By using the authority vested through Hyderabad Municipal Corporation Act 1955, videunder Sec.1 16, 1 1 9, 521 , 626. Notification with Rules and Regulations for implementation ofthe Municipal Solid Waste Rules, 2016 and Service level benchmarks for core urban servicesunder 14th FC E.G.Gazette.Reg.No 3912019, in accordance with council resolution No. 28128

dt.26-07-2019.Government of lndia has issued Solid Waste Management Rules,2016 on 18-04-20'16

after considering the objects vide S.O.'1357 (E), Ministry of Environment, Forest and Climate.ln the said rules, Government of lndia has issued certain guidelines for waste generators andresponsibility of ULBs and requested to comply the said rules in all ULBs. MoHUA has frameddetailed draft sanitation rules for implementing the same in all ULBs. Hence, in compliancewith said rules, the following draft sanitation rules have been prepared and put up for councilapproval.

1. Name in brief and beginning: -

1) These Rules/ Bye-laws shall be known as Solid Waste (Management & Handling), Cleanlinessand Sanitation Byelaws for Rajamahendravaram Municipal Corporation,and come into operation from the

2) These Rules/Bye-laws shall remain in force until amended in accordance with MunicipalCorporation of Andhra Pradesh Act '1965, due notice of such amendment betng published in thelocal newspapers of the State /UT of Andhra Pradesh.

2. Appticabitity: -These byelaws shall be applicable within the limits of the Rajamahendravaram Municipal Corporationand to every public place within the jurisdiction of, to every generator of municipal soltd waste and toevery premise under the ownership or occupation of any person within the limits of the MunicipalCorporation Urban Local Body of Andhra Pradesh. Any value (in Rupees) or componentsmentioned in the bye-laws shall be changed or added periodically as per the pproval ofCouncil resolution or any competent authority. However the bye-laws are re yearly.

3. ln these Rules/ ByeJaws and the Schedule attached there to the foltowing words shal!have the meaning herein defined i.e.:

3.1 "Aangan"/premises/ place means the public place in front of, or adjacent on any sidaof any premises, extending to the road, kerb side including the footpath kerb, drain, nala,plot or premises ;

32 "aerobic composting" means a corrtrolled process involving microbial decompositionlbreaking down of organic matter in tlre presence of oxygen;

3.3 "Agency/ Agent" means any entity/ person appointed or authorized byRajamahendravaram Municipal Coryoration to act on its behalf, for discharge of dutiesor functions i.e. sweeping of streets, collection of waste, collection of charges / fines,and other such delegated responsibilities etc.;

34 "anaerobic digestion" means a controlled process involving microbial decomposition/breaking down of organic matter in a bsence of oxygen;

3.5 "authorization" means the permission given by the State Pollution Control Board orPollution Control Committee, as the case may be, to the operator of a facility or urbanlocal authority, or any other agenc), responsible for processing and disposal of solidwaste;

36 "Bio-degradable waste" means ary organic material that can be degraded by micro-organisms into simpler stable compounds; for example the waste of plant and animalorigine.g. kitchen waste, food & flower waste, leaf litter, garden waste, animal dung, fish/meatwaste and any other material that gets degraded/decomposed by the action of micro-organ isms;

3.7 "Bio-medical waste" means any waste, which is generated during the diagnosis,treatment or immunization of hunran beings or animals or in research activitiespertaining thereto or in the production or testing of biological, and including categoriesmentioned in Schedule lV of the Bye-laws ;

3.8 "bio-methanisaton" means a process which entails enzymatic decomposition/breaking down of the organic matter by microbial action to produce methane-rich biogas;

3.9 "Brand owner" means a person or company who sells any commodity under aregistered brand label.

3.10 "Buffer zone" means zone of non-development to be maintained around solid wasteprocessing and disposal facility, er:ceeding 5 TPD of installed capacity. This will bemaintained within the total area allotted for the solid waste processing and disposalfacility.

3.11 "Bulk Waste Generator" means the owner, occupier or any other person representingowners and occupiers of House(s)/l:lat(s), Group of Houses/Flats, housing society(s) /complex(s), Restaurant(s); Hotel(s,), Market(s), lndustrial Estate(s) and ShoppingComplex(s) / Mall(s) and includes buildings occupied by the Cenkal GovernmerrtMinistries, Departments or Undertakings, State Government Departments orUndertakings, Local Bodies, Public Sector Undertakings or Private Companies, '

Hospital(s), Nursing Home(s), School(s), College(s), University(s), Other Educationallnstitutions, Hostel(s), Hotel(s), Ccmmercial Establishment(s), Places of Worship,Stadia and Sports complexes, clubs, gymkhanas, marriage halls, recreation/

entertainment complexes having an average waste generation rate exceedino 100ko oerday or other establishment sources / premises that are speciftcally identified and notifiedby the officials of Rajamahendravaram Municipal Corporation of Andhra Pradesh of theconcemed Zone/area to be so;

3.12 "Bulk garden and horticultural waste" means bulk waste from parks, gardens, trafficislands, road medians etc. including grass & wood clippings, weeds, woody 'brown'carbon-rich material such as pruning, branches, twigs, wood chipping, straw or deadleaves and tree trimmings, which cannot be accommodated in the daily collectionsystem for bio-degradable waste;

3.13 "Rules/ byeJaws" means regulatory framework notified by State / urban local body,census town and notified area townships for facilitating the implementation of these rues/byeJaws in their jurisdiction.

