are still valued as highly by the consumer. Certainly investors may benefit from a single entry national portal. However, few home buyers search outside their desired area and more recently the trend is to search by the address or the suburb or the town. Mobile platforms and social media are changing consumer search behaviour.

Any successful strategy requires “owning” the market. This means starving competitors of web content (listings) and dominating the local media. The marketing power of the national portals should not be underestimated and it would be foolish not to take all the steps necessary to ensure success.

A free or low cost model will not provide the required funds to guarantee on-going development and maintenance or to dominate the local market.

Q. What were you doing job wise before working with EAC? I completed my certificate III in Children’s services and worked in the child care industry for 2 years. It is a very exhausting but rewarding profession. I loved the children even though they could drive you to distraction at the best of times and greet you with the warmest welcome when you arrived at work. They would peep through the window and run up to the door yelling out your name and give you a cuddle and be excited to see you. Nevertheless, due to work schedules and personal reasons I had to seek another job which ultimately led me to EAC.

Q. What are your usual daily tasks as EAC Receptionist? Answering and screening incoming calls and making sure they are put through to the correct department, stationery sales, replenishing office stock, organising social events and administration for training events.

Q. Give an example without naming names of an interesting situation you have had to deal with since being appointed to your position.

It is still early days yet as I have only been in this role for just 3 months, however, I did get phone calls from people requesting to list their homes thinking we are real estate agents. Someone called the other day asking for their TV antenna to be fixed.

Q. What motivates you to come to work every day? My work colleagues have been very welcoming, that makes a big difference to whether you enjoy coming into work or not.

Q. What sort of hobbies or activities do you like to participate in after work hours?

I am an avid reader; I love to travel and to catch up with family and friends. I also work most Saturdays for half a day as an invigilator.

Q. What sort of music do you listen to?

I like to listen to most types of music but while I am exercising it needs to be upbeat. As long as the music keeps me jogging or walking to the beat, I’m happy.

Q. What’s your favourite movie and why?

Hunger Games Trilogy because I enjoyed reading the books, the movie stayed true to the book. I’m looking forward to seeing the 3rd instalment that comes out in November this year.

Q. What is your favourite food? Least Favourite?

Favourite Food: Roast dinners, with chicken or lamb and crispy potatoesLeast Favourite Food: I have two, seafood and cheese.

Q. What’s your favourite tourist destination?

I don’t really have a favourite destination. I have already travelled quite a bit covering UK, Paris, Italy, Germany, Canada and US. When I was young I got to see a bit of Australia like driving across the Nullarbor and visiting friends in Western Australia, South Australia and Victoria. There are still a few places that I wouldn’t mind visiting, but if you asked me where I would love to visit, it would have to be Africa. I want to go on a Safari. I want to see the Big 5, Victoria Falls and volunteer for a Lion conservation, rehabilitation and release place for 2 weeks. The other top wish list for travelling would be Russia, Egypt and Alaska.

Q. What’s got your interest on TV right now?

All my favourite shows like Revenge and Persons of Interest have finished for the year. I like The Mentalist and Under the Dome has again commenced so I am watching those shows at the moment.

Q. Where do you see yourself in 5 years?

I don’t like this type of question as anything can happen in 5 years but this is where I would like to see myself in less than 5 years - Winning the Lottery and finally going to Africa.