3.14 "census town" means an urban area as defined by the Registrar General and CensusCommissioner of lndia;

3.15 "Collection" means lifting and removal of municipal solid waste from designatedcollection points or any other location;

3.16 "Collection at Source" means the collection of municipal solid waste byRajamahendravaram Municipal Corporation directly from the premises of any building orcommon premises of a group of buildings. This is also referred to as "point to point collection";

3.17 "combustible waste" means non-biodegradable, non-recyclable, non-reusable, non-hazardous solid waste having minimum calorific value exceeding 1500 kcal/kg andexcluding chlorinated materials like plastic, wood pulp, etc;

3.18 "Composting" means a controlled process involvingmicrobial decomposition/degradation/breaking down of organic matter including vermi-composting - which is a process of using earthworms for conversion of biodegradablewaste into compost;

3.19 "Community Service" means to serve the community by sweeping of road, cleaningof walls, tree guard portion etc.;

3n "contractor" means a person or firm that undertakes a contract to provide materials orlabour to perform a service or do a job for service providing authority;

321 "Construction and Demolition waste" means waste from building materials, debrisand such rubble resulting from construction, remodeling, repair and demolitionoperations;

32. "co-processing" means use of non-biodegradable and non-recyclable solid wastehaving calorific value exceeding 1500 kcal as raw material or as a source of energy orboth to replace or supplement the natural mineral resources and fossil fuels in industrialprocesses;

"decentralized processing" mean:s establishment of dispersed facilities for localized.processing of biodegradable waste Elnd recovery of recyclables closest to the source ofgeneration so as to minimize transportation of waste for processing or disposal;

"Delivery" means handing over any category of solid waste to RajamahendravaramMunicipal Corporation Urban Loczrl Body of Andhra Pradesh)worker or any otherperson appointed, authorized or licerrsed persons by the Rajamahendravaram MunicipalCorporation for taking delivery of sur:h waste;

"disposal" means the final and sa,'e disposal of post-processed residual solid wasteand inert street sweepings and silt from surface drains on land as specified in ScheduleI to prevent contamination of grounc water, surface water, ambient air and attraction ofanimals orbirds;

"domestic hazardous waste" merans discarded paint drums, pesticide cans, CFLbulbs, tube lights, medicines including expired medicines, broken mercurythermometers, batteries, used nee,lles and syringes and contaminated gauge, etc.,generated at the household level;

"door to door collection" means; collection of solid waste from the door step ofhouseholds, shops, commercial establishments , offices , institutional or any other non-residential premises and includes collection of such waste from entry gate or adesignated location on the ground |1oor in a housing society, multi storied building orapartments , large residential, comnrercial or institutional complex or premises;

"Door-to-Door collection system Municipal vehicle" means the bell-ringing or suchvehicle (includes a carriage, cart, van, dray, truck, hand-cart, bicycle, cycle-rickshaw,auto-rickshaw, motor vehicle and ev,:ry wheeled conveyance which is used or is capableof being used on a street) provided by Municipal Corporation/Council/Municipality/UrbanLocal Body of XYZ for point to point collection of Municipal Solid Waste.

"dry waste" means waste other th;rn bio-degradable waste and inert street sweepingsand includes recyclable and non-recyclable waste, combustible waste and sanitarynapkin and diapers, etc;

"Dry Waste" means the category of municipal solid waste referred to at No.5.'1 (6) ofthese Bye-laws;

"Dry Waste Sorting Center" me€rns any designated land, shed, kiosk, or structurelocated on any municipal or Goverrrment land or in a public space which is authorizedto receive and sort dry waste;

"dump sites" means a land utilized by local body for disposal of solid waste withoutfollowing the principles of sanitary land filling;

"extended producer responsibility" (EPR) means responsibility of any producer ofpackaging products such as plastic, tin, glass and corrugated boxes, etc, forenvironmentally sound managemerrt, till end-of-life of the packaging products;

"facility" means any establishmerrt wherein the solid waste management processesnamely segregation, recovery, storage, collection, recycling, processing, treatment orsafe disposal are carried out,

3.38 ',Hazardous waste,, means any waste, which by reason of any of its physical, chemical,reactive, toxic harm able, explosive or corrosive characteristics causes danger or islikely to cause danger to health or environment, whether alone or when in contact with

other wastes or substances and shall include wastes specifically listed in Schedule lll ofthese Bye-laws.

3.39 ,,House-gully,'/lane/service Lane means a passage or strip of land, constructed, setapart or utilized for the purpose of serving as a drain or of affording access to the latrine,

urinal, cesspool or other receptacle for filthy or other polluted matter by persons

employed in the removal of cleaning thereof or in the removal of such matters there

from;

3.40 "incineration" means an engineered process involving burning or combustion of solid

waste to thermally degrade waste materials at high temperatures;

341 "inerts" means wastes which are not bio-degradable, recyclable or combustible streetsweeping or dust and silt removed from the surface drains;

342 ,'lnert solid waste" means any solid waste or remnant of processing whose physical,

chemical and biological properties make it suitable for sanitary land filling;

3.43 "informal waste collector" includes individuals, associations or waste traders who are

involved in collection, sorting, sale and purchase of recyclable materials;

34 "Landfill" means a waste disposal site for the deposit of residual solid waste in a facility

designed with protective measures against pollution of ground water, surface water and

air fugitive dust, windblown litter, bad odour, fire hazard, bird menace, pests or rodents,greenhouse gas emissions, slope instability and erosion;

"fine,' means penalty imposed on waste generators or operators of waste processing

and disposal facilities under the bye-laws for non-compliance of the directions containedin these rules and/or bye- laws;

"Generator of waste" means any person generating municipal solid waste within thelimits of Rajamahendravaram Municipal Corporation;

"handling" includes all activities relating to sorting, segregation, material recovery,collection, secondary storage, shredding, baling, crushing, loading, unloading,transportation, processing and disposal of solid wastes;

,'leachate,, means the liquid that oozes and seeps through solid waste or other mediumand has extracts of dissolved or suspended material from the media;

"Litter" means all refuse and other such waste material which, tends to create nuisance,dirt, insanitary conditions, ugliness and endangers cleanliness, public orderliness &

movement, environment, public health, safety, life and welfare if dropped, thrown,scattered, deposited or left un-cleaned or unpicked as against the prohibition underthese Bye-laws;

"Littering" means carelessly spreading litter so that falls, descends, blown, seeps,percolates or otherwise escapes or is likely to fall, descend, blown, seep, percolate orotherwise escape

into or onto any public or private place; Or causing, permitting or allowing litter to fall,descend, blow, seep, percolate or otherwise escape into or onto any public or privateplace;

3.,l8 " local body" for the purpose of these rules means and includes the municipalcorporation, nagar nigam, municipal council, nagarpalika, nagara palaka, nagarPalikaparishad, municipal board, nagar panchayat and town panchayat, census towns,notified Local Body and notified industrial townships with whatever name they are calledin different States and union territor es in lndia; l

3.49 "Lysometer" means a device which is used to measure the movement of water in orthrough the medium of soil layer or which is used to collect the leached water forqualitative analyses.

3.50 "Market" includes any place where persons assemble for the sale of, or for the purposeof exposing of sale, meat, fish, fruits, vegetables, animals intended for human food orany other articles of human needs vrhatsoever, with or without the consent of the ownerof such place notwithstanding thrat there may be no common regulation for theconcourse of buyers and sellers and whether or not any control is exercised over thebusiness of, or the person frequenting, the market by the owner of the place or by aniother person;

3.51 "materials recovery facility" (MRF) means a facility where non-compostable solidwaste can be temporarily stored by the local body or any other entity mentioned in rule2 or any person or agency authorised by any of them to facilitate segregation, sortingand recovery of recyclables from various components of waste by authorised informalsector of waste pickers, informal rer:yclers or any other work force engaged by the localbody or entity mentioned in rule 2 fcrr the purpose before the waste is delivered or takenup for its processing ordisposal;

3.52 "Municipal Commissioner" me;lns the Commissioner of the RajamahendravaramMunicipal Corporation.

3.53 "Municipal Corporation/Council/Municipality/Urban Local Body,, means theMunicipal Corporation/Council/Municipality/Urban Local Body of Rajamahendravaramestablished under AP Municipal Cc rporation/Municipality Act 1 965 (Act No.,)

3.il "Municipal Solid Waste" includer; commercial and residential wastes generated in aMunicipal or Notified Local Body in either Solid or Semi -Solid form excluding industrialhazardous waste but including prcperly and fully treated bio-medical waste( as perapplicable rules);

3.55 "non-biodegradable waste" means any waste that cannot be degraded by micro-organisms into simpler stable compounds;

3.56 "Nuisance" includes any act, omis;sion, place, animal or thing which causes or is likelyto cause injury, danger, annoyance or offense to the sense of sight, smell, hearing,breath, modesty and dignity or disl.urbance to movement, work, rest or sleep, or whichis or may be dangerous to life or injurious to health or property;

3.57 "Nuisance Detectors" (NDs) rneans those employees of RajamahendravaramMunicipal Corporation , who are appointed by Rajamahendravaram MunicipalCorporation to detect acts of Publir: nuisance etc. under the Bye laws;

3@. "Premises" means any land or building or part of a building and includes-(a)The garden, ground and out- houses, if any, appertaining to a building or part of abuilding; and(b) Any fittings affixed to a building or part of a building for the more beneficial enjoymentthereof;

3.63 "primary collection" means collecting, lifting and removal of segregated solid wastefrom source of its generation including households, shops, offices and any other non-residential premises or from any collection points or any other location specified by thelocal body;

"Processing" means any scientific process by which solid waste is treated forprocessing for the purpose of reuse, recycling or transformation into new products or

making it suitable for land filling;3.65 "Public Nuisance" means any act, omission, offence or wrong-doing which causes or

is likely to cause nuisance ( as defined) in any public place;

3.66 "Public place" means any place which is open to the use and enjoyment of the public,

whether it is actually used or enjoyed by the public or not;

3.68 "Rubbish" includes ashes, broken bricks, broken glasses, dust, malba, mortar andrefuse of any kind which is not filth;

3.@ "Receptacle" means container, including bins and bags, used for the storage of anycategory of municipal waste as prescribed by Rajamahendravaram MunicipalCorporation from time to time;

310 "Recycling" means the process of transforming segregated non-biodegradable solidwaste into raw materials for producing new products, which may or may not be similarto the original products;

"Pellet forming" means a process used to make pellets' which will. be small

cubes/cuboids or cylindrical piLces from solid waste and will also include fuel pellets

which is obtained from garbage.

firm or company or issociation or body of individuals whether incorporated or not andtheir agents; assignee etc;

"Point to Point Collection" means the system of collection of municipal solid wastefrom specific pick-up points as designated by Rajamahendravaram MunicipalCorporation, up to which the generator must bring the collected and stored waste fordelivery in vehicles so provided/appointed by the Rajamahendravaram MunicipalCorporation;

313 "Refuse" means any waste. matter generated out of different activities, processes.either degradable/non-degradable gar6age ino ruouisn /inert in nature in either sotid orsemi-solid form which cannot be consumed, used or processed uv tn. g;.r.tor in itsexisting form;

3.74 "residual solid waste" means and includes the waste and rejects from the solid wasteprocessing facilities which are not s.ritable for recycling or further processing;

3.75 "sanitary land filling " means the final and safe disposal of residual solid waste andinert wastes on land in a facility des;igned with protective measures against pollution ofground water, surface water and ''ugitive air dust, wind-blown litter, bad odour, firehazard, animal menace, bird menace, pests or rodents, greenhouse gas emissions,persistent organic pollutants slope instability and erosion;

3.76 "Sanitation" means the promotion of hygiene and the preventlon of disease and otherCauses of ill health related to environmental factors. However, the relevant provisionsin respect of sanitation and health; in "Rajamahendravaram Municipal CorporationSanitation and Public Health Byelavrs" and "Rajamahendravaram Municipal CorporationMalaria and other Mosquito borne Diseases Byelaws etc "; shall continue to prevail, asusual.

3.n "sanitary waste" means wastes cc,mprising of used diapers, sanitary towels or napkins,tampons, condoms, incontinence s,teets and any other similar waste;

3.78 "Schedule" means the Schedule arppended to these Bye-laws;3.79 "secondary storage" means the temporary containment of solid waste after collectron

at secondary waste storage depots or MRFs or bins for onward transportation of thewaste to the processing or disposal facility;

3.80 "segregation" means sorting ancl separate storage of various components of solidwaste namely biodegradable wastes including agriculture and dairy waste, non-biodegradable wastes including rercyclable waste, non-recyclable combustible waste,sanitary waste and non- recyclable inert waste, domestic hazardous wastes, andconstruction and demolition wastes;;

3.81 "service provider" means an authority providing public utility services like water,sewerage, electricity, telephone, roads, drainage, etc;

3.P. "solid waste" means and includers solid or semi-solid domestic waste, sanitary waste,commercial waste, institutional raraste, catering and market waste and other non-residential wastes, street sweepinr;s, silt removed or collected from the surface drains,horticulture waste, agriculture and dairy waste, treated bio-medical waste excludingindustrial waste, bio- medical waste and e-waste, battery waste, radio-active wastegenerated in the area under the local authorities and other entities mentioned in rule 2;

3.83 "sorting" means separating various components and categories of recyclables such aspaper, plastic, cardboards, metal, glass, etc., from mixed waste as may be appropriate

to facilitate recycting: means separating organic, inorganic, recyctabte and hazardcuswastes into categories to facilitate recycling,

"stabilizing" means the biological decomposition of biodegradable wastes to a stablestate where it generates no leachate or offensive odours and is fit for applicationto farmland,soil erosion control and soil remediation;

"State board or Committee" means, as applicable, the State Pollution contrat Boardof a state or the Pollution Control Committee of a Union Territory.

"street vendor" means any person engaged in vending of articles, goods, wares, fooditems or merchandise of everyday use or offering services to the general public, in astreet, lane, side walk, footpath, pavement, public park or any other public place orprivate area, from a temporary built up structure or by moving from place to place andincludes hawker, peddler, squatter and all other synonymous terms which may be localor region specific; and the words "street vending" with their grammatical variations andcognate expressions, shall be construed accordingly;

"Source" means the premises from which waste is generated.

"Stabilized biodegradable waste" means the biologically stabilized (free ofpathogens) waste resulting from the mechanical / biological treatment of biodegradablewaste; only when stabilized such waste can be used with no further restrictions;

"Storage" means the temporary containment of municipal solid waste in receptacles;prevent littering, attraction to vectors, stray animals and excessive foul odour;

"Street" includes any way, road, lane, square, court, alley, gully, passage, whether a

thoroughfare or not and whether built upon or not, over which the public have a right ofway and also the roadway or footway over any bridge or causeway."tipping fee" means a fee or support price determined by the local authorities or anystate agency authorized by the State government to be paid to the concessionaire oroperator of waste processing facility or for disposal of residual solid waste at the landfill;

"transfer station" means a facility created to receive solid waste from collection LocalBody and transport in bulk in covered vehicles or containers to waste processing and,or, disposal facilities;

"transportation" means conveyance of solid waste, either treated, partly treated oruntreated from a location to another location in an environmentally sound mannerthrough specially designed and covered transport system so as to prevent the foulodour, littering and unsightly conditions and accessibility to vectors, animals and birds;

"treatment" means the method, technique or process designed to modify physical,chemical or biological characteristics or composition of any waste so as to reduce itsvolume and potential to cause harm;

"user fee" means a fee imposed by the local body and any entity mentioned in rule 2on the waste generator to cover full or part cost of providing solid waste collection,transportation, processing and disposal services.

"Vadose water" means the water situated between top soil and ground water tablelevel, i.e. in the unsaturated soil skata.

3.97 "vermi-composting" means the process of conversion of bio-degradable waste into

compost using earth worms:

3.98 "waste generator" means and includes every person oJ S.roYp of persons' every

residentiil premises and non-residr3ntial establishments including lndian Railways'

Defense establishments, which generate solid waste;

3.99 "\.raste hierarchy" means the priority order in which the solid waste is to should bemanaged by giving emphasis to prevention, reduction, reuse, recycling, recovery anddisposal, with prevention being the most preferred option and the disposal at the landfillbeing the least;

3.10 "Waste picker" means a person or groups of persons informally engaged in collectionand recovery of reusable and recyclable solid waste from the source of waste generationthe streets, bins, material recovery facilities, processing and waste disposal facilities fcrsale to recyclers directly or through intermediaries to earn their livelihood.

3.101 means a an area or stretch ol land having a particular characteristic, purpose, or use oisubject to particular restrictions..

3.10 Words and expressions used herein but not defined, but defined in the Environment(Protection) Act, 1986, the Water (Prevention and Control of Pollution) Act, 1974, Water(Prevention and Control of Pollution) Cess Act, 1977 and the Air (prevention and Controlof Pollution) Act, 1981 and all the Waste Management Rules shall have the samemeaning as assigned to them in the respective Acts/Rules.

4. Prohibition of littering, and other nuisances and ensuring "Clean Aangan /Premises/Place"

4.1. Littering in/or on any public/privirte place: No person shall throw or deposit litter inany occupied/unoccupied/open/var:ant public or private place except in authorizedpublic or private litter receptacles.

4.2. Littering from vehicles: No person shall throw or deposit litter upon any street, roacl,sidewalk, playground, garden, traffic i:;land or other public/private place from any vehicleeither moving or parked.

4.3. Litter from waste carriage vehicles: No person shall drive or move any truck or othervehicle filled with litter unless such vehicles are so designed to cover the litter and loadedas to prevent any litter from being blorvn off or deposited upon any road, sidewalks, trafficislands, playground, garden or other public place.

4.4. Creating Public Nuisance: No person shall cook, bathe, spit, urinate, defecate, feedanimals / birds or allow their droppings;/poop, wash utensils or any other object or keep anytype of storage in any public place except in such public facilities or conveniencesspecifically provided for any of these purposes.

5. Segregation, storage, delivery and collection of Municipal Solid Waste:

5.1 Segregation of waste into separate specified groups: Every generator of MunicipalSolid Waste shall separate the waste at source of generation into the followingcategories as applicable and shall store separately, without mixing it for segregatedstorage in authorized storage bins, private/public receptacles for handing over oidelivering to authorized waste pickers or waste collectors as directed by the localauthority/body from time to time;

The Municipal corporation of Rajamahendravaram may separatety notify differentstages for implementation of the rules/ byelaw taking into account the level of awjreness amonggenerators of waste as well as availability of infrastructural support in their operational LocatBody.

The Rajamahendravaram Municipal Corporation shall separately notify from time to timethe mandatory color coding and other specifications of receptacles prescribed forstorage and delivery of different types of solid waste to enable safe and easy collectionwithout any mixing or spillage of waste, which generators of different types of solid wasteshall have to adhere to.

Delivery of segregated premises waste: lt shall be the duty of every generatol. ofmunicipal solid waste, either owner or occupier of every land and building to collect orcause to be collected from their respective land, premises and building, to segregatewaste and to store and deliver the same to the municipal worker/vehicle/waste picker iwaste collector deployed by the Rajamahendravaram Municipal Corporation for thepu rpose.

Bio-degradable waste: Segregated Bio-degradable Municipal Solid Waste (as per theillustrative list in Schedule ll if not composted by the generator, shall be stored by themwithin their premises and its delivery shall be ensured to the municipalworker/vehicle/waste picker / waste collector or to the bio-degradable waste collectionvehicle provided for specified commercial generators of bulk bio-degradable waste atsuch times as may be notified from time to time.

Composting by all generators: Local composting of waste shall be promoted tominimize transportation of waste.

Specified household hazardous waste: (as listed in Schedule lll) shall be stored anddelivered by every generator of waste to the collection vehicle, which shall be providedweekly/periodically by Rajamahendravaram Municipal Corporation or any other Agenc'vauthorized by the AP Pollution Control Board / Committee ( APPCB) for collection ofsuch waste, or to a center designed for collection of such waste for disposal in a mannerthat is mandated by the Government of AP or the AP Pollution Control Board /Committee (APPCB).

Untreated bio-medical waste (as listed in Schedule lV) shall be collected & stored inspecified type of covered receptacles and delivered by every generator of such wasteto the collection vehicle which shall be provided weekly/periodically byRajamahendravaram Municipal Corporation or any other Agency authorized by the APPollution Control Board / Committee ( APPCB), or to a center designated for collectionof such waste, for disposal in manner that is mandated by AP Pollution Control Board /Committee ( APPCB) in accordance with the Bio-Medical Waste (Management &Handling) Rules, 2016.

Municipal Corporation and on their v/ebsite.5.10 All other Non-biodegradable ("Dry") waste - both recyclable and non-recyclable * shall

be stored and delivered by every gelerator of waste to the dry waste collection vehicle,

which shall be provided by Rajamahendravaram Municipal Corporation or its Agents at

such spots and at such times as may be notified by them from time{o-time for collectiollof such waste.

5.11 Bulk garden and horticultural waste shall be kept un-mixed and composted at source.The Rajamahendravaram Municipal Corporation shall also notify lnstructions/ guidelineswith regard to pruning of trees anrl storage and dellvery of tree trimmings includingsegregated garden and horticulturerl waste by charging suitable fees as notified by itfrom time to time, for collection and transport to its facility.

5.12 Burning of waste: Disposal by burning of any type of solid waste at roadsides, or atany private or public property is prohibited.

6. Obligatory duties of Rajamahendravaram Municipal Corporation6.'1. Action against Transport Contractors / Municipal Corporation/Council/M u nicipality/U rba n

Local Body of Rajamahendravaram Employees: Rajamahendravaram Municil;alCorporation shall take action against the Transportcontractor and/ or Agents/ employees ofRajamahendravaram Municipal Corporation, if any worker of the contractor or of any Rajamahend ravaramMunicipal Corporation mixes segregated waster at any point of collection, or fails to pick up waste as perthe specified time schedule.

6.1 lnfrastructure facilities: Rajamahendravaram Municipal Corporation shall provideadequate infrastructure facilities to assist citizens' compliance with these Rules/Bye-laws. ln addition to waste collection services, lifter bins, dry waste sorting centers, andcomposting centers shall be set up, wherever possible and essential, in consultationwith local citizens. Adequate comnrunity toilets shall be provided in slum localities withthe participation of Community Eiased Organizations to prevent nuisance such asdefecatingiurinating, washing and lathing in public places.

6.2 Citizen Resource Base: The Rajamahendravaram Municipal Corporation shall facilitateinformation about composting as well as recycling of dry waste through compostingcenters and dry waste sorting centers listing them on its website.

6.3 Bio-degradable puja articles: The Rajamahendravaram Municipal Corporation shallauthorize interested organization,s to collect bio-degradable 'puja' articles (flowers,leaves, fruits etc.) at certain designated sites near waterbodies such as beaches, lakes,ponds, etc. in notified receptacles. The collection from such receptacles shall preferablybe composted at a suitable location.

64 Point-to-Point waste collection services: TheRajamahendravaram Municipal Corporation shall provide for the collection of themunicipal solid waste from specifir; pick-up points on a public or private road up to whichthe generator must bring the collected, segregated and stored waste for delivery to

municipal worker/vehicle/waste picker / waste collector provided by Rajamahendravaram

Municipal Corporation according to the route plans at Such times and at Such spots as

notified by the concerned official/authority in advance for specified types of waste fordifferent localities.Collection at source: Rajamahendravaram Municipal Corporation shall provide for thecollection of municipal solid waste from premises of a building or group of buildings fromwaste storage receptacles kept on the premises to which Rajamahendravaram MunicipalCorporation vehicles / workers shall be provided access at such times as may be notifiedby the concerned official/authority of Rajamahendravaram Municipal Corporation.

Data about waste received at landfill: Rajamahendravaram Municipal Corporation shallrelease publicly, the monthly data about the quantity of waste going to the differentlandfills and waste processing sites. Such information shall be available at the Officeand on Rajamahendravaram Municipal Corporation website.

Community Bins in public places:a) Rajamahendravaram Municipal Corporation shall provide and maintain suitable

community bins on public roads or other public spaces, as determined by theRajamahendravaram Municipal Corporation itself or through an Agent as an interimarrangement till Ra.lamahendravaram Municipal Corporation make provision forcollection at source or poinlto-point collection at the required frequencies and shallnotify the same on Rajamahendravaram Municipal Corporation website from time totime.

b) Segregated waste shall be delivered by the concerned generators to suchcommunity bins, and thereafter collected by Rajamahendravaram MunicipalCorporation. Rajamahendravaram Municipal Corporation or its Agents to ensurecompliance of segiegation and avoidance of public nuisance and health hazards from thesecommunity bins. Every community bin shall be separate for bio-degradable and non-bio-degradable waste. Details of all such places including the arrangements and schedules ofwaste collection from such places shall be available at the Office and on

Rajamahendravaram Municipal Corporation website.

c) Official/authority of Rajamahendravaram Municipal Corporation shall ensure thatat no point of time the community bins are not overflowing nor exposed to openenvironment and prevent their scattering by rag pickers, stray animals or birds etc.

Dry waste sorting centers / Material Recovery Facilities: ln order to regulate andfacilitate the sorting of the recyclable and non-recyclable waste, the RajamahendravaramMunicipal Corporation shall provide for as many dry waste sorting centers as possibleand required. These dry waste sorting centers shall be on Rajamahendravaram MunicipalCorporation land or land belonging to the Government or other bodies, made availableespecially for this purpose, or in the form of sheds or kiosks provided at suitable publicplaces and shall be manned/operated by registered cooperative societies of wastepickers / licensed recyclers or any other Agents authorized / appointed byRa.lamahendravaram Municipal Corporation. The non-recyclable waste, which remair'safter sorting shall be further, transported from such sorting centers from time-to- timeto waste disposal sites for processing or land-filling.

Such center shall be fenced/ screened in such a way that waste shall not be visible topassersby

6.8 Time schedule and route of colle,ction: The daily and weekly time schedules androutes of Rajamahendravaram Muni,:ipal Corporation collection of different types ofmunicipal solid waste shall be fir:ed and notified in advance by the concernedofficial/authority. Details shall be averilable at all Offices and on the RajamahendravararnMunicipal Corporation.

6.9 Similarly, the arrangements for the collection of construction and demolition waste, andgarden and horticultural waste, by Rajamahendravaram Municipal Corporation or itslicensees shall be made available to the public as well as to the bulk generators of wasteby the official/authority as the case rnay be.

6.10 Surprise checks: Any authorized Officer / Agent of Rajamahendravaram MunicipalCorporation shall have right to enter at all reasonable times, with such assistance as heconsiders necessary, any place for the purpose of(i) performing any of the functions entrusted to him by Rajamahendravaram MunicipalCorporation or (ii) determine whetherr, and if so, in what manner, any such functions areto be performed, or whether any provisions of these Rules/Bye-laws has been compliedwith.

6.11 Nuisance Detectors: The official/authority shall provide and strengthen the system ofNuisance Detectors by providing suitable uniforms and vehicles to Nuisance Detectors.

612 Publicity: Citizen lnformation Sen,ices: The Rajamahendravaram Municipal Corporationshall publicize the provision of the Rules/Bye-laws through the media of signs,advertisement, leaflets, announcement on radio and televisions, newspapers andthrough any other appropriate means, so that all citizens are made aware about thestatutory duties of citizens and :he Rajamahendravaram Municipal Corporation forservices, recycling, anti-litter and anti-nuisance penalties and fines.

6.13 Designated officers and periodic reports: The official/authority concerned shalldesignate officers under their control who shall be responsible for implementing theobligatory responsibilities of Ralam ahendravaram Municipal Corporation specified underthese Rules/Bye-laws in accorclance with the plans and time schedules forimplementation. The specific plans, and time schedules and achievements against thesame along with reasons for short falls, if any, shall also be shared publicly by theofficial/authority through the Rajamr:hendravaram Municipal Corporation website.

6.14 Transparency and Public Accessibility: To ensure greater transparency and publacaccessibility, the Rajamahendravar€rm Municipal Corporation shall provide all necessaryinformation that is required to be publicized through its website.

6.15 Co-ordination with Government Bodies: Rajamahendravaram Municipal Corporationshall co-ordinate with other government agencies and authorities, to ensure complianceof these Rules/Bye-laws, within L ocal Body under the jurisdictlon or control of suchbodies.

6.16 The urban local body shall ensure arrangements for cleaning daily or at set intervals andall the year through at all the public roads, places, coronies, srums, Local Body, marketsand tourism places, parks of the urban body, cremation grounds etc. and the urban localbody shall be committed to collect and carry the garbag; from these places door to dooror from the nearest garbage bin/container/facility and transport it from there to the finaldisposal place in closed vehicles.

6.17 The urban local body shall utilize its own/outsourced/contract sanitation workers andvehicles in carrying out sanitation and solid waste management functions for full orpartial daily cleaning work, so that the urban body is able to keep its area neat and cleanin public interest.

6.18 ln order to manage the complete daily cleaning system of the city, the urban local bcdyshall establish a ward office (complaint center) in each ward, garbage bin/container atsuitable places as required, public toilets/urinals, transfer stations to hansport thegarbage to the landfill for final disposal, processing unit, etc.

6.19 USer ChangeS: The urban local body shall levy user charges from the households /premises for the waste management services rendered as per the table given below asdetermined from time to time. For this purpose, the urban local body shall appoint its

staff/designated persons in all the regions/Local Body/wards of thecorporation/council/municipality to collect garbage from every home/premises in

compliance with Solid Waste Management Rules, 2016.

6n A time will be fixed compulsorily in each area to collect garbage from eachhouse/premises/Aangan. Usually, the time will be from 7.00 to 11.00 in the morning butcan vary. But the urban local body should ensure compliance with the timed fixed forany special cleaning purpose. A bell/horn/announcement (whose sound must not be

over the permissible sound limit) should be fitted on the vehicle of garbagecollection/blown by worker so that the residents can be made aware of collection beingundertaken.

621 The time for garbage collection from commercial establishments/shops/markets shall he

from9.00 to 12.00 in the morning in general but can vary.

62 The Rates/User Charges/Fees for collecting garbage from home and establishmentsfor Garbage Collection are fixed as follows: -

The above rates may be increased by at least 5 percent every year.

68 The charges for door to door or point garbage collection as above shall be collected onlyby the authorized institution/person of each watdlarca. The above rates shall be properlyadvertised by the UlB/institution/person and the rates shall also be displayed on theWaste Management Vehicles. The authorized institution/person shall also write thename of the authorized institution/person on the Waste Management Vehicles.

624 The waste shall not be handled manually. But, due to some unprecedentedcircumstances, if the waste material has to be manually handled and lifted using manuallabor, in such circumstances manual labor would be used with all due care andprecautions of personal safety gear.

6% lf the waste material is not disposed by any person on the designated sites, waste bins,litter bins, containers kept on the road and parks by the concerned municipalcouncil/corporation and is disposed by any person/party elsewhere where wastedisposal is prohibited, in such circumstances, Fine / compounding charges can be leviedon the concerned person/party in addition to fine.

7. Obligatory Responsibilities of Rajamahendravaram Municipal Corporation and /orgenerators of waste in case of some specific categories/situations:

Keeping in mind the particular nature of some situations, the following responsibilities arespecifically mandated :

7.1. Slums7 .1 .1 The official/authority shall extend solid waste management to the uncovered LocalBody with in their jurisdiction.

7.1.2 tMhere applicable, Rajamahendravaram Municipal Corporation shall extend dborto-door collection system at fixed times at a point outside the slum, for collection ofsegregated solid waste.

7 .1.3 ln exceptional cases, until the services of a door-to-door collection system atrequired frequencies are provided at designated spots on a public road or any otherpublic place for the time being, manned community waste storage bins shall bemaintained by Rajamahendravaram Municipal. Corporation, where segregated wasteshall be deposited by the generator, and from where Rajamahendravaram MunicipalCorporation shall collect such waste.

7 .1.4 Cleanliness drives shall be conducted byRajamahendravaram Municipal Corporation with the help of local councilors, Citizensorganizations, Government bodies / Corporates etc for the cleanliness of Local Bodyinside the slums, from time to time.

7,Z,Poultry, Fish and Slaughter Waste (From all Local Body other than designated slaughterhouses and markets)

7.2.1 Every owner / occupier of any premises other than designated slaughter housesand markets, who generates poultry, fish and slaughter waste as a result of anycommercial activity, shall store the same separately in closed, hygienic condition and

deliver it at a specified time, on:r daily basis to Rajamahendravaram MunicipalCorporation collection vehicle provided for this purpose. Deposit of such waste in any'community bin is prohibited and shall attract fines as indicated in the schedule of Fines..

7.2.2 fhe official/authority of Rajarnahendravaram Municipal Corporation shall be, responsible for repair/remodeling of civic facilities in the markets to provide maximumhygiene and sanitary conditions in the market premises.

7.3. Vendor/Hawkers:All vendors/hawkers shall keep tl'eir biodegradable and other waste unmixed incontainers / bins at the site of vending for segregated storage of waste generated bythat vending activity. lt shall be the n:sponsibility of the generator/ vendor to deliver thiswaste duly segregated to the Municipal Collection Vehicle of RajamahendravaramMunicipal Corporation or to the nea'est designated community bins. Failing which fineshall be imposed as per the Scnedule of Fines. Each Vendor/hawker shall beresponsible to maintain their 'Clean Aangan'.

7.4. House /gullies/Service Lanes:

7.2.3 lt shall be the responsibility of lhe owner/occupier of premises within house-gulliesto ensure that no waste is dumped or thrown in the house-gully, and to segregate anddeliver any solid waste to the waste collection vehicle which shall be provided byRajamahendravaram Municipal Corporation at such spots and at such times as may benotif ied by off icial/authority

' 7.2A Where owners/occupiers of such premises wish to avail of the services ofRajamahendravaram Municipal Corporation for the cleaning of the house gully, theymust apply to the concerned Office of Rajamahendravaram Municipal Corporation andpay suitable prescribed charges as notified by Rajamahendravaram MunicipalCorporation from time to time. lt shall be the responsibility of the owners/occupiers toprovide access to the house gully for cleaning purposes.

7.5. Lifter by owned / pet animalsIt shall be the responsibility of the owner of any pet animal to promptly scoop/clean upany poop/litter/fecal matter created by any owned/pet animals on the street or any publicplace, and take adequate steps for the proper disposal of such waste their own sewageor other such sanitary system.

7.6. Public Gatherings and Events:

For Public Gatherings and Events, organized in public places for any reason (includingfor processions, exhibitions, circus, fairs, political rallies, commercial, religious, socio-cultural events, protests and demonstrations, etc.) where Police andiorRajamahendravaram Municipal Corporation permission is required, it shall be the

. responsibility of the Organizer of thr: event or gathering to ensure the cleanliness of thatarea as well as all appurtenant Local Body immediately after the event.

7.7. Receptacles on private property:Every owner or occupant of p,rivate property shall maintain authorized refusereceptacles on private premises provided the receptacles are neither visible from publicstreeUroads and sidewalks nor acr:essible to animals.

7.8. Other public placesThe Government / Semi-government, statutory bodies shall be responsible forimplementation of these Rules/Bya-laws within the public premises owned/occupied bythem.

8. Penalties for contravention of these Rules/Bye-laws

8.1 . Whosoever contravenes any of the provisions of these Byelaws or fails to cornplywith the requirements made under any of these Byelaws shall be punished with a fineas mentioned in schedulel appended to these Bye-laws, failing which, the saiddefaulter shall be liable to do the community service for at least one hour like roadsweeping or gralfiti cleaning etc. as directed / ordered by the Nuisance Detectoror lmplementing Authority or any person authorized to do so.

8.2 ln the event of continuation of the breach of the provisions of these Bye-laws, theequal amount of fine for every day of default shall be levied or Rs.100/day, whichever is

higher, in addition to original fine.

9. Miscellaneous provisions:9.1. Bio medical waste and industrial waste shall not be mixed with urban solid waste and the

collection of such waste shall be made as per the rules/byelaws specified separately for thepurpose. Common Bio MedicalWaste Treatment Facility (CBWTF) services shall be availedfor disposal of bio medical waste as per rules/byelaws. Disposal of such hazardous wastewill have to be ensured at the Common Bio Medical Waste Treatment Facility (CBWTF)plant at the prescribed charges.

9.2. Stray animals shall not be allowed to roam freely around waste dumps or at other places

in the city and arrangement will have to be made for restraining them at authorizedarea/place only.

9.3. No one will collect or throw waste water, muddy water, night soil, dung, excreta etc. fromhis/her building, institution or commercial establishment to pollute the atmosphere andground with its stench and harm public health or obstruct traffic, failing which, carryingcharges shall be levied on the spot for spreading such waste, and case can be broughtagainst them in court.

9.4. lf a person is found spreading pollution or filth in public parks etc. by throwing deadanimal/cattle or its parts, it will be a punishable offense and carrying charges shall also belevied.

10 Responsibility of Urban local bodies -

10.1 Transport of the municipal solid waste: - The vehicles used for the transport of solid

waste are to be duly closed so that the waste should not be visible to the public and the

waste is not scattered elsewhere on the road during transportation, the following standards

should be maintained during the transportation of the solid waste.

10 2 The solid waste would be collected and cleaned as per schedule from the established

waste collectors. Along with the waste, the surrounding area of the disposal site should

also be kept clean.

10.3 The design of the transport vehicles will be such that the waste will not be allowed to

touch ground until it reaches its final processing/d isposal site, and thus the recurring

handling of the waste will not be allowed.

10.4 All the septic tanks in the city has to be de-sludged at least once in three years in ascheduled manner.

10.5 . ULB have constructed 100 % ofapproved IHHL applications and constructed 100 %of CT/PT as per target

10.6 . All toilets (individual, community a,nd public) are either connected to:

a. sewer networks: or

b. safe containment systems(such as septic tanks, twin pits or other on-site sanitationsystems prescribed by CPHEEO or under SBM-Urban Mission Guidelines),with regularemptying, treatment and/or safe d sposal of septage from these toilets managed as per

conditions.

All occupants of those households that do not have space lo construct toilet haveaccess to a community toilet within a distance of 500 meters .AIl public areas havefunctional public toilets within a span of 1 kilometer.All septic tank cleaning service providers are registered with and licensed by ULB/Development Authority/ Cantonment Board, operate through contract with therespective administration or

Authority in a scheduled manner/allotted areas and are utilizing well maintainedmechanized equipment

City has carried out structural audit of all community /public toilets and carried out :

. necessary repairs and renovations on the basis of the findings.

The city has issued and notified fines against persons /desludging operators dumpinguntreated faecal sludge in drains and / or open areas.

11 . Recycling of the municipal solid waste -To process the solid waste collected in the Local Body of Municipal Corporation/ council asuseful materials, various solid waste disposal units approved by the pollution control board/PCCand different techniques of such solid waste should be applied so that the dependency of wastedisposal on the landfills can be minimized. Following standards should be applied for theexpected results:-

11.1 Forthe processing of the bio-degradable waste, various techniques can be used suchas vermicomposting, compostintJ, mechanized composting, bio-methanization etc.Also the waste can be degraded using the other natural methods/resources byobtaining the required authorizations.

11.2 For the waste material mixed with the recyclable/renewable resources as a mixture,the method of recycling should tre used. ln some cases the waste resources can be' used to generate energy. Such plants with the technology should be authorized by thepollution control board.

'12. Prosecution and Penalties: -As provided in these Rules/byelaws, for any breaching of the said byelaws, prosecutionsand penalties can be rendered as le'ried down in these byelaws. Further, as per theEnvironment Protection Act of 1986, cases can be filed against them.

13.Repeal and saving of Orders: -

1 1.3 Before these bylaws are brought into force, any actions taken according to theprevious rules/bylaws will not be considered as void, due to these rules/bylaws coming into

effect, provided that such actions do rot violate these rules/bylaws.

such repeating will not affect anything or any action taken, or any acquired or incorporated

rights, privilege, obligation or responsibility, approved sanction on going or completed

15. Public Grievance Redressal.'Citizens of Rajamahendravaram approaching RMC to report grievances/issues related to services

provided by RMC through Spandana, Nagara Seva (formerly Puraseva), Swachtha (for sanitation), Dialyour commissioner and Social media platforms (Facebook, Twitter, Whatsapp and Telegram). A systemhas been developed to distribute the grievances to the concerned department and redressed within the SLAtime defined.

On filing the grievance, a receipt shall be distributed to the citizen wrth gflevanc.details. Concerned Officer/Staff allotted on r€lctifying the grievance received. On rectifying the tssue

concerned officer/staff shall provide the endors€)ment on the resolution of grievance and submit in podai by

uploading it.

15.2. Nagara Seva (Pura Seva):Vy'henever the Citizen approaches the Puraseva Centre Counter with a grievance, then the operetor ofthe counter will choose the "Grievance" Option from the drop down list. This will take him to the

relevant page where he can create a grievance. After that, an acknowledgement screen will pop up

along with CRN number (Complaint Registration Number). This can be printed and handed over to the

citizen.

Upon successful registration, the citizen and grass root level functionary will get the message (SMS) with

CRN Number. Once the SMS reaches the Funclionary he shall act as per the SLA. When complaint ts

redressed, the citizen gets a sms stating that his complaint is redressed. ln case of unhappy redressal the

citizen can reopen the grievance.

15.3. Swachhta App:The Swachhata-MoHUA is the official app of Ministry of Housing and Urban Affairs (MoHUA), GOI The

app enables a citizen to post a civic-related issu: (eg; a garbage dump) which is then forwarded to the cLt\/

corporation concerned and thereafter assigned to the sanitary inspector of the particular ward.

Take a picture of the Civic-related issue using your smart phone, and post it in one of the following

categories.

. Dustbins not cleaned

. Sweeping not done

. Dead animals

. Public toilet(s) cleaning

. Public toilet(s) blockage

The app will capture the location while the pictur(l is being taken. Just type in the landmark of the compla ;rt

location. The complaint will then be assigned to the concerned sanitary inspector/eng ineer. Sanitar,,

lnspector /Engrneer shall check the complaints received and redress within the SLA.

15.4. Dial your Commissioner:RMC Commissioner directly takes the complaintr; via RMC Helpline number (+91 94 94 060 060) on every

Monday 10.00AM to 1 1 :00AM and HODs of ever1, department available during this t hour session and these

complaints directed to concerned department HOD after every call. On completion of Dial your commissioner

session, HODs redirect them to the concerned off cer of the respective department and those can be rectif ie'l

and reverted back to the call center, who managr;s logging and resolving the complaints at their end.

15.5. Social Media Platforms:Citizens of Rajamahendravaram reporting isr;ues/complaints through the official pages/handles oiRajamahendravaram Municipal Corporation (vaa Messages, tweets and comments).
